Aberdeen City Planning Commission December 18, 2018 MINUTES ABERDEEN CITY PLANNING COMMISSION December 18 , 2018 The City Planning Commission was called to order by Chairman Dean Marske. Members present at roll call were Schumacher, Marske, Lien, Mitchell, Woodward, and Mettler. Cogley was absent. Also present were Brett Bill, Planning & Zoning Director, Eric Miller, City Planner, Ken Hubbart, City Planner, and Paula Nelson, Planning Commission Secretary. Schumacher moved and Lien seconded to approve the minutes of November 20, 2018, all members voting aye, the motion carried. OPEN FORUM – No one was present. There being no old business Chairman Marske began with new business as follows: 1) A petition to rezone from (A-1) Agricultural District to (R-2) Medium Density Residential District for property described as “Proposed Lot 1, Prairie’s Edge Thirteenth Addition to the City of Aberdeen in the NW ¼ of Section 8, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 3004 24th Ave NE) was submitted by Kevin Weisbeck. Eric Miller stated that the petitioner is requesting this petition to rezone in order to bring the parcel into a zoning district that is consistent with its intended future use as a lot containing a single family residence. Following further discussion Lien moved and Woodward seconded to approve, all members voting aye, the motion carried. 2) A petition to vacate public right-of-way for property described as “The 120’ of 16’ wide public alley right-of-way located between Lot 1, Battest First Consolidation Subdivision and Lots 7-10, Block 43, Roches East Side Addition, all in the SW ¼ of Section 17, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. North/South Alley between 402 Illinois St S and 423 Harvard St S) was submitted by Alissa Battest & Terry Larson. Eric Mller stated that the petitioners have submitted this petition to vacate a portion of unused public alley R.O.W. in order to consolidate numerous adjacent lots with an unused alley. Following discussion Mitchell moved and Mettler seconded to approve with the stipulations that the petitioners must replat their adjacent properties to include the newly vacated R.O.W. and that a utility easement is established for any utilities currently located within the right-of-way. Upon roll call, all members voting aye, the motion carried. 3) A preliminary and final plat described as “Larson and Battest First Addition to the City of Aberdeen in the SW ¼ of Section 17, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 423 Harvard St S, 402 Illinois St S, and 2601 6th Ave SE) was submitted by Tracy and Alissa Battest, and Terry and Kathryn Larson. Eric Miller stated that the petitioners are requesting this preliminary and final plat in order to clarify the legal description for three existing parcels containing structures with commercial uses. This plat will combine various vacated rights-of-way with multiple underlying lots to create three legal parcels. Following discussion Lien moved and Mettler seconded to approve with the following stipulations: 1) Sidewalks need to be installed, where missing, along all adjacent rights-of-way within five years of the plat filing date, 2) No development of {00044582.DOC / 1} 1 Aberdeen City Planning Commission December 18, 2018 structures, fences, etc. shall be allowed within the utility easements noted on this plat, and 3) All inspections (building, fire, landscape, etc) that are required to obtain a Certificate of Occupancy must be completed for Proposed Lot 2. Upon roll call, all members voting aye, the motion carried. 4) A preliminary and final plat described as “Reed Second Addition to the City of Aberdeen, in the SE ¼ of Section 8, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 1815 Sixth Ave SE) was submitted by JR & R II, LLC. Eric Miller stated that the petitioner is requesting this preliminary and final plat in order to combine four newly acquired lots with their existing property. At their December 13, 2018 meeting, the Aberdeen Board of Zoning Adjustment granted a Special Exception for the open storage of goods and materials related to the commercial use on this property. Upon roll call, all members voting aye, the motion carried. There being no further business before the Commission, Mitchell moved and Schumacher seconded to adjourn the meeting, all members voting aye, the motion carried. Adjournment {00041498.DOC / 1} FORMAT GUIDELINES: 1) Open forum provides an opportunity for the public to address the Aberdeen City Planning Commission with questions, concerns or comments on items, which are not on the agenda. Citizens are asked to sign up to speak prior to the open forum portion of the meeting. Open forum will be limited to 10 minutes (if no one is in attendance for the open forum, the regular meeting may begin) unless a majority of the Aberdeen City Planning Commission agrees to extend the time period. The open forum may not be used to make personal attacks, to air personality grievances, to make political endorsements, or for political campaign purposes. Open forum will not be used as a time for problem solving or reacting to the comments made, but, rather for hearing the citizen for informational purposes. The Aberdeen City Planning Commission may respond with request for city management to follow up and report back on any issue raised during the public address time. A presentation may not exceed two minutes in duration. 2) ADA Compliance: The City of Aberdeen fully subscribes to the provisions of the American ’s With Disabilities Act.
