ZIONSVILLE TOWN COUNCIL MEETING MEMORANDA FOR MONDAY, APRIL 12, 2021 AT 7:00 P.M. ONSITE AND ELECTRONIC MEETING 1100 West Oak Street 1. OPENING A. Call meeting to order President Garrett called the meeting to order at 7:00 p.m. B. Pledge of Allegiance Council Members Present: Josh Garrett, President; Jason Plunkett, Vice-President; Brad Burk, Alex Choi, Joe Culp, Craig Melton, and Bryan Traylor Also Present: Heather Willey, Town Council Attorney; Amy Lacy, Municipal Relations Coordinator, and Town Department Staff. 2. APPROVAL OF THE MEMORANDUM OF THE MARCH 15, 2021 REGULAR MEETING (copy posted) COUNCIL ACTION: President Garrett moved to approve the Memoranda of the March 15, 2021 Regular Town Council Meeting. Vice-President Plunkett seconded the motion. The Memoranda of the March 15, 2021 Regular Town Council Meeting was approved by a vote of seven in favor, zero opposed. (7/0) 3. APPROVAL OF THE MEMORANDUM OF THE MARCH 19, 2021 EXECUTIVE MEETING (copy posted) COUNCIL ACTION: President Garrett moved to approve the Memoranda of the March 19, 2021 Executive Town Council Meeting. Vice-President Plunkett seconded the motion. The Memoranda of the March 19, 2021 Executive Town Council Meeting was approved by a vote of seven in favor, zero opposed. (7/0) 4. REQUEST TO SPEAK Zionsville resident and Plan Commission and Board of Zoning Appeals member Larry Jones expressed multiple concerns with the proposed Zionsville Historic Conservation District Commission, Item 7C. Indianapolis Executive Airport representative Sam Sachs spoke in favor of Item 7E, a potential request to the Plan Commission to rezone property near airport to disallow residential zoning. Hamilton County Port Authority representative William Frye spoke in favor of Item 7E. Vice President and General Manager of First Wing Jet Center Sean White spoke in favor of Item 7E. Zionsville resident Craig Triscari spoke in opposition of an approved VanTrust project near Saratoga Springs, stating that as of April 2021, VanTrust had failed to run eight-inch water lines into Saratoga Springs as promised and that the current landscape on the berms was currently incorrect with the wrong size and type trees planted. Mr. Triscari discussed upcoming tax assessments and advised homeowners they had the right to request a reduction in the tax assessment based on the negative effects of development in the area. He expressed concerns regarding trash, pollution, and noise issues in the area. President Garrett responded to Mr. Triscari’s concerns by saying he had received a note from VanTrust stating that construction on the waterline had begun on April 5, 2021. He concluded by saying that the project was progressing as expected. 5. MAYOR/ADMINISTRATION UPDATE There was no update from the Mayor or Administration. 6. OLD BUSINESS There was no old business to discuss. 7. NEW BUSINESS A. Boone County Solid Waste Management District Presentation Executive Director Jennifer Lawrence gave a presentation introducing the Boone County Solid Waste Management District. She shared the District’s mission, makeup of Executive Board members, staff, and Citizen’s Advisory Committee. She explained that there was currently an opening for an additional Zionsville Town Council member on the Executive Board due to increased census numbers. Ms. Lawrence went on to highlight District funding sources, proper disposal and recycling events, education, and programming. She shared information about the “REUSE Heart and Sole” shoe collection and the “A Bench for Caps” bottle cap recycling programs and several upcoming activities for Earth Month.  Ms. Lawrence answered questions from the Council. Councilor Traylor praised Ms. Lawrence and the Boone County Solid Waste Management District for all their work and positive impact on Boone County and the community. B. Consideration of an Appointment to the Boone County Solid Waste District Board COUNCIL ACTION: President Garrett moved to appoint Alex Choi to the Boone County Solid Waste District Board. Councilor Traylor seconded the motion. The appointment of Councilor Choi to the Boone County Solid Waste Management District Board was approved by a vote of seven in favor, zero opposed. (7/0) C. Historic Preservation Committee Presentation Committee Chairman Mark Walters shared a presentation on a proposed Historic Conservation District in the Village and a proposed Historic Conservation District Commission. Mr. Walters outlined the process the Historic Preservation Committee had followed in researching and developing a plan for establishing a Historic Conservation District. He explained the concept and purpose of a Conservation District, stating that it was less restrictive than a Historic Preservation District, affecting only new construction or demolition of historic structures. He detailed what would qualify as a historic structure and what the boundaries of the District would be. Mr. Walters went on to highlight the benefits of a Historic Conservation District and the importance of protecting the Village as an asset to Zionsville. He shared results from surveys of Village property owners, stating that out of the 50% response rate, 81% wanted their property protected by a Conservation District and 83% wanted a Conservation District for the Village. Mr. Walters explained the purpose, responsibilities and formation of a Conservation Commission and the steps needed to finalize it. Mr. Walters, Attorney Heather Willey, Councilor Culp, and Historic Preservation Committee member Chelsea Overbeck answered questions from the Council. Lengthy discussion followed. D. Consideration of an Ordinance to Amend the Zoning Ordinance – Petition 2021-04-Z (Goddard School) Ordinance 2021-04 Brad Schoeff of Weihe Engineers, Inc., representing property and Goddard School owner Dea Walls, explained the need for the rezone from the Urban General Business Zoning District (B2) to Urban Neighborhood Business District (B1) to allow the Goddard School to construct a new day care facility as well as a potential future professional office building on the site. Mr. Schoeff answered questions from the Council.  COUNCIL ACTION: Councilor Traylor moved to approve Ordinance 2021-04. Councilor Melton seconded the motion. Ordinance 2021-04 was adopted by a vote of seven in favor, zero opposed. (7/0) E. Discussion of a request to direct the Plan Commission to Rezone Property Councilor Traylor stressed the importance of rezoning the property just south of the Indianapolis Executive Airport from its current residential zoning to agricultural or some other use, citing safety concerns when the runway is extended and airplane traffic and noise complaints. Attorney Heather Willey explained the process for requesting the Plan Commission rezone the property. Attorney Willey and Councilor Traylor answered questions from the Council. After consensus from the Council, Attorney Willey said she would prepare a resolution for the April 19th meeting directing the Plan Commission to rezone the property. 8. OTHER MATTERS President Garrett noted the passing of Steve Jacob who was President of the Boone County Council, Chairman of the Boone County Convention and Visitors Bureau, and a Boone County Economic Development Corporation Executive Committee board member. President Garrett acknowledged Mr. Jacob’s service to multiple organizations and the Boone County community. 9. APPROVAL OF CLAIMS COUNCIL ACTION: Councilor Choi moved to approve claims as presented. Councilor Melton seconded the motion. Claims were approved by a vote of seven in favor, zero opposed. (7-0) 10. ADJOURN COUNCIL ACTION: President Garrett moved to adjourn the meeting. Councilor Culp seconded the motion. The motion was approved by a vote of seven in favor, zero opposed. (7/0) The meeting was adjourned at 9:03 p.m. The next regular Town Council meeting is scheduled for Monday, April 19, 2021 at 7:30 a.m. Determination of the need for a solely electronic meeting will be evaluated prior to the meeting and final notice will be posted in compliance with the Indiana Open Door Law.
