ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR Monday, March 20, 2017 at 7:30 AM Zionsville Town Hall Community Room 1100 West Oak Street Date of Preparation: March 20, 2017 Members Present: Elizabeth Hopper, President; Josh Garrett, Vice-President; Bryan Traylor, Jeff Papa; Susana Suarez Also Present: Tim Haak, Mayor; Ed Mitro, Deputy Mayor; Heather Willey, Town Attorney; Amy Lacy, Director of Finance & Records and Town Department Staff. 1. OPENING A. Call meeting to order B. Pledge of Allegiance 2. APPROVAL OF THE MEMORANDUM OF THE March 6, 2017 REGULAR MEETING (copy posted). COUNCIL ACTION: Vice President Garrett moved to approve the Memoranda of the March 6, 2017 Town Council Meeting. Councilor Traylor seconded the motion. The Memoranda of the March 6, 2017 meeting was approved by a vote of four in favor, zero opposed. 3. SWEARING IN OF NEW POLICE OFFICER – Mitchel Tuttle Mayor Tim Haak swore in Officer Mitchel Tuttle 4. PRESENTATION – Brad Cozza, Indianapolis Executive Airport – 2016 Review. Director of the Indianapolis Executive Airport Brad Cozza gave a brief 2016 review of the airport, citing its current and past structure and role in the Zionsville area community. He highlighted upcoming improvements outlined in the Capital Improvement Plan and finished his presentation by inviting all to join him at the airport on August 5, 2017 for the 11th Annual Open House, Fly-IN and Air Race Supporting Down Syndrome Indiana and on August 17, 2017 for a joint Zionsville-Westfield Chamber of Commerce Luncheon. Councilor Suarez joined the meeting at this time. 5. PRESENTATION – Zionsville Community Schools Resolution Regarding Intergovernmental Cooperation in Matters of Planning and Development Zionsville Community School’s Chief Financial Officer Mike Shafer offered some background on the resolution, stating that Zionsville Community Schools has historically asked that the impact on schools be an equal factor in the Town’s evaluation process on proposed new developments. He explained that Zionsville Community Schools works to quantify the expected financial effects of proposed developments to the schools and to communicate the results to the Town planning and zoning authorities in a factual, unbiased way. Mr. Shafer summed it up by saying that Zionsville Community Schools’ role is not to be an advocate for or against any development, but to be a resource and an informational service for the Town. 6. REQUEST TO SPEAK There being no Request to Speak cards submitted, President Hopper asked if anyone in the audience wishing to speak on any matter would please come forward. There was no response from the audience. 7. OLD BUSINESS A. Consideration of an Ordinance creating a Promotional Fund ORDINANCE #2017-03 (Final Reading). Deputy Mayor Mitro briefly reviewed the purpose of the fund. Questions and discussion followed from the Council. Town Attorney Heather Willey addressed concerns raised by Councilor Suarez regarding the broad language of the Ordinance explaining that the language followed state statute. COUNCIL ACTION: Vice President Garrett moved to adopt the Ordinance on final reading. Councilor Papa seconded the motion. Ordinance #2017-03 was adopted on final reading by a vote of four in favor, one opposed, with Councilor Suarez opposing. B. Consideration of an Ordinance to amend the Town of Zionsville Code of Ordinances (Traffic Code) to prohibit on-street parking on a portion of Clarkston Road in the Coventry Ridge subdivision ORDINANCE #2017-04 (Final Reading). Streets and Stormwater Superintendent Lance Lantz briefly reviewed the ordinance. COUNCIL ACTION: Councilor Traylor moved to adopt the ordinance on final reading. Vice President Garrett seconded the motion. Ordinance #2017-04 was adopted on final reading by a vote of five in favor, zero opposed. Councilor Suarez departed the meeting at this time. 8. NEW BUSINESS A. Consideration of an Ordinance establishing a public safety local income tax (“lit”) fund and authorization to transfer two hundred ninety-three thousand five hundred sixteen dollars and twenty-one cents ($293,516.21) from police operating fund to public safety lit fund and to transfer seven hundred seventy-nine thousand six hundred one dollars and sixty-six cents ($779,601.66) from fire operating fund to public safety lit fund and to transfer thirteen thousand nine hundred seventy-eight hundred and eighty-seven cents ($13,978.87) from cumulative fire equipment fund to public safety lit fund and to reimburse the police and fire operating funds for disbursements that were done prior to the public safety lit fund being established ORDINANCE #2017-05 (First Reading). Mark Adam of Crowe Horwath presented the ordinance and explained the need for the separate fund for Public Safety LIT revenues and expenditures as well as the transfers to the new fund. COUNCIL ACTION: Vice President Garrett moved to introduce Ordinance # 2017-05 on first reading. Councilor Papa seconded the motion. The motion passed with a vote of four in favor, zero opposed. Ordinance 2017-05 was introduced on first reading. No further action taken. B. Consideration of a Resolution to transfer funds from the General Fund to the Promotional Fund and the Additional Appropriation of funds from the Promotional Fund RESOLUTION #2017-10 (PUBLIC HEARING) Deputy Mayor Ed Mitro briefly reviewed the need for the transfer and additional appropriation. With Proof of Publication for a Public Hearing noted, President Hopper opened the Public Hearing for comment With no public comment, President Hopper closed the Public Hearing and called for discussion or a motion. COUNCIL ACTION: Vice President Garrett moved to approve Resolution #2017-10. Councilor Traylor seconded the motion. Resolution #2017-10 was approved by a vote of four in favor, zero opposed, 9. OTHER MATTERS Councilor Traylor questioned the status of a statement which was made by Zionsville Town Council at the October 11, 2016 Special Joint Meeting of Boone County Municipalities regarding the intention to introduce a sunset provision in the ordinance of no less than seven years on the Public Safety/LIT. President Hopper indicated that no further discussion or action had occurred on the matter at this time. 10. ADJOURN COUNCIL ACTION: Vice President Garrett moved to adjourn the meeting. Councilor Traylor seconded the motion. The motion was approved by a vote of four in favor, zero opposed. The next regular Town Council meeting is scheduled for Monday April 10, 2017 @ 7:00 PM in the Zionsville Town Hall Beverly Harves Meeting Room (note that meeting date is the second Monday due to Spring Break).
