17901 MINUTES ABERDEEN CITY COUNCIL MEETING City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, April 26, 2021 at 5:30 p.m., regular meeting of the City Council. CALL TO ORDER MEETING ROLL CALL Present at roll call were City Council Members Mark Remily by teleconference, Rob Ronayne, Dave Lunzman, Josh Rife, Alan Johnson, Justin Reinbold, Tiffany Langer, Clint Rux, and Mayor Travis Schaunaman. City Staff present were Joe Gaa, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, Dave McNeil, Mark Hoven, and Aaron Kiesz. PLEDGE OF ALLEGIANCE Mayor Schaunaman led the Pledge of Allegiance. APPROVAL OF AGENDA Motion by Johnson, second by Ronayne to approve the agenda. Upon roll call vote, all voting aye, motion carried. MINUTES Motion by Rux, second by Reinbold to approve the minutes of the April 12 and 19, 2021 City Council Meetings, as circulated. Upon roll call vote, all voting aye, motion carried. OPEN FORUM No one appeared in open forum to address the Council. CONSENT CALENDAR Motion by Ronayne, second by Lunzman to approve the following items on the consent calendar: SET BID DATE – of May 11, 2021 at 2:00 p.m. for bids on a Refuse Collection Unit for Public Works Department – Solid Waste Division CANCELLATION OF HEARINGS - for April 26, 2021 at 5:30 p.m. for the following petitions to rezone: Rezone the property described as Erdmann 1st Subdivision (302 and 320 South Fourth Street and 416 Fourth Avenue, SW) from (I-2) Unrestricted Industrial District and (C-3) Central Business District/(R-4) Special Density Residential District to (C-3) Central Business District/(R-4) Special Density Residential District; Rezone the property described as Rohl Subdivision (118 and 120 First Avenue, NE) from (C-3) Central Business District to (I-2) Unrestricted Industrial District. REPORTS AND MINUTES FROM CITY BOARDS – Aberdeen Airport Board Meeting Minutes; Aberdeen City Planning Commission Meeting Minutes; Board of Zoning Adjustment Meeting Minutes; K.O. Lee Aberdeen Public Library Board of Trustees Meeting Minutes. Upon roll call vote, all voting aye, motion carried. OLD BUSINESS ORDINANCE NO. 21-04-04 Motion by Ronayne, second by Rux to approve second reading of Ordinance No. 21- 04-04 amending the landscape standards for new construction and parking lots. Discussion followed. Motion by Ronayne, second by Reinbold to amend Sec. 56-214(2)(e) as recommended by City Forester Aaron Kiesz to read as follows: Planting islands must have sufficient ground cover of blue grass, fescue, or similar sod grasses, insert “with organic mulch placed within a two-foot radius of each tree and shrub,” or have three inches of organic mulch such as woodchips, bark, or other type of organic mulch with a professional weed barrier fabric placed under the mulch. Landscape rock with a professional weed barrier fabric placed underneath may be used. and delete the phrase “so long as organic mulch is used within a two-foot radius of each tree and shrub.” After further discussion, the motion was withdrawn by Ronayne. The Council decided to move the discussion of Ordinance No. 21-  17903 04-04 toward the end of the agenda and directed City Attorney Ron Wager to provide a revised version of the Sec. 56-214(2)(e) amendment to the ordinance. ORDINANCE NO. 21-04-07 Motion by Rux, second by Ronayne to approve second reading and final adoption of Ordinance No. 21-04-07 supplementing the 2021 Budget for various unanticipated projects, activities, and expenses. Upon roll call vote, all voting aye, motion carried. NEW BUSINESS HEARING ON PETITION TO REZONE PROPERTY Mayor Schaunaman opened a hearing on a petition from the City Manager for the City of Aberdeen to rezone property described as Lot 1, Keller Addition to the City of Aberdeen in the SE ¼, Section 14, T123N, R64W of the 5th P.M., Brown County, SD (824 Third Avenue, SW) from (R-3) High Density Residential District to (M) Municipal, State, and County Use District. City Planning/Zoning Director Brett Bill explained that the reason for the rezoning request is to bring the property into a zoning district that will allow for its future use as a parking lot for the existing City shop. No other public comments were received so Mayor Schaunaman closed the hearing. Motion By Johnson, second by Rife to approve first reading of Ordinance No. 21-04-03 to rezone the property. Upon roll call vote, all voting aye, motion carried. HEARING ON PETITION TO REZONE PROPERTY Mayor Schaunaman opened a hearing on a petition from Eldon Wahl and Rochelle Gosvener to rezone property described as the East ½ of the South 80 Feet of Lot 16, Lawson’s First Replat of Block 10, Woolverton Addition to the City of Aberdeen, in the NE ¼ of Section 24, T123N, R64W of the 5th P.M., Brown County, SD (819 Tenth Avenue, SE) from (R-3) High Density Residential District to (C-1) Neighborhood Commercial District. City Planning/Zoning Director Brett Bill explained that the reason for the rezoning request is to bring the property into a zoning district that will allow for a takeout food and ice cream establishment. Brett Bill stated that the Aberdeen Planning Commission denied the petition to rezone at their April 20, 2021 Meeting and also recommended denial of this rezoning request. Mayor Schaunaman closed the hearing. Motion by Rux, second by Ronayne to deny the request to rezone the property. Upon roll call vote, all voting aye, motion carried. REVIEW AND APPROVAL OF CLAIMS AND PAYROLL Motion by Rife, second by Lunzman to approve payment of the bills listed for April 26, 2021, and payroll for the period from April 11, 2021 through April 24, 2021. CONTINUED DISCUSSION OF LANDSCAPE ORDINANCE NO. 21-04-04 City Attorney Ron Wager provided an amended Ordinance No 21-04-04 including the changes to Sec. 56-214(2)(e) to read as follows: “Planting islands must have sufficient ground cover of blue grass, fescue, or similar sod grasses, with organic mulch placed within a two-foot radius of each tree and shrub, or have three inches of organic mulch such as woodchips, bark, or other type of organic mulch with a professional weed barrier fabric placed under the mulch. Landscape rock with a professional weed barrier fabric placed underneath may be used.” Motion by Ronayne, second by Rife to approve the Sec. 56- 214(2)(e) amendment as recommended by the City Attorney. Upon roll call vote, all voting aye, motion carried. On the original motion to approve the second reading and final adoption of Ordinance No. 21-04-04 as amended, all voting aye, motion carried. CITY MANAGER’S REPORT City Manager Joe Gaa gave his report which included a discussion on an incident Saturday evening involving the Police Special Weapons and Tactics Team and the cooperation by Trinity Lutheran Church located nearby. EXECUTIVE SESSION Motion by Ronayne, second by Lunzman to move into executive session to consult with legal counsel about proposed or pending litigation or contractual matters, pursuant to SDCL §1-25-2(3). Upon roll call vote, all voting aye, motion carried. Motion by Ronayne, second by Rux to move out of executive session. Upon roll call vote, all voting aye, motion carried.
