• Council Members Doesschate, Johnson and Ellis made statements on the Seventy-Six (76) project in
which Stephanie Ferradino, Council Member Doesschate, Council Member Johnson and Edward
Larkin responded to.
• John-Raphael Pichardo made a statement in which Kelsey Carr responded to.
• Kelsey Carr displays the shadow study
• Jeffrey Baker made a comment on the shadow study in which Derek Johnson responded to
• Michele Andre stated that the meeting was made public for viewing.
• Council Member Hoey made a motion to move Ordinance 9.61.20 out of committee with a positive
recommendation, which was seconded by Council Member Love. Council Members Doesschate and
Ellis, and Frederick spoke on the Ordinance prior to the vote. 1 Abstain (Doesschate), 1 Negative
(Fahey), and 2 Positive, the motion failed.
• Council Member Doeeschate made a motion to move Ordinance 9.61.20 out of committee with no
recommendation and completion of SEQRA findings, which was seconded by Council Member
Fahey. The motion passed unanimously.
• John-Raphael Pichardo New York's State Environmental Quality Review Act (SEQRA) FEAF Part 2
& 3 recommendations
• Council Members Doesschate and Fahey asked questions in which John-Raphael Pichardo, Kelsey
Carr and Stephanie Ferradino answered.
• The Chair would like Planning staff to assist by completing not only the SEQR FEAF Part 2 but also
Part 3 and make a recommendation for the SEQR declaration (drafts submitted to Council's attorney)
to be discussed and finalized by the Council's Planning Committee with Planning staff in attendance.
• Resolution 72.81.20R was a table for further discussion.

Council member Doesschate asked for a motion to adjourn, which was duly made, seconded by Council
member Hoey, and passed.

The City of Albany, in Common Council convened, does hereby ordain and enact:
Section 1. Chapter 375 of the Code of the City of Albany (Unified Sustainable
Development Ordinance) and the Official Zoning Map are hereby amended to change the zoning
classifications of 90 Second Avenue, 88 Second Avenue, 86 Second Avenue, 84 Second Avenue,
76 Second Avenue from Mixed-Use Neighborhood Edge (MU-NE) to Mixed-Use
Campus/Institutional (MU-CI) said properties being more particularly described as follows:

GENERAL PURPOSE OF LEGISLATION
This zoning map amendment proposes to rezone parcels located at 90 Second Avenue, 88 Second
Avenue, 86 Second Avenue, 84 Second Avenue, 76 Second Avenue from Mixed-Use
Neighborhood Edge (MU-NE) to Mixed-Use Campus/Institutional (MU-CI), as well as rezone
parcels located at 8 Leonard Street, 10 Leonard Street, 12 Leonard Street, 4 Leonard Street, 15
Scott Street, 13 Scott Street, 11 Scott Street, 9 Scott Street, 7 Scott Street, 10 Krank Street, 15
Krank Street, 1 Scott Street, 10 Scott Street, 8 Scott Street, 6 Scott Street, 4 Scott Street, 33 Krank
Street, 37 Krank Street, 45 Krank Street, 32 Leonard Street, 17 Leonard Street, 16.5 Leonard

Street, from Townhome (R-T) to Mixed-Use Campus/Institutional (MU-CI)
The purpose of the MU-CI district is to provide for sites or campuses with large public and
institutional facilities such as hospitals, museums, and institutions of higher education. Additional
land uses include a variety of retail, commercial, and residential uses traditionally associated with
these large institutions. The MU-CI districts allow for buildings of upwards of 7 stories to be
erected as well.
NECESSITY FOR LEGISLATIONN AND CHANGES TO EXISTING LAW
Development in the area is highly anticipated. The MU-CI would allow for the area to produce
mixed use residential areas with retail. Also known as “Eat, Play, Work” which has been highly
well received and positively impacted the economies of several municipalities throughout the
nation.

RESOLUTION REGARDING THE STATE ENVIRONMENTAL QUALITY
REVIEW ACT (SEQRA) REVIEW OF ORDINANCE 9.61.20
WHEREAS, Ordinance 9.61.20 by Council Member Frederick amends the zoning map of
the City of Albany, changing various parcels of land in the City of Albany from Mixed-Use
Neighborhood Edge (MU-NE) to Mixed-Use Campus/Institutional (MU-CI), and other parcels
from Townhome (R-T) to Mixed-Use Campus/Institutional (MU-CI); and
WHEREAS, South End Development, LLC (herein referred to as “Developer”) has
proposed development of four (4) 6 to 8 story mixed-use modular buildings that will each have
solar canopies extending over the entire building footprints. The buildings will be built into the
topography of the site. Parking will be provided below-grade underneath the buildings and will be
accessed via two access drives on Leonard street and once access drive on Krank Street; and
WHEREAS, the zoning map amendment is a Type I action under SEQRA; and
WHEREAS, on June 1, 2020, the City of Albany Common Council declared itself as the
lead agent for coordinated review and contacted all involved agents of the Common Council
designation of lead agent. All involved agents have until July 20, 2020, to notify the Common
Council if they consent, or object, and to provide any commentary related to environmental
review; and
WHEREAS, ….; and

This legislation will be used upon completion of the SEQRA coordinated review of the zoning map
amendment 9.61.20. The resolution is currently intentionally left unfinished as coordinated review is
being investigated.
