ZANESVILLE CITY COUNCIL MEETING MONDAY, NOVEMBER 25, 2019 ZANESVILLE CITY COUNCIL MEETING - MONDAY, NOVEMBER 25, 2019 The Zanesville City Council met in regular session at 7:00 p.m. on Monday, November 25, 2019 in the City Council Chambers, 401 Market Street, Zanesville, Ohio. Mr. Vincent led those present in the Lord’s Prayer and the Pledge of Allegiance to the Flag. The following members of Council answered roll call: Mr. Roberts, Mr. Baker, Mrs. Gentry, Mrs. Norman, Miss Bradshaw, Ms. Gildow, Mr. Sharrer, and Mr. Vincent. Mrs. Osborn and Mr. Foreman were absent. Mr. Roberts moved to excuse Mrs. Osborn and Mr. Foreman. Ms. Gildow seconded the motion. A voice vote was taken with all present being in favor except Mr. Sharrer who voted nay. The motion carries. APPROVAL OF MINUTES Mr. Roberts moved to accept the minutes as printed, seconded by Mr. Baker. Motion carried. COMMUNICATIONS, REPORTS, AND RESOLUTIONS There were no communications. PROPOSED ORDINANCES Ordinance No. 19-131 – Introduced By Council – An Ordinance authorizing the Public Safety Director to enter into a Memorandum of Understanding between the City Of Zanesville and the Public Utilities Commission of Ohio for use of space at 34 South 4th Street, Zanesville, OH, and declaring an emergency. Mr. Sharrer moved to waive the readings and it was seconded by Mr. Baker. Mr. Vincent: Is there any discussion on waiving? Hearing none, we will have roll call vote for waiving of the readings. Ordinance is passed. Ordinance No. 19-132 – Introduced by Council – An Ordinance authorizing the proper City Official to advertise for bids for the City of Zanesville’s solid waste disposal needs. Miss Bradshaw moved for first reading, seconded by Mr. Baker. Mr. Vincent: Is there any discussion? Hearing none, all in favor of first reading signify by saying aye. All present were in favor. Ordinance No. 19-133 – Introduced by Council – An Ordinance amending Ordinance 01-128, making findings and determinations as permitted in Sections 3735.65 to 3735.70 of the Ohio Revised Code, establishing and describing the boundaries of “Community Reinvestment Areas” and Designating a Housing Officer to administer the program. Mr. Baker moved for first reading, seconded by Miss Bradshaw. Mr. Baker: This and the next two Ordinances made their way through the Community Development Committee and which we looked at making reinvestment areas for tax abatements available as a tool to bring investment to those particular areas a little bit more feasible. This is based on the Housing Needs Assessment that we have an Ordinance coming up for approval as well for that. Which this again is a way to; actually, it is a practical tool to bring that Housing Needs Assessment to life in a way. So, this was passed unanimously by the CD Committee with the caveat that instead of reassessing whether it is doing its job that we hope it will do every four years this and the other two Ordinances will be reevaluated every two years by Council. Mr. Vincent: Thank you, Mr. Baker. I appreciate you and your committee’s time spent on that session and Mr. Bill Arnett’s time on these Ordinances. Page 2 of 10  ZANESVILLE CITY COUNCIL MEETING MONDAY, NOVEMBER 25, 2019 Mr. Sharrer: I have one small amendment under Section 7. I would like to add Subsection (a) that reads: (a) That a “Community Reinvestment Area Housing Council” shall be created, consisting of two members appointed by the Mayor, two members appointed by the Council, and one member appointed by the Planning Commission. The majority of the members shall then appoint two additional members who shall be residents within the area. Terms of the members of the Council shall be for three years. An unexpired term resulting from a vacancy in the Council shall be filled in the same manner as the initial appointment was made. And then shifting the paragraph starting with A Tax Incentive Review Council shifting that to subsection (b). Mr. Vincent: I have that motion by Mr. Sharrer. I won’t read through that all again. Council does have a copy of that in front of them. That puts it in line with the other CRA Ordinances that are before you as that wording got missed. This was from the 2001 amendment and that is why it didn’t get pulled over. Mr. Baker: So, that language is on the other two Ordinances as well, as I understand? Mr. Vincent: Correct, yes. Mr. Baker: Is the language for the terms actually three years, is that right on all three? Mr. Vincent: Yes, I believe so. It could create problems if Council changes. Mr. Baker: Just a thought. Would it be more effective if it was every two years therefore being in line with when this comes up for reevaluation by Council? Just a thought. Mr. Sharrer, do you have any input as to that? Mr. Vincent: I think the Ohio Revised Code actually guides this. Mr. Baker: Oh, does it. Never mind, Mr. Sharrer. Mr. Sharrer: I was waiting for a second before we had discussion, but that is okay. Mr. Vincent: It took off, so a second by Mr. Roberts. Is there any further discussion? Okay all in favor of the amendment signify by saying aye. Those opposed nay. Ordinance No. 19-135 – Introduced by Council – An Ordinance amending Ordinance 03-107, making findings and determinations as permitted in Sections 3735.65 to 3735.70 of the Ohio Revised Code, establishing and describing the boundaries of “Community Reinvestment Areas” and designating a Housing Officer to administer the program as referenced in Ordinance 06-10. Ms. Gildow moved for first reading, seconded by Mr. Baker. Mr. Vincent: Is there any discussion? Hearing none, all in favor of first reading signify by saying aye. All present were in favor. Ordinance No. 19-136 – Introduced by Council – An Ordinance accepting the City of Zanesville Housing Needs Assessment, as herein provided. Mr. Baker moved for first reading, seconded by Miss Bradshaw. Mr. Vincent: Is there any discussion? Mr. Baker: This was examined by the CD Committee as well. We had started discussing this several weeks ago and again in the comprehensive nature this particular document we feel it will be used in a variety of ways for grants and reassessing the needs of the City so kudos to these folks responsible. Ordinance No. 19-137 – Introduced by Council – An Ordinance providing temporary appropriations for use during the period January 1, 2020 through March 31, 2020 and declaring an emergency. Mr. Roberts moved to waive the readings and it was seconded by Mr. Baker. Mr. Vincent: Is there any discussion on waiving? With that we will have roll call vote for waiving of the readings. Ms. Gildow: This was discussed in some detail at Ways & Means. Rhonda Heskett was kind enough to go through any of the appropriations that seemed not in line with the previous figures. She answered any questions we had. We would like to thank Rhonda for doing that. This was recommended for passage, but to also go the three readings. Page 5 of 10  ZANESVILLE CITY COUNCIL MEETING MONDAY, NOVEMBER 25, 2019 Mr. Baker: This is an effort to make sure the City stays current in adapting its Historic Preservation Guidelines with those of the state and nation as a whole and thanks to the folks who actually took a look at that including Perspectus Architecture did a good job. Ordinance No. 19-94 – Introduced by Council – An Ordinance establishing a “Dig Once” Policy reducing underground excavation for communications infrastructure within the City’s right of ways. (For First Reading) Mr. Vincent: We are at first reading. Mr. Roberts moved to postpone this legislation until 01-13-2020. It was seconded by Mr. Baker. Ordinance No. 19-127 – Introduced by Council – An Ordinance authorizing the proper city official to grant funds to the City of Zanesville Community Improvement Corporation resulting from the sale of property. Mr. Sharrer moved for second reading, seconded by Mr. Baker. Mr. Vincent: Is there any discussion? Hearing none, all in favor of second reading signify by saying aye. Ordinance No. 19-128 – Introduced by Council - An Ordinance authorizing the proper city official to advertise for bids and enter into a five-year lease with options for renewal or extension for the leasing of land for farming at Zanesville Municipal Airport. Mr. Vincent: There will be a public hearing prior to the next meeting at 6:30 p.m. Ordinance No. 19-130 – Introduced by Council - An Ordinance authorizing the proper city official to sign an amendment to the Programmatic Agreement between the City of Zanesville and the Ohio Historic Preservation Office. Ordinance No. 19-119 – Introduced by Council - An Ordinance authorizing the proper City official to provide funds to South East Area Transit for the year 2020. Mr. Sharrer moved for third reading and passage, seconded by Ms. Gildow. Ms. Gildow: This was reviewed at the Ways & Means meeting previously and then Howard Stewart was here and presented. I think it’s easy to say that he has done a wonderful job. It’s a big asset for the City to have public transit. Mr. Vincent: Excellent. Thank you. Is there anything else from Council? Mr. Roberts moved for third reading, seconded by Mr. Baker. Ms. Gildow: Just wanted to remind everybody that Matt Abbott was here for our last Council meeting and made a presentation and similarly to Southeast Area Transit; Matt and the Port Authority have done a great job and continue to be a huge plus for our community. Mr. Vincent: Thank you, Ms. Gildow. Yes, definitely bringing in lots of businesses, excellent businesses that pay well and JEDD Agreements, and they are quite helpful to the City. Mr. Sharrer: I would just like to welcome back our City Law Director Mr. Tarbert. We haven’t seen his face down there for a while. Mr. Tarbert: Just at the meetings. I have been at work. Mr. Sharrer: I understand. We enjoy when you come and hang out with us on Monday evenings. Mr. Tarbert: It is a pleasure for me too.
