16797 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, October 3, 2016, 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Todd Campbell, Alan Johnson, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, and Cody Roggatz. Mayor Levsen led the Pledge of Allegiance. MINUTES Rux moved, Ronayne seconded to approve the minutes of September 26, 2016, as circulated. All voting aye, motion carried. OPEN FORUM – No one present. OLD BUSINESS REQUEST FOR STREET USE Ronayne moved, Campbell seconded to approve the request from Dennis Thrift Store for street use at the 10 Block of 2nd Avenue, SE for an Auction Sale on October 29, 2016. All voting aye, motion carried. CONSENT CALENDAR Johnson moved, Remily seconded to approve the following items on the consent calendar: SET HEARING DATE – of October 17, 2016 at 5:30 p.m. for an application for a Special One-Day Retail Liquor License on October 27, 2016 for Aberdeen Downtown Association’s Summer Concert Series, Yelduz Shrine Temple, 802 South Main St. SET HEARING DATE – of October 24, 2016 at 5:30 p.m. to discuss a petition to rezone from (C-2) District and (R-3) District to (C-2) District property described as Lots 1 and 2, Baggett’s 1st Addition in the NE ¼ of Section 24, T123N, R64W of the 5th P.M., Aberdeen, Brown County, South Dakota (618 South Penn St. and 720 – 6th Avenue, SE). NEW BUSINESS HEARINGS ON ALCOHLIC BEVERAGE LICENSES This being the time and place set for a hearing on an application for transfer of Retail On-Off Sale Malt Beverage License with Video Lottery from William Ochs and Mary Ann Ochs at Casino Bleu, 1713 – 4th Avenue, SE-Suite B to DOM Inc. at Casino Bleu, 316 South Wilson St.-Suite B, recommendations to approve were received, Ronayne moved, Remily seconded to approve the transfer of the Retail On-Off Sale Malt Beverage License with Video Lottery from William Ochs and Mary Ann Ochs at Casino Bleu, 1713 – 4th Avenue, SE-Suite B to DOM Inc. at Casino Bleu, 316 South Wilson St.-Suite B. All voting aye, motion carried. This being the time and place set for a hearing on an application for transfer of Retail On-Sale Liquor and Package Off-Sale Liquor Licenses from Wild Oats, LLC at 322 South  16798 Main St. to Ronald J. Rivett at 2020 – 8th Avenue, NE-Suite #5 (Inactive), recommendations to approve were received, Johnson moved, Campbell seconded to approve the transfers of Retail On-Sale Liquor and Package Off-Sale Liquor Licenses from Wild Oats, LLC at 322 South Main St. to Ronald J. Rivett at 2020 – 8th Avenue, NE-Suite #5 (Inactive). All voting aye, motion carried. This being the time and place set for a hearing on an application for transfer of Retail On-Off Sale Malt Beverage License with Video Lottery from Amusement Service Corp. at 1923 – 6th Avenue, SE-Suite 104B (Inactive) to Lafayette Casino Corp. at 3015 – 6th Avenue, SE #2, recommendations to approve contingent upon final health and fire inspections were received, Rux moved, Olson seconded to approve the transfer of Retail On-Off Sale Malt Beverage License with Video Lottery from Amusement Service Corp. at 1923 – 6th Avenue, SE-Suite 104B to Lafayette Casino Corp. at 3015 – 6th Avenue, SE #2 contingent upon final inspections by the Health and Fire Departments. All voting aye, motion carried. This being the time and place set for a hearing on an application for a new Retail On- Off Sale Malt Beverage & SD Farm Wine License for Melynda Sletten at 714 South Main St., recommendations to approve contingent upon a health inspection were received, Remily moved, Ronayne seconded to approve the new Retail On-Off Sale Malt Beverage & SD Farm Wine License for Melynda Sletten dba Platinum Salon & Spa at 714 South Main St. contingent upon a final inspection by the Health Department. All voting aye, motion carried. This being the time and place set for a hearing on an application for a Special One- Day On-Sale Liquor License on October 13, 2016 for the Aberdeen Area Chamber of Commerce at 224 – 1st Avenue, SE, recommendations to approve contingent upon a health inspection were received, Johnson moved, Rux seconded to approve the Special One-Day On-Sale Liquor License on October 13th for Aberdeen Area Chamber of Commerce’s Business After Hours at Profiling Beauty, 224 – 1st Avenue, SE contingent upon a final inspection by the Health Department. All voting aye, motion carried. SDDOT SECTION 5311 AGREEMENT FOR RIDE LINE Bunsness moved, Johnson seconded to approve and authorize the City Manager to sign the Section 5311 Fiscal Year 2017 Grant Agreement with SD Department of Transportation to allow Aberdeen Ride Line to submit qualifying administrative costs for reimbursement at 82.81% and operating costs for reimbursement at 51.76%. All voting aye, motion carried. BIDS FOR SNOW REMOVAL SERVICES Bids were received and opened for 2016-2017 Snow Removal Services on September 27, 2016. A list of the bids is on file at the Finance Office. Campbell moved, Bunsness seconded to accept all bids for the Snow Removal Services, to rent equipment as needed in order of price as recommended by the Public Works Department, and to authorize the City Manager and Finance Officer to sign all necessary documents after approval by the City Attorney.
