16708 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, May 16, 2016, 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Council Members David Bunsness, Todd Campbell, Alan Johnson, Mark Remily, Rob Ronayne, Jennifer Slaight-Hansen and Laure Swanson. City Council Member Clint Rux was absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, Doug Johnson, Mark Hoven, Dave Usselman, and Kathie Allstot. Mayor Levsen led the Pledge of Allegiance. MINUTES Swanson moved, Slaight-Hansen seconded to approve the minutes of May 9, 2016, as circulated. All present voting aye, motion carried. OPEN FORUM – No one was present. OLD BUSINESS ORDINANCE NO. 16-05-04 Bunsness moved, Johnson seconded to approve second reading as amended and final adoption of Ordinance No. 16-05-04 supplementing the 2016 Budget for various unanticipated projects, activities, and expenses. Upon roll call, all present voting aye, motion carried. CONSENT CALENDAR Ronayne moved, Campbell seconded to approve the following items on the consent calendar: PROCLAMATION – May 21, 2016 as “National Kids to Parks Day” LICENSES – Private Security – Jacqueline Delonais-Olson; Residential Building Contractor – Mary Jones dba South Dakota Roofing LLC; Residential Building Contractor – Austin Stugelmayer; Sidewalk Contractor – CWF Masonry & Construction, Inc.; Transient Merchant – Jose Gallardo dba Fabian Seafood Company; Taxi Cab Driver – Kyna Scheuffele. NEW BUSINESS HEARING ON SPECIAL ALCOHOLIC BEVERAGE LICENSE This being the time and place set for a hearing on an application for a Special One- Day Wine License on May 23, 2016 for Dacotah Prairie Museum dba Strings Art Creations at 21 South Main Street including an application for a Community Event Permit, recommendations received were to approve, Remily moved, Swanson seconded to approve the Special One-Day Wine License on May 23, 2016 for the Dacotah Prairie Museum and a Community Event Permit with co-sponsor, Hub City Events, LLC, for the Strings Art Creations Event at 21 South Main Street. All present voting aye, motion carried. COMMUNITY EVENT PERMIT FOR FALLOUT CREATIVE COMMUNITY Johnson moved, Ronayne seconded to approve the Community Event Permit for Fallout Creative Community’s Art & Bicycle Spectacle on May 28, 2016 including a street closing on 2nd Avenue, SW from South Main Street West to Alley from 11:00 a.m. until midnight. All present voting aye, motion carried. COMMUNITY EVENT PERMIT FOR EAGLES CLUB Remily moved, Slaight-Hansen seconded to approve the Community Event Permit for the Eagles Club’s Concerts/Dances at 316 South Second Street on May 21, May 28, June 11, June 18, July 9, July 30, August 6, August 27, and September 10, 2016 from 5:00 p.m. until  16709 2:00 a.m. including a time extension for the music until 1:00 a.m. for each event however the City Council has the ability to change or revoke the event permit if complaints are received. All present voting aye, motion carried. RESOLUTION NO. 16-05-01R Resolution No. 16-05-01R to vacate public right-of-way for property described as the 16’ Wide East/West Alley Public Right-Of-Way located in Block 48, Howard & Hedger’s Replat of Northwestern Addition; 66’ Wide Section of Second Avenue, NE Public Right-Of- Way commencing at the East Side of Jackson Street North and lying adjacent to and to the West of Lot 2, Northwestern Gas Plant Addition; 16’ x 300’ North/South Section of Alley Public Right-Of-Way located in Block 37, Howard & Hedger’s Replat of the Northwestern Addition; 66’ Wide Section of Congress Street North Public Right-Of-Way commencing at the South Side of Third Avenue, NE lying adjacent and to the West of Lot 2, Northwestern Gas Plant Addition and adjacent to and to the East of Lots 1 – 6, Howard & Hedger’s Replat of the Northwestern Addition dba 102 and 214 North Jackson Street was presented. Bunsness moved, Campbell seconded to approve Resolution No. 16-05-01R. All present voting aye, motion carried. LEGAL COUNSEL FOR RENEWAL OF CABLE TV FRANCHISES Ronayne moved, Campbell seconded to retain the law firm of Moss & Barnett to represent the City on negotiations for possible renewal of Cable TV Franchises of Midcontinent Communications and Northern Valley Communications, to authorize the Mayor or City Manager to execute the Engagement Agreement; to designate the City Attorney as contact person for Moss & Barnett, and to supplement the City Attorney Budget by $20,000 to cover anticipated professional services costs of the franchise renewal negotiations. All present voting aye, motion carried. APPOINTMENTS TO PARKING BOARD Swanson moved, Bunsness seconded to confirm Mayor Levsen’s appointment of Jeff Rich, Christina Olson, and Jeremy Backous to the Parking Board effective June 1, 2016. All present voting aye, motion carried. EIGHTH AVE NW STREET PROJECT Campbell moved, Swanson seconded to approve and authorize the City Manager to sign Change Order #1 in the amount of $5,998.50 and Payment Request #1 in the amount of $133,435.44 for Reede Construction for work performed on the Eighth Avenue, NW Street Reconstruction Project ST-2016-1.
