MINUTES OF A REGULAR MEETING MONDAY, DECEMBER 7, 2020 The Common Council was convened at 7:01p.m and was called to order by President Ellis. This meeting was held following Governor Cuomo’s executive order 202.1 and it live streamed on Facebook using Zoom as the meeting platform. If we experience any technical difficulties on Facebook, the video will be streamed to YouTube. REPORTS OF STANDING COMMITTEES: Law, Buildings and Code Enforcement: Council Member Igoe reported that the committee met on December 3, 2020 to review Local Law N of 2020, Ordinance 23.101.20 and Ordinance 45.122.19. The legislation was moved out of committee with a positive recommendation. Finance, Assessment and Taxation: Council Member Farrell reported that the committee will meet on December 17, 2020 to review Resolution 115.121.20R, Ordinance 37.102.20 As Amended, and Ordinance 42.112.20. The committee will also interview candidates for the City of Albany Board of Assessment (BAR). Human Resources and Human Resources: Council member Robinson reported that the committee met on November 18, 2020 at 5:30PM to review Ordinance 24.101.20. The legislation was moved out of committee with a positive recommendation. Planning, Economic Development and Land Use: Council member Fahey reported that the committee met on November 19, 2020 at 5:30PM to review Resolution 104.112.20 to 109.112.20R that are appointment and re-appointment for the Board of Zoning Appeals (BZA). The legislation was moved out of committee with a positive recommendation. Public Safety: President Pro Temp reported that the committee met on November 30, 2020 at 5:30PM to interview candidates for Community Police Review Board (CPRB). The committee will meet on December 9, 2020 and December 10, 2020 at 5:30PM to interview candidates for the Violent Prevention Task Force. The committee will also meet on December 14, 2020 at 5:30PM to the police reforms legislations. CONSIDERATION OF RESOLUTIONS Council Member Anane noticed Resolution 112.121.20R as follows, asked passage and a roll call vote thereon: Resolution Number 112.121.20R A RESOLUTION CALLING ON THE UNITED STATES DEPARTMENT OF HOMELAND SECURITY TO HALT ALL DEPORTATION PROCEEDINGS FOR THE LENGTH OF THE COVID-19 PANDEMIC, AS A MEANS OF RESTRICTING THE GLOBAL SPREAD OF THIS DISEASE. WHEREAS, SARS-CoV-2 is the virus responsible for causing the new infectious disease known as COVID-19; and  WHEREAS, the first cases of humans infected with COVID-19 were identified in December 2019, and by mid-June 2020, there were more than eight million cases reported across the world, with more than 400,000 deaths linked to the disease; and WHEREAS, at the same time, the United States continues to lead in the number of confirmed COVID-19 cases worldwide, with more than two million positive cases and 116,000 deaths; and WHEREAS, many countries are struggling to deal with the ever-evolving COVID-19 pandemic, so much so that the United States Department of State has issued a global “Level 4 – Do Not Travel” warning, as of March 31, 2020, recommending that all U.S. citizens avoid all international travel due to the virus; and WHEREAS, the possibility of disease transmission remains, while the U.S. Department of Homeland Security (“DHS”) continues to conduct international deportations; and WHEREAS, deportees pose a risk to both the U.S. and the countries receiving them, many of which are ill-equipped to handle large-scale COVID-19 outbreaks; and WHEREAS, in the case of detained individuals, U.S. Immigration and Customs Enforcement (“ICE”) facilities have been rife with COVID-19 clusters, raising the risk that if detained individuals are deported, they could infect individuals in their countries of origin; and WHEREAS, the U.S. Center for Disease Control (“CDC”) has issued standards that govern detention facilities, which advise that transfers should be restricted unless absolutely necessary, as transfers of detained individuals risk spreading the virus; and WHEREAS, against CDC standards, DHS has transferred and deported thousands of people in its custody to their countries of origin since the onset of the pandemic; and WHEREAS, as part of its removal procedure, ICE conducts a “visual screening consistent with its own guidance,” and checks body temperatures prior putting detainees aboard airplanes, which protocols are insufficient for determining if a person is infected with SAR-CoV-2; and WHEREAS, international advocates including Amnesty International have called on DHS Acting Secretary Chad Wolf to halt deportations for domestic and international public health; and WHEREAS, by the end of April one in five COVID-19-positive individuals in Guatemala were recently deported from the United States; and WHEREAS, by mid-June, individuals deported to at least five different countries have tested positive for COVID-19; and WHEREAS, simultaneously, the Trump administration has coerced countries into assisting in the United States’ immigration policy by threatening to withhold access to ventilators or deny visas to countries that do not cooperate; and  WHEREAS, ICE continues to contravene expert guidance by deporting individuals, thereby putting immigrant New Yorkers at risk of infection, and risking further transmissions internationally; NOW, THEREFORE, BE IT RESOLVED, that the Albany Common Council calls on the United States Department of Homeland Security to halt all deportation proceedings for the length of the COVID-19 pandemic, as a means of restricting the global spread of this disease. * Council Member Anane spoke on the Resolution prior to passage Resolution 112.121.20 was co-sponsored by Council Members Anane, Balarin, Conti, Doesschate, Fahey, Farrell, Flynn, Frederick, Hoey, Igoe, Johnson, Kimbrough, Love and O’Brien There being no further discussion, President Ellis called for a voice call vote thereon and the motion was ADOPTED: Council Member Farrell noticed Resolution 113.121.20R as follows, asked passage and a roll call vote thereon: RESOLUTION NUMBER 113.121.20R RESOLUTION OF THE COMMON COUNCIL RECOGNIZING AND HONORING HOWARD STOLLER FOR HIS CONTRIBUTIONS TO THE CITY OF ALBANY WHEREAS, Howard Stoller was born on October 13, 1953 in Brooklyn, New York, and lived there until his marriage on the bicentennial. Howie and Bettina Stoller had two sons, Aaron, who passed, and Jeremy who lives in New Jersey and works in theater as a dramaturg; and WHEREAS, he got his Bachelor’s in Business Administration from Baruch College in 1974 and his Master’s in Public Administration from State University of New York at Albany in 1977. Howie and his wife Bettina moved to Albany at her request, as she had visited Howie often when he went for his Master’s degree and liked it there.; and WHEREAS, Howie began his career with New York State in 1977 at the Office of Court Administration as a budget analyst; he went on to do the same job at the Division of the Budget. He moved to doing Information Technology at the Department of Taxation and Finance, and later at the Department of Transportation; and WHEREAS, after retiring from New York State, he headed up the 2010 Census, then returned to being a budget analyst at USDA Veterinary - and later Wildlife – Services, from which he retired in December 2019; and  WHEREAS, when Marggie Skinner chaired CANA, Howie was her Vice Chair, after having headed up the Melrose Neighborhood Association. He agreed to cover the chairmanship for a year or two when Marggie left the position in 2001, but wound up staying, keeping CANA vital for the past 20 years; and WHEREAS, Howie’s passions are travel (to national parks and abroad) and exercise, including biking, cross-country skiing, hiking, kayaking, and swimming; NOW, THEREFORE, BE IT RESOLVED, that Albany Common Council hereby honors Howie Stroller for his dedication and contributions to his community and the City of Albany. * Council Members Farrell and O’Brien spoke on the Resolution prior to passage Resolution 113.121.20 was co-sponsored by Council Members Anane, Balarin, Conti, Doesschate, Fahey, Farrell, Flynn, Frederick, Hoey, Igoe, Johnson, Kimbrough, Love and O’Brien There being no further discussion, President Ellis called for a voice call vote thereon and the motion was ADOPTED: Council Member Conti noticed Resolution 114.121.20R as follows, asked passage and a roll call vote thereon: RESOLUTION NUMBER 114.121.20R RESOLUTION OF THE ALBANY COMMON COUNCIL CALLING ON GOVERNOR CUOMO AND THE NEW YORK STATE LEGISLATURE TO PROTECT THE 340B SAFETY NET PROVIDERS AND HIV SPECIAL NEEDS PLANS AND THE COMMUNITIES THEY SERVE WHEREAS, the Federal Public Health Services Act of 1992 created the 340B drug discount program enabling safety net providers such as community health centers, hospitals and Ryan White providers to obtain pharmaceutical drugs from manufacturers at reduced cost; and WHEREAS, safety net providers reinvest savings from the 340B program to expand access to care for the medically underserved communities they serve, including the uninsured, underinsured, the homeless, people with or at risk for HIV, hepatitis C, and mental health and substance use disorders; and WHEREAS, safety net providers also use 340B program savings to address the health disparities suffered by the communities they serve by providing services to address social determinants of health, including transportation, housing, food and nutrition, legal services, and other supportive services; and  WHEREAS, HIV Special Needs Plans (SNPs) work in tandem with safety net providers to help people with HIV/AIDS access life-extending therapies and reduce hospital use associated with unmanaged HIV disease; and WHEREAS, the COVID-19 pandemic has exacerbated the needs of vulnerable populations served by safety net providers and HIV SNPs, and the number of those in need, even as traditional sources of funding have been reduced; and WHEREAS, it is counter to sound principles of public health to reduce vital health care services in the midst of a global pandemic; and WHEREAS, the FY2020-2021 NYS budget implemented changes that impact the 340B drug discount program by carving out the Medicaid pharmacy benefit from managed care into fee- for-service starting April 1, 2021; and WHEREAS, this change will eliminate safety net providers’ access to at least $250 million annually which would otherwise be directly invested in the highest need communities in New York State through programs and services that are designed to address the health disparities suffered by these communities; and WHEREAS, this change will also eliminate the HIV SNPs ability to collaborate with the safety net providers to provide focused, expert care to people living with and affected by HIV, jeopardizing the State’s ability to meet the Ending the Epidemic goals; and WHEREAS, this change will have a significant negative impact on safety net providers within the City of Albany including Albany Medical Center, Whitney Young Community Health Center and the Albany Damien Center and the communities they serve; NOW, THEREFORE, BE IT RESOLVED, that the Albany Common Council calls on the Governor and the New York State Legislature to take all steps necessary to protect New York State’s safety net providers and SNPs and the health of New York’s most vulnerable citizens and reject the Medicaid pharmacy benefit carve-out from managed care into fee-for-service. * Council Member Conti spoke on the Resolution prior to passage Resolution 114.121.20 was co-sponsored by Council Members Anane, Balarin, Conti, Doesschate, Fahey, Farrell, Flynn, Frederick, Hoey, Igoe, Johnson, Kimbrough, Love and O’Brien There being no further discussion, President Ellis called for a voice call vote thereon and the motion was ADOPTED: Council Member Farrell on the behalf of Finance, Assessment and Taxation Committee noticed Resolution 115.121.20R as follows, which was held for further consideration: RESOLUTION NUMBER 115.121.20R A RESOLUTION OF THE COMMON COUNCIL CONSENTING TO THE TRANSFER OF UNASSIGNED FUNDS TO COVER WAGE INCREASES OWED UNDER THE ALBANY POLICE SUPERVISORS’ ASSOCIATION COLLECTIVE BARGAINING AGREEMENT WHEREAS, section 604(D)(b) of the Charter of the City of Albany dictates that any transfer of budgeted funds that affects a salary rate or salary total that occurs outside of those described in the duly adopted budget requires approval of the Common Council; and WHEREAS, the Budget Office has requested amendments to the 2020 budget as follows: From: Unassigned Fund Balance $940,877 To: Police Salaries (A.3120.7000) $660,633 Police Overtime (A.3120.7499) $177,931 Police Social Security (A.3120.7801) $50,538 Police Longevity (A.3120.7192) $51,775 WHEREAS, these changes are being requested to cover wage increases owed to the members of Albany Police Supervisors’ Association for the years 2017 to 2019, as detailed in their Collective Bargaining Agreement with the City of Albany; NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Albany consents to the transfer of funds affecting the salary totals for various positions as detailed above for budget year 2020. Council Member Farrell on the behalf of Finance, Assessment and Taxation Committee noticed Resolution 117.121.20R (MC) as follows, asked passage and a roll call vote thereon: Resolution Number 117.121.20R (MC) RESOLUTION OF THE COMMON COUNCIL ESTABLISHING THE LOCALLY-ADJUSTED BASE PROPORTIONS OF THE HOMESTEAD AND NON- HOMESTEAD CLASSES FOR PROPERTY TAX PURPOSES PURSUANT TO ARTICLE 19 OF THE REAL PROPERTY TAX LAW WHEREAS, by Local Law No. 1-1998, the Common Council adopted the provisions of Section 1903 of the Real property Tax Law relating to the establishment of homestead and non- homestead base proportions; and WHEREAS, pursuant to Section 1903 of the Real Property Tax Law, the locally-adjusted homestead base proportion of the City of Albany’s base year assessment roll of 2020 has been determined to be 54.87 percent; and  WHEREAS, pursuant to Section 1903 of the Real Property Tax Law, the locally-adjusted non-homestead base proportion of the City of Albany’s base year assessment roll of 2020 has been determined to be 45.13 percent; NOW, THEREFORE, BE IT RESOLVED, that the Common Council of the City of Albany does hereby establish the existing class shares as follows: The locally-adjusted homestead base proportion shall equal 54.87 percent and the locally- adjusted non-homestead base proportion shall equal 45.13 percent. There being no discussion, President Ellis called for a roll call vote thereon and the motion was ADOPTED: The motion passed by the following vote of all Council Members present voting in favor thereof: Affirmative – Anane, Balarin, Conti, Doesschate, Fahey, Farrell, Flynn, Frederick, Hoey, Igoe, Johnson, Kimbrough, Love and O’Brien Affirmative 14 Negative 0 Abstain 0 Council Member Farrell on the behalf of Finance, Assessment and Taxation Committee noticed Resolution 118.121.20R (MC) as follows, asked passage and a roll call vote thereon: Resolution Number 118.121.20R (MC) RESOLUTION OF THE COMMON COUNCIL AUTHORIZING THE LEVY UPON CITY OF ALBANY PROPERTIES FOR UNPAID WATER AND SEWER CHARGES WHEREAS, Section 604(e) of the Charter of City of Albany states that “all water and sewer charges shall be collected by the City Treasurer in the manner set forth in Second Class Cities Law and be a lien upon the property assessed as a general City tax and as a part thereof shall be levied and collected” pursuant to the procedures set forth in Section 604 of the City Charter; and WHEREAS, Public Authorities Law Section 1115-i(9) calls for all unpaid water and sewer charges in the preceding year to be levied and placed on annual tax rolls of the City of Albany under the name “delinquent water and sewer charges”; and WHEREAS, the Chief Financial Officer of the Albany Water Board has filed with the City of Albany a statement of unpaid water and sewer charges for the year 2019 and 2020 totaling $3,113,174.38; NOW, THEREFORE BE IT RESOLVED, that there be a delinquent water and sewer charge levied and assessed against each specific lot or parcel of land as set forth in the statement of unpaid water and sewer charges for the years 2019 and 2020 by the Albany Water Board; and  BE IT FURTHER RESOLVED, that such individual sums, being hereby levied against said liable properties, amounting in the aggregate to $3,113,175.38 shall be placed on the 2021 tax roll of the City of Albany and further allocated individually to the liable properties in conjunction with said properties’ 2021 tax bills; and BE IT FURTHER RESOLVED, that the Clerk of the City of Albany is directed to forward a certified copy of this resolution to the Treasurer of the City of Albany. There being no discussion, President Ellis called for a roll call vote thereon and the motion was ADOPTED: The motion passed by the following vote of all Council Members present voting in favor thereof: Affirmative – Anane, Balarin, Conti, Doesschate, Fahey, Farrell, Flynn, Frederick, Hoey, Igoe, Johnson, Kimbrough, Love and O’Brien Affirmative 14 Negative 0 Abstain 0 Council Member Conti noticed Resolution 120.121.20R (MC) as follows, asked passage and a roll call vote thereon: RESOLUTION NUMBER 120.121.20R(MC) RESOLUTION OF THE ALBANY COMMON COUNCIL MEMORIALIZING THE LIFE AND CONTRIBUITIONS OF HAROLD RUBIN TO THE CITY OF ALBANY AND EXPRESSING ITS CONDOLENCES TO HIS WIFE AND FAMILIY UPON HIS PASSING WHEREAS Harold Rubin moved to Albany in 1950 with his wife Ruth to accept a position in state government which was to culminate in a distinguished 39 year career in public service; and WHEREAS during his career Harold worked under six governors and for the departments of Civil Service, Public Service, Commerce, the Office of Employee Relations and the Division of the Budget where he rose to the position of Chief Budget Examiner; and WHEREAS during his career with the Budget Division he created and headed the first statistical coordination unit in the country, helped establish the state’s policy for collective bargaining after passage of the Taylor Act of 1967 and emerged as an expert on the New York State retirement system having written the Tier II Pension Plan legislation; and WHEREAS in addition to his distinguished career in public service, Harold was a civic and community leader who advocated for Albany’s neighborhoods and transparency in city government and played a major role in stimulating the neighborhood movement in Albany; and WHEREAS Harold’s activities and those of the Center Square Association in advocating for code and zoning enforcement and obtaining municipal services as a right and not a favor to be bestowed by City Hall encouraged residents throughout the city to form their own neighborhood associations; and WHEREAS Harold played leadership roles in the Center Square Association, Coalition for Effective Code Enforcement, Neighborhood Resource Center (NRC) and the Council of Albany Neighborhood Associations (CANA) helping to found many of these organizations; and WHEREAS in 1968 Harold was instrumental in the opposition and defeat of the proposed Mid- Crosstown Arterial Highway that would have run through Albany’s historic district and devastated an urban neighborhood; and WHEREAS in 1974 Harold helped form the Coalition for Effective Code Enforcement whose mission was to stimulate the city to enforce building codes so as to promote the health and safety for the city’s residents and identified the City of Albany as a Code Violator of the Year for not enforcing its own codes; and WHEREAS Harold was a constant presence before the Board of Zoning Appeals on behalf of neighborhood issues and the main spokesperson for CANA on city budget issues where he advocated for more citizen involvement and a transparent budget process; and WHEREAS as a neighborhood activist, Harold avoided partisan electoral politics, was not enrolled in any political party, and used the power of civic involvement and engagement to force city government to give residents a say in the fate of their neighborhoods; and WHEREAS in addition to his neighborhood involvement, Harold served as a president or board member of innumerable civic and professional organizations including: Friends of the Albany Public Library; the Torch Club of Albany; the Albany Police Athletic League; Senior Services of Albany; Albany’s first Charter Revision Commission; and a founding member of the Historic Albany Foundation, to name a few; and WHEREAS Harold was also the recipient of several civic and professional awards in recognition of his public and civic service including the Equinox Victor A. Lord Courage of Convictions Award, the NRC Award for Community Leadership, and several other honors; and WHEREAS Harold’s contributions to the residents of the City of Albany and good government are innumerable and will have lasting impact; and WHEREAS on November 24, 2020 Harold passed from this earth at the age of 93 and is survived by his wife of 70 years, Ruth, their daughters Lisa and Nancy and five grandchildren; and WHEREAS it is appropriate and fitting for this body to pause in its deliberations to recognize and honor the work and lifetime achievements of Harold Rubin and his contributions to the City of Albany. NOW, THEREFORE BE IT RESOLVED that the Common Council of the City of Albany recognizes and extends its gratitude to Harold Rubin for his career of public service and civic leadership to the residents
