CALL TO ORDER Mayor Serdy called the meeting to order at 7:02 p.m. B. INVOCATION AND PLEDGE OF ALLEGIANCE Vice Mayor Wilson gave the invocation and Councilmember Schroeder led the meeting attendees in the Pledge of Allegiance. C. CONSENT AGENDA Vice Mayor Wilson moved, seconded by Councilmember Evans that the consent agenda be accepted as presented. 1. 19-265 Consideration of acceptance of agenda. City of Apache Junction, Arizona Page 1 City Council Meeting Meeting Minutes June 18, 2019 The agenda was accepted. 2. 19-266 Consideration of approval of minutes of regular meeting of June 4, 2019. The minutes were approved. 3. 19-264 Consideration of approval of a model uniform cable tv and video service license agreement and corresponding application. The model uniform cable tv and video service license agreement was approved. 4. 19-271 Consideration of approval of the City of Apache Junction's Public Safety Personnel Retirement System (PSPRS) Pension Funding Policy. The Apache Junction's Public Safety Personnel Retirement System Pension Funding Policy for Fiscal Year 2019-2020 was approved. 5. 19-280 Consideration of approval of Resolution 19-19 for an intergovernmental agreement with Maricopa County for Geographic Information Systems (GIS) data sharing. The intergovernmental agreement with Maricopa County for Geographic Information Systems (GIS) Data Sharing was approved. E. AWARDS, PRESENTATIONS AND PROCLAMATIONS 6. 19-238 Recognition by the mayor and city council of individuals and/or organizations who have made donations to support city activities, programs and projects. Recipients may wish to make comments on their donation. Mayor Serdy and the city council recognized individuals and organizations who have made donations and contributions to support city activities, programs and projects. Development Services Program Coordinator Fox Young introduced Dana Cannizzaro, incoming president of the Friends of Apache Junction Board and announced that in 2019, donors gave more than $40,000 to support the community. He then announced several of the organizations and community members that included: - The Apache Junction Mounted Rangers - Golden Vista RV Resort, - American Legion Post 27, - Mr. and Mrs. Stosel, - Marianne Kelly and Charles Iverson - Philip Hinds - The Lost Dutchman Kennel Club - The Paws and Claws Care Center which received donations from Dennis and Dawn Douglass, Henry and Mary Jo Duilus, Rhietta Enterprises, Elizabeth Magee and Curt Fonger in memory of Marta St. James. F. ANNOUNCEMENT OF CURRENT EVENTS 7. 19-267 Announcement of current events from mayor and councilmembers. City of Apache Junction, Arizona Page 2 City Council Meeting Meeting Minutes June 18, 2019 Councilmember Rizzi reported on a social media request sent out a few months back from Diane Sherman. Diane asked people to send birthday cards to her father who served in World War II and would be turning 96. The Apache Junction community sent 150 cards. Diane sent a post card that had a picture of all the cards sent to him, he was surrounded by boxes and boxes from the post office filled with cards. She announced in partnership with a special needs teacher from Peralta Trail Elementary School, tables will be set up around the community for people to make thank you cards for the fire crews and hot shot volunteers. Announcements as to the date and location where you can find one of these "Pop-Up" events will be sent out on Facebook. Locations so far will be at Shoppers Supply, the AJ Walmart, Gold Canyon Bashas and the AJ Frys grocery store. A card drop-off location will be at Arizona Tireman Services. Councilmember Struble reminded the community that local resident Logan Reichwald will be traveling with fellow teammates to Huron, South Dakota, June 23-29 to compete at the 15th annual National Junior High Finals Rodeo in bull riding. This is his second trip to South Dakota and he asked the community if they could, to support Logan and his family with defraying some of the costs. He also reminded everyone to be careful with their fireworks this 4th of July. The Woodbury fire is quite extensive and extreme caution should be used this holiday. The firework festivities will still be held this year. There will be the Kiwanis booth where you can throw wet sponges at local dignitaries, it is a great fundraising event. Mayor Serdy announced 2022 is the Founder's Day 100th anniversary. There will be a call for local artists to design a logo to memorialize this anniversary. He announced Mediacom has put up special satellite locations to help the fire fighters communicate with each other. These will be stand alone stations in a parking lot. The city will hold its 4th of July festival, but reminded people to use extreme caution, what goes up comes down and is usually on fire. The minimum fine for using illegal fireworks is $1,000 and will be enforced. G. CITY MANAGER'S REPORT 8. 19-268 City manager's report. City Manager Bryant Powell thanked the Friends of Apache Junction. All the work done by the Board and members is volunteer. They have done an outstanding job at raising funds. He announced today was Mayor Serdy's last day serving as Chairman on the Phoenix-Mesa Gateway Airport Board. The Mayor passed the gavel to Gila River Indian Community leader Lieutenant Gov. Robert Stone. He thanked all the firefighters and Hot Shot volunteers for their hard work and efforts in battling the Woodbury fire; and MediaCom for their support in providing extra cell service at the incident command center. The Apache Trail beautification project has kicked off. There will be flyers and outreach to the community for volunteers and donations of various materials needed to complete the project. He then announced the new Executive Director of United Way of Pinal County, Allen Villalobos. City of Apache Junction, Arizona Page 3 City Council Meeting Meeting Minutes June 18, 2019 9. 19-246 Introduction of and discussion with the new Executive Director, Allen Villalobos, of United Way of Pinal County. Mr. Allen Villalobos briefly addressed Council and had Braden Biggs provide a presentation on the programs United Way has participated in here in Apache Junction. He introduced his wife and then introduced Taylor Serdy, one of the Boardmembers for United Way of Pinal County. H. PUBLIC HEARINGS 10. 19-281 Presentation, discussion, public hearing and consideration of approval of proposed Ordinance No. 1476, amending Apache Junction City Code, Volume I, Chapter 3: Administration, Article 3-9: Department of Development Services, by repealing and replacing in its entirety Section 3-9-4, Division of Building Safety and Inspection, repealing any conflicting provisions; and providing for severability. Mayor Serdy read items 10, 11, and 12 since they were all related. City Manager Powell stated staff had prepared some alternative language for Council depending on how they wanted to address various items in Ordinance 1475. Mayor Serdy opened the public hearings. George Schroeder, 2444 W. Virginia St. Apache Junction, inquired about the block wall that is over 6-feet tall along Colorado that was just resurfaced and asked if the resident acquired a permit for the wall. He closed the public hearings. Councilmember Barker moved, seconded by Councilmember Rizzi that Ordinance No. 1476 be read by title only and the reading of the entire ordinance be waived. Acting City Clerk Jennifer Pena read the Ordinance by title only. Councilmember Barker moved, seconded by Councilmember Evans that Ordinance No. 1476 as read by the City Clerk be adopted. Yes: 7- Mayor Serdy, Vice Mayor Wilson, Councilmember Barker, Councilmember Evans, Councilmember Rizzi, Councilmember Struble and Councilmember Schroeder No: 0 11. 19-284 Presentation, discussion and possible consideration of approval of Resolution No. 19-14, declaring as a public record that certain document filed with the city clerk entitled “2019 Amendments to the Apache Junction City Code, Volume I, Chapter 7: Buildings", repealing any conflicting provisions; and providing for severability. Mayor Serdy asked if there was any further comments on Resolution No. 19-14. There were no further comments and Mayor Serdy called for a motion. Yes: 7- Mayor Serdy, Vice Mayor Wilson, Councilmember Barker, Councilmember Evans, Councilmember Rizzi, Councilmember Struble and Councilmember Schroeder No: 0 12. 19-278 Presentation, discussion, public hearing and consideration of approval of Ordinance No. 1475 amending Apache Junction City Code, Volume I, Chapter 7: Buildings, by repealing and replacing in its entirety all articles under Chapter 7 and adopting by reference that certain document entitled "2019 Amendments to Apache Junction City Code, Volume I, Chapter 7: Buildings"; repealing any conflicting provisions; providing for severability; and providing for penalties. Vice Mayor Wilson moved, seconded by Councilmember Barker that Ordinance No. 1475 be adopted and be read by title only and the reading of the entire ordinance be waived. Acting City Clerk Jennifer Pena read Ordinance No. 1475 by title only. Vice Mayor Wilson moved, seconded by Councilmember Rizzi that Ordinance No. 1475 as read by the city Clerk be approved and adopted with the following amendments to incorporate the redline version dated June 10, 2019 in a clean format to be produced by the building official with the following modifications using alternate 2, accept the alternative language for exemptions as presented by staff regarding building permits for fences or block walls not over six fee in height measured at three feet from the exterior side. Fences constructed in Federally Patented easements adjacent to public right-of-way, or across natural drainage ways require zoning review. Motion passed 5 in favor, 2 opposed. COUNCIL DIRECTION TO STAFF 13. 19-285 Council direction to staff on selection of the Pinal County Complex Retention Basin for an off-leash dog park and direct staff to 1) begin the design process, 2) seek grants and other sources to assist in the funding of the project, and 3) begin coordination efforts with Pinal County leadership to update our current intergovernmental agreement for that property. Parks and Recreation Director Liz Langenbach stated at the June 2nd Council meeting the Commission provided a recommendation of using the Pinal County Complex Retention Basin for an off-leash dog park and tonight they are looking for Council's direction to move forward with the chosen site, to seek design options and process, to research grants and other funding options for the park and work with Pinal County in drafting an Intergovernmental agreement for the use City of Apache Junction, Arizona Page 5 City Council Meeting Meeting Minutes June 18, 2019 of that site. Councilmember Barker moved, seconded by Vice Mayor Wilson that direction to staff be given regarding the selection of the Pinal County Complex Retention Basin for an off-leash dog park to: 1) begin the design process, 2) seek grants and other sources to assist in the funding of the project, and 3) begin coordination efforts with Pinal County leadership to update our current intergovernmental agreement for that property. CALL TO PUBLIC Tess Nesser, representing the Apache Junction Chamber of Commerce announced the Chamber will be hosting the annual awards banquet at Roadhaven 1000 S. Idaho Rd. on Thursday, July 27th. The annual award event reflects on the prior year's accomplishments and celebrates the people and businesses in our community that make us an exceptional community. Those honored include small, medium and large businesses, non profits, volunteers, teachers, fire fighters, police officers and professors. These award winners demonstrate community involvement and leadership, committment to customer service, business success and growth, dedication to employees and membership in the chamber. George Schroeder, 2444 W. Virginia St. Apache Junction, stated the improvement to Delaware Drive is great. He expressed concern the street will flood. In response to questions posed to staff in regards to aerial photography Mr. Schroeder stated it has been around for several years and using GIS there are 4 levels various parties can use depending on their access rights.
