KINGS STREET; AVENAL, CA MINUTES Mayor Casida called the meeting to order at 6:00 p.m. Council Members Present: Preciado, Woolley, Gravelle, Ovalle, Casida. Council Members Absent: None. PLEDGE OF ALLEGIANCE: Lead by Mayor Casida. CITY CLERK ANNOUNCED: Government Code Section 54952.3: The members of the City Council, Successor Agency and Housing Authority are entitled to receive a total of $150.00 each as a result of convening a meeting as the City Council, Successor Agency and Housing Authority and, unless declined, each member will receive $150.00 (maximum aggregate of $300.00 per month per member) as a result of convening a meeting as the City Council, Successor Agency and Housing Authority. CONSENT CALENDAR: All items listed under the consent calendar are considered to be routine and enacted by one motion: (Action) A. City of Avenal/Successor Agency/Housing Authority – Approval of Minutes for November 10, 2016: B. City Warrants and Financial Statements for November: Mayor Casida abstained from warrant #42173. He explained that he and his wife are involved with the Coats for Kids every year. They had an event at Macy’s for the purchase of the coats and would receive an additional 20% off the purchase if he used his Macy’s credit card. This would allow more coats to be purchased. He used his Macy’s credit card to purchase the coats for $4,351.25. The Avenal Police Department requested reimbursement to Mr. & Mrs. Casida. In total, the event was successful and 199 coats and 96 bicycle helmets were given to children. A motion to approve the Consent Calendar was made by Councilman/Successor Agency/Housing Authority Member Gravelle, seconded by Mayor Pro Tem/Successor Agency/ Housing Authority Member Preciado and carried. Presentation of “Years of Service” Recognition – Harlin Casida, Mayor would be moved to Item B. Therefore, Item B. Consider Resolution Accepting November 8, 2016 Election Results would be moved to Item A. CITY COUNCIL RE-ORGANIZATION: A. Consider Resolution Accepting November 8, 2016 Election Results: Ms. Whitten reported that Staff received the November 8, 2016, Certified Election results on Tuesday, December 6, 2016. The Election results are as follows: 1) The total number of ballots cast at said election was 1,917; 2) The total number of ballots cast at the City's t w o (2) precincts established for said election was 1,101; and, Amended Special Joint City Council/Successor Agency/Authority Meeting December 8, 2016 Page 2 of 10 3) The total number of absentee voter ballots cast in said City was 816. Also, Section 3. Of the Certified Election results states the votes received were as follows: Dagoberto Ovalle - 416 votes, Rosa Isela Moreno - 477 votes and Glenda Woolley - 489 votes. Staff is asking City Council to certify results by resolution. RESOLUTION 2016-55: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL RECITING THE FACT OF THE GENERAL MUNICIPAL ELECTION HELD IN SAID CITY OF AVENAL ON THE 8TH DAY OF NOVEMBER, 2016 DECLARING THE RESULTS THEREOF. Presentation of “Years of Service” Recognition – Harlin Casida, Mayor: Ms. Whitten stated that she would like to say a few words and welcomed Councilmembers or anyone that would like to say a few words or offer good wishes to Mayor Casida. She researched historical records in order to see how many years Mayor Casida had served with the City of Avenal. Mayor Casida had served on the City Boundary Formation Committee which laid out the boundaries for Avenal. At that time, it was 18 ½ miles. He was first voted in as a Councilman in 1979 and served until 1988. He was elected Mayor for the years between 1996 and 2016. Mayor Casida has served over 29 years of public service and for that, the City of Avenal “thanks him”. Mayor Casida has been involved in many significant projects as follows: 1) the building of the Avenal State Prison; 2) the Street Project 87-1 and obtaining bonds; 3) improvements in Avenal with the help of the City of Avenal Redevelopment Agency where 52 miles of curbs, gutters and sidewalks were poured; and, 4) the community project to move the first School House in Avenal. It was brought into the City in 1929. The School District wanted to remove it from the Avenal Elementary School property. Through the support of the community and City Council, and, with a grant, the school house was moved to Rice Park. It is currently used as the City of Avenal Recreation and Technology Centers. Mayor Casida has served on many committees. In addition, he either attends or helps with most community events. He has missed very few meetings in his 29 years. Mayor Casida was honored by the City of Avenal for his “Years of Service” with a plaque to hold his gavel, a matching decorative clock and a gold pocket watch with a knife attached which was engraved with his initials. In addition, the City of Avenal wanted to acknowledge his wife, Carol Casida, for her service as “she put up with a lot”, endless phone calls and dinners without Mayor Casida, due to community meetings, etc. She asked that the Mayor “thank Carol”, because he could not have done everything without her help and support. She thanked them both for their service and wished them the best. Councilman Ovalle mentioned he started as a City Council Member in 2008 and it has been a pleasure and honor to have worked with Mayor Casida. Mayor Casida is very knowledgeable and very caring about the city as a whole and he made it easy to work with him. He noted that everything that has been covered and voted for, has been in part, because Mayor Casida truly cares about the community and has been a great Mayor for all these years. He will personally will miss him. Councilmember Woolley mentioned Council politics and she had learned much from Mr. Woolley but Mayor Casida was always there and willing to explain all sorts of things. Mayor Casida asked to her to take a position on the Council and it got her started on the City Council. She will not stay for 30 years but will as long as she can. Richard Valle, District 2, Kings County Supervisor stated Mayor Casida is a legend and a hero for the City of Avenal. Over the last 8 years in which he has served as a County Supervisor, any time there was a very critical issue facing a vote which affected the City of Avenal, Mayor Casida would make the drive to represent Avenal. He thanked Mayor Casida for his years of service and presented a Certificate of Recognition to Mayor Casida. Amended Special Joint City Council/Successor Agency/Authority Meeting December 8, 2016 Page 3 of 10 Dixie, a representative from Congressman Valadao’s office, also presented a Certificate of Recognition to Mayor Casida. William Munoz from Assemblyman Rudy Salas’ office stated Mayor Casida was the first person he met when he began working for Assemblyman Salas. He related a story, in which he had an acquaintance who was thinking of running for public office and talked to his friends. One friend told him, “Well, you are a warm blooded person and your body temperature is 98.7 degrees. Now, politics is like the San Francisco Bay, which is very cold, either you can warm up the waters or the waters are going to cool you down.” He did not know about the Bay, but Mayor Casida, “you have warmed the waters for Avenal” and presented Mayor Casida with a Certificate of Recognition. Mayor Casida said when he first got into government, Mrs. Casida stated “I am not going to any of the meetings so that when I am asked questions, I will not know the answers”. She did not lie and she can honestly say she doesn’t know. Also, the Raiders were playing tonight. Ms. Whitten mentioned she had a picture when they broke ground for the prison. This was what caused the Mayor to step down for 8 years, as his Superintendent of the school was not supportive of his position on City Council. He also stated that during his 29 years he has met a lot of good people. He stated “it’s been a pleasure, it’s been fun and educational, he is not going away and thanked everyone.” Mayor Pro Tem Preciado thanked Mayor Casida for all he has done for the City of Avenal and he has learned a lot from him. Mayor Casida was there with him from the beginning. Rusty Stivers presented a plaque with the Avenal Police Department star to Mayor Casida for his vision of the Avenal Police Department. Rosa Moreno, representing the residents, said her daughter had gone to high school when Mayor Casida was a teacher. She stated that “few leaders are good leaders like you; you lead by example without promising that you would deliver.” Mayor Casida then left the meeting. Administering the Oath of Office to Newly Elected Council Members: Ms. Ortiz, City Clerk, administered the Oath of Office to Glenda Woolley, Rosa Moreno, and Dagoberto Ovalle who were seated as the new City of Avenal Councilmembers. CITY CLERK Opened Nominations for MAYOR: Ms. Ortiz opened nominations for Mayor. Councilman Gravelle nominated Councilmember Woolley. Councilmember Moreno nominated Mayor Pro Tem Preciado. A motion was made by Councilmember Woolley to close nominations, seconded by Councilmember Moreno and carried. Roll Call Vote: AYES: Woolley, Moreno, Ovalle, Gravelle, Preciado. NOES: None. ABSENT: None. ABSTAIN: None. Ms. Whitten stated, at this time, she would call for the votes for Mayor. Councilman Gravelle has nominated Councilmember Woolley and Councilmember Moreno nominated Mayor Pro Tem Preciado. A show of hands was called for Councilmember Woolley as Mayor. She received two (2) votes. A show of hands was then called for Mayor Pro Tem Preciado as Mayor. He received three (3) three votes. She thanked the City Council and everyone as it has been a busy year with a lot of changes. There was a big win tonight, but as the former Mayor said, “Keep moving forward.” She shared she had been sending text messages to Public Works Director, Rob Williams, who is currently off for medical reasons. Mr. Williams had expressed that there are changes going on in every department, but told her, “Mel we get up, we do it and we keep moving forward.” He also sends his best to everyone. MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/HOUSING AUTHORITY MEMBER REPORTS/ITEMS FOR CONSIDERATION: A. None. PUBLIC COMMENT /ANNOUNCEMENT &UNSCHEDULED APPEARANCE: No comments were offered. ACTIVITY REPORTS/SPECIAL PRESENTATIONS AND COMMITTEE REPORTS: A. Activity Reports: 1) Public Works/Building/Code Enforcement/Animal Control Departments Activity Report: Scott Davis, Acting Public Works Director; Scott Davis, Acting Public Works Director reported on the following: 1) Building Department; 2) Code Enforcement; 3) Park & Landscaping; 4) Street; 5) Water Distribution; 6) Waste Water Collection; and, 7) Vehicle, Equipment, & Building Maintenance. Mr. Davis did comment that in regards to the electrical concerns about the Veterans Hall kitchen area, when the remodel was done, no electric circuits were added. Some of the circuits were cleaned up and loads were shifted around in order to have a more power in a kitchen area. The funding did not allow Staff to install a new sub-panel for that area so there is still a problem when you plug in two or three hot plates or roaster ovens. Staff did their best with the monies provided. Councilmember Woolley asked if electrical outlets have been added since then. Mr. Davis stated no, not to the main panel box. It is his understanding that when having functions there, too many thing are plugged in at one time and that will cause the breakers to pop. 2) Community Development/Planning Activity Report: Fernando Santillan, Amended Special Joint City Council/Successor Agency/Authority Meeting December 8, 2016 Page 5 of 10 Community/Economic Development Director; Fernando Santillan, Community/Economic Development Director reported the following: 1) the basketball court surface has been installed at Rice Park and the lines for basketball, volleyball, and futsal (soccer) have been painted. The next step is to patch areas under tiles where the ball may not bounce well and to install the new basketball hoops. LED lighting options are currently being researched for installation early next year; 2) He participated in Career Day at Reef-Sunset Middle School along with the Recreation Department to talk to kids about potential careers at the City and the types of work that we do; 3) Work on the Tire-Derived Product Grant for rubber mulch, pavers, and landscaping at Rice Park and downtown is scheduled to begin the week of Dec. 5th; 4) Work has begun on the Planning, Engineering, and Design phase of Water Line Replacement Project. Easement owners are to be contacted and planning is starting for the surveying phase; 5) He toured the Avenal State Prison as part of the Novembers ASP Citizens Advisory Committee and was very impressed with the work being done by Warden Ndoh and her staff; 6) Work on implementation and administration of City’s First-Time Homebuyer and Housing Rehabilitation programs is continuing; 7) He attended a focus group at the Fresno Council of Governments to discuss ways to improve transportation options in underserved Central Valley communities, particularly with regard to medical and school-related transportation; 8) the official Ribbon-Cutting ceremony for the Arroyo del Camino Apartments will take place Tuesday, December 12, 2016, at noon; 9) the General Plan continues to move forward. The Economic Development Strategy is under development and Alternative Transportation Plan/Safe Routes to School Plan is scheduled for adoption this month; 10) Work is continuing with interested parties considering potential development and business expansion projects in Avenal; 11) the procurement process for a Housing Program Contractor is underway and he is working with the California Housing and Community Development Department to evaluate bids. Self-Help Enterprises’ contract with the City has expired and we were just awarded a $480,000 HOME Grant to continue our First-time Homebuyer and Housing Rehab programs; 12) He is working with Reef-Sunset Unified School District and the Kings County Office of Education to begin Parent Education classes at the Technology Training Center. The next class will start on Tuesday, December 6, 2016 and will run once a month until June 2017. The Technology Center is currently being used extensively for various programs, including the Wonderful after-school program; 13) the hiring process has begun for the additional Community Development staff person. Council will be updated on the progress; and, 14) Permit and Zoning applications are continuing at a steady pace, keeping staff and Planning Commission busy. 3) Avenal Police Department Activity Report: Rusty Stivers, Chief of Police Rusty Stivers, Chief of Police reported the following: 1) a double homicide in the 200 block of South Fourth Avenue; 2) a gang related shooting on Thanksgiving Day; 3) a parolee was arrested for meth sales; 4) CAD Calls Received; 5) Monthly Statistical Report; and, 6) He thanked Officer Tapia and everyone involved with the Coats for Kids program. B. Special Presentations/Requests: 1) Mid Valley Disposal 3rd Quarter Activity Report: Isaac Kulikoff Isaac Kulikoff, Mid Valley Disposal Quarter Activity reported the following: 1) Elia Medina was unable to come tonight, but she is working with the community in Avenal and will be there next quarter to do the presentation; 2) He mentioned that a vehicle fire caused the loss of one truck but the other two were saved. The fire is still under investigation however, it appears to have been an electrical fire. He thanked Staff, Avenal Police Department and Fire Department for their help; 3) Elia Medina kicked off the recycling contest at Avenal Elementary and the winner was awarded a pizza party on the cafeteria stage and a recycling charm. The kids were happy; 4) A presentation was made at the El Palmar Apartments regarding the importance of separating recyclables from waste. Games were played and everyone had fun; 5) on the commercial site visits, great improvement was made by the West View Apartments. 6) Villa Esperanza also had a presentation; 7) the Day of the Family was successful and Kings County had provided kiosks for disposal of sharps and medications; and 8) Tonnage Report: Recycling- Residential 134, Green Waste 142 and Refuse 558. PUBLIC HEARING(s): A. None. Amended Special Joint City Council/Successor Agency/Authority Meeting December 8, 2016 Page 6 of 10 OLD BUSINESS: A. Consider Extending Local Emergency Declared on February 27, 2014: Staff is requesting by motion, to approve the ongoing Local Emergency Declaration and drought conditions as they continue to exist; therefore, Staff recommends that the Local Emergency Declaration be renewed/extended for 21 days and reviewed again at the January 12, 2016 City Council meeting. After a brief discussion, the following action was taken. A motion made by Councilmember Woolley to approve the ongoing emergency Resolution, and specifically, prior to the expiration of the 21st day, the emergency Resolution be renewed for an additional 21 days, after the conclusion of the 21 days, unless a Council member or member of the public request that the Council convene to consider the ongoing emergency Resolution, at which time a special meeting would be scheduled; seconded by Mayor Pro Tem Ovalle and carried. Consider Ratifying Action to Purchase Relift Pump #2, Variable Frequency Drive: Ronald Brumley, Utilities Supervisor, reported that the Variable Frequency Drive (VFD) at Relift Pump #2 has suffered an electrical short within the unit, rendering it inoperable and unable to control Relift Pump #2. Staff currently has Relift Pump #1 on line and Relift Pump #3 is currently in the shop for repair. If Relift Pump #1 should fail, Staff would not be able to transmit water from Tank #2 to Tank #3, which is the City’s main supply. Also, if a water leak should occur on the 18” main from Plant #2, Staff would not be able to supply Tank #3. This is, in essence, putting the City’s water in jeopardy in case of any emergency that may occur. Staff recommends, by motion, to approve the expenditure of $10,000.00 plus tax and shipping per pump. Ms. Whitten clarified that Staff is asking for the City Council by motion, to ratify the emergency purchase at this time. Staff has purchased Variable Frequency Drive (VFD) Relift Pump, due to the emergency and is asking the City Council to ratify the purchase. Councilmember Woolley asked for clarification, one pump is one working, one is getting installed and one is being repaired. Mr. Brumley stated, yes. A motion made by Councilman Gravelle to ratify the purchase of the Water Treatment Plant Variable Frequency Drive (VFD) Relift Pump expenditure from Fund 14.14000.625, not to exceed $10,000.00, seconded by Mayor Pro Tem Ovalle and carried. Consider Adoption of Final Active Transportation Plan and Safe Routes to School Plan: Amended Special Joint City Council/Successor Agency/Authority Meeting December 8, 2016 Page 7 of 10 Mr. Santillan reported the item before the City Council is a recommendation from Staff to approve the Final Draft of the Active Transportation Plan. As the City Council recalls, back in November, they held a workshop with the Planning Commission, City Council and our General Plan consultant, PlaceWorks. The Active Transportation and Safe Routes to School Plan has been finalized after input from the community, the General Plan Citizens Advisory Committee, Planning Commission, and City Council. The comments received have been incorporated into the document and the document is now ready for formal adoption by the City Council. Councilmember Woolley was concerned with residents crossing San Joaquin at the Lodging House and noted it is not indicated in the plan. Mr. Santillan stated the consultant did send the change for that intersection in the list, but the Resolution could be approved with the condition that the change be made. Staff recommends by resolution, to approve/adopt the Active Transportation and Safe Routes to School Plan. After a brief discussion the following action was taken: A motion was made to adopt RESOLUTION 2016-56: A RESOLUTION OF THE AVENAL CITY COUNCIL ADOPTING THE FINAL DRAFT OF THE AVENAL ACTIVE TRANSPORTATION AND SAFE ROUTES TO SCHOOL PLAN by Mayor Pro Tem Ovalle, seconded by Councilmember Moreno and carried. Consider The Purchase of a new Air Compressor and Replacement Engine for the Backup Jet Rodder: Mr. Davis reported that in September 2016, the San Joaquin Valley Air Pollution Control District (SJVAPCD) sent notification informing the city that effective January 1, 2017, all Tier 0 diesel engines would no longer be permitted to operate within California. The city has two (2) pieces of equipment that are affected by this notification. One, a 1989 185cfm air compressor and a 1996 jet rodder. Both machines were previously given permits to be operated as low usage. The State Water Resources Control Board requires backup equipment to be available within one-hour in response to any sewer plugs. The air compressor is also needed for street and water line repairs. He continues that Staff has contacted various companies to get options for replacing this equipment. The first option being to re-power both pieces with newer diesel engines. The second option is purchasing used equipment that meets the SJVAPCD standards. The third option is purchasing new equipment. Staff has not found any used jet rodders that meet the new standards and the air compressors were all very high-hour machines. He concluded that Staff has received quotes for replacement engines and new air compressors. The replacement engine that was quoted is a direct replacement for the one in the jet rodder. This will allow the installation to be done with minimal modifications and no adaptors to be needed. The air compressor will be replaced as the cost of a new engine is more than a new compressor. Mr. Davis reported he contacted the SJVAPCD, and was told that although it is not known for sure, the Tier 4 engine could be run past the year 2030. This engine is projected to be satisfactory until the SJVAPCD says otherwise. Councilmember Woolley asked what a jet Rodder is? Mr. Davis reported, it is a machine used to clean sewer lines when there is a sewer plug and it uses water pressure with a nozzle. After a brief discussion, a motion was made by Councilmember Woolley to approve the City Manager to: 1) Purchase the ROTAIR D185T4F portable air compressor at a cost not to exceed $16,501.25; 2) Purchase the John Deere 4045TFC03 Tier 4 diesel engine at a cost not to exceed $29,167.17; 3) Draw down $45,668.42 from CIP Fund 75, transfer $29,167.17 to Fiscal Year 15/16 Wastewater Fund 15.15000.726 and the remaining $16,501.25 to Fiscal Year 15/16 General Fund 10.18000.726; seconded by Mayor Preciado and carried. Consider the Purchase of a Utility Locator: Mr. Davis reported that as Mr. Santillan had mentioned, Staff is planning to replace the 18” pipe line. Staff is currently in the phase of locating the existing pipe’s proximity to our easement boundary and its location, including its depth. This will require potholes to be dug approximately every 100 feet for both the 18” and the 12” water lines which equates to approximately 5,200 holes. The proposed length of replacement is +/- 26,000 linear feet. Staff had discussed using a utility locator instead of the pot holing. The Public Works Department does not have enough staff to handle the amount of work required so an estimate from a contractor was requested. The price is $90.00 per hour for the use of a backhoe and operator. Staff is currently in the process of obtaining utility locator prices and demonstrations. The purchase of a locator would save time and money for this phase of the project as well as being useful for locating other City utilities. Staff has contacted one company to date and have scheduled a demonstration for December 5, 2016. Other companies and locator options are being considered. Staff has determined a price range between $4,000 to $10,000 Amended Special Joint City Council/Successor Agency/Authority Meeting December 8, 2016 Page 9 of 10 depending on the locator and necessary accessories. Staff will get three quotes and determine the best locator for our needs. Staff is requesting approval from Council to allow the following: 1) authorize the City Manager to purchase a utility locator (after receipt and review of three (3) quotes in the range of $4,000 to $10,000; 2) draw down an amount not to exceed $10,000 from General Fund Reserves; 3) transfer needed funds to FY2016/17 City Budget, Fund 10.18000726; and, 4) let FY 2016/17 Budget reflect the change. Mr. Davis has three quotes above $5,000 and one (1) is almost $9,000. He mentioned that they seem to be more in the $6,000 range. This is a realistic price range for what Staff is requesting. Councilmember Moreno was concerned whether the City keeps maps of where pipes are located or installed within the City. Mr. Davis stated Staff have good records, but they are not accurate, as no as-built plans were ever made. Staff will still need to locate the pipe physically by digging for it or using a utility locater. He is confident with the demonstration given, these locaters are very accurate. CLOSING COMMENTS: Councilman Gravelle commented in the following: 1) Santa will be at the Theater. Councilmember Woolley commented on the following: 1) She enjoyed the Christmas Extravaganza and thanked Public Works for all the work they do. She had a unique experience with Mayor Preciado on a Christmas float, laughing all the way down the route because they have never been invisible before; and, it was the strangest feeling sitting there waving and no one even see’s you, because Santa Claus was right behind them throwing candy. It was a really good night, the crowd was just amazing and they went to the Fire Station after the parade. There was a long line for hot chocolate and more people than they could seat, inside. Mayor Pro Tem Ovalle commented on the following: 1) Christmas lighting was a great event and he loved the children getting overly excited, singing nativity songs, and then waving at the children as they liked “Santa trying to keep still while singing!” It was a great event and he and his wife really enjoyed it; and, 2) the Coats for Kids drive was a great event and we should try to double the effort so no one is sent away. Councilmember Moreno commented on the following: 1) she thanked everyone for welcoming her and said earlier “A good leader does not promise, but finds ways to deliver the best. That is what she will do.” Melissa Whitten commented on the following: 1) she thanked the Avenal Police Department, CRT, and all the volunteers who helped with a very successful coat drive; 2) Holiday Magic was a real success and a lot of fun. She thanked, Shelia, Anna, Mr. & Mrs. Claus, all of the children that sang and everyone that helped; 3) she stated Lupe Chavez is being sworn in tonight at the School District Board of Trustee meeting.
