Board of Trustees Minutes June 14, 2021 Meeting called to order at 7:30 p.m. MEMBERS PRESENT: Mayor Dennis Siry, Deputy Mayor Kevin Smith, Trustee Whalen, Trustee O’Neill, Trustee Brooks ALSO PRESENT: Village Attorney Bruce Kennedy APD Chief Bryan Burton AFD Assistant Chief Gavin Budde Superintendent Bruce Hopper Building Inspector Gregg Doerner Clerk/Treasurer Catherine Murdock Assistant to the Mayor Wendy O’Neill Mayor Siry welcomed everyone to the Board of Trustees meeting and invited Chief Bryan Burton to conduct the Pledge of Allegiance. Good News & Upcoming Community Events Deputy Mayor Smith shared upcoming dates: • The Bay Village Civic Association will again host the Farmer’s Market on Saturdays, starting on June 12th through October 9th, 9 a.m. to 1 p.m. • The Village will host a free “theater in the park” performance of Romeo and Juliet on July 18th at 5 pm. down at James A. Caples Park at the Amityville Beach. • Concert at the Beach – features Radio Flashback on July 24th, at 8 p.m. • We are having a Village July 4th Parade. For information or to register to march contact Village Hall or Roger Smith. • Junior League is presenting their scholarship winner this week to an accomplished student • Town of Babylon will again conduct the Wounded Warrior Ride (with only veterans riding) on July 16th. All are encouraged to welcome them and cheer them on (the ride starts at 9 a.m. at Town Hall and comes down Broadway via Oak Street. • The dredging project has started on Ketcham’s Creek and we are happy that will alleviate a navigational hazard • Kiwanis is having a pitch and putt golf tournament at Cedar Beach and you can call a Kiwanian or show up that day; they will also hold a “Show Me The Money fundraiser on July 22nd at the Village Beach. • The Historical Society will be opening the Museum soon. Mayor Siry requested Committee Reports for the month of May DPW (Trustee O’Neill): • We are in full swing for spring/summer and the beach has been prepped for the season. • Hanging baskets and sidewalk planters are in; DPW worked closely with the Parks Commission. Superintendent Hopper has asked the businesses and homeowners to help us keep the planters around their businesses and homes watered, especially on the hot days. • Performed two clean ups and one board-up for the Building Department • Planted nine (9) additional trees throughout the Village • Cleaned the south pavilion kitchen and north pavilion refrigerators and disposed of nonworking appliances. • Disposed of 43.0 tons C& D, 6.58 tons of yard waste and 6.32 tons of municipal waste • Supplied barricades for a funeral last Saturday. • Weeding the tree wells, pruning, and trimming 1 Board of Trustees Minutes June 14, 2021 • Assisted the electrician for the LIRR viaduct lighting • Performed streetlight repairs, painting decorative lamp posts, and performing street sweeping daily • Maintained the ballfields – they are ready for play • Planted trees, bushes and plants for the PD/Fireman’s Park (Graziano Park) on the south side of Oak St. Special thanks to Trustee Smith for coordinating the upgrades. The park had been languishing. • Assisted the HVAC technician at Village Hall – the well will need cleaning and the heat exchanger will need to be replaced and a back-up unit should be repaired. • Disposed of one surplus vehicle, and in the process of disposing of a second vehicle. Fire Department: Report be delivered at future meeting. Village Beach (Trustee Brooks): • Employee Orientation is on June 22nd • Swimming and sailing program sign-ups are at 3:30 p.m. on June 23rd and on June 28th & 29th at the beach. • The beach opens on June 26th and everyone is excited about getting back to a normal season. • Mayor Siry added that as of now, Lu’s Deli will operate the beach food concession and there will be music on Wednesday nights during the summer. Justice Court (Trustee Brooks): Grand total for May 2021 reported to the State $29,892.00; Village Justice $19,551.00; Associate Village Justice $4,116.00; Parking Violations $6,225.00. Penal/Criminal, Vehicle & Traffic, and Village Ordinances: 171 charges processed by the office; 201 charges closed; $23,667.00 collected in fines and surcharges. Parking: Tickets processed by the office, 73; tickets collected on, 53; and $6,225.00 collected in fines and penalties. The New York State Unified Court System offered a few webinars for Justice Court Clerks. On May 11, the Clerks attended the virtual 2021 Impaired Driving webinar, which was an update of DWAI’s and the correct procedures of handling traffic tickets. The series also touched on the legalization of recreational marijuana. Further, on May 21, 2021, the Clerks virtually attended the “Right to Drive” webinar, which outline the major provisions of the driver’s license suspension reform bill and touched on provisions, which are set to take place as of June 29, 2021. Parking: Tickets processed by the office; tickets collected on,; and $collected in fines and penalties. Amityville Police Dept. (Deputy Mayor Smith): May Arrests 7, blotters 446, cases 40, citations 149, field interviews 2, impounds 1, medical aided 66, and traffic accidents 16. Building Dept. (Trustee Whalen): Report to be delivered at future meeting. 2 Board of Trustees Minutes June 14, 2021 Mayor Siry then announced that denial of an application for Storage of Trailer by Michelle Hawley of Riverside Ave. has been nullified since after further review -- and being informed that the trailer is under 30 feet -- the permit is not required in accordance with of the Village Code, Section 166-2. Mayor’s Actions: Request to approve Board of Trustees Minutes from the May 24th Board of Trustees Meeting Mayor Siry recused himself from the vote due to his absence at the May 24th meeting. He questioned the Board’s prior comments about the matter. Debbie Magnani, 75 Meadow Lane, said the marina has increased traffic and noise, and asked why nothing has been done. Mayor Siry replied there is a Court case in progress and the Board cannot comment on that at this time. Trustee O’Neill recommended that she call the Police Department if she hears any loud noises or disturbances and file a complaint. Donnelle Cronin, 32 Mole Place, asked if the Article 78 decision has been rendered for Security Dodge’s use of property on Merrick Rd. which she said is now being cleared. Mayor Siry reported that the Village was just notified of the decision, which is in favor of the Village. It validates that the Board of Trustees was within its rights to grant a Special Use Permit, he said, and the dealership can now put in a service station.
