Aberdeen City Planning Commission December 15, 2020 MINUTES ABERDEEN CITY PLANNING COMMISSION December 15, 2020 The City Planning Commission was called to order by Chairman Dean Marske. Members present at roll call were Cogley, Mettler, Woodward, Lien, Mitchell, Schumacher, and Marske. Also present were Brett Bill, Planning & Zoning Director, Joe Gaa, City Manager, Eric Miller, City Planner, and Ken Hubbart, City Planner. Schumacher moved and Lien seconded to approve the Aberdeen City minutes of November 17, 2020, all members voting aye, the motion carried. OPEN FORUM – No one was present. There being no old business Chairman Marske began with new business as follows: 1) A preliminary and final plat described as “Weidner Consolidation Subdivision to the City of Aberdeen, in the SW ¼ of Section 17, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 103 Harvard St S) was submitted by Heather Weidner. Eric Miller stated that the petitioner is requesting this preliminary and final plat in order to combine multiple underlying lots into one legal parcel to allow for the future construction of a residential addition. Following discussion Cogley moved and Mettler seconded to approve with the stipulation that the petitioner has sidewalks installed, where missing, along all platted rights- of-way within five years of the plat filing date. Upon roll call, all members voting aye, the motion carried. 2) A preliminary and final plat described as “JMD Properties LLC Consolidation Subdivision to the City of Aberdeen, in the SE ¼ of Section 18, T123N-R63W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 223 Park St S & 220 Roosevelt St S) was submitted by JMD Properties LLC – Julie Dvorak. Eric Miller stated that the petitioner is requesting this preliminary and final plat in order to combine multiple underlying lots into one legal parcel. By combining these lots the existing garage at 223 Park Street South will now conform with Zoning Ordinances regarding detached structures as an accessory land use. Following discussion Mitchell moved and Woodward seconded to approve with the stipulations that the petitioner acquires a building permit to reside and shingle either the house or garage so they are aesthetically similar (prior to filing the plat) and the existing water and sewer on the west side of the property is disconnected prior to July 1, 2021. Upon roll call, all members voting aye, the motion carried. 3) A petition to vacate public right-of-way described as “The entire 16’ wide public alley right-of-way commencing at the north right-of-way line of Sixth Avenue SW continuing north 304.74’ to a point of termination at the south right-of way-line of Fifth Avenue SW, located adjacent to the east of “Lot 1, Hardee’s Addition”, “Lot “P” A Replat of Lot 6, Block 32, 1st Addition, Lots 12-16, Subdivision of Lot 5, 1st Addition, Lots 12-16, Block 32, Second Addition”, and “Lot 4, Beard’s {00070748.DOC / 1} 1 Aberdeen City Planning Commission December 15, 2020 Rearrangement of Lots 7&8, Block 32, First Addition” and adjacent to the west of “Lot 2, Hardee’s Addition” and “Lots 1-3, Block 32, 1st Addition in the NW ¼ of Section 24 & SW ¼ of Section 13, all in T123N-R64W of the 5th P.M., Brown County, South Dakota,” (a.k.a. 102 & 124 Sixth Ave SW and 506 First St S) was submitted by Northland Real Estate Holdings LLC, JOPY Inc. and Paces Lodging. Eric Miller stated that the petitioners are submitting this petition to vacate a portion of public alley right-of-way with the intention of combining the R.O.W. with their adjacent property. The alley is currently utilized as an access point for parking at the existing businesses and apartments. There are no City water or sewer lines within the alley. An application for a Special Exception to operate a carwash on the south half of this block was approved by the Aberdeen Board of Zoning Adjustment at their December 10, 2020 meeting. Following discussion Schumacher moved and Lien seconded to approve with the stipulations that utility easements are maintained for any existing utilities, and a plat is submitted combing the vacated R.O.W. with the adjacent property. Upon roll call, all members voting aye, the motion carried. In other business, Marske asked about access for the old Max & Erma’s building. No action taken. There being no further business before the Commission, Schumacher moved and Cogley seconded to adjourn the meeting, all members voting aye, the motion carried. Open forum will be limited to 10 minutes (if no one is in attendance for the open forum, the regular meeting may begin) unless a majority of the Aberdeen City Planning Commission agrees to extend the time period. Open forum will not be used as a time for problem solving or reacting to the comments made, but, rather for hearing the citizen for informational purposes.
