AVENAL THEATER MINUTES CALL TO ORDER: Mayor Pro Tem Preciado called the meeting to order at 6:00 p.m. Council Members Present: Ovalle, Preciado, Woolley, Gravelle. Council Members Absent: Casida PLEDGE OF ALLEGIANCE: Led by Mayor Preciado CITY CLERK: Government Code Section 54952.3: The members of the City Council, Successor Agency and Housing Authority are entitled to receive a total of $150.00 each as a result of convening a meeting as the City Council, Successor Agency and Housing Authority and, unless declined, each member will receive $150.00 (maximum aggregate of $300.00 per month per member) as a result of convening a meeting as the City Council, Successor Agency and Housing Authority. MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/HOUSING AUTHORITY MEMBER REPORTS/ITEMS FOR CONSIDERATION: A. Introduction of New Public Works Landscaping Employee Randy Weatherford: Mayor Casida Arthur Mora, Public Works Leadsman reported that Randy Weatherford is doing a great job. The City Council welcomed Mr. Weatherford to the Avenal family. B. Introduction of New Avenal Police Department Police Officer Jose Garcia: Mayor Casida Assistant Chief LaBlue stated the following: 1) Jose Garcia is the new full-time Police Officer; 2) Mr. Garcia has been a Reserve Officer since August 8, 2016 , graduated from the Police Academy Wednesday and started Thursday morning; and, 3) he also mentioned that Mr. Garcia is an Avenal boy and was part of the Explorers Program and they are happy to have him. Mayor Pro Tem Preciado announced that it shows commitment when you finish the Police Academy one day and show up to work full- time the next day. The City Council welcomed Jose Garcia to the City family. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: Maria Ovalle, Treasurer of the Miss Teen Avenal Scholarship Pageant stated that Domenica Sanchez, Chairperson, could not make it to the meeting and asked Mrs. Ovalle to come on her behalf. Mrs. Ovalle thanked the City of Avenal for making the Miss Teen Avenal a great success and for sponsoring the pageant. Also, she thanked Mayor Casida and Mr. and Mrs. Tuttle for helping organize and decorate the Miss Teen Avenal event. Mrs. Ovalle then introduced, New Miss Teen Avenal 2016/2017: Sofia Lopez. Joint City Council/Successor Agency/Authority Meeting November 10, 2016 Page 2 of 6 Sofia Lopez thanked the City Council and Staff for making the Miss Teen Avenal Pageant possible. Miss Lopez loves helping her community and will not take it for granted. She is a part of the Avenal Police Department Explorer Program and will be attending all events. Mrs. Ovalle added, the Miss Teen Avenal Committee has a new member, who could not be present today. His name is Edgar Garcia and his title will be “Activities”. She gave updates on previous winners of Miss Teen Avenal: 2012 - Mariana Zavala: attended West Hills College and joined the Navy. She is currently serving as a 3rd Class (E-4) Petty Officer and working to move up in rank; 2013 - Anna Atilano: attended West Hills College, Lemoore Campus and completed an Associate’s Degree in Health Science. She is currently working on her Bachelor’s Degree in Nursing and by 2018, will be an RN; 2014/2015 - Marisol Pacheco: is attending Fresno State and has completed her third year and will complete her Bachelor’s Degree in 2017; and, 2015/2016 - Jenifer Cabrera: She is currently a Senior in high school and will be attending a four year university majoring in Agriculture Business Management. Mrs. Ovalle thanked, the City of Avenal for supporting Miss Teen Avenal and without the City, this event would not be possible. Weston Anderson, Senator Andy Vidak’s District Representative, stated that he had toured Avenal and thanked everyone for a great time. Claudia reported that on December 6, 2016; 9:00 a.m - 5:00 p.m., they will see 40 patients with Vision Service Plan (VSP) and Adventist Health for free eye exams and eye care. There are pre-qualifications which include income, lack of insurance and have not used the program within the past twelve months. It is by appointment only. Residents need to call to make an appointment and will be issued a voucher. They will also be in Dinuba on December 8, 2016. Jeannie Tillotson stated concerns as follows: 1) she wants to clean the Avenal Theater and there are others that also would volunteer; and 2) she wants to know when is it will be open. Melissa Whitten, City Manager mentioned that City Council and Staff met recently to discuss how this was going to be handled. The Recreation Department is going to play a very large part in this and they have been in contact with people that are very interested in renting the facility. As far as getting a professional service to clean the theater, we are looking into that and it will be quite expensive. Ms. Tillotson mentioned that there are volunteers that want to come in to clean the theater, as they feel they are a part of this theater. They built the theater and want to keep the theater by helping bring it back again. Volunteers do not cost the City anything. Ms. Whitten stated this is the first she has heard that anyone wanted to volunteer. She will take name and phone numbers for anyone wanting to volunteer. ACTIVITY REPORTS/SPECIAL PRESENTATIONS AND COMMITTEE REPORTS: A. Activity Reports: 1) Public Works/Building/Code Enforcement/Animal Control Departments Activity Report: Scott Davis, (Acting) Public Works Director; Ms. Whitten mentioned that Scott Davis had a family emergency and Arturo Mora will present report. Arturo Mora, Public Works Leadsman reported on the following: 1) Building Department; 2) Code Enforcement; 3) Park & Landscaping; 4) Street; 5) Water Distribution; 6) Waste Water Collection; 7) Vehicle, Equipment, & Building Maintenance. 2) Community Activities Department Activity Report: Shelia Verdugo, Supervisor; Anna Lara, Senior Recreation Leader, reported the following: 1) Farmers Market; 2) September 10th Soccer Clinic; 3) September 14th Rap Up for Farmers Market meeting with KCAO, UCCE, and the County Health Department; 4) KCAO hosted a Karate Demonstration during the Fruits and Veggies Fest by State Foods; 5) Day of the Family; 6) assisted RAP with the Youth Soccer Program; 7) participated in the Kings County Coalition for Wellness to bring awareness to Domestic Violence, Human Trafficking, and other critical topics; 8) participated in the “Rock the Purple” luncheon; 9) Staff participated in the Pistachio Festival October 22-23; 9) the Safe ‘n’ Sane Halloween will be held on October 28th and will be partnered with AES; 10) Staff assisted Champions to distribute information on “Celebrating Families,” a 16 week program for the entire family; and, 11) Staff is working on bring back Holiday Magic Parade. Councilmember Woolley expressed concern regarding the on-going usage of buildings. She did not see the nutritional programs at the Veterans Hall. Ms. Lara mentioned that she did not put them on there but she will put it on the ongoing building use. Joint City Council/Successor Agency/Authority Meeting November 10, 2016 Page 3 of 6 3) Community Development/Planning Activity Report: Fernando Santillan, Community/Economic Development Director; Fernando Santillan, Community/Economic Development Director reported the following: 1) $1.85 million CDBG Grant was awarded, including $1.2 million for public recreation facility (gym) and $511,628 for Housing Rehabilitation and Homebuyer Programs; 2) conducted the Active Transportation Plan/Safe Routes to School Plan presentation with the City Council and the Planning Commission on November 1, 2016; 3) work continues on the Tire-Derived Product Grant for rubber mulch, pavers, and landscaping at Rice Park and downtown; 4) the Basketball Court Resurfacing Project underway, waiting on tiles and basketball goals to arrive and Public Works crew will be smoothing out the surface prior to installation; 5) work continues on implementation and administration of the City’s First-Time Homebuyer and Housing Rehabilitation programs; 6) the General Plan continues to move forward with the Safe Routes to School, Non- Motorized Transportation Plan, and Economic Development Strategy under development. A joint City Council and Planning Commission meeting is scheduled for Nov. 1, 2016; 7) the City was awarded a $500,000 planning grant for the 18” water transmission line replacement project; and, 8) Work continues with interested parties considering potential development and business expansion projects in Avenal; Mayor Pro Team Preciado asked the status on the fence around the basketball court which was mentioned at a previous meeting. Mr. Santillan reported that it is still a part of the project, which will be done in phases. The phase for the containment fence around the court, will be done towards the beginning of the new year, after goals, tile, and new lights have been installed. Staff has received two quotes and is working on another for the net. It is just a process of coordination. Mayor Pro Tem asked how the Technology Center is being used. Mr. Santillan reported that the City has partnered with Reef Sunset Unified School District to offer parent education classes. They have been marketed at the school sites and in the Avenal Chimes. They were to start today but the attendees had canceled so the first class has been postponed until December. It will run the second Thursday of each month from 6:00 – 8:00 p.m., until June. Rosa Moreno asked if there will be public use of the Technology Center’s computers. Mr. Santillan stated that Staff has not established a public use plan yet. Staff is planning to do this in the new year by coordinating with the Recreation Department and establishing the hours. 4) Avenal Police Department Activity Report: Arend LaBlue, Assistant Chief of Police. Arend LaBlue, Assistant Chief of Police commented on the following: 1) Monthly Statistical report; 2) multi-day crime spree suspect; 3) traffic stop leads to recovery of Avenal Elementary School Computer; 4) May 2016 stolen vehicle and burglary suspect arrested; 5) commercial burglary solved; and, 6) Detectives solve September shooting. Rosa Moreno thanked the Avenal Police Department for the training provided for CRT members. B. Special Presentations/Requests: 1. None. PUBLIC HEARING(s): 1) None. OLD BUSINESS: A. Extending Local Emergency Declared on February 27, 2014: Staff is requesting by motion, to approve the ongoing Local Emergency Declaration and drought conditions as they continue to exist; therefore, Staff recommends that the Local Emergency Declaration be renewed/extended for 21 days and reviewed again at the December 8, 2016 City Council meeting. After a brief discussion, the following action was taken. A motion made by Councilmember Woolley to approve the ongoing emergency Resolution, and specifically, prior to the expiration of the 21st day, the emergency Resolution be renewed for an additional 21 days, after the conclusion of the 21 days, unless a Council member or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled; seconded by Councilman Ovalle and carried. Joint City Council/Successor Agency/Authority Meeting November 10, 2016 Page 4 of 6 Roll Call Vote: AYES: Woolley, Ovalle, Gravelle, Preciado. Consider Acceptance and Approval of Final Site Plan Design for New Transit Hub Located on South Seventh Avenue: Mayor Pro Tem Preciado state that there was a study session on this item was impressed at that time. Ms. Whitten reported that Staff has been working with Angie Dow, Director of Kings County Area Public Transit Agency (KCAPTA), to locate a new transit hub in Avenal for the last two and half years. Once a site was identified, KCAPTA obtained REY Engineering for the project’s planning and design. Staff has been working with both agencies on a practical but efficient design of the site, which will greatly improve the area, as well as meet a transportation need within the community. As part of the agreement with KCAPTA, City Council’s acceptance and approval of the final plan design is needed prior to moving forward on the project. Staff had brought a conceptual plan before the City Council in July. Council indicated although the project’s design plans seemed to be going in the right direction, more detailed information was needed in order to consider acceptance and approval. Summers Engineering and Staff recently met to review the plan documents. There were a few comments and recommendations to be submitted to REY Engineering but, overall, the plans seemed to be in good order. Staff recommends by motion, accept and approve final design plans for new Transit Hub in Avenal. Ms. Dow did confirm that the structure on the plans is what will be installed at the Transit Hub. After a brief discussion, a motion made by Councilman Gravelle to accept and approve final design plans for new Transit Hub in Avenal and seconded by Councilman Ovalle and carried. Roll Call Vote: AYES: Gravelle, Ovalle, Woolley, Preciado. NOES: None. ABSENT: Casida. ABSTAIN: None. NEW BUSINESS: A. Consider Agreement with Sierra Rubber Company for Installation of Rubberized Tree Wells and Rice Park Walkway: Mr. Santillan reported as part of the Tire-Derived Grant project currently underway, the City has sought bids from contractors to perform the installation of 54 rubberized tree well mats on Kings Street and a rubberized walkway at Rice Park. Only two potentially available contractors were identified. One contractor, Sierra Rubber Co., is the vendor who will be providing the rubber for the projects. The other contractor is Community Services Employment Training (CSET), a non-profit contractor from Visalia. Sierra Rubber Co. - $12,500 (including labor and materials) Est. completion: 2 weeks CSET - $17,300 (labor only, materials extra) Est. completion: 4 weeks Based on the quotes received, Sierra Rubber Co. would be the lowest overall cost to complete the installation. Staff recommends authorizing the City Manager to enter into an agreement with Sierra Rubber Co. for an amount not to exceed $12,500. After a brief discussion the following action was taken: RESOLUTION NO. 2016-54: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH SIERRA RUBBER CO. FOR INSTALLATION OF RUBBER TREE WELLS AND PARK WALKWAY. The motion was made by Councilmember Woolley, seconded by Councilman Ovalle, and carried. Consideration to Approve Change Order for Emergency Operations Center (EOC) Parking Lot Paving: Arend LaBlue, Assistant Chief of Police, stated during the update on the North Wing of the Avenal Police Department, an approximately 2,500 square foot dirt area was slated to be paved for parking. This was measured and quoted by Robbie’s Construction in the original bid. The area was excavated and leveled by Avenal Public Works and Acting Public Works Director Scott Davis during which time, it was determined to be necessary to replace an additional 1,200 square feet of existing aged and deteriorated asphalt. He continued the additional 1,200 square feet of asphalt would allow the new parking lot asphalt to mate with asphalt laid during the remodel of the Avenal Police Department in 2010. The 1,200 sq. ft. of asphalt was last replaced in the 1950’s. Scott Davis consulted Robbie’s Construction representative Giovanny Andrade, who agreed to pave the additional 1,200 sq. ft. Due to timing of the problem’s identification and the scheduling of the arrival of the asphalt, it was not possible to do a change order at that time. Assistant Chief LaBlue, Scott Davis and Mr. Andrade agreed to a change order at a later time to reimburse the cost of materials. Staff recommends approval of a change order in the amount not to exceed $5,940.00 to be expended from 10.12500, Account 725 (construction account) from the Grant monies received from the State. No impact to the General Fund. A motion made by Mayor Pro Tem Preciado to approve change order in the amount not to exceed $5,940.00, seconded by Councilman Gravelle, and carried. CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS: Councilman Ovalle reported the following: 1) he has learned to appreciate the State of Pennsylvania. Ms. Whitten reported the following: 1) she mentioned tomorrow is Veterans’ Day and as it is a Federal holiday, City Hall will be closed but Avenal Police and the On-Call personnel will be available; 2) Staff received a picture plaque from the Avenal High School 2016/2017 Cheer Team as a thank you for the City’s budgeted donation; and the two cheerleaders who came to City Hall with the plaque were invited to the meeting but were not able to attend; and, 3) Staff is proceeding with the Holiday Magic as Anna said. It will be a nice event. Mayor Pro Tem Preciado reported on the following: 1) Joint Planning Commission and City Council meeting regarding the Walkability Study was held in conjunction with Fresno State and Staff; 2) He attended a meeting in Fresno where Manuel Cuna was awarded “Agriculturalist of the Year” by the Chamber of Commerce. Manuel Cuna has been a promoter for farmer’s rights, immigration concerns, and many other issues. Also, a citrus company out of Orange Cove was awarded the “Farmer Business of the Year” and they are number four (4) in the nation regarding citrus production. They also give back to the community like the Wonderful Company; and, 3) He also attended the Water Commission meeting in Sacramento. Ms. Whitten commented on Manuel Cuna, as she also was invited to attend the presentation yesterday. She did sit at the Knee’s Farm head table. Mr. Cuna is a very humble man, representing this whole area of California and beyond. Mr. Cuna has included Avenal as one of his cities in which he is very concerned in regards to water and economics. This has been going on for several years. She spoke to Mr. Cuna and personally “Thanked him on behalf of the City of Avenal.” There was a video of him explaining his history and what he has done, with his concluding remark being “Put your cell phones down, sit down, and have dinner with your family” He is a wonderful man and has really helped Avenal.
