Athens Planning Commission 2018 June 19 Page 1227 I. Call to Order: The Planning Commission of the City of Athens, Alabama was called to order by Chairperson Gina Garth, at 5:45 p.m. on June 19, 2018. II. Roll Call. Members present: Members absent: Gina Garth, Chairman Rick Johnson, Vice Chairman Jerold Blaxton Mayor Ronnie Marks Rod Huffman Venard Hendrix Councilman Harold Wales Robert Malone Chief Bryan Thornton Also present: James Rich, Director of Public Works Erin Tidwell, Planning Commission Secretary APPROVAL OF MINUTES: III. Resolution: The Chairman called for a motion to accept the proposed minutes from the May 15, 2018 meeting. Mr. Blaxton offered the following resolution and moved its adoption: "BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ATHENS, ALABAMA, to approve the minutes of the May 15, 2018 meeting." Mr. Malone seconded the motion and the vote was unanimous of the voting members present. OLD BUSINESS NEW BUSINESS Subdivisions Prior to discussing the items on the agenda, Mr. Rich explained that the public hearing notices were sent out indicating the wrong meeting date. Therefore, the items on the agenda that require a public hearing would come before the Commission next month for preliminary approval. Tonight the Commission would only look at layouts for each project. IV. Resolution: Consider the request of City of Athens Board of Education for approval of a layout for Athens Intermediate School Subdivision, a subdivision of 60.17 acres of property located at 1916 US HWY 72 West in an R-1-2 Medium Density Single Family Residential District and an INST Institutional District. Athens Planning Commission 2018 June 19 Page 1228 Mr. Rich stated that the Board of Education is dividing a single large tract of land into 5 tracts. Tracts 1,4 and 5 are in the Institutional District while tracts 2 and 3 are zoned R-1-2 Medium Density Single Family Residential District. Mrs. Garth asked what tract contains the intermediate school, to which Mr. Rich explained that Tract 1 is where the school is located. Mr. Malone questioned whether Tracts 3 and 4 touched Highway 72, to which Mr. Rich confirmed that they do. Mr. Blaxton questioned what the arrowed line on the plans indicated. Mr. Rich responded that the arrowed line indicates drainage. Mrs. Garth questioned whether anyone was present to represent the project. Mr. Taz Morell was present. Mrs. Garth stated that since there was originally a public hearing scheduled, she would allow for a short public comment period. Jerry Curry came forward to speak on behalf of his mother, Shirlene Curry, who was also present. Mrs. Curry lives at 16088 Lucas Ferry Street. Mr. Curry asked what the school's intent was. His mother was concerned that the school was rezoning so that apartments could be placed on the property. Mr. Rich stated that the property is currently zoned R-1-2 which does not allow for apartments. To be rezoned, notice must be given to adjoining property owners. Louise Prystaloski, 23349 Hazeltine Drive, inquired as to what could be built on Tract 4· Mr. Rich stated that Tract 4 is zoned Institutional. Permitted uses within that district include schools, churches, hospitals, and similar institutional uses. No other comments were made; therefore Mr. Wales offered the following resolution and moved for its adoption: "BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ATHENS, ALABAMA, to grant the request of City of Athens Board of Education for a layout for Athens Intermediate School Subdivision, a subdivision of 60.17 acres of property located at 1916 US HWY 72 West in an R-1-2 Medium Density Single Family Residential District and an INST Institutional District." Mr. Blaxton seconded the motion and the vote was unanimous of the voting members present. V. Resolution: Consider the request of Kenny Winter for Approval of a layout for Cog Hill at Canebrake Subdivision, a subdivision of 21.52 acres of property located to the southwest of Piney Creek Drive off of the Medinah Lane street stub in a C-PUD, Conventional Planned Unit Development. Mr. Rich stated that these lots had come before the Commission previously in Revision #9 of the Canebrake Master Plan. He stated that there will be about 43 new lots with 30 foot front, 35 foot rear, and 8 foot side setbacks. Corner lots will have a 15 foot side street setback. Staff has reviewed the plan and recommends the layout. Athens Planning Commission 2018 June 19 Page 1229 Louise Prystaloski, 23349 Hazeltine Drive, came forward to state that she likes the development. No other comments were made; therefore Mr. Malone offered the following resolution and moved for its adoption: "BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ATHENS, ALABAMA, to grant the request of Kenny Winter for Approval of a layout for Cog Hill at Canebrake Subdivision, a subdivision of 21.52 acres of property located to the southwest of Piney Creek Drive off of the Medinah Lane street stub in a C-PUD, Conventional Planned Unit Development." Mr. Hendrix seconded the motion and the vote was unanimous of the voting members present. VI. Resolution: Consider the request of Gregg Crow for Approval of a layout for Park Place Addition #3, a subdivision of 10-48 acres located at the stub of Wickerberry Way and Park Place in a TN-2 Traditional Neighborhood 2 District. Mr. Rich explained that this development would be located at the ends of Wickerberry Lane and Park Place. These roads would extend for the development of about 32 more lots. Staff has review the plan and would recommend it. · No other comments were made; therefore Mr. Malone offered the following resolution and moved for its adoption: "BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF ATHENS, ALABAMA, to grant the request of Gregg Crow for Approval of a layout for Park Place Addition #3, a subdivision of 10.48 acres located at the stub of Wickerberry Way and Park Place in a TN-2 Traditional Neighborhood 2 District." Mr. Wales seconded the motion and the vote was unanimous of the voting members present. VII. Resolution: Consider the request of Canebrake Club, LLC. for Approval of a layout for Canebrake Club at Piney Creek, a subdivision of +I- 2. 78 acres located on the East side of Canebrake Development on the East side of Piney Creek Drive in a C-PUD Conventional Planned Unit Development District. Mr. Rich stated that this came before the Commission at the last meeting for the preliminary plat. There is an existing roadway. They are adding 4 lots. Staff has reviewed and recommends approval. Mr. Wales stated that there are two lots within the floodzone. He questioned whether those could be built on. Mr. Rich explained that lots in the flood zone are required by FEMA to have a minimum floor elevation that allows the home to be built up out of the flood zone. The lot is built to remove it from the flood zone. Mr. Blaxton questioned whether this would affect adjoining properties, to which Mr. Rich stated that it should not as long as they are built according to FEMA. The drainage should go to the road or onto the golf course. Athens Planning Commission 2018 June 19 Page 1230 Mr. Huffman stated that the Planning Commission has seen minimum floor elevations before with other subdivisions. It is not unusual in terms of the Planning Commission history. Mr. Wales asked Mr. Rich whether the Public Works Department has a set of regulations that they check when they are out there inspecting the property. Mr. Rich responded that he is correct. The Building Department also requires a Flood Elevation Certificate for houses built in flood zones. He stated that there are different ways to handle it as long as the finished floor elevation meets FEMA standards. John Jordan, 24111 Piney Creek Drive, came forward to ask is lot T-56 had been added since the Preliminary Plat. Taz Morell answered that this lot is why it was brought back. Property lines had to be shifted around some. They lost two lots, so there are now 4 lots instead of the original 6 shown on the Master Plan. No other comments were made; therefore Mr. Blaxton offered the following resolution and moved for its adoption: "BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CI1Y OF ATHENS, ALABAMA, to grant the request of Canebrake Club, LLC. for Approval of a layout Canebrake Club at Piney Creek, a subdivision of+/- 2.78 acres located on the East side of Canebrake Development on the East side of Piney Creek Drive in a C-PUD Conventional Planned Unit Development District." CITY OF ATHENS PLANNING COMMISSION Public Hearing Procedure ● During the course of a Planning Commission Meeting whenever an application that requires a public hearing (zoning, re-zoning, conditional use, certain subdivisions of property, etc. . . .) appears on the Commission’s agenda, the Chair will declare the same and introduce the application to the Commission and citizens who are in attendance. ● The Chair will proceed through each scheduled public hearing as follows: o Staff will provide an explanation of the case and a recommendation. o Applicant will be given an opportunity to address the commission and should limit their comments to less than ten (10) minutes. o When a public hearing is slated, the Chair will open the hearing for public input. o Members of the public, having been recognized, will be allowed three (3) minutes each to address the Commission (unless the Chairman specifies otherwise). NOTE: Large groups may wish to, but are not required to, appoint a spokesperson for the group, in which case the Chair may grant the spokesperson additional time to speak. ▪ Generally, those desiring to speak “for” the request will be allowed to speak first, followed by those desiring to speak “against” the request. ▪ Persons wishing to speak should raise their hand to be recognized by the Chairman. Once recognized, please stand and state your name and address. ▪ Comments should be concise and limited to issues related to the request. o When the Chairman believes that the Commission has received sufficient citizen input to make a determination on the application, the public hearing will be closed and the applicant and/or the Staff will be given an opportunity to address any issues brought out during public comment. o Chairman will then allow Commission members to make comments or ask questions of anyone present to clarify issues or provide additional information. o The Chairman will call for a motion and a second on the motion. Commission members may speak to the motion, any amendments, or points of parliamentary procedure. o If a motion is forthcoming, a voice vote will be taken. If the decision is not unanimous, then the Chairman will direct a roll call vote. o If a motion is NOT forthcoming, the request will be considered “Denied” for lack of a motion. PLEASE NOTE: The above-procedure is provided to serve as a guideline for the conduct of public hearings. The chairman is not limited and/or constrained by this procedure and, under certain circumstances, may deem it necessary to deviate from this guideline.
