Board of Trustees Minutes August 24, 2020 Meeting called to order at 7:30 PM MEMBERS PRESENT: Mayor Dennis Siry, Deputy Mayor Kevin Smith, Trustee Jessica Bernius, Trustee Whalen, Trustee O’Neill ALSO PRESENT: Village Attorney Bruce Kennedy AFD Chief Rob Waegerle APD Chief Bryan Burton Superintendent Bruce Hopper Building Inspector Bryan Donato Clerk/Treasurer Catherine Murdock Assistant to the Mayor Wendy O’Neill The salute to the flag was led by Mayor Siry. Mayor Siry welcomed everyone to the August 24th Meeting of the Board of Trustees, conducted via Zoom Meeting. The Mayor thanked the Department of Public Works and Superintendent Bruce Hopper for their outstanding work during the recent storm. Mayor Siry then asked the Trustees to provide Committee Reports, as follows: Dept. of Public Works (Trustee O’Neill): In July, DPW was busy with regular activities and did a great job with the storm-related work they also took on. They placed drainage rocks at the Norman Ave. bulkhead, helped install the lighting for the steel beam at the AFD 9/11 Memorial, moved a flag pole in memory of AFD Ex-Chief Murney E. Lewis, Jr., and cleaned up a property at Stuart Ave., and backfilled the pathway to the fishing pier. They arranged repair of the elevator at Village Hall, repaired a playground, and picked up 8.2 tons of yard waste from the storm. Amityville Fire Department (Trustee Whalen): 215 calls, 84 rescue, 39 fire calls, and 6 motor vehicle accidents. Year to date there were 1,620 calls, 709 rescue calls and 207 fire calls (including alarms). Amityville Police Department (Deputy Mayor Smith): For the month of July - 394 Arrests, 37 blotter cases, 7 citations, 79 medical aided and 29 traffic accidents. Justice Court (Trustee Bernius): Grand total reported to the state $5,571.00 ($2,991.00 Village Justice; $430.00 Assoc. Village Justice; $2,150.00 Parking Violations). Penal/Criminal, Vehicle & Traffic, and Village Ordinances: 61 charges processed, 21 charges closed out, $3,421.00 collected in fines and surcharges. Parking: 50 tickets written; 24 tickets collected on; $2,150 collected in fines and surcharges. Judges and Court Clerk attended virtual impaired driving seminar. Court office resumed normal business hours on June 29th and Village Justice Court resumed on July 28th. Court was in session on August 18th with new Covid protocols in place. On August 20th Courts permitted to “Return to In-Person Operations” allowing arraignments on all appearance tickets regardless of date issued, hold in-person arraignments, calendar town ordinance cases and calendar parking tickets for conferences and dispositions. Maximum capacity is 25%. Trustee Bernius thanked Senior Justice Court Clerk Shannon Kokoneshi for her thorough summary. 1  Board of Trustees Minutes August 24, 2020 Building Department (Building Inspector Donato): Revenue: $30,740.25, 41 Permits Issued, 48 Inspections Performed, Fire Marshal Responded to 2 Callouts. Notable news: Crunch is reopening for business after the Covid closure. Mayor Siry announced upcoming events, including a special live-streamed concert through Town of Babylon and Babylon Citizens Council on the Arts in the library parking lot. It will showcase local artists and promote local businesses. It is open to anyone who is interested. Two Drive-in Concerts also are scheduled at the Amityville Beach featuring Village residents/musicians: the Byrne Unit on August 29th, Radio Flashback on September 5th. Tickets are free, and it is open to Village residents. you must stay in your car or social distance. No walk ups or bicycles permitted. Mayor Siry invited the public to attend the 9/11 Memorial Service which is planned for 5 PM on 9/11/2020 at the main fire house, where there will also be a dedication of the memorial plaza -- which is in honor of all volunteer firefighters --and the focal point, a steel beam from the WTC. Be it enacted by the Board of Trustees of the Village of Amityville as follows: Section l. The Board of Trustees finds that it is necessary to modify the hours of permitted parking in several of the municipal parking fields, and to establish a Downtown Resident Parking Permit to address the increased off-street parking demands created by the downtown residential revitalization of the village. Section 2. §172-2 of the Code of the Village of Amityville is hereby amended to read as follows: §172-2 Authority of Police Chief The Chief of Police is hereby authorized and directed to designate in the public streets and municipal parking fields of the Village such areas for safety zones, handicapped parking spaces, bus, cab or taxi stands, fire hydrant zones, driveway and other non parking zones and areas for employee parking and permit parking, as in his discretion, may be required by the interests and convenience of the public, and shall cause such zones, stands and spaces to be marked in a suitable manner to indicate the appropriate uses thereof." Section 3. §172-39 of the Code of the Village of Amityville is hereby amended to read as follows: §172-39 Parking Permits 12  Board of Trustees Minutes August 24, 2020 A. Municipal Parking Fields No. 1, No. 2 and No. 8, except as to that portion thereof in which parking meters are installed are hereby designated as parking fields where vehicles shall be permitted to park only after procuring a parking permit as hereinafter provided, except that vehicles without such permits shall be permitted to park in Field No 8 for up to four (4) hours during the hours from 6:00 am to 6:00 pm. B. There is hereby established a Downtown Resident Parking Permit to be issued to a village resident actually occupying a residential dwelling unit located on Broadway (NYS Rt. 1 10) between Avon Place and Railroad Avenue on the following conditions: 1. The applicant for the permit must provide proof of current residency within the designated area. 2. No more than one (1) permit will be issued per person and no more than two (2) permits per dwelling unit, regardless of the number of persons residing therein. 3. Downtown Permit parking shall be restricted to the designated areas in Municipal Parking Fields 3, 4, 5 9, 10, 11 and 14, and shall be open to permit holders on an "as available" basis. Permittees parking in non-designated areas shall be subject to the hourly limits which apply to the general public." Section 4. §172-40 of the Code of the Village of Amityville is hereby amended to read as follows: §172-40. Issuance and display of parking permits All parking permits shall be issued by the Village Clerk based upon a showing of proof of residence and ownership of the vehicle for which a permit is sought. The Clerk shall issue a numbered permit indicating the year for which the same shall be issued, and such permit shall be conspicuously displayed on said vehicle." Section 5. §172-41 of the Code of the Village of Amityville is hereby amended to read as follows: "§ 172-41. Fees for parking permits. A. Residents. The annual fee for each parking permit issued hereunder to the residents of the Village shall be established by the Board of Trustees by resolution. The fee for each half-yearly permit, which may be applied for on or after August I shall be established by the Board of Trustees by resolution. B. Nonresidents. The annual fee for each parking permit issued hereunder to a nonresident of the Village for Municipal Parking Fields No. l, No. 2 and No. 8 shall be established by the Board of Trustees by resolution. The fee for each half-yearly permit for a nonresident which may be applied or on or after August 1 shall be established by the Board of Trustees, by resolution. Section 6. §172-42 of the Code of the Village of Amityville is hereby amended to read as follows: §172-42. Section 8. §172-44 of the Code of the Village of Amityville is hereby amended to read as follows: §172-44 Replacement of lost and mutilated permits A parking permit issued hereunder shall be kept by the permittee in the approved location in good condition, and if such plate, tag or sticker becomes lost or mutilated, the permittee shall immediately secure a new permit from the Village Clerk upon the payment of an additional fee as set forth by the Board of Trustees. Trustee O’Neill explained the law would standardize the parking regulations which vary from lot to lot and provide a limited number of permit parking spaces to residents of buildings in the downtown business district (including the old movie theater building at 221 Broadway, soon to be developed).The parking law would also accommodate employee parking for businesses in the various downtown lots. The plan is being modeled after the Village of Babylon. The plan is a starting point, Trustee O’Neill said, and Deputy Mayor Smith agreed, saying we can modify the plan based on the comments we get. Building Inspector Donato noted this is a good time to enact the parking law to be prepared for new businesses. A letter was read from Annette Drago, the owner of Wrapping It Up, a business on Park Avenue, asking to have permitted parking behind her store, to ensure parking for staff and customers. Janet Colletti, 17 Wellington Place, spoke vehemently against the parking law and claimed that the Village misled the people of Amityville about parking needs/available parking as it relates to upcoming residential developments. She suggested a parking garage be constructed. Joan Donnison, Bay Village Civic Association, 150 S. Ketcham Ave. asked the Board to ensure ample parking for events like the Farmer’s Market. She also asked about parking fees. Kirk Hurme, Amityville Wellness, 108 Ocean Ave. and 209 Broadway expressed concern that the law neglects business owners and that attention should be paid to businesses such as his that are open beyond 9 AM – 5 PM. He would need 12-15 parking spaces for clients and staff, 6 days a week. Right now they park along the fence nearest to St. Martin’s lot. Mayor Siry pointed out the plan is to find a solution that works for everyone and the Board will be speaking with business owners to get their opinions. Jack and Debbie Magnani, 75 Meadow Lane: Mr. Magnani told the Board he is concerned for his family’s safety and wellbeing because of the activity he has seen from boaters at the marina. He questioned the approval process for marina expansion, specifically with the DEC and Army Corps of Engineers and asked if the Village Code prohibits overnight stays on boats. He also stated the manager of the marina, Todd Brice, is a member of the Village Zoning Board. Al Strollo, 84 New Pointe Place, said he spoke to two representatives of the DEC. He also commented that a recent oil leak from a boat in the marina posed a threat to children swimming. Village Attorney Bruce Kennedy stated that the marina project has received DEC approval, and Deputy Mayor Smith read a DEC permit approving construction of the finger slips. Mayor Siry said the property manager is willing to remedy problems with individual renters of slips, the police department is monitoring and addressing quality of life issues, and the Mayor is in touch with the DEC and Army Corps of Engineers concerning the matter. Building Inspector Bryan Donato stated the Village Code has no overnight stay restrictions. He noted that the property owner must go before the Planning Board (pending filing of an application). Lisa Strollo, 80 New Pointe Place, read a communication from the Army Corps of Engineers for a proposed bulkhead project in 1988. She pointed out that the document called for public and Village commentary, however, Mayor Siry suggested procedures may have changed. Mayor Siry and the Trustee O’Neill reassured the residents that their concerns have been heard and the Board is reaching out to get additional clarity on the issue, however, it appears the project has appropriate DEC approval. There being no further comments, Mayor Siry called for the meeting to be adjourned.
