The Unified Government of Athens-Clarke County, Georgia met this date in a special called
session. Present: Mayor Girtz; Commissioners Davenport, Parker, Link, Wright, Denson, Houle,
Edwards, Herod, Myers, Thornton, and Hamby. No one was absent.
The purpose of the meeting was to consider request of Smith Planning Group Owner: Lexington
Associates, LP for rezoning from C-G, RS-8 A (Commercial-General, (Single-Family Residential, Airport)
to C-G/RM2, A, PD (Commercial-General, Mixed-Density Residential, Airport Overlay, Planned
Development) on 40.93 acres known as 2400, 2480, and 2490 Lexington Road. This will require an
amendment to the Future Development Map from General Business and Traditional Neighborhood to
General Business and Mixed-Density Residential; and consider any other item in proper order.
Citizen input
There was no citizen input.
A motion was made by Commissioner Parker, seconded by Commissioner Link, to approve an
amendment to the Future Development Map from General Business and Traditional Neighborhood to
General Business and Mixed-Density Residential. There was a tie roll call vote with Commissioners
Parker, Link, Denson, Houle, and Edwards voting YES and Commissioners Davenport, Wright, Myers,
Thornton, and Hamby voting NO. (5YES; 5 NO). Mayor Girtz broke the tie with a vote of YES. The
following ordinance (#21-02- ) which was presented by title only was declared adopted.
AN ORDINANCE TO AMEND THE CODE OF ATHENS-CLARKE COUNTY, GEORGIA WITH RESPECT
TO AMENDING THE OFFICIAL FUTURE DEVELOPMENT MAP OF ATHENS-CLARKE COUNTY BY
CHANGING THE DESIGNATION OF THREE PARCELS OF LAND COMPRISING APPROXIMATELY
40.93 ACRES LOCATED AT 2400, 2480, & 2490 LEXINGTON ROAD FROM GENERAL BUSINESS
AND TRADITIONAL NEIGHBORHOOD TO GENERAL BUSINESS AND MIXED DENSITY
RESIDENTIAL; AND FOR OTHER PURPOSES.
The Commission of Athens-Clarke County, Georgia hereby ordains as follows:
SECTION 1. The Official Future Development Map referred to in the Zoning Ordinance of
Athens-Clarke County, Georgia, as specifically identified in Section 9-3-3(A)(2) thereof, is hereby
amended by changing the future development map designation of the three parcels of land comprising
approximately 40.93 parcels located at 2400, 2480, and 2490 Lexington Road, Athens-Clarke County tax
parcel numbers 233 007, 233 008, and 233 008B, from General Business and Traditional Neighborhood
to General Business and Mixed Density Residential, as more particularly shown on Exhibit A, which is
attached hereto and incorporated herein by reference.
The date of this amendment to the Official Future Development Map of Athens-Clarke County as
shown by Exhibit A shall be duly noted in the minutes of the Commission meeting. The Official Future
Development Map and Exhibit A hereto are available for inspection in the office of the Clerk of
Commission, 301 College Avenue, Athens, Georgia.
SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed.

GENERAL, SINGLE-FAMILY RESIDENTIAL, AIRPORT OVERLAY) TO C-G/RM-2, A (PD)
(COMMERCIAL-GENERAL, MIXED-DENSITY RESIDENTIAL, AIRPORTY OVERLAY, PLANNED
DEVELOPMENT); AND FOR OTHER PURPOSES.
The Commission of Athens-Clarke County, Georgia hereby ordains as follows:
SECTION 1. The map constituting the component part of the Zoning Ordinance of Athens-Clarke
County, Georgia, by virtue of and in compliance with Section 9-3-3 and Section 9-3-6 thereof, is hereby
amended by changing the zoning of three parcels of land comprising approximately 40.93 acres from C-
G, RS-8, A (Commercial-General, Single Family Residential, Airport Overlay) to C-G/RM-2, A (PD)
(Commerical-General,Mixed Density Residential, Airport Overlay, Planned Development) as shown on
Attachment A hereto. Said affected parcels of land being more fully described in the drawing entitled
“2400 Lexington Road, Sheet Title: Master Plan, Sheet Number PD-20” said drawing being last revised
July 02, 2020, prepared by Smith Planning Group, and being on file and available for public inspection in
the office of the Athens-Clarke County Planning Department, 120 W. Dougherty Street, Athens, Georgia.
The subject parcels are also known as parcel numbers 233 007, 233 008, and 233 008B on the
Athens-Clarke County tax maps, being on file and available for public inspection in the office of the
Athens-Clarke County Planning Department, 120 W. Dougherty Street, Athens, Georgia. The date of this
amendment to the Official Zoning Map of Athens-Clarke County as shown by Attachment A shall be noted
on said Official Zoning Map in the Clerk of Commission’s Office at 301 College Avenue, Athens, Georgia,
and duly noted in the minutes of the Commission meeting.
SECTION 2. The binding master site plan associated with this ordinance and incorporated herein
by reference consists of 23 sheets in total, with each sheet being numbered and titled in the lower-right
hand corner and stamped “Binding 1-13-21”. The respective number, title and date of each sheet is listed

The binding master site plan associated with this ordinance is on file and available for public
inspection in the office of the Athens-Clarke County Planning Department, 120 W. Dougherty Street,
Athens, Georgia.
The binding written report associated with this ordinance and incorporated herein by reference is
entitled “Master Planned Development Report, 2400 Lexington Road” consists of 16 pages, dated
December 4, 2020, stamped “Binding 1-13-21,” and is on file and available for public inspection in the
office of the Athens-Clarke County Planning Department, 120 West Dougherty Street, Athens, Georgia.
SECTION 3. The conditions of zoning associated with this ordinance are as follows:
1. A minimum of sixty-six (66) affordable residential units will be provided, as further described in
the document entitled “Administrative Oversight Agreement: Affordable Residential Dwelling Units,”
attached hereto as Attachment B, and on file and available for public inspection in the office of the Athens-
Clarke County Planning Department, 120 West Dougherty Street, Athens, Georgia. Said document shall
be signed and executed by both parties.
2. Developer shall dedicate a 10-foot public right-of-way easement along the property edge directly
abutting Lexington Road for the purpose of a public sidewalk or multi-modal path.
3. The proposed nature trail shall be located outside of the riparian areas.
4. Developer shall allow community amenities within the market-rate, multifamily development to be
available to all residents of the proposed development, specifically including residents of the designated
workforce housing.
5. Developer will provide nine (9) electric charging stations within the designated parking areas for
the benefit of residents within the proposed development.
6. A deed restriction will be recorded on parcel(s) that contain workforce housing. The deed
restriction will mandate permanent workforce housing in perpetuity.
7. Administrative Oversight of the workforce housing will be provided by the Athens Land Trust
through an Administrative Oversight Agreement.
8. The developer agrees that the proposed workforce housing will be completed as part of Phase
1. The number of workforce housing dwelling units to be provided in any single phase will equal 15% of
the number of non-workforce / market-rate housing dwelling units approved for occupancy as outlined in
the Planning Staff report.
9. The developer agrees that the traffic signal at the entrance on Lexington Road will be installed
prior to project completion and funded as part of the developer’s budget as outlined in the Planning Staff
report.
10. The developer agrees to continue pursuing TAD funding for an additional 54 units of workforce
housing for the project.
SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
