ZANESVILLE CITY COUNCIL MEETING MONDAY, OCTOBER 28, 2019 PUBLIC HEARING A Public Hearing began a little late for the 6:15 p.m. scheduled start time due to technical difficulties. The date is Monday, October 28, 2019 in the City of Zanesville’s Council Chambers, 401 Market Street, Zanesville, Ohio. The hearing is to hear a request to amend and revise the zoning map and make permanent zoning in the City of Zanesville, Ohio from RM-1 Low-Density Multi-Family to C-4 Highway Commercial for Muskingum County Auditor’s parcel number 86-33-01-04-000. In attendance were the following individuals: Matthew Schley, City Zoning and Planning Administrator; Mayor Jeff Tilton; Councilman J. Rob Sharrer; Councilmember Joey Osborn; Council President Daniel Vincent; Bill Arnett, Community Development Director; Councilmembers Sandy Gentry, Connie Norman, Jan Bradshaw, and Ann Gildow; Todd Ware from Third Ward; Thomas Robertson, Times Recorder Reporter; and the Clerk of Council Susan Culbertson. Matthew Schley presented information pertaining to this request. He stated it was a very simple request and has already gone through the Community Development Committee and the Planning Commission. What we are looking at doing is rezoning that parcel #86-33-01-04-000, not the parcel to the north, just the highlighted portion in yellow to a C-4 Highway Commercial. The purpose behind this is for a development on the northern lot as a developer wants to build a Menards store. They are looking to rezone that southern parcel to C-4 to allow for a detention pond to be constructed on that site. The way the code reads is that any accessory use to a conditional use in the zoning district the parcels must be zoned the same. A detention pond is not outright a use allowed in a residential district, but it is something that would be a conditional use to the conditional use to the Menards store on the northern development. Basically you can’t have a detention pond supporting a commercial enterprise on a residentially zoned lot. What we have been told is preliminarily, as they have not formally seen a site plan, is a portion in the rectangle at the top is where the detention pond is going to be which is further away from the residential properties. Access preliminarily will be from Northpointe and Brandywine for the store. There will be no further development on this lot. The lot will also have to abide and any new development will have to abide by our new landscaping and screening codes which will require a ten foot buffer zone between all commercial and residential uses City and non-City. Mr. Vincent said he thought for a property owner it makes a nice additional buffer and kind of locks that property in. Some of the other concerns had to do with would the pond hold moisture and draw mosquitos and it turns out there is a pond right across the street and has been there probably since the subdivision was developed. I have tried to think of all the different things that might be a concern to the residents being there. Mr. Schley said one of the things he was looking at when this came in was this is going to create a massive buffer zone. He pointed out the parking units which creates a larger buffer area. The only concern mentioned a citizen did not want access to occur off of Mark Lane or Street and that is not going to happen. There is no need for that. Mrs. Osborn: How does this address the new storm water program? Is this just satisfying the basic requirements or are they taking some steps to take advantage of some of the credits that are built into the system? Mr. Schley said he does not handle the credits as they will be the engineering department. He does know one of the credit items is a stormwater detention pond. I would assume they would apply for those credits. Again that is outside of my purview. No one was forthcoming to testimony for or against this request. This public hearing was called to a close by Mr. Vincent about 6:25 p.m. PUBLIC HEARING A Public Hearing was held as scheduled for 6:30 p.m., Monday, October 28, 2019 in the City of Zanesville’s Council Chambers, 401 Market Street, Zanesville, Ohio to hear a request by the City of Zanesville to amend Chapter 1105 of the City of Zanesville Planning and Zoning Code pertaining to the Board of Zoning Appeals. In attendance were the following individuals: Matt Schley, Zoning and Planning Administrator; Mayor Jeff Tilton; Councilman J. Rob Sharrer; Councilmember Joey Osborn; Council President Daniel Vincent; Bill Arnett, Community Development Director; Councilmembers Sandy Gentry, Connie Norman, Jan Bradshaw, and Ann Gildow; Todd Ware from the Third Ward; Don and Mary Ann Wahl, property owners; Thomas Robertson, Times Recorder Reporter; and the Clerk of Council Susan Culbertson. Matthew Schley presented information on this code change. It may seem small, but it is actually very big and important to what we do with our process with the Board of Zoning Appeals. I would like to start by pointing out a few things. The attendance for the Board of Zoning Appeals has created issues when we only have three members in attendance. It is not consistent with who is in attendance as people get busy or have disruptions to their schedule that do not permit them to attend the meetings. As the current code reads, anything that doesn’t have three concurring votes fails. If you have a two to one vote in the Board of Zoning Appeals it fails. So what this has kind of done is it encourages people if they know there will be a three member board they will request to table it because they do not want the chance of it failing. If it fails they have to wait a year to bring it back in front of the board or you have twenty days after the decision in order to go to the Court of Common Pleas. In that situation we have seen kind of a backlog on things or items actually going up for a vote so Bill Arnett and I put our heads together to figure out a way to solve this problem. We want items to go for a vote. What we did and this is just a highlight of it. We created a special condition where if you have a three member board you don’t get a zero to three decision you get a two to one Page 2 of 16  ZANESVILLE CITY COUNCIL MEETING MONDAY, OCTOBER 28, 2019 decision or a one to two decision what happens is you have the opportunity to have that item reconsidered in front of the BZA at the next meeting where you have four or more members present. This increases our due process by allowing applicants to come back to get a much fairer hearing and it prevents that backlog where people are constantly coming in and saying there are only three members so we are going to table it. Out of twelve meetings we had five times where we had three members and out of those five meetings we would have one to two items tabled and that creates a backlog and there were stretches where we had three members for two or three months. That means an item isn’t getting heard before the board for two to three months because items would get tabled. It is the fear of the two to one vote and having to wait a year to come back. Instead of changing it as we don’t change the code to say having a quorum of three and you get a vote of two to one because if two vote yes that still leaves three so two no voting at all, one voting no, that is still not a majority of the board so we still want to get that majority of the board voting. It allows a one-time reconsideration. If it fails, then it fails and we have to go through the next process that we have for appealing or bringing it back forward in front of the board. Mr. Vincent: Are there any questions from Council? Mrs. Osborn: Are these paid positions? Mr. Schley and Mayor Tilton responded no. Mrs. Osborn: Is there a reason folks are not showing up? Does the meeting date need to be considered or what happens? Matthew Schley: In my experience with this it just depends. One month we had two last minute medical emergencies. Another month somebody got stuck in traffic. Some of our board members work out of town, they live in town. I know our chairman comes from Columbus so there are times like for example at the last meeting he was 25 minutes late. He still came, but the two actionable items had been heard. So, we run into that situation where it is just a variety of reasons: medical, work, sick, vacations so this just allows the process to continue moving forward without being stalled. No one was forthcoming to testimony for and against this request. Mr. Sharrer: I would just like to again bring up what I brought up in Ways & Means tonight that I realize that this needs passed prior to the election, but I think I would like to continue to have our law department look at whether or not this could be done in increments as opposed to all at once. Mr. Vincent: I guess with that as mentioned earlier as far as the opinion from the Law Director this could not be done that way. Mr. Sharrer: I know we have done it that way in the past and I know that our Law Director looked at it and deemed it was not according to Ohio Revised Code, but I think I just want to be on record. Ordinance No. 19-110 – Introduced by Council - An Ordinance to amend and revise the Zoning Map and make permanent zoning in the City of Zanesville, Ohio as herein provided. Mr. Baker moved for third reading and passage, seconded by Mr. Sharrer. Mr. Vincent: Is there any discussion? Mr. Baker: Yes, this made its way through the Community Development Committee a few days ago where the committee took information from a representative from Menards who of course are interested in the location and the rezoning to C-4 Commercial and they are going to create a drainage basin out of it. Some of the Page 10 of 16  ZANESVILLE CITY COUNCIL MEETING MONDAY, OCTOBER 28, 2019 problems that were discussed or potential problems or concerns that were discussed are landscaping, potential noise and a temporary access road for delivery and construction. All of these concerns were met to the committee’s satisfaction. Therefore, the CD Committee recommends that this be passed. Mr. Vincent: Thank you, Mr. Baker. Is there anything else from Council? Just to help be clear on that there will be no access from the private residential road in the back. There would be additional buffers as it will fall under new landscaping requirements for the additional buffering and the use of the property itself creates a buffer from the actual commercial activity down below the property. Mr. Sharrer, do you have something? Mr. Sharrer: I was just mentioning the screening. Mr. Vincent: The screening, yes. I think Council did hear concerns and expressed concerns as far as for the residential people back there. As you said, all the concerns were answered. Mr. Baker: Yes, I would like to say that the representative from Menards, whose job it is to actually acquire real estate for this purpose around the nation, was very forthcoming and very helpful relaying concerns several of us had in meeting with him. Mr. Vincent: Also, he offered to have someone here at tonight’s meeting, but based on your committee meeting then I think there was no need for him to come from Wisconsin or wherever he is from for this meeting. Ordinance No. 19-111 – Introduced by Council - An Ordinance to amend Chapter 1105. Mr. Sharrer moved for third reading and passage, seconded by Mr. Baker. Mr. Baker: This made its way through the CD Committee as well and the primary purpose of course is to make the appeals process for Code and Zoning a little bit more streamlined. Mr. Arnett could you bullet point this out, again? Mr. Arnett: Sure, I think the primary purpose is to allow an applicant of the Board of Zoning Appeals to have an item reconsidered if the original request was only heard by a three member board and the board voted two to one way or the other. At this point the only procedural step after that two to one vote, which would be a defeat, would be to go to the Court of Common Pleas or before the vote they could ask for the item to be tabled. So by doing this new Code change or the new Code language it would allow a Page 11 of 16  ZANESVILLE CITY COUNCIL MEETING MONDAY, OCTOBER 28, 2019 person who gets a two to one vote to actually request reconsideration at an upcoming meeting where you had at least four members present, because it is backlogging as Mr. Schley reported earlier. Folks would come in and see three members and say we would like to have our item tabled for another month. Mr. Baker: To be clear as well, there are also some limitations for the appeals process as well. Don’t you need at least two votes in the affirmative in order for the appeals process to go forward? Mr. Arnett: The Code change, Mr. Baker, would be a two to one or a one to two. If you had a five member panel a three to two vote would be a pass. A two to two still remains a failure. If it is a tie vote it is a fail, but if in theory if you came to the Board of Zoning Appeals with three members and you were turned down one vote affirmative and two votes negative, if you had a five member panel and the other two members voted affirmative, you would pass three to two. So, the only case this would not be applicable is if you were defeated zero to three, because even if the other two people were there you would still lose. Mr. Baker: So, this is another sort of outlet for an appeals process short of court basically? Okay. Mr. Vincent: Thank you, Mr. Arnett and thank you, Mr. Baker. I think it is fairer or it sounds fairer to me for the citizens and applicants to be heard. Is there anyone else from Council? Is there anything else? Ordinance No. 19-112 – Introduced by Council - An Ordinance authorizing the proper City official to enter into a purchase agreement for computer hardware and software for the Income Tax Department. Ms. Gildow: David Wolfe, our City Treasurer, came to one of our Ways & Means Committee meetings and explained more thoroughly that the reason for the need for this new software largely relates to the fact that the existing software isn’t going to be backed up or supported by the company that provided that so while it will bring some advantages it is almost necessary to spend the money at this point to get the new one and the Ways & Means Committee recommends that Council approve this. Section Two: Northwest of intersection of Dryden Road and Dearborn Street on Dryden: Move the “NO PARKING HERE TO CORNER” sign which is presently located 45 ft. north of the intersection of Dryden Rd. and Dearborn St. Move the sign 22 ft. south of its current location. The new location will be placing the sign in front of 831 Dryden Road. Section Three: The appropriate signs shall be installed in accordance with O.R.C. 4511.09. Mr. Vincent: A motion to receive? MISCELLANEOUS AND UNFINISHED BUSINESS Mayor Tilton: I have a couple of things, Mr. President. First of all I would like to thank Shelly and Sands and Bud, Inc. for their fast mobilization on our two projects on Wayne Avenue, because of their working full bore and the weather cooperating, I feel that we should have that opened before the completion date of mid-December. I am hoping that sometime in November we have that back opened. I want to thank them for what they have done. Is there anything else from Council? Ms. Gildow: I would just like to remind people that November 5 th is Election Day and to encourage people to get out and vote. Mr. Vincent: Is there anything else from Council? We will move on to private petitions and communications. PRIVATE PETITIONS AND COMMUNICATIONS Sarah Chapman, Zanesville Think Tank on Poverty, 995 S. Hopewell Road, Hopewell, OH 43746 speaking on solution on homeless. Mr. Vincent: Will you come to the podium and pull the microphone around so we can hear you? You will have three minutes. Sarah Chapman: This is my first time so please be gentle. I am Sarah Chapman and I am from the Zanesville Think Tank on Poverty. I am here to speak upon a very sensitive matter. As we all know that our homeless in our town has grown. There is no secret to that. I myself as a domestic violence survivor was homeless with my three boys and I know the feeling that comes with it. The fear alone was just crippling. It was overwhelming and what am I going to do with my babies? Truthfully, I was just scared. I was grateful when Transitions opened their doors for me and my boys. With that being said, my feeling of being afraid was still there, because I was only allowed to be there for a short period of time. The uncertainty was scary. I was worried about our safety. I can only imagine what it is like today as I read the paper and I watch the news and I question what is next. The cold is setting in and I wonder how the City of Zanesville is going to resolve some of these issues. What is the City’s thought to help the homeless families, children, men, women, and the disabled? Is there a possibility to provide transportation to and from a job? How about just getting them an address? Just an address to use so they can get their mail and receive important things that are needed; things like this are needed and above all shelter for this upcoming winter. I have faith in my community that they are able to resolve these matters. Once again, thank you. Sarah Chapman. Thank you for listening. Mr. Vincent: Thank you very much. We appreciate it. Jill Sharrer, the Think Tank on Poverty, 1052 Brandywine Blvd, Apt. A, Zanesville, OH speaking on experiencing homelessness on addressing the situation. Jill Sharrer: My name is Jill Sharrer and I am on the Board of Zanesville Think Tank on Poverty. I know first-hand what it is like to the struggles of feeling of staying warm and to know where our next meal is coming from. As of August the first of 2018, up until then me and my husband were homeless, in Muskingum County and surrounding states Page 14 of 16  ZANESVILLE CITY COUNCIL MEETING MONDAY, OCTOBER 28, 2019 trying to find jobs. I do have my own place and everything, and do go to college and stuff now and is an advocate. Extreme cold can make your body lose heat more quickly than it can produce heat according to the Centers for Diseases and Control. Which then prones us to having humans to illness; which increase which includes ER visits and medical expenses that tax payers will have to provide for, plus the law enforcements that have to deal with the crimes because our basic needs are not being met. They have to do what consists for them to do to stay warm. That means breaking in places; the crime rate goes up because they are just trying to stay warm. We need a short term solution. It is going to take a time and agreement on a warming shelter. We understand that as a community. It is going to take money, effort, and a place, but we need to use harm reduction of illness, crimes, and reduce hospital visits. Let’s show compassion of our fellow community members and give a hand up, meet them where they are, not how they got there or where they came from. Our community needs a solution to find out. It is cold now and there has already been one death in Ohio related to homelessness and being out in the cold. Our temperatures have not got cold yet, but they are too. So, we need to find a solution and we come to you to ask, “What is your guys’ solution to help us find a shelter; or something temporarily until another solution can be appropriate.” I thank you for letting me speak tonight. Have a good night. Mr. Vincent: Thank you very much for sharing. Thanks for coming. With that, this is a challenging problem, not only in Zanesville, but all across the nation, except for warmer climates of course. With that, I know a lot of different things are going on between communities such as the Think Tank, churches, and the administration has been involved in many different areas as far as looking at things. We had Councilmembers involved looking at this. There are no easy answers. I do know there are a lot of really good people working on this issue and does anyone have anything they want to add to that on what their involvement is? Mrs. Osborn: I just want to encourage folks; I know I said this at the forum last week, but the warming shelter situation; that issue is not right now a Council issue. That issue is going to Board of Zoning Appeals on November 14th and so if folks have opinions, strong ideas about that that; is the place where you can express those and that is the appropriate place to do so at this point in time. It is not here on our desk to be voted on right now. Mr. Vincent: Is there anything else from Council or the Administration? Keane Toney: To let you and Council know that the intersection of Brown and Maple where Dresden comes in also. There have been a lot of close calls there and we spoke with a couple of residents there. The Traffic Committee is going to have us erect two left turn yield signs just to make people aware because what is occurring is people are turning left, not realizing the thru traffic is still proceeding. So it does not go on a traffic order, but I wanted to let all of you know that it is going to take place.
