Unified Government of Athens-Clarke County, Georgia Mayor and Commission Special Called Session Tuesday, May 14, 2024 5:35 p.m. Clarke County School District Administrative Office, 595 Prince Avenue The Unified Government of Athens-Clarke County, Georgia met this date in a special called session. Present: Mayor Girtz; Commissioners Davenport, Link, Taylor, Wright, Fisher, Houle, Culpepper, Myers, and Thornton. Absent: Commissioner Hamby. Commissioner Taylor arrived at 5:37 p.m. The purpose of the meeting was to consider several items of old and new business. Public input The following spoke in support of funding for YWCO Girls Club. 1. Cshanyse Allen 2. Brad Hubacher Old business – Discussion A motion was made by Commissioner Link, seconded by Commissioner Thornton, to a) Approve the proposed FY25 Annual Action Plan V for submission to HUD, as shown in amended Attachment #1 of agenda report revised May 8, 2024; with the following additional amendments. *PROPOSED AWARD FUNDING SOURCED FROM $3,394,184 REMAINING ARPA YOUTH DEVELOPMENT & VIOLENCE PREVENTION FUND ACC High School Completion Initiative Education Matters Program Ranking 6, Score 111.86 FY25 Request: $50,000 FY25 Award: $30,000 (60% of request) Chess & Community Project Rewire Ranking 7, Score 110.79 FY25 Request: $46,894 FY25 Award: $0 *PROPOSED AWARD: $28,000 (60% of request) YWCO Summer Girls Club Ranking 8, Score 109.07 FY25 Request: $30,000 FY25 Award: $0 *PROPOSED AWARD: $18,000 (60% of request) b) Authorize staff to include eligible carryforward funds in FY25 subrecipient contracts if the agency’s remaining project fund balance is 15% or less of the original allocation; c) Authorize acceptance of the associated HUD Grant awards; and d) Authorize the Mayor and appropriate ACCGov staff to execute all related contracts and documents. A substitute motion was made by Commissioner Houle, seconded by Commissioner Myers, to approve the proposed FY25 Annual Action Plan V for submission to HUD, as shown in amended Attachment #1 of agenda report revised May 8, 2024; as well as the commission defined option. The substitute motion failed by roll call vote with Commissioners Davenport, Houle, and Myers voting YES and Commissioners Link, Taylor, Wright, Fisher, Culpepper, and Thornton voting NO. (3 YES; 6 NO) Commissioner Link amended her motion as follows. a) Full funding of youth development programs using a combination of CDBG and ARPA as follows.  • Fund ACC High School Completion (Education Matters Program) at 100% request ($30,000 CDBG, $20,000 ARPA) • Fund Georgia Conflict Center (Restorative Justice Program) at 100% request ($30,000 CDBG, $4,200 ARPA) • Fund Chess and Community Conference (Project Rewire) at 100% request ($46,894 ARPA) • Fund YWCO (Summer Girls Camp) at 100% request ($30,000 ARPA); b) Authorize staff to include eligible carryforward funds in FY25 subrecipient contracts if the agency’s remaining project fund balance is 15% or less of the original allocation; c) Authorize acceptance of the associated HUD Grant Awards; and d) Authorize the Mayor and appropriate ACCGov staff to execute all related contracts and documents. The motion as amended passed by roll call vote with Commissioners Davenport, Link, Taylor, Wright, Fisher, Culpepper, Myers, and Thornton voting YES; and Commissioner Houle voting NO. (8 YES; 1 NO) A motion was made by Commissioner Wright, seconded by Commissioner Taylor, to a) Approve the list of roadways and associated maintenance activities recommended for the CY24 Pavement Maintenance Program (PMP) project, as shown in Attachment #1 of agenda report revised May 10, 2024; b) Adopt the following project resolution, as shown in Attachment #2, authorizing the Mayor and appropriate staff to sign all related contracts, documents, and certifications associated with funding for this project; c) Authorize the Mayor to execute a second one-year extension to the Unit Price Construction Services Contract with Pittman Construction Company, Inc. for the CY24 PMP Project at a cost not to exceed $8,414,455 ; and d) Authorize Mayor and appropriate staff to execute all related documents. The motion passed by unanimous vote. AUTHORIZING RESOLUTION CY2024 PAVEMENT MAINTENANCE PROGRAM PROJECT WHEREAS, The Mayor and Commission of the Unified Government of Athens-Clarke County, Georgia, have specifically determined and found that it is in the public interest to perform rehabilitation on approximately 25.18 (twenty five point eighteen) lane miles and preventive maintenance on approximately 78.83 (seventy eight point eighty three) lane miles of locally maintained roads (hereinafter referred to as “the PMP Project”); and WHEREAS, The Mayor and Commission of the Unified Government of Athens-Clarke County have further found that the PMP Project is necessary and appropriate for the protection of public safety and serves the general welfare of Athens-Clarke County. NOW, THEREFORE, the Commission of Athens-Clarke County, Georgia, hereby resolves as follows: SECTION 1. This PMP Project is authorized and approved as an official project of the Unified Government of Athens-Clarke County, Georgia. SECTION 2. The Mayor, Clerk of Commission, and Manager, or their respective lawful designees, are hereby expressly authorized to initiate, certify, and sign all documents and to per- form all lawful acts necessary to secure funds from the State of Georgia, or the United States of America, or from any department, agency, or subdivision thereof or from any private individual or entity, to defray, in whole or in part, the cost of the said PMP Project; and SECTION 3. The Manager or his lawful designees are hereby expressly authorized to acquire appropriate interest or title to all real estate necessary for the reasonable execution of  said PMP Project, by any means allowed by law including, without limitation, the exercise on behalf of the Unified Government of Athens-Clarke County, of the power of eminent domain; SECTION 4. The Manager or his lawful designees are hereby authorized to employ or contract for the professional services of attorneys, accountants, engineers, architects, appraisers, sureties, indemnitors, actuaries, and other professional consultants necessary for the plan, design, construction, execution, and general management of the said PMP Project; and, SECTION 5. The Manager or his lawful designees are hereby authorized to seek bids or competitive proposals in the newspaper, on radio stations and television stations, or by other means as they deem appropriate or as may be required by law; and SECTION 6. The Mayor, Clerk of Commission, and Manager, or their respective lawful designees, are hereby authorized to execute and file all documents and certifications necessary for the proper completion of the said PMP Project. SECTION 7. This Resolution shall be construed to confer upon the Mayor, Clerk of Commission, and Manager, or their respective lawful designees, all incidental authority necessary to carry out the purposes of this Resolution as expressed in the preamble and the foregoing sections. New business – Consider under suspension of Rules A motion was made by Commissioner Davenport, seconded by Commissioner Myers, to suspend Rules of Commission for one item of new business. The motion passed by unanimous vote. A motion was made by Commissioner Link, seconded by Commissioner Myers, to adopt the following ordinance (#24-05- ) which was presented by title only. The motion passed by unanimous vote. AN ORDINANCE AMENDING THE DATE, TIME AND PLACE OF REGULAR MEETINGS OF THE COMMISSION OF ATHENS-CLARKE COUNTY, GEORGIA; AND FOR OTHER PURPOSES The Commission of Athens-Clarke County, Georgia hereby ordains as follows: SECTION 1. The Mayor and Commission of Athens-Clarke County, Georgia, shall hold its regular June business meeting on Wednesday, June 5, 2024, at 6:00 p.m. in the Clarke County School District’s Vernon Payne Meeting Hall in its administrative offices at 595 Prince Avenue, Athens, Georgia, while additional security measures are implemented at the Mayor and Commission’s normal meeting place in the Commission Chamber of City Hall, 301 College Avenue, Athens, Georgia. SECTION 2. All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 3. The Clerk of Commission, in consultation with the County Attorney, shall have the power to correct scrivener’s errors. A motion was made by Commissioner Fisher, seconded by Commissioner Wright, to adjourn. The motion passed by unanimous vote.
