Athens-Clarke County Board of Elections Continuation of Election Certification Minutes November 12, 2018— AMENDED 12/ 04/ 18 A meeting of the Athens-Clarke County Board of Elections to continue the certification of the 2018 General Election was held on Monday, November 12, 2018 at the Facilities/ Landscape Management Building, 2555 Lexington Rd., Athens, Georgia. A. Call To Order The meeting was called to order at 4: 36 p. m. by Charles Knapper, Chairman. Other Members Present: Michele Simpson, Vice Chairperson; Jesse Evans, Board Member Others Present: Charlotte Sosebee, Director; Bill Berryman, ACC Attorney; John Hawkins, ACC Assistant Attorney; Wanda Raley, Recording Clerk Guests: See attached list. B. Items Covered 1. Bill Berryman stated that Code 21. 2. 419 provides that counted provisional ballots be determined by 7:00 on Friday following the election. Based on this law, Charlotte Sosebee stated that there were a total of 219 provisional ballots for ACC; 41 provisional ballots could be counted; 2 provisional ballots from previous meeting did not provide IDs to Board of Elections Office. 2. Voters presented seven " Petitions to Recanvass November 6, 2018 General Election in Athens- Clarke County" as follows: 2B Howard B. Stroud Elem. Sch., 3A Clarke Central High Sch., 3B Thomas Lay Park, 4A Athens Transit Multi- Modal Ctr., 5A/ 5B Whitehead Rd. Elem. Sch., 5C Chase St. Elem. Sch., 8B Cedar Shoals High Sch. Jesse Evans explained the relevant statute. i. 5: 05 pm: Mr. Berryman requested a 1 hour adjournment( recess) to determine Board' s next action. ii. 6: 06 pm: Board reconvened. a) Bill Berryman explained to Board that there were two competing legal requirements regarding the recanvass vs. the deadline for certification of election. A determination was made that a Board quorum (Charles Knapper, Alison McCullick, Jesse Evans) would be available from 10: 45 am until 2: 00 pm on November 13, 2018. Jesse Evans requested a 30 minute adjournment( recess) at 6:40 pm. iii. 7: 06 pm: Board reconvened. a) Jesse Evans made a motion that recanvass of precincts who filed petitions start at 7: 00 am the following day. No second. b) Jesse Evans made motion that recanvass of precincts who filed petitions begin at 10:45 a. m. and that staff and Board members take necessary steps to notify pertinent poll managers/ candidates/ parties and adhere to time constraints in order to meet all deadlines. No second. Michele Simpson expressed concerns regarding consequences of failure to meet certification deadline. Page 1 of 2 Athens-Clarke County Board of Elections Continuation of Election Certification Minutes November 12, 2018— AMENDED 12/ 04/ 18 c) After further discussion of Board of Elections quorum availability from 10:45 am until 2: 00 pm, on the following day( Nov. 13), Jesse Evans made motion that staff and Board members take necessary steps to notify pertinent poll managers/ candidates/ parties and adhere to time constraints in order to meet all deadlines, beginning recanvass on November 13, 2018 at 10:45 am and certifying election by 2: 00 pm. Michele Simpson seconded motion. 3. 7: 57 pm: Board began process of reviewing absentee ballots in question. Paula Williams stated that there were a total of 14 absentee ballots; 11 ballots could be counted. C. Adjourn Meeting adjourned by Chairman Knapper at 9: 15 pm. Page 2 of 2 Athens-Clarke County Board of Elections Recanvass) Continuation of Election Certification Minutes November 13, 2018— AMENDED 12/ 04/ 18 A meeting of the Athens-Clarke County Board of Elections was held on Tuesday, November 13, 2018 at the Facilities/ Landscape Management Building, 2555 Lexington Rd., Athens, Georgia. Recanvassing was conducted for those precincts that submitted petitions (2B Howard B. Stroud Elem. Sch., 3A Clarke Central High Sch., 3B Thomas Lay Park, 4A Athens Transit Multi- Modal Ctr., 5A/ 5B Whitehead Rd. Elem. Sch., 5C Chase St. Elem. Sch., 8B Cedar Shoals High Sch.). A. Call To Order The meeting was called to order at 10:45 a. m. by Charles Knapper, Chairman. Other Members Present: Jesse Evans, Board Member; Alison McCullick. Board Member Others Present: Charlotte Sosebee, Director; Bill Berryman, ACC Attorney; John Hawkins, ACC Assistant Attorney; Wanda Raley, Recording Clerk Guests: See attached list. B. Items Covered 1. 10: 00 a. m. Moved to storage room to prepare for 10:45 recanvassing. 2. 2: 06 p. m. Moved back into training room. Charlotte Sosebee explained the process of recanvassing and certification of election. Bill Berryman explained that once we complete the recanvassing, these results become the official results. Alison McCullick made a motion to accept the recanvassing numbers as official certification results. Jesse Evans seconded the motion to accept the recanvassing numbers as official totals for certification. Motion passed by unanimous vote. Staff reported that they would provide further data later in the day. Charles Knapper and Alison McCullick signed the required certification paperwork. Jesse Evans stated that he would sign if further data was provided to him for review. Meeting recessed at 2: 20 pm. 3. Board reconvened at 7: 05 p. m. Charlotte provided unofficial and recanvassing results for comparison. Alison McCullick stated that she felt comfortable that the totals decreased slightly for all recanvassed precincts, citing possible reasons for this decrease. Jesse Evans stated that he did not feel comfortable signing the certification. Bill Berryman stated that a board quorum was present to sign certification and as such, the election would be certified. Certification was signed by Alison McCullick and Charles Knapper. At that time, Jesse stated that the" sequence of events" made him uncomfortable and that he wished to see the results of those precincts that were not involved in recanvassing.
