16949 CITY COUNCIL PROCEEDINGS Brown County Commission Chambers, 25 Market Street, Aberdeen, South Dakota, June 9, 2017, at 10:00 a.m., Special City Council Meeting to canvass results from the City Election with the Brown County Auditor’s Office. Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Alan Johnson by teleconference call, Rob Ronayne, and Jennifer Slaight-Hansen. City Councilors Todd Campbell, Dennis “Mike” Olson, Mark Remily, and Clint Rux were absent. City Staff present were Jordan McQuillen and Ron Wager. CANVASS ELECTION RESULTS County Auditor Maxine Fischer and County Deputy Auditor Cathy McNickle were present to canvass the election results with the City Council. City Councilor Todd Campbell arrived at the meeting at 10:10 a.m. RESOLUTION NO. 17-06-01R Ronayne moved, Campbell seconded to approve the following Resolution No. 17-06- 01R: WHEREAS, on January 9, 2017, the City Council of the City of Aberdeen set the time and date of the Annual Municipal Election to be held in the City on June 6, 2017 for the purpose of electing City Councilors for the NE District, NW District, and SE District, and WHEREAS, at the Annual Municipal Election held in three voting centers in the City of Aberdeen, South Dakota, on Tuesday, June 6, 2017, there were cast the following votes for Office of City Councilor for NE District, five-year term, to wit: Mark Remily received 220 votes, James Washnok received 165 votes, and Luke Bunke received 163 votes, there being a total of 548 legal votes cast; for City Councilor, NW District, five-year term to wit: Joshua L. Jones received 49 votes, Dave Lunzman received 258 votes, and Thomas Black received 130 votes, there being a total of 437 legal votes cast; for City Councilor, SE District, five-year term, to wit: Kaleb W. Weis received 233 votes and Clint Rux received 306 votes, there being a total of 539 legal votes cast; for City Councilor SE District, three-year term, to wit: Tim Prater received 247 votes and Dennis “Mike” Olson received 278 votes, there being a total of 525 legal votes cast, and WHEREAS, the returns of said election have been delivered and canvassed by the City Council, and WHEREAS, Mark Remily, Dave Lunzman, Clint Rux, and Dennis “Mike” Olson received a plurality of the legal votes cast for City Councilors, NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ABERDEEN, that Mark Remily is hereby elected City Councilor NE District, Dave Lunzman is hereby elected City Councilor NW District, Clint Rux is hereby elected City Councilor SE District, and Dennis “Mike” Olson is hereby elected City Councilor SE District and the City Finance Officer is hereby directed to issue the proper Certificates of Election. NEW BUSINESS RESOLUTION NO. 17-06-02R Bunsness moved, Johnson seconded to approve the following Resolution No. 17-06- 02R declaring surplus real property: BE IT RESOLVED by the Aberdeen City Council, that the following described real property is declared surplus property and may be disposed of according to law, said property to be described as follows: All of the City of Aberdeen’s right, title, and interest in: Parcel 1: 0.24 acre in Lot 1, Dakota Estates Subdivision, Block 4, in the Southwest Quarter (SW ¼) of Section 6, Township 123 North, Range 63 West of the 5th P.M., Brown County, South Dakota Parcel 2: 0.14 acre in Lot 2, Dakota Estates Subdivision, Block 4, in the Southwest Quarter (SW ¼) of Section 6, Township 123 North, Range 63 West of the 5th P.M., Brown County, South Dakota The property being declared surplus is shown in the red hatched areas on the map attached hereto. RESOLUTION NO. 17-06-03R Johnson moved, Bunsness seconded to approve the following Resolution No. 17-06- 03R to exchange land with a private owner: WHEREAS, the City of Aberdeen has declared certain real property as surplus, said land described as: Parcel 1: 0.24 acre in Lot 1, Dakota Estates Subdivision, Block 4, in the Southwest Quarter (SW ¼) of Section 6, Township 123 North, Range 63 West of the 5th P.M., Brown County, South Dakota Parcel 2: 0.14 acre in Lot 2, Dakota Estates Subdivision, Block 4, in the Southwest Quarter (SW ¼) of Section 6, Township 123 North, Range 63 West of the 5th P.M., Brown County, South Dakota; and WHEREAS, Purple Cow Properties, LLC, a South Dakota limited liability company, owns land described as: Parcel 3: 0.38 acre in Lot 3, Dakota Estates Subdivision, Block 4, in the Southwest Quarter (SW ¼) of Section 6, Township 123 North, Range 63 West of the 5th P.M., Brown County, South Dakota; and WHEREAS, Purple Cow Properties, LLC, desires, pursuant to SDCL §9-27-34.1, to exchange Parcel 3 for Parcels 1 and 2 because the City’s property is adjacent to its property and acquisition of Parcels 1 and 2 will permit it to develop its land consistent with its development west of the property, as is more fully described in the hatched red and green areas on the map attached hereto and incorporated herein by reference; and WHEREAS, a notice of public hearing was published as required by law and the hearing was held by the City Council in City Council Chambers at 5:30 p.m., on June 12, 2017, in which all persons interested in the proposed exchange were permitted to appear and be heard; and WHEREAS, the exchange is recommended by the City Engineer as Parcel 3 will improve the City’s access to, and the configuration of, the irregular lot containing a storm water retention pond intended to be dedicated to the City; and WHEREAS, no person appeared in opposition to the proposed exchange; and WHEREAS, the City caused the proposed parcels of land to be appraised by a state- licensed appraiser who determined that Parcel 1 and Parcel 2 have a combined value equal to Parcel 3, as Parcel 1 is valued at $26,000.00, Parcel 2 is valued at $15,000.00, and Parcel 3 is valued at $41,000.00; and WHEREAS, Purple Cow Properties, LLC, will pay all costs associated with transferring the property between it and the City, including title insurance, filing fees, deed preparation, and re-platting the subject lots to reflect the new lot dimensions. THEREFORE, BE IT RESOLVED that the City of Aberdeen, pursuant to SDCL §9- 27-34.1, hereby approved the exchange of the real property described above and authorizes the Mayor and City Manager to execute any documents necessary to effectuate the exchange. COMMUNITY EVENT PERMIT FOR EAGLES CLUB Remily moved, Slaight-Hansen seconded to approve a Community Event Permit for the Eagles Club’s Outdoor Dance at 316 South 2nd Street Parking Lot on June 17, 2017 including a time extension for the music until 1:00 a.m. the following day however the City has the ability to change or revoke the event permit if complaints are received. AGREEMENT FOR UPDATE TO COMPREHENSIVE PLAN Bunsness moved, Olson seconded to approve and authorize the City Manager to sign the Professional Services Agreement with STANTEC for the development and completion of the Aberdeen Comprehensive Plan in the amount of $218,399.
