16919 JOINT CITY/COUNTY PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, April 17, 2017, at 5:30 p.m., Joint City Council/County Commission Meeting. Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Todd Campbell, Alan Johnson, Dennis “Mike” Olson, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Councilor Mark Remily was absent. Brown County Commissioners present were Doug Fjeldheim, Duane Sutton, and Rachel Kippley. Brown County Commissioners Tom Fischbach and Nancy Hansen were absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Jay Tobin. County Auditor Maxine Fischer was present. RESOLUTION NO. 17-04-01R Bunsness moved, Rux seconded to approve Resolution No. 17-04-01R to vacate public right-of-way described as that portion of the 60’ wide Camino Real Public Right-Of- Way commencing at the North Side of Brown County 13 Public Right-Of-Way and continuing North 1,860’ between Lots 1 – 5, Block 1, and Lots 1 – 6, Block 2, DeVaan’s Villa Rancheras Subdivision, then continuing West 1,446’ between Lots 7 – 11, Block 1, and Lots 5 – 8, Block 2, DeVaan’s Villa Rancheras Subdivision, and then continuing South 501’ between the North 501’ of Lot 8, Block 1, and Lots 12 – 13, Block 2, DeVaan’s Villa Rancheras Subdivision, located in the SE ¼ of Section 31, T124N, R63W of the 5th P.M., Brown County, South Dakota (NE 130th Street and Roosevelt Street Intersection). All present voting aye, motion carried. Sutton moved, Fjeldheim seconded to approve Resolution No. 17-04-01R (466) as presented. All present voting aye, motion carried. There being no further business, Sutton moved, Fjeldheim seconded that the meeting be adjourned. All present voting aye, motion carried. Present at roll call were City Councilors David Bunsness, Todd Campbell, Alan Johnson, Dennis “Mike” Olson, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Councilor Mark Remily was absent. MINUTES Ronayne moved, Rux seconded to approve the minutes of April 10, 2017, as circulated. All present voting aye, motion carried. PROCLAMATIONS Mayor Levsen read and proclaimed April 17 – 21, 2017 as “Chamber of Commerce Week” and April 22, 2017 as “Day of Champions”. OPEN FORUM – No one was present. OLD BUSINESS CONFLICTS OF INTEREST POLICY City Attorney Ron Wager had drafted two different versions of the Conflicts of Interest Policy and submitted these versions of the policy to the City Council for consideration. Bunsness moved, Rux seconded to approve the adoption of the City of Aberdeen Conflicts of Interest Policy Option 2 that includes a Board of Ethics to guide and govern City Council Members, City Board Members, City Officers, and City Employees. All 16920 present voting aye, motion carried. CONSENT CALENDAR Slaight-Hansen moved, Bunsness seconded to approve the following items on the consent calendar: SET HEARING DATE – of April 24, 2017 at 5:30 p.m. for an application for Special One- Day Retail On-Sale Liquor Licenses on April 29, June 10, July 1, September 9, October 7, November 4, and November 11, 2017 for Yelduz Shriners’ Events at 802 South Main Street. SET BID DATE – of May 2, 2017 at 2:00 p.m. for an advertisement for bids for AGP Water & Sewer Improvements Project (WS-2017-1). LOTTERY NOTICE – Aberdeen Hardball Association – receive and place on file All present voting aye, motion carried. NEW BUSINESS RESOLUTION NO. 17-04-02R Ronayne moved, Rux seconded to approve Resolution No. 17-04-02R to vacate public right-of-way described as the 66’ x 330’ Portion of Third Avenue, SE Public Right- Of-Way located between Lot 1 and Lot 2, Harr Motor’s Subdivision in the SW ¼ of Section 16, T123N, R63W of the 5th P.M., Brown County, South Dakota (4255 – Sixth Avenue, SE and 4255 – Third Avenue, SE). All present voting aye, motion carried. GRANT AGREEMENT WITH SD DOT FOR TRAIL DEVELOPMENT Parks, Recreation & Forestry Director Doug Johnson was present to request the City Council consider an agreement with the SD Department of Transportation concerning a Transportation Alternatives Program (TAP) Grant for construction of a trail along 15th Avenue, NE between Dakota Street North and Second Street North. Johnson moved, Rux seconded to approve the grant agreement with SD Department of Transportation for trail development along 15th Avenue, NE. Motion carried by voice vote. APPOINTMENT TO LIBRARY BOARD Johnson moved, Rux seconded to approve the appointment of Misty Francom to the Alexander Mitchell Library Board of Trustees for a three-year term ending June 30, 2020. All present voting aye, motion carried. PERFORMANCE REVIEWS OF CITY OFFICERS Ronayne moved, Campbell seconded to approve and place in each employee’s personnel file the performance reviews of appointed officers Lynn Lander – City Manager, Karl Alberts – Finance Officer, and Ronald Wager – City Attorney, such appraisals to remain privileged and confidential according to state law. All present voting aye, motion carried.
