RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: MAY 20, 2024 Page 1 of 3 The Council of Ashville convened in Regular Session from 6:30 PM to 6:55 PM in the Council Meeting Room at 200 East Station Street, Ashville, Ohio 43103. Mayor Welsh called the meeting to order with the Pledge of Allegiance and a moment of silence. The following members and visitors were present: Mr. CHAD NOGGLE Excused Mr. COLTON HENSON Excused Mr. ROGER CLARK Present Mr. DAVE RAINEY Present Mr. RANDY LOVELESS Present Mr. MATT SCHOLL Present MINUTES OF PREVIOUS MEETING: Randy Lovelss moved, seconded by Roger Clark, to approve the May 6, 2024 minutes for the Regular Session as presented. All votes were yay. DEPARTMENTAL REPORTS POLICE: Chief George presented April's report. Randy Loveless asked about staffing at the Police Department. Chief George reported that he has a candidate and is planning on visiting the academy for recruits. PLANNING & ZONING: Samantha Pemberton presented the P & Z report for April. Dave Rainey moved, seconded by Matt Scholl, to approve P & Z's April repot. All votes were yay. VILLAGE ADMINISTRATOR: Bert Cline discussed looking at Muni-link to make billing changes and how best to measure usage for billing. LEGISLATION RESOLUTIONS FOR FIRST READING 06-2024 A RESOLUTION AMENDING ORDINANCE 2024-04, THE PERMANENT APPROPRIATIONS ORDINANCE FOR THE VILLAGE OF ASHVILLE, OHIO, AND AUTHORIZING THE FISCAL OFFICER TO TRANSFER FUNDS BETWEEN ACCOUNTS TO SATISFY THE VILLAGE'S AGREED UPON SHARE OF THE STATE ROUTE 316 PAVING PROJECT AND DECLARING AN EMERGENCY. Dave Rainey moved, seconded by Randy Loveless, to have the First Reading. After the reading, Dave Rainey moved, seconded by Roger Clark, to accept the First Reading. All votes were yay. 07-2024 A RESOLUTION AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND FISCAL OFFICER TO EXECUTE A SETTLEMENT AGREEMENT AND RELEASE WITH KRISTIN CLEMENS AUTO GROUP, LLC AND DECLARING AN EMERGENCY. Roger Clark moved, seconded by Matt Scholl, to have the First Reading. After the reading, Dave Rainey moved, seconded by Roger Clark, to accept the First Reading. All votes were yay.  RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: MAY 20, 2024 Page 2 of 3 NEW BUSINESS Trackside - Determine if Council objects to liquor permit issuance and wants a hearing with Division of Liquor Control. Dave Rainey remarked that council has a right to ask for a hearing with the Division of Liquor Control regarding Trackside, but he has noticed that the previous issues at Trackside have gotten better. Chief George agreed with Rainey's assessment. Randy Loveless asked if there was new management and Rainey said there is new family management. Rainey also noted that he had spoken to other businesses in the area and they have also said it has gotten better, because of this he does not feel we should hinder the process with Liquor Control. After discussion, Dave Rainey made a motion to not object to Trackside to being issues a liquor license, seconded by Matt Scholl. All votes were yay. MAYOR: Mayor Welsh said he would like to have a Utility Committee meeting scheduled regarding a 6119 District and Harrison Township. Matt Scholl said he will reach out to other committee members and schedule a meeting. COUNCIL COMMENTS • Roger Clark asked if the school uses the park during recess, should they provide insurance. Randy Loveless said it wouldn't be a bad idea. Bert Cline asked what was the difference between the school using it or kids playing throughout the week. Clark also asked who is responsible for painting the red, white, and blue stripes for the 4th of July Festival. Mark Stewart was asked to check with the Men's Club at the May 21st meeting. Clark pointed out the weeds down at the wellfield and Bert Cline replied that it will be looked after. • Randy Loveless asked about the ODOT sign that is down. Bert Cline said it's ODOT's responsibility. • Matt Scholl apologized for not being present as of late. Scholl expressed his disappointment at how plain the D.R. Horton homes look and said he was surprised that they were on slabs. Samantha was asked to get Matt the elevations that were presented by D.R Horton. At 6:55 PM, Dave Rainey moved, seconded by Randy Loveless, to adjourn the meeting. All votes were yay and the meeting adjourned.
