April 10, 2023 STATE OF ALABAMA, LIMESTONE COUNTY, CITY OF ATHENS. The City Council of the City of Athens, Alabama met in regular session at the Athens Municipal Building, 200 Hobbs Street West, Athens, Alabama, on April 10, 2023 at 4:30 p.m. The meeting was called to order by Councilman Harold Wales, President of the City Council. Upon roll call, the following were found to be present: Councilmembers Chris Seibert, Harold Wales, James E. Lucas, Dana Henry and Wayne Harper. Kim Glaze, Executive Secretary, was present and recorded the minutes of the meeting. Chris Seibert offered the invocation. Mayor Marks led the Pledge of Allegiance. The Chairperson stated that a quorum was present and that the meeting was open for transaction of business. The Chairperson stated that the Minutes of the March 27, 2023 City Council Meeting had been submitted for approval. Councilman Harper moved that the reading of the Minutes be suspended and that the Minutes be approved as recorded. The motion was seconded by Councilman Seibert and was unanimously carried. The Chairperson stated that the Minutes of the March 27, 2023 City Council Work Session Meeting had been submitted for approval. Councilman Harper moved that the reading of the Minutes be suspended and that the Minutes be approved as recorded. The motion was seconded by Councilman Seibert and was unanimously approved. Mayor Marks referenced an article in the newspaper regarding a local young man by the name of Troy Young, who is wheelchair bound and a member of the Athens Swim Team for 6 years. Troy was named Class 6A Student-Athlete Achievement winner in the Bryant-Jordan Scholarship Competition. Mayor Marks stated that Troy was an inspiration to others. The Mayor also noted that the city of Athens needs a facility for special needs children and adults and hopes to bring something to the City Council in the near future. He announced that the education budget in the State of Alabama has a 2.8 billion dollar surplus and hopes that there is an opportunity for people to apply for funds. Mayor Marks then turned the floor over to Garth Lovvorn, President of Athens Arts League, who introduced a group of children from the local Boys and Girls Club, Tubano Thunder Drummers. The group played two songs for the City Council. The group was accompanied by Jarrett Collier, Athens Boys and Girls Club Director and their teacher, Aaron Plunkett. Members of Tubano Thunder Drummers present were: Avay Lynch, Victoria Horton, Aarya Moore, Khloe Fairbanks, Aubriana Stinnett, Kayden Harris, Jonah Jude, Ari Patt, Kadin McNaughton and Skylee Drawbaugh. Councilwoman Henry added that the Make-A-Way Foundation held an Easter Egg Hunt for members of the special needs community and praised Athens Arts League for providing more opportunities for the citizens. She stated that it was wonderful to see people taking an interest in our hometown. Councilman Harper stated that he enjoyed Tubano Thunder’s performance and that he was happy to see people taking an interest in our town, as well. Council President Wales echoed all of the comments and stated that it was great to see our community growing. PUBLIC HEARING RELATING TO THE VACATION OF A PORTION OF HATFIELD LAKE ROAD, A PUBLIC RIGHT OF WAY No one spoke in favor of or against. No action was taken and the public hearing was closed. PUBLIC HEARING CONCERNING THE ZONING APPROVAL FOR THE SALE OF ALCOHOL IN THE CITY OF ATHENS BY D AND L SEAFOOD AND GRILL, LLC, DBA: D AND L SEAFOOD AND GRILL, 229 FRENCH FARMS BLVD, SUITE L, ATHENS, AL, 35611 No one spoke in favor of or against. The public hearing was closed. PUBLIC HEARING CONCERNING THE ZONING APPROVAL FOR THE SALE OF ALCOHOL IN THE CITY OF ATHENS BY MOZZA PIZZA BUFFET, LLC, DBA: MOZZA PIZZA BUFFET, 202 SOUTH JEFFERSON STREET, ATHENS, AL, 35611 No one spoke in favor of or against. PUBLIC HEARING RELATING TO A STRUCTURE AT 701 N. MADISON STREET BEING UNSAFE AND A PUBLIC NUISANCE, AND ORDERING ABATEMENT OF SAME Erik Waddell, Chief Building Inspector, addressed the City Council and recommended condemnation of the structure. The public hearing was closed. Councilman Harper introduced the following resolution: RESOLUTION NUMBER 2023 - 1879 A RESOLUTION DETERMINING THAT A STRUCTURE AT 701 N MADISON STREET IS UNSAFE AND A PUBLIC NUISANCE, AND ORDERING ABATEMENT OF SAME WHEREAS, this Resolution is authorized by § 46-280, et seq. of Article IX of Chapter 46 of the City Code of Athens, Alabama, and/or § 11-40-30, et seq. of the Code of Alabama, in addition to other legal authority; WHEREAS, the appropriate municipal official has presented information to the City Council about a structure (herein referred to as the “Structure”) located at the real property described as follows: Address: 701 N Madison Street, Athens, AL 35611 PARCEL # 10-03-05-4-003-018.000 Legal Description The following land lying and being in Limestone County, Alabama, and more particularly described as follows: The South Half of Lot Nos. 1 and 2 of Block No. 7, according to Map #2 of the Fairview Addition to Athens, Alabama, according to the map recorded in Plat Book A, Page 51 in the Office of the Judge of Probate of Limestone County, Alabama. (herein referred to as the “Property); WHEREAS, an image of the Structure is shown below:  WHEREAS, the appropriate municipal official has determined that the condition of the Structure is unsafe in that the Structure constitutes a public nuisance to the citizens of Athens; WHEREAS, the City Council has conducted a public hearing concerning this matter, and has received and reviewed information (including applicable photographs) from the appropriate municipal official concerning the Property and Structure; WHEREAS, the Structure has been deemed unsafe to the extent that it is a public nuisance due to the following reasons: 1. The building has improperly distributed loads upon the floors or roofs, or in which the same are overloaded, or has insufficient strength to be reasonably safe for the purpose used; 2. The building has been damaged by fire, wind, earthquake, flood, sinkhole, deterioration, neglect, abandonment, vandalism, or any other cause so as to have become dangerous to life, health, property, morals, safety, or general welfare of the public or the occupants; 3. The building has become or is so damaged, dilapidated, decayed, unsafe, unsanitary, lacking in maintenance, vermin or rat infested, containing filth or contamination, lacking proper ventilation, lacking sufficient illumination, or so utterly fails to provide the amenities essential to decent living that it is unfit for human habitation, or is likely to cause sickness or disease, so as to work injury to the life, health, property, morals, safety, or general welfare of the public or the occupants; 4. The building does not provide minimum safeguards to protect or warn occupants in the event of fire; 5. The building is so damaged, decayed, dilapidated, structurally unsafe, or of such fault construction or unstable foundation that partial or complete collapse is possible; 6. The building, or any portion thereof, is clearly unsafe for its use or occupancy; 7. The building is neglected, damaged, dilapidated, unsecured, or abandoned so as to become an attractive nuisance to children who might play in or on the building, structure, part of building or structure, party wall, or foundation to their danger, has become a harbor for vagrants, criminals, or immoral persons, or enables persons to resort to the building, structure, part of building or structure, party wall, or foundation for committing a nuisance or an unlawful act; and 8. The building is, because of its condition, unsafe, unsanitary, or dangerous to the life, health, property, morals, safety, or general welfare of the public or the occupants.  WHEREAS, after the finding by the appropriate municipal official that the Structure was unsafe to the extent that it is a public nuisance, notice was issued pursuant to § 46-280, et seq. of Article IX of Chapter 46 of the City Code of Athens, Alabama to persons who may have an interest in the Property, and such notice was issued more than fifty (50) days prior to the date of this Resolution; WHEREAS, it appears that no person has remedied the conditions on the Property; and WHEREAS, after due deliberation and an examination of the conditions on the Property, it appears to the City Council that the Structure is unsafe in that it presents a public nuisance to the citizens of Athens, and that the same is due to be demolished. THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA on April 10th, 2023 at 4:30 p.m., as follows: 1. The Structure shall be demolished by the City of Athens. 2. This work may be performed by City’s own forces, or, if the appropriate municipal official investigates and determines it to be preferable that the work occur through the use of third parties, then the Athens Public Works Department is authorized to contract, on behalf of the City of Athens, with a third party(ies) for an asbestos survey and demolition of the unsafe structure(s), for a cost not in excess of $15,000.00, although the City Council directs that the cost be as low as possible to accomplish the intended purpose. Should the combined screening, remediation and demolition costs appear to exceed $15,000.00, then the appropriate municipal official is directed to report the same to the City Council prior to further action. 3. The City may sell or otherwise dispose of salvaged materials resulting from the work, at the election of the Mayor and/or his designee. 4. After demolition, the appropriate municipal official shall make a report to the City Council of the costs associated with the demolition of the Structure so that it may adopt a resolution fixing all costs reasonably incurred in the demolition and assessing such costs against the Property. David Malone, 1300 Somerest Drive, Athens, AL, addressed the City Council regarding Jimmy Gill Park. Mr. Malone stated that the park is still not complete. Mr. Malone also stated that more outlets and a spigot need to be added for outdoor events, more swings need to be added to the park, a fence needs to be around the pond for safety purposes, the new fence is too close to the basketball court and the trees that were supposed to be removed for a ballfield are still standing. Mayor Marks asked Mr. Malone to meet with him and others with his concerns. Mr. Malone stated that he had contacted OSHA and is waiting for a return phone call. Billy Cannon, 2387 S. Hine Street, Athens, AL, addressed the City Council regarding the condemnation at 701 N. Madison Street and provided information regarding the process of being able to purchase such properties after being condemned. Councilman Seibert introduced the following resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, to declare and add a 2013 Mack MRU633 CNG Residential Garbage Truck, VIN #1M2AV17C0DM010436, mileage 96670, to the existing Public Works surplus list. The motion was seconded by Councilman Harper and was unanimously carried. Councilman Seibert introduced the following resolution: RESOLUTION BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, to approve the purchase of 24 sets of Lion VForce turnouts (head-to-toe) from NAFECO through the HGAC Contract # EF08-19 at a cost of NTE $124,000 and shall be funded from the Fire Department’s existing capital account. The motion was seconded by Councilman Harper and was unanimously carried. Councilman Lucas introduced the following resolution: RESOLUTION NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ATHENS, ALABAMA, at its meeting on April 10, 2023, that the Council has received and reviewed the Municipal Water Pollution Prevention Report for calendar 2022 by the Athens Water Services Department. The Water Services Department Director is authorized to submit the report per Alabama Department of Environmental Management requirements and the Athens Utilities WWTP NPDES discharge permit AL0020206. The motion was seconded by Councilman Harper and was unanimously carried. Councilman Seibert introduced the following ordinance: ORDINANCE NUMBER 2023 - 2259 AN ORDINANCE ANNEXING CERTAIN PROPERTY OWNED BY TIMOTHY A. MILLER _____________________________________________________________________ WHEREAS, Timothy A. Miller, being the owner of all of the real property hereinafter described, did file with the City Clerk a petition asking that the real property described herein be annexed to and become a part of the City of Athens; WHEREAS, said petition did contain the signature of the owner of the described territory and a map of said property showing its relationship to the corporate limits of the City of Athens, Alabama; and WHEREAS, the Athens City Council determines that it is in the public interest that said property be annexed into the City of Athens, and it further determines that all legal requirements for annexing said real property have been met pursuant to §§ 11-42-20 through 11-42-24 of the Code of Alabama.
