COMMON COUNCIL COMMITTEE MEETING PLANNING, ECONOMIC DEVELOPMENT AND LAND USE COMMITTEE Cathy Fahey, Chair Meeting called by: Cathy Fahey, Chair Date: 09-14-20 Time: 5:30PM Committee Members Present: Fahey, Chair ☒ Doesschate ☒ Balarin ☒ Love ☒ Hoey ☒ Invitees/Speakers Commissioner Chris Spencer Stephanie Ferradino Edward Larkin Debra Dunbrook Kelsey Carr Jahkeen Hoke Council Members Present: Ellis, Kimbrough, Farrell, and Frederick City Personnel Present: Cashawna Burt and John-Raphael Pichardo Minutes Agenda Item (s): RESOLUTION NUMBER 72.81.20R RESOLUTION REGARDING THE STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQRA) REVIEW OF ORDINANCE 9.61.20 Questions and Discussion • Chair called the meeting to order. • Chair open up public comment. • Stephanie Ferradino provided a presentation on the project (Seventy-Six project). • Chair opened up the meeting for questions. • Council members Love, Fahey, Doesschate and Balarin asked question which Amy Lavine, Chris Spencer and Kelsey Carr answered. • Council President Ellis, Council member Doesschate, Council member Farrell and Council member Hoey spoke on the project. • Research Counsel John-Raphael Pichardo presented the amendment to Resolution 72.81.20. • Chair asked for a motion on the Resolution. • Council Member Balarin made a motion to move Resolution 72.81.20 As Amended with negative declaration out of committee with a positive recommendation, which was seconded by Council Member Hoey. The motion passed unanimously. Public Comment: Jeffrey Baker, Attorney for Debra and James Dunbrook, owners of 86 Second Avenue and Audrey Wedenbine, owner of 84 Second Avenue (Spoke on Resolution 72.81.20 As Amended). Adjourn: Chair asked for a motion to adjourn, which was duly made, seconded, and passed. If we experience any technical difficulties on Facebook, the video will be streamed to YouTube: https://www.youtube.com/channel/UC-rQHp1fBLPcdk_4N6J4XbQ COMMON COUNCIL MEETING PLANNING, ECONOMIC DEVELOPMENT AND LAND USE COMMITTEE Cathy Fahey, Chair DATE: Monday, September 14, 2020 TIME: 5:30 p.m. TOPIC(S) OF DISCUSSION/CONSIDERATION: RESOLUTION NUMBER 72.81.20R RESOLUTION REGARDING THE STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQRA) REVIEW OF ORDINANCE 9.61.20 PUBLIC COMMENT PERIOD: YES Council Member Frederick introduced the following: RESOLUTION NUMBER 72.81.20R RESOLUTION REGARDING THE STATE ENVIRONMENTAL QUALITY REVIEW ACT (SEQRA) REVIEW OF ORDINANCE 9.61.20 WHEREAS, Ordinance 9.61.20 by Council Member Frederick amends the zoning map of the City of Albany, changing various parcels of land in the City of Albany from Mixed-Use Neighborhood Edge (MU-NE) to Mixed-Use Campus/Institutional (MU-CI), and other parcels from Townhome (R-T) to Mixed-Use Campus/Institutional (MU-CI); and WHEREAS, South End Development, LLC (herein referred to as “Developer”) has proposed development of four (4) 6 to 8 story mixed-use modular buildings that will each have solar canopies extending over the entire building footprints. The buildings will be built into the topography of the site. Parking will be provided below-grade underneath the buildings and will be accessed via two access drives on Leonard street and once access drive on Krank Street; and WHEREAS, the zoning map amendment is a Type I action under SEQRA; and WHEREAS, on June 1, 2020, the City of Albany Common Council declared itself as the lead agent for coordinated review and contacted all involved agents of the Common Council designation of lead agent. All involved agents have until July 20, 2020, to notify the Common Council if they consent, or object, and to provide any commentary related to environmental review; and WHEREAS, ….; and NOW, THEREFORE, BE IT RESOLVED,….. The resolution is currently intentionally left unfinished as coordinated review is being investigated. FISCAL IMPACT(S) None.
