RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: JUNE 3, 2024 Page 1 of 3 The Council of Ashville convened in Regular Session from 6:30 PM to 6:54 PM in the Council Meeting Room at 200 East Station Street, Ashville, Ohio 43103. Mayor Welsh called the meeting to order with the Pledge of Allegiance and a moment of silence. The following members and visitors were present: Mr. CHAD NOGGLE Present Mr. COLTON HENSON Present Mr. ROGER CLARK Present Mr. DAVE RAINEY Present Mr. RANDY LOVELESS Present Mr. MATT SCHOLL Excused MINUTES OF PREVIOUS MEETING: Randy Lovelss moved, seconded by Roger Clark, to approve the May 20, 2024 minutes for the Regular Session as presented. All votes were yay. DEPARTMENTAL REPORTS CONSTRUCTION REP: Darryl Ward reported that DLZ is inspecting Phase 3 of Maranda Homes. FISCAL OFFICER: Colton Henson moved, seconded by Chad Noggle, to approve the Then & Now payable to Crossroads Community Planning, LLC for zoning ordinances updates in the amount of $8,000. All votes were yay. COMMITTEES PARKS: Roger Clark reported that the Parks Committee met prior the council meeting to discuss working with the business association to place lighted Christmas trees throughout the park and possibly have vendors this Christmas. Randy Loveless moved, seconded by Dave Rainey, to move forward with the project. All votes were yay. Clark also said the committee discussed who can and cannot park inside the park during events and recommend that parking inside the park would be permitted for village related community events during the event only but parking will still be prohibited for ball games and park rentals. Dave Rainey moved, seconded by Randy Loveless, to approve the committee's recommendation. All votes were yay. LEGISLATION RESOLUTIONS FOR SECOND READING 06-2024 A RESOLUTION AMENDING ORDINANCE 2024-04, THE PERMANENT APPROPRIATIONS ORDINANCE FOR THE VILLAGE Of ASHVILLE, OHIO, AND AUTHORIZING THE FISCAL OFFICER TO TRANSFER FUNDS BETWEEN ACCOUNTS TO SATISFY THE VILLAGE'S AGREED UPON SHARE OF THE STATE ROUTE 316 PAVING PROJECT AND DECLARING AN EMERGENCY. Dave Rainey moved, seconded by Roger Clark, to have the Second Reading. After the reading, Roger Clark moved, seconded by Randy Loveless, to accept the Second Reading. All votes were yay.  RECORD OF PROCEEDINGS ASHVILLE COUNCIL REGULAR SESSION Held: JUNE 3, 2024 Page 2 of 3 07-2024 A RESOLUTION AUTHORIZING AND DIRECTING THE VILLAGE ADMINISTRATOR AND FISCAL OFFICER TO EXECUTE A SETTLEMENT AGREEMENT AND RELEASE WITH KRISTIN CLEMENS AUTO GROUP, LLC AND DECLARING AN EMERGENCY. Dave Rainey moved, seconded by Chad Noggle, to have the Second Reading. After the reading, Dave Rainey moved, seconded by Colton Henson, to accept the Second Reading, suspend the Rules of Council, waive the Third Reading, and adopt as an emergency measure. All votes were yay. MAYOR: Mayor Welsh reported that an apartment developer is interested in building in the village and had questions about CRAs and TIFs. Welsh said he would like to get more information and get moving on implementing these agreements. GUEST • Candy Allen of 205 ½ Powell Street requested that the alley that runs East and West between her property and 213 and 213 ½ Powell Street be blocked off. Allen complained that traffic from Kelli Jo's is a problem and that the alley is crumbling and needs repair. Mayor Welsh requested that Ms. Allen submit the signatures of two neighbors who are in favor of blocking off the alley. Welsh then asked Greg Sturgill to look at the alley to see what repairs are needed and address as necessary. • A representative of the Sons of the American Revolution said that the organization is traveling around the county to get the signatures of the elected officials of townships, villages, and city on a copy of the Declaration of Independence and asked if the mayor and council would be willing to sign after the meeting. All agreed to do so. • Nance Vallette was present to check in with council and Chief George on the Viking Festival. Council and George reported that everything seemed to have ran smoothly and hadn't received any complaints or made aware of any issues. Vallette said the festival went well with the exception of the tragic loss of a long-time vendor. COUNCIL COMMENTS • Chad Noggle reported that The Distillery posted No Thru traffic signs on Rail Street. Noggle said he was part of the pre-construction meetings and that it was agreed that that would be open to the public to access SR 752. Noggle said he would like the original agreement reviewed to see what was agreed upon. • Roger Clark said he has concerns about students using the park during school hours out of fear that if a student is injured, the village could be held liable. Dave Rainey stated that the school has insurance for such incidents and that during school hours the school would be responsible for the student, not the village. At 6:54 PM, Colton Henson moved, seconded by Randy Loveless, to adjourn the meeting.
