17024 CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, October 10, 2017, at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight-Hansen. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Dave McNeil. Mayor Levsen led the Pledge of Allegiance. MINUTES Bunsness moved, Remily seconded to approve the minutes of October 2, 2017, as circulated. All voting aye, motion carried. OPEN FORUM – No one was present. OLD BUSINESS City Attorney Ron Wager requested that the Old Business Item to discuss the bid for Tract C (Parcel III) on the surplus library property be moved to an executive session at the end of the meeting. CONSENT CALENDAR Rux moved, Slaight-Hansen seconded to approve the following items on the consent calendar: LETTER OF ACCEPTANCE – of the 2016 City of Aberdeen Audit Report from the SD Department of Legislative Audit – receive and place on file. LETTER OF ACCEPTANCE – of the 2016 Airport Passenger Facility Charge Report from the SD Department of Legislative Audit – receive and place on file. SET HEARING DATE – of October 23, 2017 at 5:30 p.m. for an application for a Special Six-Day Retail On-Sale Liquor License on October 31 – November 5, 2017 for ACT2, Inc. dba Aberdeen Community Theatre, 417 South Main Street. LICENSE – Private Security – Tanya Ford LOTTERY NOTICE – Junior Achievement of SD/Aberdeen Chapter – receive and place on file. All voting aye, motion carried. NEW BUSINESS EMPLOYMENT AGREEMENT TO SELL FEDERAL COURTHOUSE Bunsness moved, Ronayne seconded to postpone for one week a discussion of an exclusive representation agreement to employ Geoff Ficke and Zack Ficke in association with Marcus and Millichap Real Estate to sell the Federal Courthouse located at 102 – 4th Avenue, SE. All voting aye, motion carried. PAYMENT FOR LIBRARY PROJECT City Manager explained a payment request in the amount of $292,729.17 to Quest Construction for work on the new Library Construction Project. Bunsness moved, Johnson seconded to approve payment request #19 in the amount of $292,729.17 to Quest Construction. Upon roll call, all voting aye, motion carried. REIMBURSEMENT FOR UPSIZING WATER UTILITY City Engineer Robin Bobzien explained the request for reimbursement in the amount of $56,774.88 to Schumaker Development for upsizing the water utility system on Brown County #14 for future development. He said this requirement was made with the assurance that the City would reimburse costs associated with this upsizing. Bunsness moved, Olson seconded to approve of the payment to Schumaker Development in the amount of $56,774.88 for upsizing the water system on Brown County #14 from 8” to 12”. CITY MANAGER’S REPORT City Manager Lynn Lander had City Planning/Zoning Director Brett Bill announce a reminder to the Council of a public input meeting regarding the Comprehensive Plan and Aberdeen Rural Plan to be held on Thursday evening from 5:30 p.m. to 8:00 p.m. with a presentation by consultants at 6:30 p.m. at the Eagles Nest at the ARCC. EXECUTIVE SESSION Mayor Levsen stated that the request by the City Attorney on the Old Business Agenda Item relating to the bid on some of the old library property has elements that qualify for an executive session. Ronayne moved, Bunsness seconded to move into executive session to consult with legal counsel about contractual matters per SDCL §1-25-2(3). All voting aye, motion carried. Ronayne moved, Remily seconded to move out of executive session. All voting aye, motion carried. BID ON SURPLUS LIBRARY PROPERTY Ronayne moved, Slaight-Hansen seconded to postpone indefinitely the request to approve or deny the bid for Tract C (Parcel III) of the surplus library real property. All voting aye, motion carried. There being no further business, Slaight-Hansen moved, Lunzman seconded that the meeting be adjourned. All voting aye, motion carried.
