18013 MINUTES ABERDEEN CITY COUNCIL MEETING City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, October 25, 2021 at 5:30 p.m., regular meeting of the City Council. CALL TO ORDER MEETING ROLL CALL Present at roll call were City Council Members Rob Ronayne, Mark Remily, Dave Lunzman, Josh Rife, Alan Johnson, Justin Reinbold, Tiffany Langer by teleconference, Clint Rux, and Mayor Travis Schaunaman. City Staff present were Joe Gaa, Ron Wager, Robin Bobzien, Brett Bill, Karl Alberts, and Tanner Jondahl, and Joel Weig. PLEDGE OF ALLEGIANCE Mayor Schaunaman led the Pledge of Allegiance. APPROVAL OF AGENDA Motion by Reinbold, second by Rux to approve the agenda. Voice vote to approve, all voting aye, motion carried. MINUTES Motion by Reinbold, second by Lunzman to approve the minutes of the October 18, 2021 City Council Meeting, as circulated. Voice vote to approve, all voting aye, motion carried. OPEN FORUM No one appeared in open forum to address the Council. Council Member Langer arrived at the meeting at 5:32 p.m. CONSENT CALENDAR Motion by Remily, second by Rife to approve the following items on the consent calendar: SET HEARING DATE – of November 15, 2021 at 5:30 p.m. for a Special One-Day Retail On-Sale Liquor License on December 4, 2021 for Avera St. Luke’s Foundation’s “Deck The Halls” Event at Avera Human Performance Center, 815 First Avenue, SE SET BID DATE – of November 16, 2021 at 2:00 p.m. – Vehicle Bids for various City Departments LICENSE – Residential Building Contractor – Justin Mofle PLAT – Mother Joseph Manor Addition to the City of Aberdeen in the SE ¼, Section 12, T123N, R64W of the 5th P.M., Brown County, South Dakota (1002 North Jay Street) REPORTS AND MINUTES FROM CITY BOARDS – Aberdeen Airport Board Meeting Minutes; Aberdeen City Planning Commission Meeting Minutes; Board of Zoning Adjustment Meeting Minutes; Parks & Recreation Board Meeting Minutes – receive and place on file  18014 Voice vote to approve, all voting aye, motion carried. NEW BUSINESS ORDINANCE NO. 21-10-01 TO SUPPLEMENT THE BUDGET City Finance Officer Karl Alberts presented Ordinance No. 21-10-01 for first reading to supplement the 2021 Budget for various Parks, Recreation, and Forestry Department Activities. Alberts stated that the ordinance redistributes cash held for Parks, Recreation, and Forestry (PRF) activities in the PRF Fund and PRF Gift Fund to fund activity paid for in the PRF Fund, PRF Softball Project Fund, and the PRF Enterprise Fund for the third quarter of 2021. Motion by Ronayne, second by Johnson to approve first reading of Ordinance No. 21- 10-01 as presented. Roll call vote to approve, all voting aye, motion carried. RESOLUTION NO. 21-10-05R FOR INTENT TO LEASE 32 ACRES OF CITY LAND City Attorney Ron Wager explained a resolution of intent to lease 32 acres of city- owned land in Ordway Township north of the Elm River to a private person for a 3-year term starting in 2022 and to set a public hearing to consider final approval of such lease. Wager informed the Council that City Staff recommends leasing the property to Leroy “Butch” Podoll for farming purposes at a cash rent of $50.00 per acre for the 2022, 2023, and 2024 crop years. Motion by Ronayne, second by Johnson to approve first reading and passage of Resolution No. 21-10-05R stating the Council’s intent to lease city land to a private person for a term and rental amount invoking the requirements of SDCL §9-12-5.2, and fixing a public hearing to consider final approval of such lease, and to authorize the Finance Officer to publish notice of hearing as required by law. Roll call vote to approve, all voting aye, number of ayes 9, number of nays 0, members abstaining 0, motion carried. RESOLUTION NO. 21-10-05R RESOLUTION OF INTENT TO LEASE CITY-OWNED PROPERTY TO A PRIVATE PERSON WHEREAS, the City of Aberdeen, owns the following property: That portion of the NE ¼ of the NE ¼ of Section 6, lying north of the center of the Elm River in Township 124 North, Range 63 West, Brown County, South Dakota, which contains approximately 32.0 acres of hayable land; and WHEREAS, the City Council, upon the recommendation of City Staff, intends to lease such property to Leroy “Butch” Podoll, a private person, for the crop seasons covering a 3-year term and beginning in 2022, for $1,600.00 annual rental, such term and rental amount invoking the requirements of SDCL §9-12-5.2; NOW, THEREFORE, BE IT RESOLVED that the City of Aberdeen intends to enter into such lease and fixes November 1, 2021, at 5:30 p.m., in City Council Chambers, 123 South Lincoln Street, Municipal Building, in the City of Aberdeen, South Dakota, as the time and place for public hearing on the lease. BE IT FURTHER RESOLVED that notice of the public hearing shall be published in  18015 the official newspaper once, at least ten days prior to the hearing. BE IT FURTHER RESOLVED that following the public hearing the City Council may proceed to adopt a resolution approving the lease upon the terms and conditions it determines. The foregoing Resolution was approved after first reading and passed at a regular meeting of the Aberdeen City Council on the 25th day of October, 2021. LICENSE TO PERMIT FENCE ENCROACHMENT ON RIGHTS-OF-WAY City Attorney Ron Wager presented a request by Michael Nelson and John and Samantha Hettich for licenses to permit fence encroachment on rights-of-way abutting 301 and 305 South Dakota Street. Wager stated that the properties abut an irregular-shaped right- of-way at the eastern half of the intersection at South Dakota Street and 3rd Avenue, SE. Wager said that the fences run parallel to the public sidewalks on the rights-of-way and do not create a problem to pedestrians or traffic visibility. Motion by Johnson, second by Reinbold to approve the requests by Michael Nelson and John and Samantha Hettich for licenses for their fences to encroach upon the rights-of-way abutting the residences at 301 South Dakota Street and 305 South Dakota Street, and to authorize the City Manager to execute the same. Roll call vote to approve, all voting aye, motion carried. CITY MANAGER’S REPORT City Manager Joe Gaa reported on a discussion held at a meeting on Thursday,  18017 October 21st, regarding results of a feasibility study on the possibility of a pipeline transporting water from the Missouri River to Aberdeen and announced a ground breaking to be held on Friday, October 29th, at 11:30 a.m., for a new accessible playground at Wylie Park.
