CHAPTER 30A §§18-25 Version 7.1.10 City Council Ordinance & Administration Subcommittee Meeting Agenda February 16, 2023, at 7:30 PM City Hall- 62 Friend Street Call to order Roll Call Approval of Minutes- January 12, 2023 Public Comment Topics for Discussion- 2022-181 An Ordinance to amend the City of Amesbury Traffic and Parking Regulations Article XII – Authority & Duties of the Traffic and Transportation Commission to dispose of the Traffic and Transportation Commission of its role and responsibilities to the City of Amesbury Traffic and Parking Regulations on December 31, 2022. – Councilor Lennon Sponsor Summary: The original Traffic Regulations were adopted on October 19, 1964 and updated on November 9, 1999. The City of Amesbury first organized a Traffic and Transportation Commission in 2001 under Bill No: 2001-35. The most recent amendment to this item was via Bill No: 2015-077, An Ordinance to Request the City Council to accept the updated Traffic and Parking Regulations. In Bill No. 2021-131 (Administrative Order 2021-1), Pursuant to Section 6-1(a)(2) of the Amesbury Home Rule Charter, the Technical Review Committee was created and established, and consists entirely of City of Amesbury staff membership. Many of these members also serve on the current Traffic and Transportation Commission, thereby creating duplicate bodies to evaluate matters in the scope of the City of Amesbury Traffic and Parking Regulations. In the Bill No. 2022-036, the Amesbury City Council adopted the 13th Session City Council Rules and Procedures, which in Rule 11A-3 created and established a standing sub-committee of the Council on Planning and Development, which may serve as a public forum for the concerns of citizens toward matters relating to the City of Amesbury Traffic and Parking Regulations. Because of the duplicity of mandates across the three bodies, the Traffic and Transportation Commission is now made up of membership also serving on one of the two other bodies. The advisory role of this entity is no longer needed. 2023-005 An Ordinance to amend the Amesbury Zoning Ordinance and the Amesbury Overlay Zoning Map in order to establish a new Smart Growth Overlay District pursuant to M.G.L. Chapter 40R and 760 CMR 59.00 that shall be known as the East End Smart Growth Overlay District. -Mayor Sponsor Summary: The City of Amesbury has received a Letter of Eligibility from the Massachusetts Department of Housing and Community Development for establishing a Smart Growth District pursuant to the provisions of M.G.L. Chapter 40R and 760 CMR 59.00. The proposed Smart Growth District will be known as the East End Smart Growth Overlay District (EE-SGOD). (See ordinance for full summary). 2023-013 An Order of the Amesbury City Council exempting certain categories of public employees from the education and training requirements of the Conflict-of-Interest Law, based on the State Ethics Commission’s Conflict of Interest Law Education and Training Guidelines. -Mayor Sponsor Summary: Chapter 28 of the Acts of 2009, the ethics reform law amending the Conflict-of-Interest Law, imposes education and training requirements on public employers and public employees. The law authorizes the Commonwealth Ethics Commission to establish procedures to implement and ensure compliance with these requirements, and these Implementation Procedures are issued pursuant to that authority. Ideally, all public employees in the Commonwealth would be trained in the Conflict-of-Interest Law. However, cost, and other practical circumstances require that a principled way be found to exempt certain categories of public employees from the education and training requirements without compromising the objectives of those requirements. Therefore, the Commission established guidelines to enable public employers to determine which of their employees are exempt from the education and training requirements. Additional information relative to these guidelines and examples can be found on mass.gov. This order requests exemptions for the following positions in the City of Amesbury: • Senior and Veteran Tax Work-off Program participants; and • Poll Workers. Adjourn February 8, 2023
