17189 CITY COUNCIL PROCEEDINGS Brown County Commission Chambers, 25 Market Street, Aberdeen, South Dakota, June 7, 2018, at 4:00 p.m., Special City Council Meeting, to canvass results from the Municipal Election with the Brown County Auditor’s Office. Mayor Mike Levsen presiding. Present at roll call were City Councilors Mark Remily, Rob Ronayne, Clint Rux, and Jennifer Slaight- Hansen. City Councilors David Bunsness, Alan Johnson, Dave Lunzman, and Dennis “Mike” Olson were absent. CANVASS ELECTION RESULTS County Auditor Maxine Fischer presented the election results from the Municipal Election for the Offices of City Council Member – NE District and City Council Member – SW District held with the Primary and School Election on June 5, 2018. Rux moved, Slaight Hansen seconded to approve the canvassing of the election results and Resolution No. 18-06-02R as follows: WHEREAS, on January 8, 2018, the City Council of the City of Aberdeen set the time and date of the annual Municipal Election to be held in the City on June 5, 2018 with the Primary and School Board Elections for the purpose of electing City Council Members for the NE District and SW District, and WHEREAS, at the annual Municipal Election held in three voting centers in the City of Aberdeen, South Dakota on Tuesday, June 5, 2018, there were cast the following votes for Office of City Council Member NE District, five-year term, to wit: Rob Ronayne received 702 votes and Char Cornelius received 458 votes, there being a total of 1,160 legal votes cast; for Office of City Council Member SW District, five-year term, to wit: Alan Johnson received 394 votes and Dan Richardt received 294 votes, there being a total of 688 legal votes cast; and WHEREAS, the returns of said election have been delivered and canvassed by the City Council, and WHEREAS, Rob Ronayne and Alan Johnson received a plurality of the legal votes cast for City Council Members, NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ABERDEEN, that Rob Ronayne is hereby elected City Council Member NE District and Alan Johnson is hereby elected City Council Member SW District and the City Finance Officer is hereby directed to issue the proper Certificates of Election. CITY COUNCIL PROCEEDINGS City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, June 11, 2018, at 5:30 p.m., regular meeting of the Board of City Council Members, Mayor Mike Levsen presiding. Present at roll call were City Councilors David Bunsness, Alan Johnson, Dave Lunzman, Dennis “Mike” Olson, Rob Ronayne, and Clint Rux. City Councilors Mark Remily and Jennifer Slaight-Hansen were absent. City Staff present were Lynn Lander, Ron Wager, Robin Bobzien, Brett Bill, Jordan McQuillen, Dave McNeil, and Cody Roggatz. OPEN FORUM – Shelley Westra-Heier was present to announce the Aberdeen Downtown Association’s Summer Concert Series beginning Thursday, June 14th, at 6:00 p.m.  17190 CONSENT CALENDAR Ronayne moved, Lunzman seconded to approve the following items on the consent calendar: LICENSES – Ambulance Driver –Blaine Cooper; Taxi Cab Driver – Traci Denis REQUEST FOR PERMISSION – to block off the alley west of the First United Methodist Church on South Lincoln Street and 6th Avenue on June 17th for worship service and lunch. REQUEST FOR PERMISSION to serve and permit the consumption of alcoholic beverages at the Wylie Park Pavilion for a Schnaidt Wedding on September 1st. NEW BUSINESS ORDINANCE NO. 18-06-06 City Attorney Ron Wager presented Cable Franchise Ordinance No. 18-06-06 granting and renewing the cable franchise with Midcontinent Communications. He explained the agreement on a new cable franchise ordinance granting Midco and also Northern Valley Communications, LLC a nonexclusive cable system franchise upon the terms and conditions set forth in the ordinance and went through a summary comparing terms of the existing franchise with the negotiated renewal franchise. Ronayne moved, Rux seconded to approve first reading of Cable Franchise Ordinance No. 18-06-06 with Midcontinent Communications. Upon roll call, Bunsness voting nay, Johnson, Lunzman, Olson, Ronayne, Rux, and Mayor Levsen voting aye, motion carried. ORDINANCE NO. 18-06-07 City Attorney Ron Wager presented Cable Franchise Ordinance No. 18-06-07 granting and renewing the cable franchise with Northern Valley Communications, LLC. Rux moved, Johnson seconded to approve first reading of Cable Franchise Ordinance No. 18-06-07 with Northern Valley Communications, LLC. Upon roll call, Rux, Ronayne, Olson, Lunzman, Johnson, and Mayor Levsen voting aye, Bunsness voting nay, motion carried. RESOLUTION NO. 18-06-03R City Attorney Ron Wager presented Resolution No. 18-06-03R extending the cable television franchise of Northern Valley Communications to October 1, 2018. Olson moved, Rux seconded to approve Resolution No. 18-06-03R as follows: WHEREAS, the City of Aberdeen, South Dakota (“City”) granted a Cable Television Franchise Agreement (“Franchise”) to Northern Valley Communications, LLC (“NVC”), to own and operate a cable television system in the City; and WHEREAS, the initial term of the Franchise expires on or about April 2, 2018; and WHEREAS, the City Council by Resolution No. 18-02-01R, and accepted by NVC, extended the Franchise to July 1, 2018; and WHEREAS, both the City and NVC desire to extend the term of the Franchise to finalize renewal of the Franchise. NOW, THEREFORE, the City Council of Aberdeen, South Dakota, hereby resolves as follows: 1. The Franchise is hereby amended by extending the term of the Franchise from July 1, 2018, through the date on which NVC’s Franchise is either renewed or until and including October 1, 2018, whichever shall first occur. 2. Except as specifically modified hereby, the Franchise shall remain in full force and effect. 3. The City and NVC hereby agree that neither waives any rights either may have under the Franchise or applicable law. 4. This Resolution shall become effective upon the occurrence of both of the following  17191 conditions: (1) The Resolution being passed and adopted by the City Council of the City of Aberdeen, South Dakota, and (2) NVC’s acceptance of this Resolution. RESOLUTION NO. 18-06-01R City Planning/Zoning Director Brett Bill presented Resolution No. 18-06-01R to vacate public right-of-way described as the entire 16’ wide public alley right-of-way in Block 35, Roches East Side Addition to Aberdeen, commencing at the south side of 3rd Avenue, SE right- of-way and continuing south 300’ to point of termination (2900 – 3rd Avenue, SE) for the Mary Dell Inman Estate. Johnson approved, Bunsness seconded to approve Resolution No. 18-06- 01R as presented. All present voting aye, motion carried. ACCEPT GIFT FOR RIDE LINE City Attorney Ron Wager requested acceptance of a money gift of $3,868.05 minus a proportionate share of unpaid trust administration costs from Schwab Family Living Trust to be allocated to Ride Line and to authorize the City Manager to acknowledge distribution of the monies to the City of Aberdeen. Rux moved, Ronayne seconded to approve the acceptance of a gift of $3,868.05 from the Schwab Family Living Trust to be allocated to Ride Line. All present voting aye, motion carried. HEARING ON TRANSFER OF MALT BEVERAGE LICENSE This being the time and place set for a hearing on the transfer of a Retail On-Off Sale Malt Beverage License with Video Lottery from Bonn Express, LLC to Bonn Express, Inc. at 801 North Hwy #281, Mayor Levsen opened the hearing, no public comments were received, the hearing was closed. Ronayne moved, Olson seconded to approve the transfer of Retail On- Off Sale Malt Beverage License with Video Lottery from Bonn Express, LLC to Bonn Express, Inc. at Lucky Spot Casino, 801 North Hwy #281. All present voting aye, motion carried. HEARING ON SPECIAL LIQUOR LICENSE This being the time and place set for a hearing on an application for a Special Six-Day Retail On-Sale Liquor License on June 12 – June 17, 2018 for ACT 2, Inc. dba Aberdeen Community Theatre at 417 South Main Street, Mayor Levsen opened the hearing, no public comments were received, the hearing was closed. Ronayne moved, Lunzman seconded to approve a Special Six-Day Retail On-Sale Liquor License on June 12th – June 17th for ACT 2, Inc. at 417 South Main Street. All present voting aye, motion carried. COMMUNITY EVENT PERMIT FOR THE PUB’S FUNDRAISER Johnson moved, Rux seconded to approve a Community Event Permit for the Pub’s Fundraiser for the Humane Society on June 16th at 105 North Lincoln Street with a time extension for the music until 12:00 midnight. All present voting aye, motion carried. RFQ FOR ENGINEERING SERVICES AND AVIATION PLANNING FOR AIRPORT Transportation Director Cody Roggatz explained the RFQ Notice for the Airport Master Plan and Airport Layout Plan Project in which two submittals were received: Helms & Associates in partnership with Mead & Hunt and KLJ in partnership with Clark Engineering. He requested that Helms & Associates in partnership with Mead & Hunt be selected to perform the Airport Master Plan and Airport Layout Plan Project with a project budgeted amount of about $400,000. Olson moved, Bunsness seconded to approve Helms & Associates in partnership with Mead & Hunt to perform the Airport Project. All present voting aye, motion carried. PAYMENT FOR AGREEMENT FOR PASSENGER LOADING BRIDGE Transportation Director Cody Roggatz presented a payment request in the amount of $1,297.00 to Helms & Associates for professional agreement to acquire a Passenger Loading Bridge for the Airport. Ronayne moved, Rux seconded to approve and authorize the City Manager to sign the payment request in the amount of $1,297.00 to Helms & Associates.
