ZIONSVILLE SAFETY BOARD MEETING MEMORANDA For January 10, 2012 Zionsville Town Hall 1100 W. Oak Street 1. OPENING A. Call meeting to order – Steve Mundy called the meeting to order at 9:00 a.m. Board members present: Steve Mundy, Tim Haak, Susana Suarez Members absent: None 2. MEETING ITEMS A. Election of Officers: Mr. Haak nominated Steve Mundy for the role of President, Susana Suarez seconded and all were in favor. Susana Suarez nominated Tim Haak for Vice President, Steve Mundy seconded and all were in favor. B. Approval of minutes from the December 5th, 2011 meeting: Mr. Haak motioned to approve the minutes, Ms. Suarez seconded and all were in favor. C. Reports: None D. Old Business: 1. Fire Department Conditional Job Offers: Chief VanGorder reviewed the conditional offer recommendation to extend a conditional offer of employment to the top five on the approved hiring list. Mr. Haak motioned to approve conditional job offers for the top five candidates on the approved hiring list and authorize the fire chief to use alternates on the certified list of applicants if any of the top five choose not to accept. Ms. Suarez seconded and all were in favor. D. New Business: 1. Variance Request Baptist Homes of Indiana: Tim Oaks attorney for Ice Miller spoke on behalf of BHI Retirement Communities. Mr. Oaks proposed that new construction be allowed before the water main extension is complete with no certificates of occupancy being issued before the water main extension is completed. He also stated that the water main extension would be complete by April 1st and if it is not, they would voluntarily stop construction. Mr. Haak noted that one of the original conditions that was put into place was the requirement of a Knox box/ siren activated gate on the Zionsville Road entrance. This gate currently has no Knox box or siren activation on it and is locked at night. John Dattilo, VP of Operations at BHI stated that the siren activated gate would be installed by May 1st. Mr. Oaks stated that was not a condition of the variance approved in September by the Safety Board, but was a condition for approval by the development board of the plan commission, with no specific deadline. Fire Marshal Hayes noted that the concern of ZFD is that there is one tap on the 96th street main into Hoosier Village. If that main fails there is no water service for the fire hydrants or sprinkler systems to any of those buildings in Hoosier Village. ZFD’s conclusion for this variance request is that no new combustible construction be approved until the water main along Zionsville Road and the access road hydrants test certifications have been completely connected and the current system placed in service. ZFD staff agrees that the variance request should be denied. Mr. Oaks requested that this matter be continued to the February Safety Board meeting to allow BHI Retirement Communities to meet with ZFD to go through some of the issues that have been raised to see if they can come to an understanding. ZFD supports the continuance of the issue to the February meeting. Ms. Suarez motioned to continue the variance request for BHI Retirement Communities to the February meeting. Mr. Haak seconded and all were in favor. 2. Variance Request 12-23-11 The Domain at Bennett Farms: Jeremy Stevenson of REI Investments spoke on behalf of the Domain at Bennett Farms. He is requesting that they be able to begin construction immediately prior to the required and/or approved water source and the required fire department access roads being in-service. Fire Marshal Blake Hayes spoke on behalf of ZFD and noted that ZFD supports the variance request with the following conditions: ¾ The entry from Bennett Parkway, the eastern portion of the site, as well as the additional access drive from Lennox Court connected to the entry (all as highlighted on attached plan) be in place using a stabilized stone surface, compacted and maintained during all weather conditions. The access drives shall be maintained at a minimum of 20' in width, and shall be able to support a minimum of 80,000 lbs. The Zionsville Fire Department would retain the right that all drives be proof-rolled at our request. All access drives shall remain free of parking. The second access drive will allow a second point of entry for fire apparatus, as well as use of the second hydrant on Lennox Court. ¾ Lennox Court from the fire hydrant - north (both sides) shall remain free of parking and storage, other than the approved construction trailer. *Access to the adjacent business shall be maintained as well. ¾ Bennett Parkway shall remain free of parking and storage from the fire hydrant - west and extend 25' past (west) the entrance into the construction site. ¾ Parking on Bennett Parkway shall only be on one side. ¾ A certified check is provided to the Town of Zionsville for the cost of complete installation of the two (2) water taps and all associated materials required to complete the connection to the water main on Bennett Parkway. ¾ All site water mains, hydrants and valves are in place prior to combustible construction (minus the taps). ¾ The understanding that this variance is only allowing the combustible construction for Building #1 and the Clubhouse as highlighted on the attached plan. ¾ No Certificate of Occupancy, temporary or permanent shall be issued until all water mains, hydrants, access roads and other required systems and inspections have been installed and completed. Mr. Haak motioned to approve the variance request from the Domain at Bennett Farms, Ms. Suarez seconded and all were in favor. 3. Introduction to drive way cut policy discussion: Terry Jones, Director of Planning discussed access points as they relate to public right of ways. The general rule is that all private parcels are entitled access to public ways. Mr. Jones noted that there has been a request for a second access point on a private property. Mr. Jones stated that there is no formal policy one way or the other. Staff recommendation is to start discussion on a policy that can be given to individuals when they have such requests. The Planning Department will take the lead on establishing a policy on drive way cuts/ access points and will report back to the Safety Board at a future date. 4. Safety Board Meeting Schedule: Discussion was held on adjusting the meeting schedule. Mr. Mundy will contact the Board of Police Commissioners and discuss the matter with them.
