16626 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, January 19, 2016, 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Council Members Todd Campbell, Alan Johnson, Mark Remily, Rob Ronayne, Clint Rux, Jennifer Slaight- Hansen, and Laure Swanson. City Council Member David Bunsness was absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, and Karl Alberts. Mayor Levsen led the Pledge of Allegiance. MINUTES Rux moved, Slaight-Hansen seconded to approve the minutes of January 11, 2016, as circulated. All present voting aye, motion carried. OPEN FORUM – No one was present. OLD BUSINESS Ordinance No. 16-01-03 revising Chapter 50 of the City Code regarding refunds of certain Sales and Use Taxes was presented for second reading and final adoption. Ronayne moved, Campbell seconded the motion to amend Section 50-91 of the Ordinance taking out the word “intangible” as recommended by the City Attorney. All present voting aye, motion carried. Campbell moved, Rux seconded to approve second reading as amended and final adoption of Ordinance No. 16-01-03. Upon roll call, all present voting aye, motion carried. CONSENT CALENDAR Ronayne moved, Swanson seconded to approve the following items on the consent calendar: SET HEARING DATE – of February 1, 2016 at 5:30 p.m. for an application for a new Retail On-Off Sale Malt Beverage License for Karisma LLC dba Karisma Boutique at 305 South Main Street. LICENSES – Taxi Cab Drivers – Theodore Tampary and Tom Watson, Jr. LOTTERY NOTICES – for ACT 2, Inc. dba Aberdeen Community Theatre and for Lincoln Elementary PTA – receive and place on file. All present voting aye, motion carried. NEW BUSINESS RESOLUTION NO. 16-01-02R Johnson moved, Swanson seconded to approve Resolution No. 16-01-02R for annexation of certain property into the city limits of the City of Aberdeen, South Dakota described as Outlot A, DLV Hunt Outlot A in the NE ¼ of Section 11, T123N, R64W of the 5th P.M., Brown County, South Dakota also known as 2315 North 5th Street and adjacent 33’ of 5th Street North Right-Of-Way. All present voting aye, motion carried. RESOLUTION NO. 16-01-03R Rux moved, Johnson seconded to approve Resolution No. 16-01-03R for annexation of certain property into the city limits of the City of Aberdeen, South Dakota described as Lot 2, Hub City Livestock Third Subdivision in the East ½ of Section 26, T123N, R64W of the 5th P.M., Brown County, South Dakota also known as 1125 West Melgaard Road. All present voting aye, motion carried. RESOLUTION NO. 16-01-04R Remily moved, Swanson seconded to approve the following Resolution No. 16-01- 04R confirming Mayor Levsen’s appointment of Donna Wahlfeldt to the Business Improvement District II Board: WHEREAS, the City of Aberdeen has enacted Ordinance No. 08-08-03 creating Business Improvement District No. 2, and WHEREAS, South Dakota Codified Law (SDCL) 9-55-5 provides that the Mayor shall, with  16627 the approval of the governing body, appoint a Business Improvement District Board consisting of property owners, residents, business operators or users of space within the business area to be improved, and WHEREAS, SDCL 9-55-6 provides that the Board shall consist of no less than five members to serve such terms as the governing body, by resolution, determines, and WHEREAS, the Business Improvement District No. 2 is created for the purpose of funding a portion or all of the future proposed public activities, facilities, events, and improvements along with the costs of acquisition, construction, maintenance, operation, and funding of such improvements, facilities, events or activities for: the enhancement, expansion, marketing and promotion of visitor facilities, events, attractions and activities benefiting the city and its hotels and motels located within the district through the City Convention and Visitors Bureau, and WHEREAS, Donna Wahlfeldt shall be appointed by the Mayor to serve as a BID II Board Member representing Super 8 North, and IT IS HEREBY RESOLVED that all Business Improvement District II Board Members shall be appointed by the Mayor with the approval of the governing body at the January 19, 2016 City Council Meeting. Each Business Improvement District II Board Member shall serve until his or her successor is appointed. If the Business Improvement District II Board Member’s position becomes vacant, then his or her successor shall be appointed by the Mayor and approved by the governing body as soon as practicable at a regularly scheduled City Council Meeting. The successor shall fill the remainder of the predecessor’s term. All present voting aye, motion carried. HEARINGS ON APPLICATIONS FOR ALCOHOLIC BEVERAGE LICENSES This being the time and place set for a hearing on an application for transfer of Retail On-Sale Liquor License from HAYJON Inc. to Stacy Gossman dba Scotty’s Drive-Inn Bar & Grill at 719 North Main Street, recommendation received was to approve license contingent upon a final inspection by the Health Department, Campbell moved, Ronanye seconded to approve the transfer of Retail On-Sale Liquor License from HAYJON Inc. to Stacy Gossman at 719 North Main Street contingent upon final inspection for the issuance of a certificate of occupancy by the Health Department. All present voting aye, motion carried. This being the time and place set for a hearing on an application for transfer of an Inactive Retail On-Sale Liquor License for Sunrise Loan Inc. from 422 South Main Street to 2220 – 6th Avenue, SE, Suite #3, recommendations received were to approve the transfer of the license, Swanson moved, Remily seconded to approve the transfer of the Inactive Retail On-Sale Liquor License for Sunrise Loan Inc. from 422 South Main Street to 2220 – 6th Avenue, SE, Suite #3. All present voting aye, motion carried. This being the time and place set for a hearing on an application for a Special One- Day Retail Sale Wine License and Retail Sale Malt Beverage License on January 21, 2016 for Aberdeen Area Chamber of Commerce dba Avera Cancer Institute, 310 South Penn Street, recommendation received was to approve license contingent upon a final inspection by the Fire Department, Remily moved, Swanson seconded to approve the Special One-Day Retail Sale Wine License and Retail Sale Malt Beverage License on January 21, 2016 for Aberdeen Area Chamber of Commerce at the Avera Cancer Institute at 310 South Penn Street contingent upon a final inspection by the Fire Department. All present voting aye, motion carried. BIDS FOR RAMKOTA SANITARY LIFT STATION RENOVATIONS Bids were received and publicly opened for the Ramkota Sanitary Lift Station Renovations Project. A detailed list of the bids is on file at the Finance Office. Remily moved, Johnson seconded to award the Ramkota Sanitary Lift Station Bid to Quality Flow Systems, Inc. in the amount of $24,950.00 and authorize the City Manager and City Finance  16628 Officer to sign the necessary documents after approval by the City Attorney.
