Mayor Siry welcomed everyone to the October 26th Meeting of the Board of Trustees, conducted via Zoom Meeting. Mayor Siry noted that November 3rd is National Election Day and invited Deputy Mayor Smith to share any other upcoming events. He reported on the following: • Department of Public Works Leaf pick up starts Nov. 2nd. See the schedule on the Village website Amityville.com. Reminder – do not put trash or leaves out prior to 24 hours before the scheduled pick up. • Bay Village Civic Association’s Shredder Event takes place on Nov. 7th at the 9/11 Park on Broadway. • A Veterans Day Service will be hosted by the village and the John J. Kreyer VFW Post at the gazebo on Broadway, Wednesday, Nov. 11 at 11 a.m. • Kiwanis Field of Honor – check the Village website for information and to purchase a flag that will be displayed in honor of a loved one/veteran. Mayor Siry added that discussions are underway about the Village Tree lighting, which might need to be done virtually this year due to the Covid pandemic. Department of Public Works (Trustee O’Neill): repairs were made to the gazebo at Peterkin Park (due to vandalism); continued to clear parrot feather vegetation in Avon Lake; stump removal and tree trimming; winterizing of beach area and maintained softball and soccer fields; potholes repaired; rebuilt AFD vehicle for Quality of Life use; signage repairs and replacement; clearing vegetation around LIRR station; cleanup performed for the Building Dept.; installed portraits of Mayor and APD Chief in Village Hall; dumped yard waste; removed/returned hanging flower baskets; coordinated HVAC inspections, and performed streetlight repairs. He noted that the damaged wood chipper is back in service. Justice Court (Trustee Bernius): Grand total reported to the state $22,287.00 ($13,722.00 Village Justice; $2,650.00 Assoc. Village Justice; $5,915.00 Parking Violations). Penal/Criminal, Vehicle & Traffic, and Village Ordinances: 216 charges processed, 111 charges closed out, $16,372.00 collected in fines and surcharges. Parking: 123 tickets written; 69 tickets collected on; $5,915.00 collected in fines and surcharges. Building Department (Deputy Mayor Smith): Revenue: $23,943.00; 25 Permits Issued, 20 Permits closed; 30 Inspections Performed, 28 Notices of Violation issued; 15 Violations corrected, 4 Fire Safety Inspections, responded to 1 Callout. Amityville Police Department (Deputy Mayor Smith): For the month of September - 11 Arrests, 469 blotters, 48 cases, 203 citations, 3 impounds, 81 medical aided and 26 traffic accidents. Chief Burton reported that the Ragamuffin Parade was a success, and Mayor Siry thanked APD for maintaining control. Mayor Siry also advised there will be a Police Policy Reform Committee convening on Thursday with the following members: Mayor Siry, Deputy Mayor Kevin Smith, APD Chief Burton, APD Sgt. Frank Caramanica, Dr. Terry Fulton, John Diliberto, Rev. Geminder, and Thomas Goddard. They will be working on a plan which must be completed by April 9th, 2021. Fire Department (Chief Waegerle): The department is averaging three calls per day (fire/rescue) which is higher than last year’s volume. Mayor Siry requests that applicants be visited by Building Inspector one month in advance of a Board vote to remediate problems prior to rendering a decision. Trustee O’Neill asked about the blue shack near the building, which Mr. Giambrone explained is a food trailer that he has been working on for several years. NOW THEREFORE BE IT RESOLVED AS FOLLOWS 1. Resolution No 18-11-26-01 is hereby amended as follows: A. Paragraph 1(a) of said resolution shall provide for a maximum of 117 units instead of 115 units. 8  Board of Trustees Minutes October 26, 2020 B. Paragraph 2(b) of said resolution shall provide that said building shall be utilized as two (2) apartments rather than office space with the Village to receive $3,000 per month for twenty (20) years from the rent for such units. 2. All other terms and conditions of Resolution 18-11-26-01 shall remain in full force and effect. This Resolution shall be effective immediately. RESOLUTION No. 18-11-26-01 Approving certain zoning incentives for Greentek Living, LLC and R & S Realty Corp. WHEREAS the Board of Trustees of the Village of Amityville approved the application of Greentek Living, LLC and R & S Realty Corp. to re-zone the premises known as 235 County Line Rd. and 124 Greene Ave., Amityville, N.Y. also known as SCTM 101-3-3-26.1 and 26.2 from Industrial District to Transit-Oriented District, and WHEREAS said applicants duly requested certain zoning incentives as authorized by the Code of the Village of Amityville in consideration for certain proposed benefits and amenities to benefit the Village of Amityville, and WHEREAS a public hearing was duly held on said application including the proposed zoning incentives and the corresponding benefits and amenities, and WHEREAS pursuant to said Code, the applicants duly applied to the Planning Board of the Village of Amityville for site plan approval of their proposed project, and WHEREAS said Planning Board duly approved such site plan application after a public hearing thereon, and has recommended that the Board of Trustees approve the requested zoning incentives in consideration of said proposed benefits and amenities as required by the Code. NOW THEREFORE BE IT RESOLVED AS FOLLOWS: l. The Board of Trustees hereby approves the following zoning incentives in connection with the proposed project submitted by applicants at 235 County Line Rd. and 124 Greene Ave., Amityville, N.Y. in accordance with the site plan approved by the Planning Board of the Village of Amityville dated November l, 2018 pursuant to §183-66.10 of the Code of the Village of Amityville: 9  Board of Trustees Minutes October 26, 2020 a) Increase the density of units from 35 to 48 units per acre for a total of not more than 1 15 units b) Increase the maximum height of a portion of the proposed building as shown on the plans approved by the Planning Board to not more than four (4) stories and a height of not more than forty-eight (48) feet. 2. In consideration for the approval of said zoning incentives, applicants shall provide the following community benefits and amenities at their expense to the satisfaction of the Board of Trustees: a) Restore and preserve the building known as the Amityville Power and Light Building at 235 County Line Rd., Amityville, N.Y. b) Rent said building for office space and pay the Village of Amityville the sum of $3,000 per month from said rent for a period of twenty (20) years ($720,000 total), commencing upon the completion of the restoration. c) Contribute the sum of $150,000 toward the cost of establishing a pedestrian walkway from the LIRR station to Broadway (Rt. 110). d) Contribute the sum of $25,000 to the Amityville Fire Department for general purposes. e) Contribute the sum of $50,000 to the Village to upgrade and improve the 9/11 Memorial at the main firehouse. f) Install the enhanced architectural facade treatments on the proposed building as shown on the plans approved by the Planning Board. 3. Applicants shall make the monetary contributions other than the rent payments as follows: a) $112,500 on or before six (6) months from the date of issuance of the building permit b) $112,500 on or before one (l) year from the date of issuance of the building permit, and in any event on or before the issuance of a final certificate of occupancy. 4. Applicants shall complete said amenities prior to the issuance of a final certificate of occupancy for the proposed project. This Resolution shall be effective immediately. MOTION to APPROVE was made by Trustee O’Neill and seconded by Deputy Mayor Smith Vote on Motion: Mayor Siry aye Deputy Mayor Smith aye Trustee Bernius aye Trustee O’Neill aye Motion Carried: 4 aye 0 nays 10  Board of Trustees Minutes October 26, 2020 Local Laws Introductory Local Law No. 1 of the year 2020, a local law to modify the parking limits in certain Municipal Parking fields and to establish a Downtown Resident Parking Permit Introductory Local Law No. 1 of the year 2020 A local law to modify the parking limits in certain of the Municipal Parking Fields and to establish a Downtown Resident Parking Permit. Be it enacted by the Board of Trustees of the Village of Amityville as follows: Section 1. The Board of Trustees finds that it is necessary to modify the hours of permitted parking in several of the municipal parking fields, and to establish a Downtown Resident Parking Permit to address the increased off-street parking demands created by the downtown residential revitalization of the village. Section 2. §172-2 of the Code of the Village of Amityville is hereby amended to read as follows: "§172-2 Authority of Police Chief The Chief of Police is hereby authorized and directed to designate in the public streets and municipal parking fields of the Village such areas for safety zones, handicapped parking spaces, bus, cab or taxi stands, fire hydrant zones, driveway and other non parking zones and areas for employee parking and permit parking, as in his discretion, may be required by the interests and convenience of the public, and shall cause such zones, stands and spaces to be marked in a suitable manner to indicate the appropriate uses thereof." Section 3. §172-39 of the Code of the Village of Amityville is hereby amended to read as follows: "§172-39 Parking Permits A. Municipal Parking Fields No. 1, No. 2 and No. 8, except as to that portion thereof in which parking meters are installed are hereby designated as parking fields where vehicles shall be permitted to park only after procuring a parking permit as hereinafter provided, except that vehicles without such permits shall be permitted to park in Field No. 8 for up to four (4) hours during the hours from 6:00 am to 6:00 pm. B. There is hereby established a Downtown Resident Parking Permit to be issued to a village resident actually occupying a residential dwelling unit located on Broadway (NYS Rt. 110) between Avon Place and Railroad Avenue on the 11  Board of Trustees Minutes October 26, 2020 following conditions: 1. The applicant for the permit must provide proof of current residency within the designated area. 2. No more than one (1) permit will be issued per person and no more than two (2) permits per dwelling unit, regardless of the number of persons residing therein. 3. Downtown Permit parking shall be restricted to the designated areas in Municipal Parking Fields 3, 4, 5 9, 10, 11 and 14, and shall be open to permit holders on an "as available" basis. Permitees parking in non-designated areas shall be subject to the hourly limits which apply to the general public." Section 4. §172-40 of the Code of the Village of Amityville is hereby amended to read as follows: "§172-40. Issuance and display of parking permits. All parking permits shall be issued by the Village Clerk based upon a showing of proof of residence and ownership of the vehicle for which a permit is sought. The Clerk shall issue a numbered permit indicating the year for which the same shall be issued, and such permit shall be conspicuously displayed on said vehicle." Section 5. §172-41 of the Code of the Village of Amityville is hereby amended to read as follows: "§ 172-41. Fees for parking permits. A. Residents. The annual fee for each parking permit issued hereunder to the residents of the Village shall be established by the Board of Trustees by resolution. The fee for each half-yearly permit, which may be applied for on or after August 1 shall be established by the Board of Trustees by resolution. B. Nonresidents. The annual fee for each parking permit issued hereunder to a nonresident of the Village for Municipal Parking Fields No. 1, No. 2 and No. 8 shall be established by the Board of Trustees by resolution. The fee for each half- yearly permit for a nonresident which may be applied or on or after August 1 shall be established by the Board of Trustees, by resolution." Section 6. §172-42 of the Code of the Village of Amityville is hereby amended to read as follows: "§172-42. Issuance of half-yearly permit No half-yearly permit hereunder shall be issued, either to a resident or to a nonresident, before August 1 of each year." Section 7. §172-43 of the Code of the Village of Amityville is hereby amended to read as follows: "172-43. Transfer of parking permit. 12  Board of Trustees Minutes October 26, 2020 A parking permit issued hereunder shall not be transferable from one vehicle to another; provided, however, that in the event that a permitee shall sell or transfer his motor vehicle during the year, such permit may be transferred to any other motor vehicle owned or leased by said permitee upon payment of an additional fee as set by resolution of the Board of Trustees." Section 8. §172-44 of the Code of the Village of Amityville is hereby amended to read as follows: "§172-44 Replacement of lost and mutilated permits A parking permit issued hereunder shall be kept by the permitee in the approved location in good condition, and if such plate, tag or sticker becomes lost or mutilated, the permitee shall immediately secure a new permit from the Village Clerk upon the payment of an additional fee as set forth by the Board of Trustees." Section 9. §172-45 of the Code of the Village of Amityville is hereby amended to read as follows: "§ 172-45. Commercial vehicles prohibited in municipal parking fields. No commercial vehicle with a gross weight in excess of 10,000 pounds shall be permitted to park in a municipal parking field." Section 10. §172-46 of the Code of the Village of Amityville is hereby amended to read as follows: "172-46. Separate Permits required. Each motor vehicle occupying an area in a parking field for which a permit is required hereunder shall have an individual and separate permit" Section 11. §176-63 of the Code of the Village of Amityville is hereby amended to read as follows: "§172-63. Schedule XVI: Municipal Parking Fields. The Mayor reiterated that this is not under the jurisdiction of the Board of Trustees but advised that the owner would be going to Court for a property violation. Both he and Trustee Bernius advised Ms. Magnini to contact the Justice Court for more information. Ms. Magnani asked when in-person Board meetings would resume, to which Mayor Siry said while he would like to see in person meetings, it may be a while if Covid cases continue to rise. Mayor Siry also provided residents with an update of his conversation with a representative of the Army Corps of Engineers concerning the matter. The Village is awaiting their final report, which will determine if the marina poses any navigational issues. Al and Lisa Strollo, 84 & 80 New Point Pl., questioned the status and procedure for approving Bayside Marina’s finger slips and asked if an impact study would be performed concerning traffic and oil spills. The Mayor reminded Mr. Strollo that the marina has received a DEC permit and the owner has improved the property. Mayor Siry reminded him that the property has been approved for marine use for at least 40 years and was once a boatyard and gas dock. Mr. Strollo posed to the Mayor several statements to be fact-checked for an ad to be placed in the newspaper. After discussion, Mayor Siry and Trustee O’Neill asked Mr. Strollo to send the information to the Mayor for verification prior to publication. Building Inspector Bryan Donato reiterated that the Board of Trustees does not have jurisdiction over bulkheads or views of the bay. Trustee O’Neill also commented that the Board represents residents and businesses alike and that he understands the residents’ frustration. He reiterated that the Village needs to see the findings of the Army Corps’ report are before a course of action can be recommended. Janet Colletti, 17 Wellington Pl., asked about the Municipal Parking Law and called for the enforcement of parking laws in municipal lots, especially near the Citibank. It was explained to her that this is exactly what the law is intended to accomplish. Mayor Siry stated this is a good first step in managing parking in the Village and changes can be made in the future if needed.
