Call To Order Chairwoman Finlayson called the meeting to order at 4:21 p.m. 2. Roll Call Present: 3- Finlayson, Savidge and Arnett 3. Approval of Agenda (any changes to the agenda should be made here) This agenda was adopted as amended 4. Business before Committee a. Approval of Minutes RCG101818 Approval of Minutes for the Regular Meeting Alderman Arnett moved to approve. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett 5. Legislation before Committee O-37-18 Ethics Code - Financial Disclosure Updates - For the purpose of amending the City of Annapolis Ethics Code definition of “official”; including Housing Authority of the City of Annapolis (“HACA”) officials in the financial disclosure reporting requirements applicable to City employees and appointed officials; removing obsolete language concerning the financial disclosure reporting of HACA officials; and amending the information required for the examination of a financial disclosure statement. Michael G. Miller, representing the Board of the Housing Authority of the City of Annapolis, and JIm Dozeall, representing the Ethics Commission were present and answered questions from the committee. Assistant City Attorney Elson was present and answered questions from the committee. Alderman Arnett moved to recommend favorably. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett O-27-18 Forest Conservation - No Net Loss - For the purpose of amending the Code of the City of Annapolis concerning reforestation and other forest conservation measures to maintain the City’s current tree canopy percentage. Planning and Zoning Director Gutwald, and Office of Environmental Policy Director Guild, were present and answered questions from the committee. Alan Hyatt, 200 Westgate Circle was present and addressed the committee. Alderman Arnett moved to recommend favorably. Seconded. The motion CARRIED by the following vote: Aye: 2- Savidge and Arnett Nay: 1- Finlayson CA-1-18 Acting Mayor Designation - For the purpose of amending the procedure for designating an Acting Mayor. Assistant City Attorney Elson was present and answered questions from the committee. Alderman Arnett moved to recommend unfavorably. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett O-8-18 Adequate Public Facilities - Adequate School Facilities - Standards - For the purpose of amending the test for additional school capacity by requiring schools with enrollment greater than ninety five percent of the State-Rated Capacity to be listed as closed on the annual school utilization chart; and matters generally relating to adequate school facilities. No action taken O-19-18 2018 Zoning Code Updates and Amendments - For the purpose of updating and amending the zoning code by eliminating the restriction on existing lot width or area for variance applications; removing the “finished side out” fence installation requirement; removing the retail and/or office requirement for multi-family residential projects in the BCE zoning district; removing the sign permit application requirement outside of the Historic District; extending the time-period for displaying exempt temporary community, civic, or public interest signs from sixty to ninety days; permitting free-standing signs in certain zoning districts; removing the minimum lot width requirement for freestanding signs in certain zoning districts; removing obsolete language; and matters generally relating to updating and amending the zoning code. Alderman Arnett moved to approve the following amendment(s): Amendment No. 1: Page 3, line 1 unstrike paragraph B.; line 3-4 strike sentence beginning with “Suitability.”; line 5 unstrike paragraph “C.”; line 5, after “Surrounding Properties.” strike “The proposed adjustment”; substitute with “If a specific use is proposed, the applicant shall demonstrate that the proposed use”; line 8 after “neighborhood.” insert “If a specific use is not proposed, the applicant shall demonstrate the suitability of the property in question to the uses permitted under the proposed zoning classification.”; restore sequential lettering of D and E accordingly. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Alderman Arnett moved to approve the following amendment(s): Amendment No. 2: Page 3, line 23 after “or lots” insert “for a building or structure erected prior to City of Annapolis Page 2 Rules & City Government Standing Committee Minutes November 13, 2018 Committee August 10, 1970”; line 23-24 unstrike “However, for buildings or structures erected after August 10, 1970, the respective area and width of the lot or lots shall not be less than eighty percent of the required area and width.”; line 23 after “However,” insert “for buildings or structures erected after August 10, 1970,” Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Arnett moved to approve the following amendment(s): Amendment No. 3 Restore original language for Sections 21.38.030 and 21.44.030 (from page 3, line 40 to page 9, line 30). These sections will not be included in the ordinance at this time. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Alderman Arnett moved to approve the following amendment(s): Amendment No. 4 Page 10, line 20, restore original language. On line 23, after “wall,” insert, “Where there are practical difficulties, such as the particular physical surroundings, shape, or topographical conditions of the specific property or other existing conditions where strict compliance with the standard is unreasonable, the Director of Planning and Zoning may waive this requirement.” Restore sequential lettering of H. through L. accordingly. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Alderman Arnett moved to approve the following amendment(s): Amendment No. 5 Page 11, line 34, restore original language. On line 36 after “floor” add “if there is direct access and frontage along a principal arterial, minor arterial, or collector road. If there is no access and frontage along such a road, retail and/or office use is not required. Restore sequential numbering of 2. through 10. accordingly. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Alderman Arnett moved to approve the following amendment(s): Amendment No. 6 Restore original language for Sections 21.70.030, 21.70.060, and 21.70.080 (from page 15, line 29 to page 25, line 18). These sections will not be included in the ordinance at this time. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: Aye: 3- Finlayson, Savidge and Arnett Planning and Zoning Director Gutwald, Comprehensive Planner Dr. Nash, and Assistant City Attorney Elson were present and answered questions from the committee. Maryann Dillon, representing Housing Initiative Partnership, 6525 Belcrest Road, Hyattsville, MD 20782, was present and addressed the committee. Alderman Arnett moved to recommend favorably with amendments. Seconded. A roll call vote was taken. The motion CARRIED by the following vote: City of Annapolis Page 3 Rules & City Government Standing Committee Minutes November 13, 2018 Committee Aye: 3- Finlayson, Savidge and Arnett O-34-18 Demolition by Neglect - For the purpose of revising the definition of “demolition by neglect” set forth in Chapter 21.56; revising the procedures for investigating a property that may meet the definition of “demolition by neglect”; providing for a review process by the Historic Preservation Commission and a public hearing requirement; providing for an appeal process; and matters generally relating to demolition by neglect. No action taken This Ordinance was postponed R-46-18 Application of the City of Annapolis Stormwater Regulations - For the purpose of expressing the desire of the City Council that the City apply more than the minimum stated in our stormwater code in accordance with this resolution. No action taken This Resolution was postponed 6.
