Mr. Vincent: Good evening everyone. I'd like to call Zanesville City Council meeting to order for February 27, 2023. Please stand and join me in the Lord's Prayer followed by the Pledge of Allegiance to the Flag. Mr. Vincent led those present in the Lord's Prayer and the Pledge of Allegiance to the Flag . Mr. Vincent: May I have roll call, please? The following members of Council answered roll call: Mr. Baker, Mr. Wolfe, Mr. Ware, Miss Bradshaw, Mr. Pettit, Mrs. Osborn, Mr. Foreman, Mr. Roberts, Mr. Sharrer, and Mr. Vincent. Mr. Vincent: It's nice to have everyone here this evening. Thank you for being here and the administration. APPROVAL OF MINUTES Mr. Vincent: With that, we are now at approval of the minutes from the meeting of February 13, 2023. What is Council's pleasure? Mr. Pettit moved to approve the minutes of February 13, 2023 as written. It was seconded by Miss Bradshaw. Mr. Vincent: Is there any discussion? Hearing none, all in favor of approving the minutes signify by saying aye. Those opposed nay. A voice vote was taken with all being in favor. None were opposed . Mr. Vincent: Motion carries. The minutes stand approved. COMMUNICATIONS, REPORTS, AND RESOLUTIONS Mr. Vincent: We now move on to Communications, Reports, and Resolutions, and we do have a Policy Communication from Doug Merry, the Safety Director. But in communicating with him today and talking with him this evening , there are some things we would like to get tweaked on that and would like to send it to the Public Safety meeting on March 6. So, Mr. Merry has requested that that be pulled for this evening. So, may I have a formal motion to remove that from the agenda? PROPOSED ORDINANCES Mr. Vincent: We now move on to Proposed Ordinances, and our first and only one this evening is 2023-22. Ordinance No. 2023-22 - Introduced by Council - An Ordinance approving and accepting the new national opioid settlements and declaring an emergency. Mr. Sharrer moved to waive the readings. It was seconded by Mr. Pettit. Mr. Vincent: Is there any discussion of waiving? Mr. Roberts: Mr. President? Mr. Vincent: Mr. Roberts. Mr. Roberts: I guess I just had a couple questions in regards to the legislation as a whole. Whose ordinance is this? Kade Haddox: It's actually David's (Tarbert). Mr. Roberts: Oh okay. Mr. Vincent: Mr. Tarbert? (Attending by WebEx). Mr. Tarbert: Yes, I'm here. Mr. Roberts: By us accepting this, does this waive any liability to any of the manufacturers or anything like that? Mr. Tarbert: I'm sorry Mr. Roberts. Does it do what to the liability? Mr. Roberts: Does it waive any liability or transference of anything? We'd be opting out of going after these distributors ourselves and getting them to class action. But the reality is that I think almost every municipality is opting into this. It's similar to the one we did a year or two ago that I think Kade sponsored that the administration worked on. This is the same thing. Kade and I talked about it. I don't think there's going to be as much available for this one, but yes, we would be waiving our right to go after Walmart and Walgreens, but I don't see us ever doing that anyway. Mr. Vincent: Does that answer your question, Mr. Roberts? Mr. Roberts: Yes. Mayor Mason: Mr. Chairman? If you would like for me to give a real brief description on OneOhio right now and what they're doing, that might answer some of his questions. Mr. Vincent: Yes, let's get through waiving, then if you would Mayor, I would appreciate that. Any other questions about waiving? Okay, we have a motion and a second to waive. Mayor, yes, if you will fill us in please? Mayor Mason: Thank you . I believe this will take the settlement dollars down the path of 55 percent going to the OneOhio Recovery Foundation. I believe 15 percent will go to the State of Ohio for administration and other expenses, litigation expenses, and 30 percent will go into that local government fund they distributed to all the townships, counties, and cities, much like what we're getting now. We'll be getting that twice a year, maybe $18,000. Kade Haddox: I think it's about $11 ,000 twice a year. Mayor Mason: $11 ,000 twice a year. As far as the money goes, the statewide board, I'm Vice Chairman of the statewide board. And then you have a region 12 board that Muskingum County sets in that is Muskingum, Guernsey, Perry, Morgan, Noble, Monroe, and Washington. So collectively, the nongovernment organizations as well as some of the governmental organizations that are involved in substance abuse and mental health-related issues are putting together proposals so that when the OneOhio Page 3 of 9  ZANESVILLE CITY COUNCIL MEETING MONDAY, FEBRUARY 27, 2023 Recovery Board issues the official request for grant applications, region 12 will be able to submit. Now, the way it works, each region , and of course we're in region 12, has a certain percentage of the total settlement dollars that it's privy to. That is based on population, as well as what they call impact. So, Cuyahoga County, I believe is a district of itself, a region of itself. They might be getting, I believe, 9 percent. Muskingum County and the other seven counties in region 12 are getting a total of between 2.05 and 2.25 based on the various settlements. So the bottom line is the first year of settlements were up around $54 million, of which I believe that they'll be distributed at which I believe roughly $1 million will go to our region . This will increase that. So it's complicated, but that's what happens when you have, I don't know how many hundred counties, villages, townships, and cities all being involved. Mr. Foreman: Can I ask a question? Mr. Vincent: Yes. Mr. Foreman: So, I have looked at the numbers, what counties get what. When you say impact, what does that mean? I don't know what that means. Like, how did they determine that? Mayor Mason: That was not a determination made by any of us in this room , any mayors, county commissioners, or village administrators. That was a judicial decision as negotiated with the Attorney General's Office, the Governor's Office, and others. I don't have the answer for you , Steve. Mr. Foreman: Okay. Mr. Vincent: Okay, thank you . Any other questions from Council? Mr. Roberts: Mr. President? Mr. Vincent: Mr. Roberts. Mr. Roberts: I guess I'll just make this statement. You guys can do whatever you want, but for poisoning an entire nation, I think it's just bullshit that we're going to let them get off with 18 grand a year or 36 grand a year. The amount of money that this city alone and this community alone has spent on combatting what these people did, I'd take it to court. That's just me. Mr. Vincent: Thank you Mr. Roberts. Mr. Tarbert could we handle taking that to court? Mr. Tarbert: Well, I will defer to the Mayor, who's on the committee, but it's probably not something we could effectively do, to sue Walgreens. I mean, the cost alone of going after that and while I agree with Mr. Roberts completely and the Mayor may have these numbers, it's not necessarily what we're receiving . Remember Walmart is paying out, I think it's a nationwide settlement. So it's in the billions of dollars. So, I mean, I don't Page 4 of 9  ZANESVILLE CITY COUNCIL MEETING MONDAY, FEBRUARY 27, 2023 know that we would recover much more than we'd be getting th is way and certainly we'd have to, I mean it would be a very difficult road to take. Mr. Vincent: Okay, thank you Mr. Tarbert. Anything else from Council? Mr. Foreman: I guess I just look at, and I agree, but the decision wasn't made by us, I mean exactly. It went through the legal channels and that's kind of what happened , whether we like it or not. And I think, I mean I understand everything you're saying Mr. Roberts, and I agree with you. But I think that moving, it's a time to move forward , and this money could go to good things. I don't know. Mr. Roberts: I'm not going to debate the opioid. Mr. Foreman: Yes. Mr. Roberts: I mean, they're still pushing it on the streets right now. Mr. Foreman: I understand. Mr. Roberts: It's blood money as far as I'm concerned , and that's why I'm where I'm at. Mayor Mason: Mr. President and members of Council? Mr. Vincent: Yes, Mayor. Mayor Mason: To give a comparison, as the parties were negotiating this, what they wanted to prevent was another tobacco settlement where the money literally was supposed to go to the state and then distributed thus and so. The problem is that around 2006 or 2007, there was an economic recession in the country and in Ohio. So those funds were literally used to balance the state budget and keep operations going. So the way this, and it's been very difficult because there are so many t's to cross and i's and j's to dot in this one. In order for it not to be misspent by public officials, that a foundation board had to be created that had to have equal representation across the state. And frankly, in order for it not to be misspent like the tobacco dollars, a very complicated structure is being put in place. But at least now we have an acting executive director, we have a CFO, we're adopting all of our rules and regulations. I actually chair the investments committee and sit on the finance committee. So we're starting to make some headway. Mr. Vincent: Okay, thank you Mayor. Anything else from Council? We'll have roll call vote. And actually probably even clean up afterwards outside of the area. I mean , the sponsors are in charge of everything inside the fence , so to speak. But you know how people are when they go to events. We're going to have some work involved, but we want to make this a great experience so people will come back. Mr. Vincent: Okay, thank you Mayor. Mayor Mason: Actually I just want to give a shout-out to Scott and Ike. I've only had two complaints this year for potholes. And I think the primary driver behind that is we are out using hot mix to take care of the potholes so that you're not always throwing that cold patch down. I mean, even though sometimes we use cold patch. But there would be on any given day, you'll see we'll have a couple crews out putting hot mix down. Mason, Law Director's Office Mayor Ord 2023-23 Page 8 of8 Human Resources Darla Wooten ORDINANCE NO. 2023 - 24 AMENDING ORDINANCE NO. 2022-140 THAT CURRENTLY ESTABLISHES WAGES FOR UNAFFILIATED EMPLOYEES IN THE MUNICIPAL SERVICE, ESTABLISHING ADDITION OF JOB CLASSIFICATION. WHEREAS, Ordinance No. 2022-140 presently governs the pay, job classifications and benefit polices for unaffiliated employees of the City of Zanesville; and WHEREAS, the Human Resources has requested that a Job Classification be added. WHEREAS, the Human Resources has requested that Job Classification, Treasurer Office Assistant be added to schedule B of the Job Classification plan; WHEREAS, the Human Resources Manager desires to Update Schedule B/Job Classifications and that said job classification Treasurer Office Assistant be placed at Pay grade 4 and be a nonexempt position. NOW, THEREFORE, BE IT ORDAINED, by the Council for the City of Zanesville, State of Ohio, that Ordinance 2022-140 which reads as follows: SECTION ONE: APPLICABILITY OF ORDINANCE A. This ordinance shall apply to employees in the service of the City who are not seasonal, elected, covered by collective bargaining agreements, or any others which are governed by separate ordinances. B. For the purpose of this ordinance the employees of the City, with the exception of those mentioned in Paragraph (A), shall constitute the unaffiliated group in the municipal service who will perform work and be employees full-time or part-time throughout the year, or for a temporary period of time. SECTION TWO: APPOINTMENTS IN THE UNCLASSIFIED AND CLASSIFIED SERVICE A. The civil service of the City shall be divided into the unclassified service and the classified service. The classified service shall comprise all persons in the employ of the City not specifically included in the unclassified service. B. Appointment to a position in the unclassified service is at the discretion of the appointing authority, and the incumbent can be removed, suspended, or reduced in pay or position at the pleasure of the appointing authority.  Ordinance 2023-24 C. The authority to make appointments for positions belonging to the classified service shall be vested in the respective appointing authority, subject to proper certification of applicants by the Civil Service Commission. a. Each employee in the classified civil service shall serve a probationary period of time as a trial or testing period for the employee. This probationary period for the unaffiliated classified employee shall be four (4) months starting on the date the employee first reports for work. During this probationary period, the employee can be removed, suspended, or reduced in pay or position for any reason at the pleasure of the appointing authority. b. Upon successful completion of a probationary period, the employee shall be in a permanent status. D. All appointments to the classified service are governed by Chapter 124 of the Ohio Revised Code and rules and regulations of the Zanesville Civil Service Commission. E. The Civil Service Commission shall maintain such records as are necessary or required to accomplish the provisions of this ordinance, including but not limited to, a list of current classification titles, a copy of each job description, and a record of the pay range to which each position has been assigned. The Civil Service Commission may also maintain other records related to the City's unaffiliated employees, including but not limited to, a current roster of employees with a record of their service including dates of service; classification assignments, compensation history, and such other information as may be deemed appropriate. F. The Civil Service Commission and the appointing authority are hereby authorized to develop any additional regulations necessary to implement the policies established in this ordinance. SECTION TH REE: CLASSIFICATION PLAN A. A classification plan has been established for unaffiliated positions in the City. The Classification Plan is maintained by the City Administration through the Department of Human Resources. The classification plan consists of a point factor job evaluation system that provides a method for quantitative and qualitative assessment of positions. Within the Plan, classifications within the City are ranked by point factor score. Classifications with relatively similar point factor scores are grouped into similar pay grade assignments. B. The City Administration shall be responsible for completing point factor evaluations of new and existing classifications, as needed. Page 2 of 8  Ordinance 2023-24 C. The City Administration shall be responsible for maintaining the Classification Plan and for recommending any changes to the plan, the factors, the scoring methodology, and/or the pay grades. The Civil Service Commission shall review any changes to the Classification Plan that are recommended by the City Administration, and issue a recommendation to the City Council regarding approval of the changes. Council shall approve any changes to the Classification Plan. SECTION FOUR: PAY RANGES, GRADE ASSIGNMENTS AND SCHEDULES A. All employees subject to the provisions of this ordinance shall be paid a wage in accordance with the attached Schedules. The City Administration shall be responsible for determining wage rates for unaffiliated personnel, which shall be not inconsistent with the Schedules in this Ordinance. B. Schedule A establishes the pay grades for unaffiliated employees subject to the provisions of this ordinance, and the pay ranges that correspond to each pay grade. C. Schedule B establishes the pay grade assignments for the positions subject to this ordinance. D. The pay rates for some employees in the Legal Department and the Municipal Court are paid from two different sources. Pay increases for those affected employees shall be paid from said funding sources. The percentage to be paid from each funding source shall be determined between the City and the applicable appointing authority. E. Other than the original pay rate adjustments established in Schedule A of this ordinance, the administration must acquire Council approval for increases in pay greater than five percent (5%) of an employee's current pay rate. F. Any employee whose current rate of pay is above their stated pay range at the time of the effective date of this Ordinance shall not receive a reduction in pay, but shall have his or her pay " legacied" and shall continue to be paid their current rate of pay. Stated differently, this Ordinance shall not cause any employee to receive a reduction in pay. SECTION FIVE: EFFECTIVE DATE OF ORDINANCE Ordinance No. 2023-24 shall take effect and be in force from and after the earliest period allowed by law. Page 3 of 8  Ordinance 2023-24 SECTION SIX: SAVINGS CLAUSE If any part of this ordinance is found to be unconstitutional, illegal or invalid, such unconstitutionality, illegality, or invalidity shall affect only such part of this ordinance and shall not affect or impair any of the remaining provisions of this ordinance. It is hereby declared to be the intention of the Council for the City of Zanesville that this ordinance would have been adopted had such unconstitutional, illegal, or invalid part thereof not been included herein. SECTION SEVEN: EFFECTIVE DATE OF ORDINANCE This ordinance shall take effect and be in force from and after the earliest period allowed by law. I_ I_ Employee Date Page 3 of 3 Public Service Committee Andrew Roberts, Chair ORDINANCE NO. 2023 - 25 AN ORDINANCE AUTHORIZING THE PUBLIC SERVICE DIRECTOR TO ADVERTISE FOR BIDS AND ENTER INTO ONE OR MORE CONTRACTS, AS NECESSARY, WITH THE LOWEST AND BEST BIDDER(S) FOR THE PURCHASE OF MATERIALS AND LABOR FOR THE CONSTRUCTION OF THE MAPLE AVENUE WATER MAIN REPLACEMENT PROJECT AND DECLARING AN EMERGENCY WHEREAS, a twelve-inch water main along Maple Avenue serves as the supply line for a multi-story senior housing facility and multiple restaurants and homes; and WHEREAS, A twelve hundred foot section of the Maple Avenue water line near Bethesda Drive has broken multiple times in the last twelve months; and WHEREAS, the continuous disruption in water service at these locations has created a public health and fire safety issue; and WHEREAS, the current water main is under Maple Avenue; and WHEREAS, Maple Avenue is State Route 60; and WHEREAS, the Ohio Department of Transportation is paving this section of Maple Avenue in August2023; and WHEREAS, the City of Zanesville needs to replace this section of water main and relocate the water main under the sidewalk away from the road prior to paving; and WHEREAS, to expedite the project and promote public health and safety by installing a needed waterline for the reasons set forth above, this Ordinance is declared an emergency measure; and WHEREAS, the Administration is prepared to advertise for bids and enter into one or more contracts with the lowest and best bidder(s) to complete the project. NOW, THEREFORE, BE IT ORDAINED, by the Council of the City of Zanesville, State of Ohio, that: SECTION ONE: The Public Service Director is hereby authorized to advertise for bids and enter into one or more contracts with the lowest and best bidder(s) for the construction of the Maple Avenue water main installation project.
