CALL TO ORDER MEETING ROLL CALL Present at roll call were City Council Members Erin Fouberg, Charlotte Liebelt, Justin Reinbold, David Novstrup, and Mayor Travis Schaunaman. City Council Members Rob Ronayne, Josh Rife, Alan Johnson, and Tiffany Langer were absent. NEW BUSINESS PUBLIC HEARING ON PETITION TO REZONE PROPERTY AND FIRST READING OF ORDINANCE NO. 22-09-02 Mayor Schaunaman opened a hearing on a petition from Troy Niemen to rezone the property described as Lot 1, Howard & Hedger First Rearrangement of Lots 11 – 12, Block 4, North Aberdeen Addition in the NW¼ of Section 13, T123N, R64W of the 5th P.M., Brown County, South Dakota (110 – 2nd Avenue, NE) from (C-3) Central Business District to (R-3) High Density Residential District. City Planning/Zoning Director Brett Bill explained that the petitioner is requesting the rezoning of the property to bring it into a district that is consistent with its use as a single family rental property. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Reinbold, second by Novstrup to approve first reading of Ordinance No. 22-09-02 to rezone the property as requested. Roll call vote to approve, all present voting aye, motion carried. PUBLIC HEARING ON PETITION TO REZONE PROPERTY AND FIRST READING OF ORDINANCE NO. 22-09-03 Mayor Schaunaman opened a hearing on a petition from John and Dominika Blum to rezone the property described as Lot 1, Blum First Addition to the City of Aberdeen in the NW¼ of Section 25, T123N, R64W of the 5th P.M., Brown County, South Dakota (1801 Eisenhower Circle) from (R-2) Medium Density Residential District/(R-4) Special Density Residential District to (C-1) Neighborhood Commercial District. City Planning/Zoning  18239 Director Brett Bill explained that the petitioner is requesting the rezoning of the property to bring it into a district that allows for the operation of a teahouse. No public comments were received so Mayor Schaunaman closed the hearing. Motion by Reinbold, second by Fouberg to approve first reading of Ordinance No. 22-09-03 to rezone the property as requested. Roll call vote to approve, all present voting aye, motion carried. NEGOTIATED POLICE AND FIRE UNION AGREEMENTS FOR 2023 – 2024 AND APPROVAL OF RESOLUTION NO. 22-09-02R RATIFYING AGREEMENTS City Manager Joe Gaa requested approval of negotiated Police and Fire Union Agreements for 2023 and 2024 and recommended approval of Resolution No. 22-09-02R ratifying the City’s negotiated collective bargaining agreements with the Police and Fire Unions. Motion by Reinbold, second by Liebelt to approve Resolution No. 22-09-02R approving and ratifying the City’s negotiated collective bargaining agreements for 2023 and 2024 with the Police and Fire Unions. Roll call vote to approve, all present voting aye, number of ayes 5, number of nays 0, members abstaining 0, motion carried. RESOLUTION NO. 22-09-02R RESOLUTION APPROVING COLLECTIVE BARGAINING AGREEMENTS FOR FISCAL YEARS 2023 & 2024 WHEREAS, negotiations between the designated representatives of F.O.P. Lodge #4 Labor Council and the City of Aberdeen resulted in settlement of a collective bargaining agreement for fiscal years 2023 and 2024 to address wages and other conditions of employment for all police officers, sergeants, and detectives of the City of Aberdeen Police Department; and WHEREAS, the collective bargaining agreement between the City and the police union entitled “Collective Bargaining Agreement for 2023 & 2024” dated September 12, 2022, has been placed on file with the Finance Officer and is available for review and inspection; and WHEREAS, negotiations between the designated representatives of Local 446 of the International Association of Fire Fighters and the City of Aberdeen resulted in settlement of a collective bargaining agreement for fiscal years 2023 and 2024 to address wages and other conditions of employment for all firefighters, EMTs, paramedics, and lieutenants of the City of Aberdeen Fire Department; and WHEREAS, the collective bargaining agreement between the City and the fire union entitled “Fire Employees Union Contract for 2023 & 2024” dated September 13, 2022, has been placed on file with the Finance Officer and is available for review and inspection; and WHEREAS, the designated representatives hereby recommend approval by the City Council of the above collective bargaining agreements for the identified public employees of the police and fire departments. NOW, THEREFORE, BE IT RESOLVED that, pursuant to SDCL §3-18-8, the City  18240 Council of Aberdeen, South Dakota, hereby approves and ratifies the collective bargaining agreements and authorizes implementation of the terms and conditions therein. The foregoing Resolution No. 22-09-02R was adopted at a regular meeting of the Aberdeen City Council on the 26th day of September, 2022. 2023 – 2027 RENTAL AMOUNTS FOR HANGAR AREAS AT AIRPORT AND APPROVAL OF RESOLUTION NO. 22-09-03R OF INTENT TO LEASE THE AREAS City Attorney Ron Wager informed the Council of the 2023 – 2027 increase in rental amounts for hangar areas at the Airport and requested approval of Resolution No. 22-09-03R of intent to lease the private and executive hangar areas at the Airport for 5 years. Motion by Novstrup, second by Liebelt to approve the rental amount for hangar structure areas at the Aberdeen Regional Airport as follows $0.25 per square foot in Year 2023, $0.27 per square foot in Year 2024, $0.29 per square foot in Year 2025, $0.31 per square foot in Year 2026, and $0.33 per square foot in Year 2027, approve Resolution No. 22-09-03R declaring the Council’s intent to lease city-owned lands at the Aberdeen Regional Airport, fixing a public hearing to consider final approval of such leases, and authorize the Finance Officer to publish notice of hearing as required by law. Roll call vote to approve, Fouberg, Liebelt, Novstrup, and Mayor Schaunaman voting aye, Reinbold abstaining, number of ayes 4, number of nays 0, member abstaining 1, motion carried. RESOLUTION NO. 22-09-03R RESOLUTION OF INTENT TO LEASE AIRPORT LAND FOR HANGAR AREAS WHEREAS, the City of Aberdeen owns land at the Aberdeen Regional Airport at 4740 – 6th Ave., SE, Aberdeen, South Dakota, which it leases out for use as hangar areas for tenant hangar structures and approaches (hereafter “hangar areas”); and WHEREAS, the City is authorized by SDCL §§9-12-5.1, 9-12-5.2, and 50-6A-40 to lease its municipally-owned airport property to private persons; and WHEREAS, the City desires to enter into leases of the hangar areas for a period of five (5) years beginning January 1, 2023, to the following private persons: Aberdeen Professionals Hangar #16 Arment/Wirebaugh Hangar #17 Bellikka, Neil Hangar #26 Berg, William Hangar #5 Berg, William Hangar #30 Beving, Morgan Hangar #20 Braun, Kevin/Richelle Hangar #3 Gengerke, Ryan d/b/a Hard Deck Aviation Hangar #4 Hillestad, Darrell Hangar #6 Huber, Weylin Hangar #8  18241 Johnson, Rolf Hangar #21 Knie, Dean Hangar #13 Knie, Dean Hangar #14 Lamont, Chris – Lamont Companies Hangar #29 Outka, Wade Hangar #12 Theobald, Daryl Hangar #7 Theobald, Daryl Hangar #9 Werth, Roger Hangar #23 WHEREAS, the hangar area leaseholds shall be based upon rental amounts for the footprint of the hangar structure of $0.25 per square foot in Year 2023, $0.27 per square foot in Year 2024, $0.29 per square foot in Year 2025; $0.31 per square foot in Year 2026, and $0.33 per square foot in Year 2027; and for the footprint of the approach, fifty percent (50%) of the per square foot rental for the tenant’s hangar structure; and upon further terms and conditions to be set forth in a Private Hangar Lease Agreement or Executive Hangar Lease Agreement that permits use of the hangars primarily for non-commercial aviation activities; and NOW, THEREFORE, BE IT RESOLVED that the City of Aberdeen intends to enter into such leases and fixes October 17, 2022, at 5:30 p.m., in City Council Chambers, 123 South Lincoln Street, Municipal Building, in the City of Aberdeen, South Dakota, as the time and place for public hearing on the leases. BE IT FURTHER RESOLVED that notice of the public hearing shall be published in the official newspaper once at least ten days prior to the hearing. BE IT FURTHER RESOLVED that following the public hearing the City Council may proceed to adopt a resolution approving the leases upon the terms and conditions it determines. The foregoing Resolution was approved after first reading and passed at a regular meeting of the Aberdeen City Council on the 26th day of September, 2022. AMENDMENT NO. 1 TO SD DOT SEC. 5310 GRANT CONTRACT WITH ABERDEEN RIDE LINE Transportation Director Rich Krokel requested approval for the City Manager to sign Amendment No. 1 to the SD Department of Transportation Sec. 5310 Grant Contract No. 812024 to extend the period of performance for Aberdeen Ride Line to September 30, 2023 and to increase the contract amount by $3,108.00. Motion by Reinbold, second by Novstrup to authorize the City Manager to sign Amendment No. 1 to the SD Department of Transportation Sec. 5310 Grant Contract No. 812024 extending the period of performance for Aberdeen Ride Line to September 30, 2023 and increasing the contract amount by $3,108.00. RECOMMENDATION ON BIDS FOR 2022 – 2023 SNOW REMOVAL SERVICES  18242 City Engineer Robin Bobzien requested acceptance of all bids for the 2022 – 2023 Snow Removal Services and approval to rent equipment as needed in order of price. Motion by Fouberg, second by Liebelt to approve all the bids for the 2022 – 2023 Snow Removal Services, rent equipment as needed in order of price, and authorize the City Manager and Finance Officer to sign all necessary documents after approval by the City Attorney.
