Councilmember Woolley expressed concern that the City Attorney is not mentioned as attending the meeting on the minutes. Ms. Whitten stated that they are not unless they make a comment. Councilmember Woolley requested that Staff have the City Attorney be put on the minutes. Mayor Pro Tem Ovalle had a concern regarding the air conditioner compressor being replaced at the Veteran’s Hall and how old are the units? Scott Davis, (Acting) Public Works Director stated nine (9) years old. The building was remodeled in 2008, and the units were installed and units have run 24 hours/seven days a week, but that issue has been resolved. Consider City Council Appointments to Serve as Avenal Representative on Various Committees/Commissions: Melissa Whitten, City Manager reported a special City Council meeting was held on December 12th, with Mayor Preciado presiding. As noted, there are several vacancies on commissions where former Mayor Casida served for many years. Not all members of Council were in attendance so it was tabled to the next City Council meeting. Staff understanding that the City Council felt everyone should be in attendance for appointments to be made. She lists Committees/Commissions that have seats open. B. 2016 Holiday Magic Decorating Awards: Shelia Verdugo, Recreation Supervisor, stated that the Holiday Magic awards are given every year. The judges are the Recreation Commission and City Staff who go out and look at the homes that been decorated and are keeping the holiday spirit alive within Avenal. On behalf of the Recreation Commission & Recreation Department, she “Thanked all, for taking the time to decorate and keeping the Christmas spirit alive”. Consider Alcohol License Application for Skyline Mini Mart located at 722 Skyline Blvd: Joint Meeting City Council/Successor Agency/Housing Authority January 12, 2017 Page 3 of 8 Fernando Santillan, Community Development Director, reported that Staff had received a notification from the State of California Alcoholic Beverage Control Board (ABC) regarding a Type 21 – Off Sale General license for Skyline Mini Mart, 722 Skyline Blvd; which allows for the sale of distilled spirits in addition to beer & wine. Mr. Muharram currently holds a Type 20 – Off Sale Beer & Wine license, which only authorizes the sale of beer and wine for consumption off the premises. The Type 21 license would be transferred from La Reyna Restaurant, which recently deactivated their Type 21 license after being granted a Type 41 – On Sale Beer & Wine license for their restaurant/market. Normally, ABC requests that the local governing body state their position (in favor, opposed, neutral) with the regard to the new license. As our Census Tract is already over-concentrated with alcohol licenses (7 allowed, 13 existing), ABC is asking for the City Council to determine whether “public convenience or necessity will be served by the issuance of this alcoholic beverage license” (per form ABC-245, attached). This statement would need to be provided in the form of a resolution or on official City letterhead. ABC has also asked for verification of zoning and the acquisition of the necessary Conditional Use Permit (CUP) prior to the approval of the license application. The zoning has been determined to be adequate for the proposed use, and Mr. Muharram applied for a CUP in late November, which was approved by the Avenal Planning Commission on December 12, 2016 (contingent upon City Council approval pursuant to Form ABC-245). A copy of the Planning Commission Resolution/CUP approval is attached for the Council’s reference. Staff recommends that the City Council take either of two courses of action as follows: A) Adopt the attached resolution stating that the “public convenience or necessity will be served by issuance of this alcoholic beverage license” and thus approving the new license; or B) Adopt the attached resolution stating that the “public convenience or necessity will not be served by issuance of this alcoholic beverage license” and thus denying the new license After a brief discussion and comments from the public, the City Council asked for more information on existing alcohol licenses and continued item until the next meeting, January 26, 2017. Councilmember Woolley expressed concern that with the purchase of additional hybrid cars, would the mechanic need more training or would the cars be serviced elsewhere? Mr. Davis stated that due to the warranty, they will go out to be serviced. The mechanic has the knowledge and comprehends manuals, but if the city purchased the equipment to work on hybrid vehicles, it would not be cost effective. Councilmember Moreno expressed concerned whether the American Flag is put up and down every day even when it rains. Mr. Davis stated as long as the American Flag is lighted it can stay up 24 hours/seven days a week. Staff has purchased the utility locator. It has been used not for the water transmission line project yet, but has been used to locate city lines in three different areas for USA. It is going to be a great asset and tool to use. Community Activities Department Activity Report: Shelia Verdugo, Supervisor Joint Meeting City Council/Successor Agency/Housing Authority January 12, 2017 Page 4 of 8 Shelia Verdugo, Supervisor Activity Report: 1) Thanksgiving Meal; 2) Holiday Magic Celebration; 3) Home Decorating Judging; 4) the Family Paint Night will be held on the 1st Thursday of each month from February – May. Classes will be held at the AHS Art Room (#3). AHS Art Teacher, Mr. Paul Hyer, will be the instructor. The cost is $5.00 per person but if 4 or more people sign up together, a 10% discount will be given. Children, ages 5 and up, are permitted. All supplies are furnished. Mr. Hyer will receive 75% of the fees with the Recreation Department retaining 25%; 5) Sparkle Concert: Tickets are now on sale at City Hall or Recreation Center. They are $10.00 each pre-sale or $15.00 at the door. The concert will be held at the AHS Auditorium on February 18th at 6:00 pm with doors opening at 5:30 pm. All participants that dress up will be entered into a drawing to win a variety of official “Something Enchanted” memorabilia; 6) Staff continues to sit on the Tobacco Coalition, Diabetes Coalition and the Kings County Health and Wellness Committee; and, 7) Staff needs to begin working on setting, planning and implementing the next Farmer’s Market, with council direction. Mayor Preciado inquired into the volunteer committee that would like to help clean the theater. Mrs. Verdugo replied that she had no idea that such a committee had been formed, and felt that they were not directed to the Recreation Department. She loves the idea that someone would like to help clean theater. The facility needs much detailed cleaning, but Staff needs to sit down with whomever and discuss this issue. She met with Melissa and Dawn to discuss a Theater Cleaning volunteer committee and Staff will follow up with Mrs. Curty and Ms. Tillotson. Ms. Whitten mentioned that Staff is coordinating a meeting with Mrs. Curty and Ms. Tillotson. 2) Community Development/Planning Activity Report: Fernando Santillan, Community/Economic Development Director; Fernando Santillan, Community/Economic Development Director; 1) The next Parent Technology Education class starts on January 12 at 6:00 pm. Diana Enriquez is teaching the class and will be covering a variety of topics of interest to the students; 2) December is the reporting period for many of our open grant projects, including the Sustainable Communities Grant; 3) The Active Transportation Plan and Safe Routes to School Plan have been adopted. Thank you to all Council members, Planning Commissioners, committees and members of the public who participated in its development; 4) The City received approval from the State to move forward with the housing program administration contract with Self-Help Enterprises. The entire procurement process took four months, but we can now move forward with implementing the awarded housing program grants; 5) Community Development was very active in December assisting businesses with different types of needs in Avenal, including two existing local businesses looking for new locations. We were able to connect one business with a solid financing source and they were pre-approved for a new construction loan. The biggest need at the moment is availability and cost of real estate for development and/or leasing. Staff have been making calls to local property owners to assess availability of properties not listed on the market which may still be available for new projects; 6) Calls of interest from outside companies/investors looking to develop in Avenal; 7) Our tire-derived rubber project has been set back due to weather, but we hope to take advantage of an upcoming break from rain to complete the project downtown and at Rice Park; 8) The hiring process has begun for an additional Community Development staff person with interviews currently being scheduled; 9) Permit and Zoning applications continue at a steady pace, keeping staff and the Planning Commission busy; 10) Implementation of our recently awarded CDBG grant is set to begin this month as soon as we receive the executed agreement from the State. This grant is for the new public recreation facility/gym and housing programs. Councilmember Moreno would like to know if there will be public access to the computers lab. Staff is still trying to schedule the classes that will run on a regular basis. Staff’s goal, once that schedule established, is to then establish a good time for public access. He and his assistant will determine who will manage that aspect of the facility. Mayor Pro Tem Ovalle mentioned that, at a meeting, it was discussed if CIP money was set aside for the new public recreation facility to consider solar panels. Mr. Santillan stated yes, they are looking to incorporate solar into the original construction budget. The hope is to be able to acquire additional funding from private sources. Councilmember Moreno stated that she is happy Mr. Santillan is getting an assistant as he does a lot for Avenal. Mr. Santillan mentioned that there are three candidates interviewing and they are local people. B. Special Presentations/Requests: 1) Responsible Athletes Program Activity Report: Enrique Jimenez Enrique Jimenez reported the following: 1) He wanted to wish City Council and Staff a Happy New Year and would like to give them an overview of the year; 2) They are a 501(c) (3) nonprofit organization that is based in Avenal. They have an annual operating budget of $175,000. They serve over 5,513 youth & 1,137 adults and have since 2010. Their core elements include intramural sports programs with community gym services; 3) gym services and they are adding a boot camp for adults partnered with Vicente Resendez; 4) youth basketball, baseball, & flag football; 5) RSUSD sports academy; 6) adult basketball, softball, football & futsal; 7) youth soccer and the new soccer program for tiny-tots (3-5 year olds) was a great success thanks to Anna and Sheila’s help; 7) they plan to bring back the playmakers skill camp with Paul Williams on board; 8) He is working on developing Joint Meeting City Council/Successor Agency/Housing Authority January 12, 2017 Page 5 of 8 a pilot project with e-sports gaming at Avenal Middle School and thinks the children of Avenal would benefit from this billion dollar industry; and, 9) the Turkey Bowl. Consider Extending Local Emergency Declared on February 27, 2014: Staff is requesting by motion, to approve the ongoing Local Emergency Declaration and drought conditions as they continue to exist; therefore, Staff recommends that the Local Emergency Declaration be renewed/extended for 14 days and reviewed again at the January 26, 2017 City Council meeting. Consider Formal Acceptance of the City’s Audit/Financial Report for Fiscal Year 2015/16: Dawn Perkins, CPA, Administrative Analyst, reported the City Council reviewed the City’s Audit/Financial Report for Fiscal Year 2015/16 from Price, Paige and Company in the earlier study session. Staff recommends by motion, formal acceptance of the City’s Audit/Financial Report for Fiscal Year 2015/16. A motion was made by Councilmember Moreno to formally accept the City’s Audit/Financial Report for Fiscal Year 2015/16, seconded by Councilmember Woolley and carried. Consider Three-Year Agreement With Self-Help Enterprises for Housing Program Administration, Implementation and Grant-Writing: Mr. Santillan reported the City issued a Request for Proposals (RFP) in August of 2016, to 13 housing consultants statewide to write applications for and, if successful, operate the programs of the Community Development Block Grant Program (CDBG), Home Investment Partnership Program (HOME) and the CalHome Program. This would include the First Time Homebuyer Program and the Housing Rehabilitation Program. The RFP was advertised in the Hanford Sentinel, Avenal Chimes, and the City Website. Only one proposal, from Self-Help Enterprises (SHE), was received. He continued that Self-Help Enterprises is our current housing consultant and they have done an excellent job of implementing our housing grants, complying with state and federal regulations, and working with City staff on each project. Based in Visalia, they are well known throughout the Central Valley and Sacramento for their expertise. SHE manages housing programs for many other Valley cities, including Coalinga, Woodlake, and Visalia. Staff requested approval from the State of California Housing and Community Development Department to move forward with a sole-source contract with SHE and it was granted in December 2016. An agreement has been prepared for these services and is attached for your consideration. Staff requests, by Resolution, approval of an agreement with Self-Help Enterprises to administer the CDBG, HOME and CalHome programs for the next three years. Joint Meeting City Council/Successor Agency/Housing Authority January 12, 2017 Page 6 of 8 After a brief discussion the following action was taken: RESOLUTION NO. 2017-01: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH SELF-HELP ENTERPRISES (SHE) TO ADMINISTER THE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG), HOME INVESTMENT PARTNERSHIP (HOME) AND CALHOME PROGRAMS FOR THE NEXT THREE YEARS. C. Consider the Approval to Purchase Ford Fusion Energi Vehicles: Chief Stivers reported the first paragraph of the staff report is a review from the April 14, 2016 meeting. The City Council approved Community Development Director, Fernando Santillan’s recommendation to pursue the San Joaquin Air Pollution Control District (SJVAPCD) Public Benefit Grant Program where the City of Avenal could purchase clean air vehicles as defined on the grant program eligible vehicle list. The Air District grant would provide $20,000 per vehicle. Also approved was staff’s recommendation to utilize $40,000 from CIP Fund 75 and $5,000 from the Equipment/Maintenance Motor Vehicle Account 10.18000.727 as the City’s match which was allowed to be carried over to this budget year (FY 16/17) as per Resolution 2016-20. Staff has also located an additional grant from California Air Resource Board in the amount of $15,000 per vehicle. He continued as outlined in the April 2016 staff report, was the need to acquire the vehicles in order to replace two aging 2010 Ford Crown Victoria vehicles currently used by detectives. One additional vehicle would be purchased to replace the 2004 Ford Taurus which is currently used for city administrative travel and training purposes. Staff researched the eligible vehicles listed and found the Ford Fusion Energi hybrid vehicles would best fit the needs of the Police Department and City Hall staff. Listed below are the quotes received from the dealerships: Monarch Ford (Exeter) $32,199.63 x 3 vehicles=$96,598.69 Future Ford (Clovis) $33,538.93 x 3 vehicles=$96,598.69 Downtown Ford (Sacramento) Various prices x 3 vehicles=$103,089.80 The funds needed to make the purchase will be from the following accounts: $40,000 from Fund 75, account 45210 (CIP revenue transfer) $5,000 from Equipment/Maintenance - Motor Vehicle Account 10.18000.727 $51,598.69 from Fund 75, Account Number 45210 (CIP revenue transfer)** A total of $96,598.69. ** Upon receipt of the San Joaquin Valley Air Pollution Control District reimbursement in the amount of $60,000.00, the funds will be redeposited back into Fund 75, Account Number 45210. The total amount of City funds utilized for the three (3) vehicles would be $36,598.69 (the Police Department will still need to minimally outfit two of the vehicles with emergency equipment but will make these purchases with other funds.) Staff recommends the City Council authorize the purchase of three (3) Ford Fusion Engeri vehicles from Monarch Ford in Exeter in the amount of $96,598.69. Consider Submittal of 2016 California State Department of Housing and Community Development Application for Funding under the HOME Investment Act: Tim Sciacqua, Consultant, reported this item was discussed previously at today’s Study Session. On December 6, 2016, the Department of Housing and Community Development (HCD) issued a 2016 Notice of Funding Availability announcing applications for funds under the 2016 Home Investment Partnerships (HOME). Applications are due February 2, 2017. Typically, the City applies for HOME funds for the First Time Homebuyers Program or Housing Rehabilitation. He would like the City Council to consider the following: 1. Adoption of the attached resolution which authorizes the submittal of an application to HCD to participate in the 2016 Home Program for an allocation of funds not to exceed four million, six hundred thousand dollars ($4,600,000) for the development of a 41 unit affordable multi-family apartment complex to be located in the City of Avenal at the northeast corner of Corcoran Avenue and Kern Street. 2. Authorization for the City Manager, Community Development Director, or his/her designee(s) to execute, in the name of the Applicant, all required documents. Councilmember Woolley stated it is in the best interest of the City to finish this project. However, for future projects, more information and research is needed before the city finances another project. Mayor Preciado stated he does see the need in the community for more housing, as there are multi-families living in single homes within the City. RESOLUTION NO. 2017-02: RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING THE SUBMITTAL OF AN APPLICATION TO THE CALIFORNIA STATE DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR FUNDING UNDER THE HOME INVESTMENT PARTNERSHIP PROGRAM; AND IF SELECTED, THE EXECUTION OF A STANDARD AGREEMENT, ANY AMENDMENTS THERETO, AND OTHER RELATED DOCUMENTS NECESSARY TO PARTICIPATE IN THE HOME INVESTMENT PARTNERSHIP PROGRAM A motion was made by Councilmember Woolley, seconded by Councilmember Moreno and carried.
