AGENDA ITEM NO. 3. – A. CITY OF AVENAL JOINT MEETING OF THE AVENAL CITY COUNCIL/ SUCCESSOR AGENCY/HOUSING AUTHORITY THURSDAY, MAY 11, 2017; 6:00 P.M. AVENAL THEATER 233 E. KINGS ST.; AVENAL, CA 93204 MINUTES Mayor Pro Tem Ovalle called the meeting to order at 6:11 p.m. Council Members Present: Woolley, Moreno, Ovalle, Preciado (joined the meeting at 6:16 p.m.). Council Members Absent: Gravelle. Legal Counsel: City Attorney Jennie Barkinskaya. PLEDGE OF ALLEGIANCE: Lead by Mayor Pro Tem Ovalle. CITY CLERK: Government Code Section 54952.3: The members of the City Council, Successor Agency and Housing Authority are entitled to receive a total of $300.00 per month as a result of being elected to the City Council. They receive no other compensation for sitting as a member of Successor Agency and Housing Authority. CONSENT CALENDAR: All items listed under the consent calendar are considered to be routine and enacted by one motion: (Action) A. City of Avenal/Successor Agency/Housing Authority – Approval of Minutes for April 27, 2017: B. City Warrants and Financial Statements for April: A motion to approve the Consent Calendar was made by Councilmember/Successor Agency/Housing Authority Member Woolley, seconded by Councilmember /Successor Agency/ Housing Authority Moreno and carried. Roll Call Vote: AYES: Woolley, Moreno, Ovalle. NOES: None. ABSENT: Gravelle, Preciado ABSTAIN: None. MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/HOUSING AUTHORITY MEMBER REPORTS/ITEMS FOR CONSIDERATION: A. Consider an Appointment to the Avenal Planning Commission. Fernando Santillan, Community/Economic Development Director mentioned that the vacancy on the Avenal Planning Commission. Staff advertised, the current vacancy in the Avenal Chimes and have not receives any letters of interest at this time. Staff coming to the City Council, specifically Councilmember Moreno, because it is her appointment to recommend or direct staff to keep advertising or take other cores of action. Councilmember Moreno what other cores of action can be taken? Mr. Santillan mentioned that if she had someone in mind that Staff could reach out to that would be a good fit to the Planning Commission. Councilmember mentioned Irma Aguayo, Avenal resident for over 20-years and likes to help. Mr. Santillan state that Ms. Ortiz can obtain Mrs. Aguayo’s information; but Councilmember Moreno will provide Ms. Ortiz with all contact information. This will be Councilmembers appointment if Mrs. Aguayo accepts. Mayor Preciado joined the meeting at 6:16 p.m. B. Consider Scheduling Fiscal Year 2017/18 Budget Workshops: Joint Meeting City Council/Successor Agency/Housing Authority May 11, 2017 Page 2 of 6 Ms. Whitten stated that time again review fiscal year draft budget. Staff realizes it’s a busy time of year, but it is important to have all City Council members in attendance. Following are suggests dates as follows:  Tuesday, May 30, 2017 5:00-8:00 p.m. (General Fund)  Thursday, June 1, 2017 5:00-8:00 p.m. (all other funds) After a brief discussion, the following action was taken: A motion made by Councilmember Woolley approved Tuesday, May 30, 2017 5:00-8:00 p.m. (General Fund) And Thursday, June 1, 2017 5:00-8:00 p.m. (all other funds). Mayor Pro Tem Ovalle seconded and carried. Roll Call Vote: AYES: Woolley, Ovalle, Moreno, Preciado. NOES: None. ABSENT: Gravelle ABSTAIN: None. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: Casey Hogg with a company called 5C Holding they due drilling and transportation in Avenal for the company California Resources Corporation. He is addressing the opportunity to negotiate a price on the asphalt gridding that the city has stored would like to use them to base the roads especially the hilly roads. Ms. Whitten mentioned that she met Casey. Staff received a letter it was too late for the agenda and he was welcomed to speak and Staff will have the letter for the Council for the Agenda on the 25th. Noelio Garza stated that a big rig truck cabin has been parking in front of his house for over one year. He mentioned, that he is Noelio Garza, lives at 312 Tulare and the problem occurs at 316 Tulare. He is here today to obtain information on what are the rules and regulations on big rig. Ms. Whitten mentioned that they are allowed from 10:00 a.m. – 6:00 p.m. then they have to be moved. Mr. Garza stated that there is a big-rig has been there three weeks day and night. He was under the understanding that a police sergeant cited the big rig. The big rid has not come back but is afraid it will. Chief Stivers mentioned that it seems the Police Department have made an impression and if they come back call the police. ACTIVITY REPORTS/SPECIAL PRESENTATIONS AND COMMITTEE REPORTS: A. Activity Reports: 1) Public Works/Building/Code Enforcement/Animal Control Departments Activity Report: Scott Davis, Public Works Director (A); Ms. Whitten reported the following : 1) Scott Davis is not present due to family emergency; 2) Building Department; 3) Code Enforcement; 4) Park & Landscaping; 5) Street; 6) Water Distribution; 7) Waste Water Collection; and, 8) Vehicle, Equipment, & Building Maintenance. 2) Community Development Department Activity Report: Fernando Santillan, Community/Economic Development Director Fernando Santillan, Community/Economic Development Director reported the following: 1) He attended San Joaquin Valley Economic Summit 2) New LED lights have been installed at Rice Park, Basketball Court. We have seen increased activity at Rice Park and the new lights will also benefit the Farmers Market starting in June. Bleachers have been ordered as well as new containment net; 3) Community Development continues to support the Recreation Department with the Farmers Market planning. Tony has been active in helping with sponsorships and marketing efforts; 4) closed two grants in April; 5) The Transit Hub is moving along;6) The 18” Water Joint Meeting City Council/Successor Agency/Housing Authority May 11, 2017 Page 3 of 6 Transmission Line Replacement project continues; 7) Continued to assist brokers, developers, and site selectors on questions relating to commercial real estate development in Avenal; 8) The next Parent Technology Education class is on April 11th at 6:00 pm at the Technology Training Center; 9) Processing various zoning approvals, including one Home Occupation Permit and Zoning Variance application; 10) Reviewed various plans for small projects around town (residential, small commercial); 11) Received update on Panda Koala Ceilito Lindo #2. Curb and gutter have been completed and paving of streets is scheduled to be completed by end of June (tentatively); 12) Our housing program has kept us busy over the last several months with potential foreclosures, tax sales, subordination requests, and reconveyance; and, 13) General Plan Update continues to and next CAC meeting will be scheduled within several weeks. B. Special Presentations/Requests: 1) Report on Retail Data Collection for Kings County: Oralia Vallejo, Project Director Tobacco Control Program & Health Education Unit Environmental Health Services Oralia Vallejo, Project Director Tobacco Control Program & Health Education Unit Environmental Health Services reported the following: 1) she mentioned that 2016 Tobacco Survey continuing widespread availability of tobacco and alcohol products to kids in Kings County. In addition to selling cigarettes, 80.9% of stores sell “little cigars” or cigarillos, but only 31.8% of stores sold fresh fruits or vegetables, 43.6% of stores sold non- or low fat milk, but 84.5% sell alcohol. E-cigarettes saw a significate increase in Kings County in stores form the last time this survey was conducted in 2013, up more than 308.8%; 2) additional survey findings alcopops are sold at 53.8% of stores, tobacco chew 68.2% and 58.1% of stores that sell alcohol have storefront ads; 3) she mentioned that healthy stores for health community media event took place March 8, 20017; and, 4) she thanked the students form Avenal High School and Staff for helping her in many events. Also, Invited the City Council to the 17th Annual Recognition Luncheon on May 16, 2017; 11:00 a.m. – 1:00 p.m. Tachi Palace Hotel & Casino 17225 Jersey Avenue, Lemoore CA 93245. PUBLIC HEARING(s): 1) None. OLD BUSINESS: A. Consider Extending Local Water Emergency - Declared on February 27, 2014: Staff is requesting by motion, approval of the ongoing Local Emergency Declaration and drought conditions as they continue to exist; therefore, Staff recommends that the Local Emergency Declaration be renewed/extended for 14 days and reviewed again at the May 25, 2017 City Council meeting. After a brief discussion the following action was taken. A motioned made by Mayor Pro Tem Ovalle to approve the Local Emergency Declaration be renewed/extended for 14 days and reviewed again at the May 25, 2017 City Council meeting seconded by Councilmember Moreno. Roll Call Vote: AYES: Ovalle, Moreno, Woolley, Preciado. NOES: None. ABSENT: Gravelle. ABSTAIN: None. B. Consider Extending Local Emergency Due to Flooding Conditions - Declared on March 9, 2017: Staff is requesting by motion, approval of the ongoing Local Emergency Due to Flooding Conditions as they continue to exist; therefore, Staff recommends that the Local Emergency Declaration be renewed/extended for 14 days and reviewed again at the May 25, 2017 City Council meeting. Joint Meeting City Council/Successor Agency/Housing Authority May 11, 2017 Page 4 of 6 After a brief discussion, a motion was made by Councilmember Woolley to approve ongoing Local Emergency Declaration to be renewed/extended for 14 days and reviewed again at the April 27, 2017 City Council meeting, seconded by Mayor Pro Tem Ovalle and carried. Consider Agreement with California Employers Association to Conduct a Competitive Pay Survey: Dawn Perkins, CPA Administrative Analyst mentioned that as discusses at the FY 2016/17 Budget review meeting, survey of salary and benefits was requested to confirm whether the City’s salary benefits, as well as job titles, are comparable to the local area and also to Cities that are approximately the same size as Avenal. She continues that she contacted California Employers Association, of which the City has membership and discussed conducting a pay survey of similar size (budget and employees count) to include gathering pay information, benefit information, analyzing the City’s total compensation practices and presenting formal survey result. Staff recommends to approve by resolution, enter into an agreement with California Employers Association not to exceed 6750.00. After a brief discussion the following action was taken. RESOLUYION NO. 2017-24: A RESOLUTION OF THE AVENAL CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH CALIFORNIA EMPLOYERS ASSOCIATION TO CONDUCT A COMPETITIVE PAY SURVEY, A motion was adopted on a motion by Mayor Pro Tem Ovalle and seconded by Councilmember Woolley and carried. Roll Call Vote: AYES: Ovalle, Woolley, Moreno, Preciado. NOES: None. ABSENT: Gravelle. ABSTAIN: None. A. Consider Annual Funding to Support Summer Community Swimming Program at Avenal High SchoolPool: Manuel Aguilar mentioned that as in prior years, Reef Sunset Unified School District and City of Avenal partner up to provide the aquatic program for all the kids in the community for fun activities and aquatic safety. The RSUSD allow the children fromthe City's Kidz Spot Summer Program free admission to the pool two (2) times per week. The request is for $15,000.00. Manuel Aguilar mentioned that he is the Aquatics Director. After a brief discussion, the following action was taken: A motion was made by Mayor Pro Tem Ovalle approve expenditure of $15,000, for the Summer Community Swimming Program in consideration of funding to RSUSD, children from City’s Kidz Spot Summer Program free admission to the pool two (2) times per week seconded by Councilmember Moreno and carried. ABSTAIN: None. Joint Meeting City Council/Successor Agency/Housing Authority May 11, 2017 Page 5 of 6 CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS: Councilmember Woolley commented the following: 1) she attended Old Timers parade; and, 2) she was disappointed that the tour was canceled for the discovery well. Councilmember Moreno commented the following: 1) attended the Wonderful meeting and was very proud of Avenal students that received scholarship; and, 2) she help with a enchilada dinners in the City of Huron to help senior apartments, because the residents need lights in the alley due to criminal activities and collected over $1,700.00. Mayor Pro Tem Ovalle commented the following: 1) he attended Chat with Council all alone many items to discuss; 2) Old Timer’s was excellent; 3) attended the Oversight Board meeting; and 4) he and his wife were nominated as King and Queen for Homecoming. Melissa Whitten, City Manager commented the following: 1) she mentioned that the solar application continues to go forward and Staff is providing information; 2) she sent the color choices to KART; 3) she mentioned that there will be car wash for Sober Graduation at State Foods to inform the City Council information on May 20th and will adhere to water conservation; and, 4) Memorial Services at Pleasant Valley Cemetery, May 29, 2017 at 10:00 a.m. and Mayor Preciado will be actively involved and everyone is invited. Mayor Preciado commented on the following: 1) JPA meeting Fresno; 2) Saint Joseph Catholic Church Finance meeting; 3) Saint Joseph Catholic Church; 4) Old Timer’s Dinners had many helpers and thanked all that helped; 5) CRT meeting and had training; 6) Tour to the discovery well was canceled due to the rain; and 6) he attended the Wonderful scholarship banquet it was great.
