18230 MINUTES ABERDEEN CITY COUNCIL MEETING City Council Chambers, 123 South Lincoln Street, Municipal Building, Aberdeen, South Dakota, September 19, 2022 at 5:30 p.m., regular meeting of the City Council. CALL TO ORDER MEETING ROLL CALL Present at roll call were City Council Members Rob Ronayne, Erin Fouberg, Charlotte Liebelt, Alan Johnson, Justin Reinbold, Tiffany Langer by teleconference, David Novstrup, and Mayor Travis Schaunaman. City Council Member Josh Rife was absent. City Staff present were Joe Gaa, Ron Wager, Robin Bobzien, Brett Bill, Jordan McQuillen, Dave McNeil, Joel Weig by teleconference, and Rich Krokel. PLEDGE OF ALLEGIANCE Mayor Schaunaman led the Pledge of Allegiance. APPROVAL OF AGENDA Motion by Fouberg, second by Reinbold to approve the agenda. Voice vote to approve, all present voting aye, motion carried. MINUTES Motion by Ronayne, second by Liebelt to approve the minutes of the September 6, 2022 City Council Meeting, as circulated. Voice vote to approve, all present voting aye, motion carried. OPEN FORUM No one appeared in open forum to address the Council. CONSENT CALENDAR Motion by Reinbold, second by Ronayne to approve the following items on the consent calendar: SET HEARING DATE – of October 3, 2022 at 5:30 p.m. for a Special Two-Day Retail On- Sale Liquor License on October 13 – 14, 2022 for ACT2, Inc. at the Aberdeen Community Theatre, 417 South Main Street SET BID DATE – of October 4, 2022 at 2:00 p.m. for Bids on the Aberdeen City Hall 2023 Chiller Replacement REQUEST FOR TEMPORARY VARIANCE – from the Residential Noise Ordinance for low light training by the Aberdeen Police Department at the City Firearms Range on September 27, 28, and 29, 2022 from 7:00 p.m. – 11:00 p.m. LOTTERY NOTICES – Aberdeen Family YMCA; Sacred Heart Church; Sunrise Lodge #211; The Old Cronies, Inc. – receive and place on file Voice vote to approve, all present voting aye, motion carried. OLD BUSINESS ORDINANCE NO. 22-09-01, 2023 APPROPRIATIONS – SECOND READING AND  18231 FINAL ADOPTION City Manager Joe Gaa presented the 2023 Appropriations Ordinance No. 22-09-01 for second reading and recommended approval. Motion by Johnson, second by Ronayne to approve second reading and final adoption of Ordinance No. 22-09-01. Roll call vote to approve, Ronayne, Liebelt, Johnson, Reinbold, Langer, Novstrup, and Mayor Schaunaman voting aye, Fouberg abstaining on appropriation of economic development funds for Northern State University and voting aye on remainder of the appropriations in the ordinance, motion carried. NEW BUSINESS PUBLIC HEARING ON 2023–2027 CAPITAL IMPROVEMENT PLAN AND APPROVAL OF RESOLUTION NO. 22-09-01R Mayor Schaunaman opened the hearing on the 2023–2027 Capital Improvement Plan. City Manager Joe Gaa explained the capital generated from sales tax allocations and other funds and recommended approval of Resolution No. 22-09-01R adopting the Five-Year Capital Improvement Plan. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Ronayne, second by Johnson to approve of Resolution No. 22- 09-01R approving the 2023-2027 Capital Improvement Plan without amendments. Roll call vote to approve, all present voting aye, number of ayes 8, number of nays 0, motion carried. RESOLUTION NO. 22-09-01R RESOLUTION TO APPROVE 2023-2027 CAPITAL IMPROVEMENT PLAN WITH OR WITHOUT AMENDMENTS Whereas, the Aberdeen Home Rule Charter provides for the submission of a Five- Year Capital Improvement Program to be proposed no later than the final date for submission of the budget, and Whereas, the City Manager has presented a Capital Improvement Program as required by his duties as City Manager with a public hearing being held on September 19, 2022, with the published notice on September 1, 2022, stating the meeting time and place, and Whereas, the City Council is required to adopt the Capital Improvement Program by resolution after the public hearing with or without amendments to the Capital Improvement Program. Now, therefore be it resolved, that the City Council approves the Capital Improvement Program as presented by the City Manager and proposed at the public hearing held on September 19. 2022, without any amendments. PUBLIC HEARING AND APPROVAL OF SPECIAL ONE-DAY LIQUOR LICENSES FOR ABERDEEN AREA CHAMBER OF COMMERCE Mayor Schaunaman opened the hearing on Special One-Day Liquor Licenses for Aberdeen Area Chamber of Commerce’s Business After Hours Events on October 13, 2022 at the Civic Arena, 203 South Washington Street, and on November 10, 2022 at  18232 Montgomery’s, 3502 – 7th Avenue, SE. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Fouberg, second by Reinbold to approve of Special One-Day Retail On-Sale Liquor Licenses for Aberdeen Area Chamber of Commerce’s Business After Hours Events on October 13, 2002 at 203 South Washington Street and on November 10, 2022 at 3502 – 7th Avenue, SE. Voice vote to approve, all present voting aye, motion carried. PUBLIC HEARING AND APPROVAL OF SPECIAL ONE-DAY LIQUOR LICENSE AND COMMUNITY EVENT PERMIT FOR ABERDEEN DOWNTOWN ASSOCIATION Mayor Schaunaman opened a hearing on a Special One-Day Retail On-Sale Liquor License on September 22, 2022 for Aberdeen Downtown Association’s Wine Walk at business locations along South Main Street from 6th Avenue to Railroad Avenue with a request for a Community Event Permit for the same. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Liebelt, second by Ronayne to approve of a Special One-Day Retail On-Sale Liquor License on September 22, 2022 and a Community Event Permit for Aberdeen Downtown Association’s Wine Walk at various business locations along South Main Street from 6th Avenue to Railroad Avenue. Voice vote to approve, all present voting aye, motion carried. PUBLIC HEARING AND APPROVAL OF SPECIAL FIVE-DAY LIQUOR LICENSE FOR ACT2, INC. Mayor Schaunaman opened a hearing on a Special Five-Day Retail On-Sale Liquor License on September 21 – 25, 2022 for Act2, Inc. at the Aberdeen Community Theatre, 417 South Main Street. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Reinbold, second by Ronayne to approve of a Special Five-Day Retail On-Sale Liquor License on September 21 – 25, 2022 for Act2, Inc. at 417 South Main Street. Voice vote to approve, all present voting aye, motion carried. PUBLIC HEARING AND APPROVAL OF SPECIAL ONE-DAY LIQUOR LICENSE FOR AVERA ST. LUKE’S FOUNDATION Mayor Schaunaman opened a hearing on a Special One-Day Liquor License on December 3, 2022 for Avera St. Luke’s Foundation’s Deck the Halls Event at Avera Human Performance Center, 815 – 1st Avenue, SE. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Reinbold, second by Liebelt to approve of a Special One-Day Liquor License on December 3, 2022 for Avera St. Luke’s Foundation’s Deck the Halls Event at 815 – 1st Avenue, SE. Voice vote to approve, all present voting aye, motion carried. SD DOT SECTION 5339 GRANT-AMENDMENT NO. 2 FOR ABERDEEN RIDE LINE Transportation Director Rich Krokel requested approval to authorize the City Manager to sign Amendment No. 2 to the SD Department of Transportation Section 5339 Grant No. 811843 Agreement effective 12-20-2019 extending the period of performance  18233 from 09-30-2021 to 09-30-2023 for Aberdeen Ride Line. Motion by Ronayne, second by Johnson to authorize the City Manager to sign Amendment No. 2 to the SD Department of Transportation Section 5339 Grant No. 811843 Agreement extending the period of performance to 09-30-2023 for Aberdeen Ride Line. PAYMENTS FOR AIRPORT IMPROVEMENT PROJECTS Transportation Director Rich Krokel requested approval of the following payments for Airport Improvement Projects: 1) Payment #34 – AIP #3-46-0001-43-2021 Taxiway Geometry – Helms & Associates, in the amount of $17,405.07; 2) Payment #18 – AIP #3- 46-0001-47-2022 GA Apron Reconstruction – Helms & Associates, in the amount of $3,190.66. Motion by Ronayne, second by Johnson to approve and authorize the City Manager to sign the payments to Helms & Associates for work on the Airport Improvement Projects. PAYMENT FOR 3RD AVENUE, SE RECONSTRUCTION PROJECT City Engineer Robin Bobzien requested approval of Payment #4 in the amount of $8,218.80 to B & B Contracting, Inc. for work on the 3rd Avenue, SE Reconstruction Project. Motion by Johnson, second by Reinbold to approve of Payment #4 in the amount of $8,218.80 to B & B Contracting, Inc. for work on the project. Roll call vote to approve, Fouberg, Liebelt, Johnson, Reinbold, Langer, Novstrup, and Mayor Schaunaman voting aye, Ronayne abstaining, motion carried. PAYMENT FOR OLD HIGHWAY 281 OVERLAY IMPROVEMENTS PROJECT City Engineer Robin Bobzien requested approval of Payment #2 in the amount of $6,635.23 to Lien Transportation for work on the Old Highway 281 Overlay Improvements Project. Motion by Johnson, second by Ronayne to approve of Payment #2 in the amount of $6,635.23 to Lien Transportation for work on the project. PAYMENT FOR KLINE STREET STORM SEWER IMPROVEMENTS PROJECT City Engineer Robin Bobzien requested approval of Payment #2 in the amount of $441,325.47 to B & B Contracting, Inc. for work on the Kline Street Storm Sewer Improvements Project. Motion by Novstrup, second by Fouberg to approve of Payment #2 in the amount of $441,325.47 to B & B Contracting, Inc. for work on the project. OTHER City Engineer Robin Bobzien provided updates on the South Roosevelt Street Project, North Dakota Street Project, and roads on North Dakota Street, north of Fairgrounds Road.
