BOARD OF ZONING APPEALS MINUTES February 6, 2008 MEMBERS PRESENT: PETITION #3A-08 Submitted by Ed Martin Chevrolet, Rudy Williams, President Cadillac, Toyota and Ken Montgomery Harold Smith, Vice President Connie Klungness, Member for a Variance from the Lot Coverage Greg Spencer, Member Requirement. MEMBERS ABSENT: PETITION #3B-08 Submitted by Ed Martin Chevrolet, Willie Rayford, Member Cadillac, Toyota and Ken Montgomery for a Variance from the Maximum OTHERS PRESENT: Allowable Parking Spaces. Michael Widing, Development Director Tim Stires, Assistant Development Director PETITION #3C-08 Amber Lewis, Acting Board Secretary, Submitted by Ed Martin Chevrolet, Dave Wilbur, Sr. Zoning Administrator, Cadillac, Toyota and Ken Montgomery Stephanie George, Zoning Administrator; and for a Variance from the Sideyard Setback William C. Kreegar, Assistant City Attorney Requirement. ROLL CALL AND DECLARATION OF A Mr. Stires started the meeting with Petition QUORUM: #1-08 submitted by Stratman I, LLC. The petitioner is seeking Special Exception Mrs. Klungness called the meeting to order at approval for a Health Clinic, which is located 4:31 p.m. Ms. Lewis took roll call and at 2725 Enterprise Drive. Mr. Stires went on declared a quorum with four members in to explain that this is the former Tree attendance. Mr. Rayford was absent. Climbers Daycare Center, out in the Flagship, which has been closed for several years and is Mr. Williams performed the invocation and a 10,000 sq.ft. building with parking on the the Pledge of Allegiance was recited. north and south sides of the building, contains approximately 1.468 acres and is zoned B-3 MINUTES: Neighborhood Shopping Center. The January 2, 2008 minutes were approved as presented. Motion passed unanimously; 4 yes, 0 no. BUSINESS: PETITION #2-08 PETITION #3-08 Submitted by Benjamin, Bill and Judy Submitted by Ed Martin Chevrolet, Nagengast for a Special Exception for an Cadillac, Toyota and Ken Montgomery Outdoor Commercial Recreational for a Special Exception for an Open Enterprise. Automobile Sales Area. PETITION #2A-08 1 Submitted by Benjamin, Bill and Judy Nagengast for a Variance from the 6 ft. Fencing Where Accessible to the Public Requirement. PETITION #2B-08 Submitted by Benjamin, Bill and Judy Nagengast for a Variance from the No Parking in the Front Yard Requirement. PETITION #2C-08 Submitted by Benjamin, Bill and Judy Nagengast for a Variance from the Hard Surface Parking Requirement located at 925 Anderson-Frankton Road. Mr. Stires explained Petition #2-08, #2A-08, #2B-08, #2C-08 are being submitted by Benjamin, Bill and Judy Nagengast. The petitioners are seeking a Special Exception approval for an Outdoor Commercial Recreational Enterprise.
