16767 City Council met at 4:00 p.m. on August 15, 2016 for a Work Session in City Council Chambers regarding the proposed 2017 City Budget. Present were David Bunsness, Todd Campbell, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Mayor Mike Levsen. No action was taken. CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, August 15, 2016, 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Todd Campbell, Mark Remily, Rob Ronayne, and Clint Rux. City Councilors Alan Johnson and Jennifer Slaight-Hansen were absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Cody Roggatz. Mayor Levsen led the Pledge of Allegiance. OATH OF OFFICE Finance Officer Karl Alberts administered the Oath of Office to Dennis “Mike” Olson who was appointed a City Councilor for the SE District. MINUTES Olson moved, Bunsness seconded to approve the minutes of August 8, 2016, as circulated. All present voting aye, motion carried. OPEN FORUM – Ron Krogman of the 40 & 8 Veteran’s Organization presented the Hero of the Year Award to City Employee Jameson Bartscher who had helped people at a car accident. Duane Reidel was present to discuss law enforcement. CONSENT CALENDAR Campbell moved, Rux seconded to approve the following items on the consent calendar: SET HEARING DATE – of August 22, 2016 at 5:30 p.m. for an application for a Special One-Day Sale Liquor License on August 27, 2016 for Aberdeen Downtown Association dba Car Movies at the Capitol Theatre, 417 South Main Street. SET HEARING DATE – of August 29, 2016 at 5:30 p.m. for an application for a Special One-Day Sale Liquor License on September 8, 2016 for Aberdeen Area Chamber of Commerce dba Business After Hours, CO-OP Architecture, 1108 South Main Street #102. LICENSE – Residential Building Contractor – Careco Carpentry dba Steve Caron LOTTERY NOTICE – Aspire Foundation – receive and place on file All present voting aye, motion carried. NEW BUSINESS PUBLIC HEARING ON NATURAL GAS FRANCHISE RENEWAL This being the time and place set for a public hearing on a Natural Gas Franchise Renewal, Mayor Levsen opened the hearing for discussion and comments. The Natural Gas Franchise Agreement with Northwestern Energy is up for renewal in October, 2016. Mike Williams from Northwestern Energy was present. Mayor Levsen closed the hearing. RESOLUTION NO. 16-08-03R Campbell moved, Bunsness seconded to approve the following Resolution No. 16-08- 03R for Roadway Dedication of 15th Avenue, NW: RESOLUTION OF ACCEPTANCE OF STREET IMPROVEMENTS WHEREAS, there has been filed with the City of Aberdeen, South Dakota, a petition by the adjacent property owner to accept the operation and maintenance of a publicly used roadway, and; WHEREAS, said roadway: a. Has been used as a public roadway for more than 30 years and serves as the only other means of egress for the residents served by Olive Drive;  16768 b. Is not needed for use by the adjacent property owner; c. Has been inspected by the City and found that the road does not meet the current minimum City Standards but is uniquely necessary for public use and safety so that its acceptance will not establish an adverse precedent for the Council; and, d. Is on legally platted right-of-way known as 15th Ave. NW from Highway #281 to Olive Drive, located in Aberdeen, Brown County, South Dakota. BE IT FURTHER RESOLVED that the City of Aberdeen will accept the operation and maintenance of the street from this date. All present voting aye, motion carried. CHANGE ORDER/PAYMENT FOR S. WASHINGTON ST. PARKING LOT Bunsness moved, Rux seconded to approve and authorize the City Manager to sign the following change order and payment request for Lien Transportation for work on the S. Washington St. Parking Lot Improvements Project: Change Order #2 decreasing the contract amount by ($4,008.25) and Payment Request #2 in the amount of $15,435.04. Upon roll call, all present voting aye, motion carried. DOT MAINTENANCE AGREEMENT Ronayne moved, Bunsness seconded to approve and authorize the City Manager to sign all required documentation to accept the SD Department of Transportation Section 5310 Preventative Maintenance Grant Agreement for Ride Line. All present voting aye, motion carried.
