JOINT CITY/COUNTY PROCEEDINGS
Brown County Commission Chambers, 25 Market Street, Brown County Courthouse,
Aberdeen, South Dakota, December 27, 2016, at 8:45 a.m., Joint City/County Meeting.
Deputy Mayor Rob Ronayne presiding. City Councilors present were Jennifer Slaight-
Hansen by teleconference call, Alan Johnson, Dennis “Mike” Olson, and Mark Remily.
Mayor Mike Levsen and City Councilors David Bunsness, Todd Campbell, and Clint Rux
were absent. Brown County Commissioners present were Tom Fischbach, Duane Sutton,
and Rachel Kippley. Brown County Commissioners Doug Fjeldheim and Nancy Hansen
were absent. City Staff present were Brett Bill and Karl Alberts. County Auditor Maxine
Fischer was present.
ORDINANCE NO. 16-12-01
Ordinance No. 16-12-01 to rezone from (A-1) District to (M-AG) District property
described as Donaldson Addition in the NE ¼ of Section 8, T123N, R64W of the 5th P.M.,
Brown County, South Dakota (38395 – 131st Street) was presented. Johnson moved, Remily
seconded to approve first reading of Ordinance No. 16-12-01. Upon roll call, all present
voting aye, motion carried.
Sutton moved, Fischbach seconded to approve first reading of Ordinance No. 16-12-01
(461) as presented. All present voting aye, motion carried.
ORDINANCE NO. 16-12-02
Ordinance No. 16-12-02 to rezone from (A-1) District to (M-AG) District property
described as Lots 1 and 2, Bachmeier Family Subdivision in the N ½ of Lot 1 and Lot 2 in the
NE ¼ of Section 5, T123N, R64W of the 5th P.M., Brown County, South Dakota (38387
130th Street) was presented. Johnson moved, Remily seconded to approve first reading of
Ordinance No. 16-12-02. Upon roll call, all present voting aye, motion carried.
Sutton moved, Fischbach seconded to approve first reading of Ordinance No. 16-12-02
(462) as presented. All present voting aye, motion carried.
ORDINANCE NO. 16-12-03
Ordinance No. 16-12-03 to rezone from (A-1) District to (M-AG) District property
described as Lot 1, Weiler Subdivision in the NE ¼ of Section 32, T124N, R64W of the 5th
P.M., Brown County, South Dakota (12901 – 384th Ave. and property adjacent to the West)
was presented. Johnson moved, Remily seconded to approve first reading of Ordinance No.
16-12-03. Upon roll call, all present voting aye, motion carried.
Sutton moved, Fischbach seconded to approve first reading of Ordinance No. 16-12-03
(463) as presented. All present voting aye, motion carried.
There being no further business, Johnson moved, Remily seconded that the meeting be
adjourned. All present voting aye, motion carried.

CITY COUNCIL PROCEEDINGS
City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen,
South Dakota, December 27, 2016, at 5:30 p.m., regular meeting of the Board of City
Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors
David Bunsness, Alan Johnson, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint
Rux, and Jennifer Slaight-Hansen. City Councilor Todd Campbell was absent. City Staff
present were Lynn Lander, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, and Cody
Roggatz.
Mayor Levsen led the Pledge of Allegiance.
MINUTES
Ronayne moved, Bunsness seconded to approve the minutes of December 19, 2016,
as circulated. All present voting aye, motion carried.

OPEN FORUM – Judge Charles Kornmann gave a report on the activity and use of the
Federal Court House.
OLD BUSINESS
ORDINANCE NO. 16-12-05
Slaight-Hansen moved, Bunsness seconded to approve second reading and final
adoption of Ordinance No. 16-12-05 supplementing the 2016 Budget for various
unanticipated projects, activities, and expenses. Upon roll call, all present voting aye, motion
carried.

Rux moved, Olson seconded to approve the following items on the consent calendar:

NEW BUSINESS
ORDINANCE NO. 16-12-04
Ordinance No. 16-12-04 amending Ordinance No. 1164 to rezone from (R-2) District
to (C-2) District property described as Lot 1, Dial Second Addition except H-1 in the SE ¼ of
Section 17, T123N, R63W of the 5th P.M., Aberdeen, Brown County, South Dakota (3324
Milwaukee Ave., NE) was presented. Ronayne moved, Bunsness seconded to approve first
reading of Ordinance No. 16-12-04. Upon roll call, all present voting aye, motion carried.
HEARINGS ON SPECIAL ALCOHOL BEVERAGE LICENSES
This being the time and place set for hearings on applications for a Special One-Day
On-Sale Liquor License on January 7, 2017 for Yelduz Shriners for a National Guard
Christmas Party at 802 South Main Street and for a Special Three-Day Retail On-Sale Malt
Beverage License on January 13, 14, and 15, 2017 for Aberdeen Cue Club, Inc. for a Pool
Tournament at 1603 – 6th Ave., SW, recommendations received were to approve the special
alcoholic beverage licenses, Remily moved, Slaight-Hansen seconded to approve the Special
One-Day On-Sale Liquor License on January 7, 2017 for Yelduz Shriners at 802 South Main
Street and for a Special Three-Day Retail On-Sale Malt Beverage License on January 13, 14,
and 15, 2017 for Aberdeen Cue Club, Inc. at 1603 – 6th Ave., SW. All present voting aye,
motion carried.
CHANGE ORDER FOR LIBRARY PROJECT
Ronayne moved, Bunsness seconded to approve Change Order #2 in the amount of
$15,816.28 for Quest Construction, LLC for work on the new Library Construction Project.
All present voting aye, motion carried.
AMENDMENT/PAYMENT FOR MOCCASIN CREEK STUDY
Bunsness moved, Olson seconded to approve an amendment to the Moccasin Creek
Study Agreement with Clark Engineering/Wenck in the amount of $1,509.94 and Payment
Request in the amount of $28,850.11 to Clark Engineering/Wenck for work performed on the
Moccasin Creek Study. Upon roll call, all present voting aye, motion carried.
CHANGE ORDER/PAYMENT FOR CONCRETE ST. REHAB
Johnson moved, Bunsness seconded to approve an amended Change Order #1 in the
amount of a -$44,540.70 to the contract amount for the Concrete St. Project and Payment
Request #4 in the amount of $46,530.40 for Wright & Sudlow for work performed on the
Concrete St. Rehabilitation Project. Upon roll call, all present voting aye, motion carried.
