ZANESVILLE CITY COUNCIL MEETING MONDAY, MARCH 11, 2019 ZANESVILLE CITY COUNCIL MEETING – MONDAY, MARCH 11, 2019 The Zanesville City Council met in regular session at 7:00 p.m. on Monday, March 11, 2019 in the City Council Chambers, 401 Market Street, Zanesville, Ohio. Mr. Vincent led those present in the Lord’s Prayer and the Pledge of Allegiance to the Flag. The following members of Council answered Roll Call: Mrs. Gentry, Mrs. Norman, Miss Bradshaw, Ms. Gildow, Mrs. Osborn, Mr. Sharrer, Mr. Foreman, Mr. Roberts, and Mr. Vincent. Mr. Baker was absent. Mr. Roberts moved to excuse Mr. Baker. It was seconded by Mrs. Osborn. A voice vote was taken with all present members being in favor. None were opposed. Motion carries. Mr. Baker stands excused. APPROVAL OF MINUTES Mr. Roberts moved to accept the minutes of February 25, 2019 as written, seconded by Mrs. Osborn. All present were in favor. None were opposed. Mr. Baker was absent. COMMUNICATIONS, REPORTS, AND RESOLUTIONS Communication from Mayor Jeff Tilton - Appointment to Board of Zoning Appeals Mayor Jeff Tilton is hereby recommending the appointment of Ms. Joyce Hill to the Board of Zoning Appeals. Ms. Hill will replace Carol Kaido. Ms. Hill’s term will expire December 31, 2020. Mrs. Osborn moved to receive and concur with the Mayor, seconded by Miss Bradshaw. All present were in favor. None were opposed. Mr. Baker was absent. Motion carries. Communication from Mayor Jeff Tilton – Appointment to Historic Preservation Board – Mayor Jeff Tilton is hereby recommending the appointment of Morten Bach to the Historic Preservation Board. Mr. Bach will replace Vincent Russo. Mr. Bach’s term will expire March 11, 2024. Miss Bradshaw moved to receive and concur with the Mayor, seconded by Mrs. Norman. All present were in favor. None were opposed. Mr. Baker was absent. Motion carries. Mr. Sharrer moved for first reading, seconded by Mr. Roberts. Mr. Vincent: Is there any discussion? Hearing none, all in favor of first reading signify by saying aye. All present were in favor. None were opposed. Mr. Baker was absent. Motion carries. Ordinance No. 19-18 - Introduced by Council – An Ordinance adopting a Traffic Calming Policy for the City of Zanesville. Mr. Sharrer moved for first reading, seconded by Mr. Foreman. Mr. Vincent: Is there any discussion? Hearing none, all in favor of first reading signify by saying aye. All present were in favor. None were opposed. Mr. Baker was absent. Motion carries. Ordinance No. 19-19 - Introduced by Council – An Ordinance rescinding Ordinance No. 15-100, Ordinance No. 16-16, and Ordinance No. 16-17. Mr. Sharrer moved for first reading, seconded by Mr. Foreman. Mr. Vincent: Is there any discussion? Hearing none, all in favor of first reading signify by saying aye. All present were in favor. None were opposed. Mr. Baker was absent. Motion carries. ORDINANCES FOR ACTION Ordinance No. 19-11 – Introduced by Council – An Ordinance authorizing the Community Development Director to execute a Gift Agreement with the Muskingum County Farm Bureau. Mrs. Osborn moved for second reading, seconded by Miss Bradshaw. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. All present were in favor. None were opposed. Mr. Baker was absent. Motion carries. Ordinance No. 19-13 – Introduced by Council – An Ordinance authorizing the proper City Official to provide funds to the City of Zanesville Community Improvement Corporation for the year 2019. Hearing none, all in favor of second reading signify by saying aye. All present were in favor except Mr. Roberts abstained. None were opposed. Mr. Baker was absent. Motion carries. Ordinance No. 19-14 – Introduced by Council – An Ordinance declaring various City properties as surplus and authorizing the Zanesville Community Improvement Corporation, acting as the agent of the City of Zanesville, Ohio to negotiate the disposal of certain City owned property for economic development purposes. Ms. Gildow moved for second reading, seconded by Miss Bradshaw. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. All present were in favor except Mr. Roberts abstained. None were opposed. Mr. Baker was absent. Motion carries. Ordinance No. 19-09 – Introduced by Council – An Ordinance authorizing the proper city official to enter into a professional contract with AECOM for Phase II revisions to the City of Zanesville’s Combined Sewer Overflow Long Term Control Plan. Mr. Roberts moved for third reading, seconded by Mrs. Gentry. Roll call vote for passage. 8 Ayes 0 Nays 1 Absent Mark Baker Motion carries. Ordinance is passed. TRAFFIC ORDERS None were submitted for this meeting. MISCELLANEOUS AND UNFINISHED BUSINESS Mayor Tilton had no comments for this evening. PRIVATE PETITIONS AND COMMUNICATIONS No Non-agenda item petitions were filed for this meeting. Mr. Vincent: We do need to go into Executive Session again. This is for a conference with the Law Director concerning disputes that are the subject of real estate and imminent court action. Mr. Roberts moved to enter executive session and it was seconded by Mrs. Osborn. The Council Chambers was cleared of all non-participating persons. As individuals were exiting, Mr. Vincent then explained the following requests. Mr. Vincent: Someone will come out and let you know when executive session is over. We need people to be back 20 feet from the door just to avoid any problems as the doors are not that thick. We need privacy. The Ohio Law does allow for this under certain circumstances where we hold these meetings and as I said why we need the executive session are those reasons this evening. No decisions will be made or voted on in executive session. It is for information only. All voting would occur in a public meeting. With that, also we are at the end of our agenda and the only thing I expect after we come out of executive session will be a motion to adjourn. I can’t guarantee that, but I don’t think anything else is going to come up. This is informational tonight and we don’t have any other legislation before us so it should just be for adjournment. Some people may not want to stick around for it. The last time it went over an hour. I don’t know if we will do that tonight, but just to let you know the whole picture as far as what you would like to do. At this time, we will clear Council Chambers except for the Administration and Council. Thank you for coming officers. If you will stick around to make sure people stay clear of the doors I appreciate it. The executive session was entered at 7:07 p.m. The citizens and non-participating persons were permitted to re-enter the Council Chambers as the session had ending. The Executive Session was exited at 7:30 p.m. with no vote necessary. With that, we have concluded our final business. Mr. Sharrer moved to adjourn the Council meeting and it was seconded by Mrs. Osborn at 7:31 p.m. All present were in favor of adjournment. None were opposed. Mr. Baker was absent. Motion carries.
