RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: NOVEMBER 7, 2022 Page 1 of 3 ___________________________________________________________________________ The Council of Ashville convened in Regular Session from 6:30 PM to 7:13 PM in the Council Meeting Room at 200 East Station Street, Ashville, Ohio 43103. Mayor Wise called the meeting to order with the Pledge of Allegiance and a moment of silence. The following members and visitors were present: Mr. STEVE WELSH Present Mr. NELSON EMBREY Present Mr. ROGER CLARK Present Mr. DAVID RAINEY Present Mr. RANDY LOVELESS Present Mr. MATT SCHOLL Excused EMPLOYEES: Franklin Christman, Brenda Stewart, Greg Sturgill, Adam Kehoe, Samantha Pemberton, Jim Welsh and Chief George MINUTES OF PREVIOUS MEETING: Randy Loveless moved, seconded by Roger Clark, to approve the October 24, 2022 Regular Session minutes as presented. All votes were yea with the exception of David Rainey who abstained. LEGISLATION ORDINANCES FOR FIRST READING 2022-19 AN EMERGENCY ORDINANCE AMENDING ORDINANCE 2022-08 DECLARING THE IMPROVEMENT OF CERTAIN REAL PROPERTY LOCATED IN THE VILLAGE OF ASHVILLE, PICKAWAY COUNTY, OHIO TO BE A PUBLIC PURPOSE; DECLARING SUCH PROPERTY TO BE EXEMPT FROM REAL PROPERTY TAXATION; DESIGNATING SPECIFIC PUBLIC INFRASTRUCTURE IMPROVEMENTS THAT, ONCE MADE, WILL DIRECTLY BENEFIT THE PARCELS FOR WHICH IMPROVEMENT IS DECLARED TO BE A PUBLIC PURPOSE; REQUIRING ANNUAL SERVICE PAYMENTS IN LIEU OF TAXES; ESTABLISHING A MUNICIPAL PUBLIC IMPROVEMENT TAX INCREMENT EQUIVALENT FUND; AUTHORIZING THE EXECUTION OF A TIF AGREEMENT; PROVIDING RELATED AUTHORIZATION PURSUANT TO OHIO REVISED CODE SECTIONS 5709.40(B), 5709.42, 5709.43, 5709.82 AND 5709.83; AND DECLARING AN EMERGENCY. Steve Welsh moved, seconded by Nelson Embrey, to have the First Reading. All votes were yea. After the reading, Roger Clark moved, seconded by David Rainey, to accept the First Reading. All votes were yea. 2022-20 AN ORDINANCE AMENDING ORDINANCE 2022-07 AND APPROVING THE EXECUTION OF A COMMUNITY REINVESTMENT AREA AGREEMENT BETWEEN THE VILLAGE OF ASHVILLE AND EXEL INC., A MASSACHUSETTS CORPORATION, D/B/A DHL SUPPLY CHAIN (USA), EXECUTION OF A SCHOOL COMPENSATION AGREEMENT WITH TEAYS VALLEY LOCAL SCHOOL DISTRICT AND EXEL INC., REPEALING RESOLUTION 06-2018 ADOPTED JULY 23, 2018 AND TERMINATING THE RELATED AGREEMENTS AND DECLARING AN EMERGENCY. David Rainey moved, seconded by Randy Loveless, to have the First Reading. All votes were yea. After the reading, Nelson Embrey moved, seconded by Steve Welsh, to accept the First Reading. All votes were yea. RESOLUTION FOR FIRST READING  RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: NOVEMBER 7, 2022 Page 2 of 3 ___________________________________________________________________________ 20-2022 A RESOLUTION ADOPTING A STATEMENT OF SERVICES AND A STATEMENT REGARDING POSSIBLE INCOMPATIBLE LAND USES AND ZONING BUFFER FOR A PROPOSED ANNEXATION OF ±55.9126 ACRES OF PARCEL NUMBER D1200010007400 FROM HARRISON TOWNSHIP TO THE VILLAGE OF ASHVILLE AND DECLARING AN EMERGENCY. Roger Clark moved, seconded by Randy Loveless, to have the First Reading. All votes were yea. After the reading, Nelson Embrey moved, seconded by Roger Clark, to accept the First Reading, suspend the Rules of Council, waive the Second and Third Readings, and adopt as an emergency measure. All votes were yea. FINANCE COMMITTEE: Nelson Embrey reported that the Finance Committee met prior to the evening’s Council meeting to discuss the 2023 temporary appropriations. PLANNING & ZONING: Samantha Pemberton reported that Walnut Mills presented a preliminary plat at the last meeting but the committee wasn’t satisfied with the amount of green space. After discussion, P&Z and Walnut Mills reached an agreement for where green space will be added. Pemberton also reported that Stefanie Wharton had been appointed to the Planning & Zoning Committee. COUNCIL COMMENTS: • Steve Welsh suggested trying to pass a street levy or police levy. Welsh said the money the Village gets isn’t enough to keep up with needed street repairs and a levy would provide the Village the ability to maintain the streets and make repairs on a more regular basis. • Roger Clark asked the Village Administrator to send a letter to the elementary school asking staff to not park in the parking spaces designated for park activity. • Nelson Embrey asked if there was an update on the Ashton Woods Village HOA. The VA said he would prefer discussing it at the next Committee of the Whole meeting. Embrey then asked if the fence going up at 11 East Main Street met code. Samantha Pemberton said it does. • David Rainey thanked the Police Department for making their appearance known and a job well done during Trick-or-Treat. At 7:13 PM, Nelson Embrey moved, seconded by Randy Loveless, to adjourn the meeting. All votes were yea and the meeting adjourned.
