It was not, when I went to pull the claims it had not been updated since June 23rd. So it has since been updated, so I wasn’t able – Amy was so patient with me until the last moment and pushed it back another day but there was nothing, nothing to be done, so. Plunkett Okay. Burk Quick question – if it was pulled, if you were getting access now through the 23rd we couldn’t do anything last month, right? So could we be a month in arrears still to do claims? Adams No. We were able to – there was, no. The Council meeting before this they were approved. Plunkett Yes we did have a way to handle that. Burk Okay, Yes. Plunkett Yes. Burk Thank you. Plunkett Okay. Garrett Kellie, not to put you on the spot – I saw someone make a comment online that they were unable to pay with a credit card for a transaction. Is that a temporary glitch or is that a, kind of it is what it is situation right now? Page 2 of 15 Zionsville Town Council July 5, 2022 Adams The situation we’re in was that my predecessor took away the credit card machine in hopes that OpenGov would be doing all of that. It doesn’t – Garrett Okay. Adams And so in the meantime we have a lot of departments that are siloed so kind of what’s taking so much time is that we’re trying to find a way for - OpenGov kind of promised we - everything would be all encompassing, and we’re finding that maybe that lacks so now it’s trying to find something where we don’t have to have so many departments siloed we can’t have any one payment processor, one software or as a little, a little amount as possible so, yes, that is the truth. We did get it for Planning. I would like to start using it for Planning soon, but they have people that see it and then they’ll, well why can’t I use it for this, so everything is just kind of balanced on when we move forward with the new company so, but soon. Lacy No we do not. MAYOR/ADMINISTRATION UPDATE Plunkett Administration and Mayor Update. Any updates there? Lacy No we do not. TOWN COUNCIL UPDATE Plunkett Up next will be Town Council Update. So are there any updates from Councilors? Garrett Just one quick update on the safety committee that we’re working on. Councilors Choi, Vice President Burk and I met last week or was it early this week? The week is – Burk Last week. Garrett Last week, yes, we met and just talked about scheduling with the different department heads, figuring out that from vacation schedules so we’re going to get that going here pretty soon but just wanted to let, I know it’s of interest of the Page 3 of 15 Zionsville Town Council July 5, 2022 public, I know a lot of Town employees are interested in this, so that’ll get going here shortly. Choi Yes, obviously, that this is of paramount importance considering what’s happening across the nation, in a variety of municipalities and what we want to do is make sure that we do everything we can to create a safe environment and, not everything’s going to be perfect in that regard but we want to make sure that we’ve got all the T’s crossed and the I’s dotted in this and so we’re gathering together all the resources we can at this point and making the preliminary planning. This is not going to be a, a quick process but, it’s something that the three of us are dedicated towards and want to make sure it happens in an effective manner so thank you. Plunkett Great. Appreciate the updates there. Real quick I have, in 2018 Heather, you’ll remember this – we passed a golf cart ordinance prior to Holliday Farms coming in and, and just talking about what we did and didn’t want with golf carts and especially in the last few months I’ve had a number of constituents reach out about expanding that particular ordinance and having access to roads that previously weren’t allowed so that they could get to different parts of town. That process or the ordinance was put in place with the intent of coming back and reviewing it, looking at data if we had it and making those changes. I know that was something we did at the Safety Board level when we had that. I’ve had, again, a number of conversations with constituents in neighborhoods, on the street, in text messages, etc., etc., enough to, to warrant, in my opinion, reviewing that. Heather, is that something we would go back to the Safety Board for, or would that be presented here at the Council? Harris Yes, I think we just did it at the Safety Board because typically that group had looked at all of the sort of roads issues from a safety perspective including things like speed bumps and, and the like so we can definitely just bring it back to the full Council or if there’s a group that wants to discuss it in a small group, we can draft something and get feedback from the Council members. I know, I was going to note I had someone reach out to me on that recently actually as well because I think there was some confusion with Whitestown because Whitestown has a very open golf cart ordinance where they don’t really restrict anything, they kind of, as I understand it, you pay a fee and they say please don’t drive on the main roads, you know but it’s a different process and I think for some of those folks that live right on the edge there was some confusion about, you know, where the line of demarcation ends and what that looks like and whether or not if they’re in a neighborhood, you know, that sort of splits into Zionsville do they have to pay two fees and what does that look like? So that was a question that was put to me like, you know, is there a way to create some sort of cooperation because the communities to allow those residents to maybe have a shared fee or one license or something so, I don’t know, I want just to note that – Plunkett Yes. Harris For the Council too. Plunkett Well I think we’ve had, I mean in addition to just accessibility, I mean there’s the fee that we pay that is significantly higher than fees of surrounding areas and I Page 4 of 15 Zionsville Town Council July 5, 2022 think there’s just a lot to consider with that and with the permission of this Council I’d like to dig a little bit deeper into that with, you know, department heads and Heather and see if that’s something we can help expand. Garrett I’ve heard a lot of those too, so I appreciate you doing that. Melton I have a question – so is it urban Zionsville and then rural Zionsville all of them are under this so everybody pays the fee if you’re out in rural same as you would if you’re in town here? Harris Yes, the way that it was originally designed is that anyone within the Zionsville limits would have a registration fee – Melton Gotcha. Harris It would be an annual fee that would go through the Police Department so you would actually have an application. You’d go into the Zionsville Police Department – Melton Zionsville Police? Okay. Harris And there were certain things in our ordinance that talked about sort of parent accountability, right, if they let their child or someone who was underage without a valid license, you know, drive a golf cart who would be responsible for, you know, any incident and then I know at the time I worked closely with Lance Lantz because we looked at a lot of the streets and where there was high traffic, where there was concerns about crossing main thoroughfares and sort of how, it almost was a little bit of a swiss cheese map but just, you know, I think the key concern at the time of Chief Knox and others within the administration was the safety both for the people driving the carts as well as for – Melton So, so my question is with reciprocation from the Zionsville Police Department and the Boone County Sheriff, does the Boone County Sheriff recognize our permits? Garrett I thought it was urban only. Plunkett Yes, there’s not – the Boone County Sheriff specific to the rural parts of Zionsville, you just have to have a slow-moving vehicle sign – Harris Okay. Plunkett Just like you would a tractor, right? Plunkett Yes in the urban areas you still have to have that sign, you have to have turn signals, you have to have insurance, it’s got to be a street legal golf cart. And, you know, I’m in that area, Heather, where I pay for a Whitestown permit and I pay for a Zionsville permit just in case we ever try to get in to town but it’s difficult to do given the current restrictions on the roads, so that’s part of it, I hear that from folks in my neighborhood and I hear that from people in, in my Page 5 of 15 Zionsville Town Council July 5, 2022 district which, which heads right up north on Ford Road so there’s a lot of people that would like to have access. Melton I don’t recall, just real quick – pathways, sidewalks? Plunkett Yes, no. Can’t do that. Melton No? Okay. Plunkett No. Culp Is Main Street on there because – Plunkett You can drive on Main Street, Oak Street you can cross but you can’t drive on, Sycamore Street going out same thing – that’s restricted you can’t do that. But the problem we have is, is and I’ve seen it – driving down certain roads that are restricted you see a golf cart come out of a school parking lot or come out of a, off the sidewalk or something like that because they want to be able to cross – Culp They’re trying to get Yes – Plunkett Right and they’re crossing in places that no one would expect a golf cart to cross and, and it just, I think, opens this up to the discussion of do we expand to more roads to allow people to have access to that as opposed darting across intersections that aren’t designed for anything beyond pedestrian traffic. Culp Yes. Plunkett So, if you guys are okay with that I’ll work with Heather and start digging into that? Melton That’d be great. Thank you. Garrett Thanks. Plunkett All right, anything else for Council Update? Melton Yes one other quick question – I know that we have a consideration for additional appropriation resolution for 2022-11 and I think Lance is going to be presenting on that tonight and I just kind of wanted to publicly ask Lance, if – we’re going into budget season and I want to see if, you know, in advance of budget season you’d be willing to give us 2023 projects and associated costs in advance of the budget process for next year? I think it’s just going to help us a little bit as we move into the budget process. I’m not asking for anything tonight, obviously, but I’m just making a public request so that when it gets into budget time and we start having those conversations you know, I think it’s a little different when we have police officers and we’re presented with a whole other docket of information regarding hey we need more employees – this is primarily regarding the projects of 2023. Thanks Lance. All right, anything else from Councilors? Choi I think it’s a follow-up to that – Plunkett Sorry. Choi We really need an accountability from the administration and from the departments about the next budget process. We’re getting to, we’re in July now. This has to be approved by October and so I feel very strongly that the more we push this out that we are going to get into a situation where we are really hampered in our ability to pass a balanced budget and so this has happened in the past and I am not going to be – it’s not going to be acceptable to me to look at a budget that the administration brings to us and feels that it’s just going to be rubberstamped so I feel very strongly that the Town Council needs to be very involved in this budget process and I know all of you do as well. Garrett Yes. Plunkett I agree. Anything else from Councilors? NEW BUSINESS A. Consideration of an Additional Appropriation Resolution (CR 800 E & Oak Street Roundabout) Resolution 2022-11 (Public Hearing) Plunkett Up next is Old Business and there are no Old Business items. Next would be New Business which the first item is Consideration of an Additional Appropriation Resolution. This is for County Road 800 East and Oak Street Roundabout, Resolution 2022-11. Lance, the floor is yours. Lantz Thank you and good evening. As stated, before you this evening is an appropriation request for two funds, the Motor Vehicle Highway Fund and the Road Impact Fee Fund. Both are necessary to keep our next roundabout project on target. The first request is $38,500 from the Motor Vehicle Highway Fund and just by way of a refresher, and I’ll try and keep this as simple as possible. In 2021 this Council appropriated and thus earmarked $1.2 million dollars for the purchase of new right-of-way for the roundabout at the intersection of Oak Street and County Road 800 East. However, in 2021, we only expended a little over $300,000, and therefore, at the beginning of this year, I asked for a reduced appropriation amount of $600,000 from the remaining balance to complete our acquisitions. I thought I had enough contingency built in but in hindsight perhaps I was too optimistic, because due to a condemnation filing, on one parcel Page 7 of 15 Zionsville Town Council July 5, 2022 that was much higher than expected, as well as updated market appraisals for another parcel, that $600,000 you appropriated earlier this year just simply doesn’t cut it by the tune of $38,500. Should you approve this appropriation, we will actually only spend ultimately $953,823.10 of that original $1.2 million dollars that you appropriated and earmarked for this purpose. So while this is an ask for additional money, technically we are about a quarter million dollars under budget on this particular phase of the project. The second is in the Road Impact Fee Fund and this is an idle fund that just collects revenues and has ever since it was initiated in 2007. It can only be used for capacity improvement projects as identified in our Zone Improvement Plan. These funds are requested so that we can enter into a contract in the very near future, with a clearing contractor in advance of our road project which is slated for next year. This is necessary to allow several utilities to begin relocating the facilities well in advance of the intersection of our project in order to minimize any delays. Usually this utility relocation is done at the same time as the construction process but since we have a significant closure, to accomplish this roundabout, we want to make sure anything that we can do reasonably in advance to make sure there are no hiccups during construction we’re going to do. So, we’d like to get this area cleared and get those utilities relocating as soon as possible. So, I will turn it over to questions for now. Melton You mentioned road closure? So this is going to be different than the Marysville Road and the other roundabout so – Lantz That is correct. Due to the elevation changes, there’s about 9 to 12 feet of fall across this intersection. We simply cannot build it half the time as we have with other roundabouts, so this is going to be a full closure which is why we want this as tight as possible going into next year’s construction season. Melton Great. Thank you. Garrett Full closure east-west or just north-south? Or both? Lantz Both. Culp Oh boy. Garrett Where do all those cars go? Lantz We are in the process of developing a maintenance of traffic and a detour plan and it will probably likely be two-tiered, one for trucks with larger transportation needs and then one for the smaller passenger vehicles. Where they end up going will be entirely up to the drivers and probably follow their GPS. Garrett Okay. Burk Wow. Garrett The $1.2 you originally allocated was that inclusive of construction or was that just for property acquisition? Page 8 of 15 Zionsville Town Council July 5, 2022 Lantz No that was solely for land acquisition. Garrett Yes, okay. Melton Thanks for saving us a bunch of money. Garrett Or overestimating – I don’t know. Burk Right. Lantz You’re welcome and you’re welcome. I try and I try to over deliver. Garrett You’re a hero or a sandbagger. Culp You’re a hero now until that road’s closed. Lantz Yes. Plunkett That’s funny. Any other questions for Lance? American Rescue Plan Act (ARPA) Premium Pay Discussion Plunkett Up next is on New Business is just an ARPA – American Rescue Plan Act Premium Pay Discussion. Councilors, you’ll recall we’ve had a couple of conversations about this for other members of the Town. Obviously, it’s been a desire of this Council to do that once we got through our public safety stipends. Last month the Mayor shared recommendations on stipend amounts as well as eligible employees that were, were deemed essential at the start of the pandemic, I forwarded that information to you guys. It’s my understanding the total stipend request would be approximately $129,000, I’d like to get a sense from the Council tonight if that’s something that we, are supportive of at those levels, if there’s any adjustments or if there’s any changes that we would like to have, just so we’re all clear. We do have to publish and have a public hearing on the money, right? So, we would not even be able to do that at the next meeting, this would all be finalized, likely if we decided to suspend the rules like we did last time in, in one fail swoop in the first August meeting. But, obviously, in an effort to make sure we get the appropriate dollar amount published and everything done, we would want to make sure that if we were supportive of that we got that information to Amy as soon as possible. So, I’m certainly open to discussion. Garrett I’m supportive – I mean, I think it needs to be sort of commiserate with what their exposure was, right? So, I think it’s not appropriate at the same level of what public safety got and it’s not, but they were – those folks were interacting with the public, they were not able to work from home, so it seems reasonable. Plunkett Yes. Melton My comment on that is I’d really like to see these funds be used primarily for those employees that had duties that went above and beyond their normal duties during the pandemic. Not just being called essential as there are arguably many other positions within the Town that are, are essential – finance and all these other different, that are arguably, but I do appreciate the administration coming forward with some of these some of these ideas and price points and I want to commend Jo Kiel for her work on this and I support this ARPA fund disbursement. Garrett You asked for this right, Craig? Melton That is correct. Garrett Yes, so you started this, so appreciate that. Plunkett Yes. I also think it’s important to remember and go on record that obviously, this is not something that the Town Council essentially cherry picks, right? I mean, these are folks that were deemed essential personnel early on by the administration, required to do so, this is not something that, you know, we pick and choose people who can and can’t, you know, receive these, these funds. So, Page 10 of 15 Zionsville Town Council July 5, 2022 yes. Any other questions or any other discussion? If, if there’s not, I would just simply, ask Heather to start working on the resolution, and then Jo’s given me the information, so I have the, at least the dollar amount there. I’ll be in communication with Jo because unless there’s anybody that would be eligible that wasn’t on there or we lost or if that number needs to, if that number changes, obviously, if we’re going to publish it we want to make sure we’re as accurate as possible. If, if not maybe a little bit over just to give us some wiggle room, – Harris Yes and just for the Council members and for members of the public, so the reason we can’t do it in the next meeting is because we’re doing an additional appropriation request. That requires a 10-day public posting, and that’s 10 business days so if we started tomorrow or even if we had started today that would’ve only given us 8 days so we’ll go ahead and Amy and I talked about it and Jo prior to the meeting, you know, work on getting the public hearing posted, in advance of the 1st. You may recall, when we did the initial, ordinance to allow for the first round of essential workers to receive a stipend, we actually had that imbedded in the ARPA plan so we had the ordinance that we passed and then we had the ARPA plan which was sort of our comprehensive plan for the monies that we’ve received to date and as of March 7th we’d only received half of the allocation that was awarded to the Town so we moved some of those monies over, specific for the public safety stipend and then what we did is we dumped for lack of a better word, the rest of the money into what’s called Govern, General Government Services which is allowed under ARPA so what we’ll do kind of mechanically is we’ll take the money from that fund, move it to this premium pay fund and then we’ll have the additional appropriation request for that but we will have to go back and amend the actual plan that we passed and that’s something that that’s not unique to Zionsville, that’s what most, if not all, communities are doing as they’re figuring out how they want to spend the funds, you know, as the monies come in to the different communities, so just procedurally what we’ll have for the August 1st meeting is we’ll have the additional appropriation resolution, we will have an amendment to the salary ordinance because we have to go back and each of the identified workers fall in this category – their actual salary will be amended to account for this premium pay stipend that will be received. We did that as well for public safety. Then we’ll have an actual revised ordinance amending our plan and then a revised plan so we’re going to have like four pieces, two of which will be lumped into one vote and then there’ll be three separate pieces. So, I just wanted to let you all know because it’ll look like a lot of documents but it’s really all accomplishing the same purpose and Jo and I and Amy and Amy Nooning will coordinate just to get drafts out and make sure, we’ve got that squared away. Garrett Heather when you think about 2023 and amending the salary ordinance now and proposals from the administration or guidelines from the Council on raises are, are those raises based on that, that amended salary ordinance or are they based on the original sort of determined salaries or am I getting – Harris I don’t think that the stipend will be considered in the base salary – Garrett Okay. Page 11 of 15 Zionsville Town Council July 5, 2022 Harris We will go back and look at the actual salary for the employee but what the actual statute requires is anytime you give any additional compensation – Garrett Yes. Harris To any employee you have to go back and republish for the public and for the transparency that would go to Gateway and, and other places what that employee actually received in that year. Garrett Yes. Harris But unless Jo head nods differently, it won’t be where their base starts for the salary increase for the previous 2023. Garrett Okay. I just wanted to make sure that we’re – Harris Up to 2023. Garrett We’re continuing it appropriately and those that didn’t get the bonus aren’t somehow penalized by their salary looking, their compensation looking lower than it really is, so. Harris Yes, is that, is that correct, Jo? Kiel Correct. Harris Okay, that’s what I thought. Garrett Okay. Perfect. Thank you. Plunkett All right any other questions? Burk I appreciate you putting it on the agenda for today. I fully support doing this. I don’t have the document in front of me. I know, I think we mentioned this a couple of weeks ago in looking at it and I can get with Jo and, and you later but I just wondered if we didn’t want to bump it up a bit and I hear what Josh is saying about levels, you know, consistent with public safety. I just wondered if it was a little low and maybe that’s just my opinion but we can look at it again and I’m sure – Plunkett Well that’s – Burk Jo has, has some formulary at how she’s arrived at all that but if there’s a bit more. Plunkett Yes, I mean that’s the purpose of this conversation. I mean we would need to come out of this with the general direction so that we can publish everything appropriately and I know I’d sent that to you guys. I’m going to have to see if I can find that in my sent items here Yes, I mean, it’s, I don’t know how in depth we want to get into this but, – oh perfect, thank you. Yes, I mean, you want me to read through it or do you, do you want to – Page 12 of 15 Zionsville Town Council July 5, 2022 Garrett Well I just want to be careful. Plunkett Right. Garrett I appreciate let’s be generous, but I think there are two factors we just need to consider in that this money we have is a pretty big safety net in a pretty turbulent environment which is both turbulent for public finances in terms of inflationary pressure, unknown revenue sources but also further mitigated by the financial system that it is very hard to do projections on. So, I just don’t want to give away too much money even though it’s deserved not knowing that we may need that for sort of core operating duties, you know, once we sort of figure out what are the inputs, what are the outputs, and I couldn’t even tell you what those are right now. So, I support what you’re saying, Brad, I just, that’s just my only hesitation. Burk No, I hear you. We’re in a in a unique circumstance. I mean, obviously, you’d hate to think that these dollars which were created and, and distributed, you know, as a result of COVID and the impact it had on the community employees who did work and other needs that we have now that are equally important but that was just my, my thinking but I may be wrong. Garrett Well the impact on the community is broader than just the employees because you gotta figure our revenues are down because we’re based on Boone County so that’s the bigger community. If we’re on the receiving end of those downward pressures, that, that money may also be used to sort of plug some of those holes, if you will all respect to the employees that were working too but just – Burk Yes. Garrett And perhaps that conversation I just want that in the back of our minds, – Burk Fair statement. Garrett Of that. Plunkett Yes, I mean, I think I too would like to see it bump up a little bit but I’m also sensitive to the fact that we can always come back and do this again if we felt, you know, to your point, if we find out revenue is, is different and we find out, you know, we’re in a different spot, we have until what is it 2024, 2025? Harris 2024. Plunkett 2024 until we have to do something by then, I mean, we are certain, I think we have an opportunity to come back at a later date if we decide that’s appropriate. Choi I think that’s the safter thing to do at this point. Melton Is this the time to have a conversation about other potential uses for, you know, say we have a nest egg, say we have plenty, income comes in 2023 and we do our road projects, and we still have this lump of money from ARPA. Is this the Page 13 of 15 Zionsville Town Council July 5, 2022 conversation where we kind of throw out like our opinions on that because we, you know – Plunkett Well no. Melton Okay. Plunkett I mean this is more, this is strictly towards just the premium pay. However, what I will say is there’s a bigger picture here, right? I mean, I think as we’ve talked about in the past getting, having communication with our constituents about what they want, how they want to see the money spent because, you know, we certainly hear things from folks in the, in the, in the Town that talk about, you know, what can we use this money for, should it be, you know, the Chamber has come and spoke about using it for different opportunities there you know, the administration certainly has objectives with it as well we talked about having open sessions with, with the community and again, given we’ve got we don’t have to spend this money tomorrow, we’ve got some time, right? I think this is, this is maybe step two, right? Step one was public safety. Step two is, is this stipend now and then I think everything else moving forward would be driven by dialogue with, with the community and with the administration. Which I think goes right back to your point – find out what people in your area want. I mean maybe they want internet, right? I mean maybe it can be used for that.
