Call to Order (Vives) Chair Vives called the June 12, 2025, regular monthly meeting of the CPRB to order at 5:15 pm. B. Roll Call (Santos) a. Chair Vives – present b. Vice Chair Santos – present c. Public Comment a. No speakers present F. Communication from the City of Albany a. Det. Lt. Rittie – OPS i. Since the May 2025 meeting, OPS has completed four complaints, one of which is still being reviewed by OPS; received ten new complaints which have been assigned for investigation; APD is currently working on hiring officers; and OPS is working to determine how to participate in NACOLE Published June 26, 2025 G. Board Member Announcements a. No announcements H. Standing Committee Reports a. Bylaws and Rules (Santos) i. No official report but notification for major revisions in progress to Bylaws and Rules with the consultants b. Community Outreach (Collins-Hackett) i. Communicated with Chief Cox to ensure APD is releasing accurate information to the public in regards to high interest incidents. ii. Events planned with Alert, Community Movie Nights and other events; with a busy calendar of events. iii. Working with community groups in the county as they seek to establish an oversight system for the county. c. Investigation Review (Levendosky) i. Currently working to maximize efficiency and on resuming the presentation of complaints 1. Plans to resume on July 2025 meeting 2. Goal to have every board member to present two cases by each meeting. 3. August meeting forum will allow for larger public participation during presentation of case reviews. ii. Since start of 2025, OPS and CPRB has received 30 complaints which will be distributed on a case-by-case basis. iii. Working to complete needed steps to posted CPRB Senior Investigator and Investigator. iv. Noted vacancies on CPRB and encouraged citizen who are civic minded and expressed that current times require participation. 1. Noted and echoed by Chair Vives and remarked other City board have vacancies as well d. Mediation (Harden) i. No formal report, confirmed two contracted mediators hired to being process of mediation. ii. Remarked about Bylaws and Rules revisions needing to reflect the transition from Government Law Center of the Albany Law School to the City of Albany. e. Police Department Liaison (Harden) i. Announced Secretary Levendosky is now the Chair of this committee and he is working to resume the committee meetings. f. Public Official Liaison (Vives) i. No formal report but updates will be provided in the July meeting, to include updates of committee meeting resuming. I. Old Business a. None Published June 26, 2025 J. New Business a. Consideration of Investigation (Levendosky) i. AD2025-029 – Taser Deployment – April 25, 2025 1. Levendosky explained CPRB received a timely notification and OPS has allowed for review of footage held by APD; however, the materials include third-party private footage to fully appreciate the incident. Subpoena is needed to obtain access to the third-party private footage; but can only be issued in an investigation. 2. Motion to investigate made by Secretary Levendosky, seconded by Vice Chair Santos a. Vote i. Affirmative – All members present ii. Against – None iii. Abstention – None b. Consideration of Subpoena (Levendosky) i. AD2025-029 – Taser Deployment – April 25, 2025 1. T & M Investigator Schwartz on serious issues involved is requesting subpoena for the OPS case file. a. Secretary Levendosky moved to approve the request, seconded by Chair Vives i. Vote 1. Affirmative – All members present 2. Against – None 3. Abstention – None ii. Confidential – Court Order Prohibiting Public Release of Information 1. T & M Investigator Schwartz relayed the two subpoena two officers but that per the court order no information could be publicly released. 2. Chair Vives relayed all members are aware of the case and membership is exercising an abundance of caution in complying with court orders. 3. Secretary Levendosky Moved to add matter to agenda, seconded by Vice Chair Santos a. Vote i. Affirmative – All members present ii. Against – None iii. Abstention – None 4. Secretary Levendosky moved to approve request for subpoena’s, seconded by Member Harden. a. Vote i. Affirmative – All members present ii. Against – None iii. Abstention – None Published June 26, 2025  c. Report from the Chair (Vives) i. Chair Vives announced her resignation, effective June 17, 2025, and expressed her pleasure of serving on the CPRB; working with current and former membership, staff, consultants, Common Council, family, and community; explained that the board officers were aware of the resignation; how she will still continue to work in oversight efforts; and is moving to a new role that creates a conflict of interest with the CPRB work. Remarks about current membership being good stewards for the needed work of the CPRB. ii. Secretary Levendosky thanked Chair Vives for all her hard work. iii. Member Collins-Hackett seconded remarks from Secretary Levendosky, while also remarking about the sacrifice Chair Vives has made to support the CPRB. iv. T & M Investigator Schwartz thanked Chair Vives for her professionalism and work on the board while wishing her success in the next adventure. d. Motion to Hold Special Officer Election (Vives) i. Chair Vives moved to hold special election making Levendosky Vice Chair, and Sowek Secretary, seconded by Secretary Levendosky 1. Vote a. Affirmative – All members present b. Against – None c.
