RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: SEPTEMBER 26, 2022 Page 1 of 3 ___________________________________________________________________________ The Council of Ashville convened in Regular Session from 6:30 PM to 8:16 PM in the Council Meeting Room at 200 East Station Street, Ashville, Ohio 43103. Mayor Wise the meeting to order with the Pledge of Allegiance and a moment of silence. The following members and visitors were present: Mr. STEVE WELSH Present Mr. NELSON EMBREY Present Mr. ROGER CLARK Present Mr. DAVID RAINEY Present Mr. RANDY LOVELESS Present Mr. MATT SCHOLL Excused EMPLOYEES: Franklin Christman, Greg Sturgill, Brenda Stewart, Jim Welsh and Chief George GUESTS: Patrick Thomas, Daniel & Jennifer Fredrick, Kelly Byrd, Tracee Kirkpatrick, Judson Deskins, Laura Comek, Matthew & Jamie Waters and Lisa Edmondson. MINUTES OF PREVIOUS MEETING: Nelson Embrey moved, seconded by Roger Clark, to approve the September 12, 2022 Regular Session minutes as presented. All votes were yea. PRESENTATIONS: Kelly Byrd of NECO (Neptune Equipment Company) was present to explain how water meters calculate usage. Byrd said that NECO meters go through a series of tests before being shipped out and cannot be shipped out unless they meet the required industry standard. Byrd said that NECO meters have been recongnized as operating with the highest level of accuracy. Byrd was asked if the meter and antenna could have different readings. Byrd said it wasn’t likely. The question was asked if a pressure pump could cause a faulty reading. Byrd said no. Council member Steve Welsh said a resident recently had high usage with usage showing in the middle of the night. Welsh asked if the time could be off on reporting the usage. Byrd said no because readings are recorded every 15 minutes and reported hourly. Roger Clark asked how many meters are returned for testing? Byrd said they test about 20 a year and zero have tested as faulty. Byrd explained that meters are designed to calculate less usage rather than more if they fail. DEPARTMENTAL REPORTS TAX: Nelson Embrey moved, seconded by David Rainey, to approve the Tax Administrator’s monthly report. All votes were yea. POLICE: Chief George reported on the high-speed chase that found its way into Ashville. George said the suspects were spotted coming eastbound into Ashville by way of Main Street at which time he and Sgt. Mayse prepared to stop the vehicle. Sgt. Mayse deployed the stop sticks which flattened three tires rendering the vehicle undrivable. The suspects then fled on foot but after several hours of searching, both suspects were taken into custody. STREET: Greg Sturgill revisited the matter of making a section of Cromley Street one-way. Council agreed to discuss at the next Committee of the Whole meeting. LEGISLATION  RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: SEPTEMBER 26, 2022 Page 2 of 3 ___________________________________________________________________________ ORDINANCES FOR FIRST READING 2022-15 AN ORDINANCE TO AMEND 2000-11 AND 2012-03 TO REFLECT CHANGES IN THE VILLAGE OF ASHVILLE INSURANCE BENEFIT. THIS ORDINANCE DESIGNATES CERTAIN VILLAGE EMPLOYMENT POSITIONS AS ENTITLED TO MEDICAL AND HOSPITALIZATION INSURANCE, AND TO DECLARE AN EMERGENCY. Nelson Embrey moved, seconded by Randy Loveless, to have the First Reading. All votes were yea. After the reading, Nelson Embrey moved, seconded by David Rainey, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings, and adopt as an emergency measure. All votes were yea. 2022-16 AN ORDINANCE TO APPROVE THE APPLICATION OF MARONDA HOMES FOR THE BATES FARMS PLANNED UNIT DEVELOPMENT (PUD) FINAL DEVELOPMENT PLAN AND DECLARING AN EMERGENCY. Nelson Embrey moved, seconded by David Rainey, to have the First Reading. All votes were yea. Franklin Christman introduced Laura Comek from Maronda Homes to field questions about the development. Matthew and Jamie Waters expressed concern about apartments going in across the street from their property and asked if a clause could be put in the ordinance prohibiting low-income or HUD apartments. The Village Administrator said he won’t as it is illegal to do so. The Waters also had concerns about the type of trees that will be planted in the development because they have a horse and certain tree leaves are toxic to horses. Comek reminded residents that the development will be done in phases and many more meetings will be had with changes made before the complete plan is approved. Comek encouraged residents to contact her with concerns or questions regarding the development. After discussions ended, Nelson Embrey moved, seconded by Roger Clark, to accept the First Reading. All votes were yea. RESOLUTIONS FOR FIRST READING 16-2022 A RESOLUTION AUTHORIZING THE MAYOR OR VILLAGE ADMINISTRATOR TO EXECUTE AN AGREEMENT TO COMPLETE PAVEMENT REPAIRS IN THE VILLAGE OF ASHVILLE AND TO EXECUTE CONTRACTS AS REQUIRED. Nelson Embrey moved, seconded by Randy Loveless, to have the First Reading. All votes were yea. After the reading, Nelson Embrey moved, seconded by Roger Clark, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings and adopt. All votes were yea. 17-2022 A RESOLUTION AUTHORIZING THE ASHVILLE MUSEUM CAPITAL IMPROVEMENT PURCHASE FOR THE VILLAGE OF ASHVILLE, OHIO AND DECLARING AN EMERGENCY. Nelson Embrey moved, seconded by David Rainey, to have the First Reading. All votes were yea. After the reading, Nelson Embrey moved, seconded by Randy Loveless, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings, and adopt as an emergency measure. All votes were yea. EXECUTIVE SESSION: At 7:46 PM, Nelson Embrey moved, seconded by Randy Loveless, to go into Executive Session to discuss a legal matter. The meeting resumed at 8:02 PM with the matter being referred to the Utilities Committee. FISCAL OFFICER: Nelson Embrey moved, seconded by Randy Loveless, to approve payment to Xylem for pump rental fees in the amount of $4659.20. All votes were yea. COUNCIL COMMENTS:  RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: SEPTEMBER 26, 2022 Page 3 of 3 ___________________________________________________________________________ Steve Welsh said he had spoken to Pam Ward who complained that parking is still a problem at Cherry Street Diner. Welsh asked why the two-hour parking signs hadn’t been installed. Mayor Wise said installation would be around $3000 and because it illegal to mark tires, we really have no way of enforcing it because it’s a public street. Welsh suggested putting in parking meters. Welsh expressed frustration that it seemed the Village wasn’t supporting the business. Wise agreed he isn’t happy with the parking situation and that we do support the business but unless the neighbor breaks the law, there is nothing the Village can do. At 8:16 PM, Nelson Embrey moved, seconded by David Rainey, to adjourn the meeting. All votes were yea and the meeting adjourned.
