PUBLIC COMMENTS – Agenda Items: ONLY - Steve Nikkel Jr, Monica Job, Mike Ferman, Maria Gibson, Sarah Koshinski. CORRESPONDENCE/INFORMATION: Aaron Stevens-Stevens, Kirinovic and Tucker P.C. – Audit report: Auditor Aaron Stevens explained the purpose of the audit in which they make recommendations and express opinions. He reviewed statement of net position, statement of activities, balance sheet, statement of revenues, expenditures and changes in fund balances for year ending March 31, 2017. The township is in a sound financial condition. Fund balances are healthy. April Millsap – Memorial Scholarship: The second annual dog walk will be held on September 23, 2017 at 8:30 a.m. starting at the Memorial Garden. Funds raised will pay for a scholarship, which will be awarded to an Armada High School Senior. Motion CARRIED 1 Armada Township Board Regular Board Meeting Minutes 23121 East Main Armada, MI 48005 September 13, 2017 7:00 p.m. UNFINISHED BUSINESS: None NEW BUSINESS: Fire Dept.: Grant notification – Wildland Fire Apparatus, Recruitment & Retention, Foam and Safer Grant extension: Motion by Swiacki seconded by Finlay to receive and file notification that the Armada Township Fire Department has been awarded $104,762 towards the total purchase price of a new Wildland Firefighting Truck, from the FEMA/Assistance to Fire Fighters grant. Grant also received in the amount of $156,000 for fire recruitment and a $1,000 grant from Enbridge for firefighting foam for liquid fuel fires and an extension to the Safer Grant was approved. Ayes: Smith, Paterek, Finlay, Kanehl, Swiacki Motion CARRIED Swiacki thanked Lieutenant Kevin Kanehl for his work on obtaining several grants this year for the fire department. Total grants for this year are amounts to $271,251. Fire Dept.: Transfer funds from land sale to Capital Outlay and balance to station maintenance: Motion by Swiacki seconded by Finlay that upon closing of said property and the township recovering $2,887.81 that was spent on purchasing the property, less any fees, that the remaining balance be transferred to Capital Outlay for fire department cost of Wildland Apparatus and repairs for fixing the driveway at the fire hall. Ayes: Finlay, Swiacki, Kanehl, Paterek, Smith Motion CARRIED Fire Dept.: Purchase of Wildland Fire Apparatus: Motion by Swiacki seconded by Kanehl to purchase a new Wildland Apparatus, as specified in bid documents, for a cost not to exceed $126,800 from R&R Fire Truck Repair; funded at $104,762 from the FEMA grant received, and the balance of $22,800 from line item – Capital Outlay and to allow fire chief to enter into agreement for purchase. Ayes: Kanehl, Smith, Finlay, Swiacki, Paterek Motion CARRIED Fire Dept.: Advisory Committee: Chief wanted to have public discussion on this. Chief mentioned that Federal Grants are a stopgap measurement and our funding will run out. Developing an advisory committee is where we can discuss the truth and provide clarity by meeting with steak holders and township officials and how to move forward. Chief does not want to suggest who would be on committee. He would like a committee format where the chair can report and make recommendations to the board. Park Ordinance – Amendment: Motion by Swiacki seconded by Paterek to approve ordinance amendment as presented and to publish accordingly. Ayes: Swiacki, Finlay, Paterek, Kanehl, Smith Motion CARRIED Park – Field Permit & Use Agreement: Board discussed usage fees, security deposit amounts and different levels of uses on the field(s). Park Director, Gary Goedtel indicated he has no problems with use of pavilion. Not sure if deposit is necessary. Gary runs an annual schedule of dates for the pavilion and baseball field(s) and has had no real issues. Gary would like to have the long- term use agreement for all organizations. It should include the dates for usage, define use and also request copy of their insurance. Motion by Swiacki seconded by Paterek to postpone until next month’s meeting. Motion CARRIED Skate Park: Clerk stated that the township has paid out our contribution of $100,000 for the skate park. There is an overage of $4,030.96 left to pay on the final invoice. Clerk will review all invoices paid out to find where additional expenses were made and report back next month. Motion by Finlay seconded by Swiacki to postpone payment. Motion CARRIED Friends of Armada – Sign permit & Grant application to Four Counties Community Foundation: Jim Goetzinger submitted an application to the township for a sign hoping that the township may be able to waive the permit fee. Paterek indicated that we could not waive the inspector’s fees, but does not mean we cannot pay for it. We did pay for the skate park building fee. Motion by Paterek seconded by Swiacki to pay up to $250 in permit fees out of park maintenance to install signage, provided Friends of Armada provide proper documentation for their 501(c) (3) status. Ayes: Smith, Kanehl, Finlay, Swiacki, Paterek (Jim indicated would provide the township with copies of the Bylaws for Friends of Armada and 501 (c) (3) paperwork). Grant Application: Motion by Finlay seconded by Paterek to allow Jim Goetzinger permission to pursue the grant with Four Counties Community Foundation for the purpose of the township park. Ordinance complaints: Trustee Finlay stated that documentation received from code official is too vague. Past history indicated that more detailed reports were submitted. The complaint book was also available to the public with all documentation related to the violation. Motion by Finlay seconded by Swiacki that we go back to the original way of putting paper in a file out for the public with all the complaints and status of those complaints. Ayes: Smith, Paterek, Kanehl, Finlay, Swiacki Motion CARRIED Transfer site – Resignation of Wayne Lobeck: Motion by Paterek seconded by Swiacki to accept Wayne Lobeck’s resignation with regrets. Ayes: Smith, Swiacki, Finlay, Kanehl, Paterek Motion CARRIED Dog Kennel: A video from 2013 clearly indicates that there is a violation. A meeting is scheduled for September 22 to meet the owner of the property and his attorney, Building Inspector Mel McNutt, Code Official Mike Klein and Attorney Christine Anderson. Steve Nikkel Jr. is frustrated with how long the process is taking. Clerk Swiacki indicated that she would contact Attorney Christine Anderson on Thursday morning to purse moving forward with circuit court action as directed last month. Motion by Finlay seconded by Swiacki to bypass meeting and go directly into legal action immediately. Ayes: Finlay, Kanehl, Smith, Paterek, Swiacki Motion CARRIED Transfer site: Supervisor will handle until someone is hired. Motion by Paterek seconded by Swiacki to advertise for the position. Ayes: Smith, Kanehl, Paterek, Finlay, Swiacki Motion CARRIED Large item day: Clerk stated that Wayne recommended that we not continue to have large item day. He indicated that there are three dumpsters not two, with room for extra items. The additional cost for large item day is $1,380 for packer with one man; plus $250 for one 30-yard roll off – total of $3,310. Motion by Swiacki seconded by Finlay to suspend October 2017 large item day only. Ayes: Paterek, Swiacki, Smith, Kanehl, Finlay Motion CARRIED Code Official: International Property Maintenance Code: Code official wants us to adopt so he has more authority for addressing issues in our township. Clerk discussed the property maintenance code with Building Inspector Mel McNutt. He recommended that the board not adopt, as it is very restrictive more for large cities. Trustee Finlay stated that we are a farming community and property rights are a big deal and to allow someone just have the right to go on anyone’s land and check things out is not a good idea. No action. Fire Dept.: Emergency repairs – Alpha 2 (not to exceed $1,500). Motion by Swiacki seconded by Paterek to approve emergency repairs not to exceed $1,500.
