CITY OF AVENAL SPECIAL JOINT MEETING OF THE AVENAL CITY COUNCIL/SUCCESSOR AGENCY TUESDAY, AUGUST 21, 2018; 4:00 P.M. AVENAL THEATER, 233 E. KINGS ST.; AVENAL, CA 93204 MINUTES Mayor Pro Tem Ovalle called the meeting to order at 4:06 p.m. Staff Present: Whitten, Ortiz, Perkins, Santillan. Legal Counsel: Legal Council was available via phone. ROLL CALL: Councilman Gravelle, Councilmember Woolley, Mayor Pro Tem Ovalle, Mayor Preciado joined the City Council meeting at 4:26 p.m. CITY CLERK: Government Code Section 54952.3: The members of the City Council, Successor Agency and Housing Authority are entitled to receive a total of $300.00 per month as a result of being elected to the City Council. They receive no other compensation for sitting as a member of Successor Agency and Housing Authority. PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES: Melissa Figueroa, Mari Carmen Figueroa and Nataly Lopez. Ms. Figueroa invited the City Council, residents and neighboring communities to attend the Avenal to Youth Summit conference on August 25th 9:30 a.m. – 3:30 p.m. She is working for Central Valley Freedom Summit Organization that is working with youth within the Central Valley to help them get involved in their communities. This conference will provide free food, art workshops, registration of voters, college access and mental health information with self-care. The conference has been advertised through the schools, social media, etc. Another project that they are working on with the Youth Summit is to build a community mural by working with a muralist from Visalia. She has been working with the youth of the community and will keep the City Council updated regarding the mural. Councilmember Woolley asked where her organization is based and is the provided drawing the mural that will put on the wall. Ms. Figueroa stated that they are based out of UC Merced and Santa Cruz. It started with a professor that wanted to give back to his community and is now allowing students to give back to their own communities. She recently graduated for UC Santa Cruz and would like to give back to Avenal, as she was raised here. The provided drawing is a sample. They have been meeting with youth at the Gallery to get input for this mural. Mayor Pro Tem Ovalle is happy to hear this and believes the youth need motivation to get involved with in the community. They will be the generation that takes over for the elderly. He is glad that Ms. Figueroa is showing interest in our community. NEW BUSINESS: A. Applications Submitted By Two (2) Interested Applicants to Fill One (1) City Council Position: 1) Review Two (2) Applications; 2) Interview Two (2) Applicants; 3) Consider Appointmentof One (1) Individual to Fill Vacant City Council Seat; 4) If Appointment Made by City Council, City Clerk will Administer Oath of Office and Seat New City Council Member. A motion was made by Councilmember Woolley to move Item A. New Business to the end of New Business, consider Item B, C, & D first; seconded by Councilman Gravelle and carried Roll Call Vote: AYES: Woolley, Gravelle, Ovalle. NOES: None. ABSENT: Preciado. ABSTAIN: None. B. Consider Proposal for Geotechnical Investigation for Avenal Community Center: Special Joint Meeting City Council/Successor Agency August 21, 2018 Page 2 of 4 Fernando Santillan, Community Development Director, stated as part of the design and engineering for the Avenal Community Sports and Recreation Center, a geotechnical analysis and report will need to be conducted to determine soil conditions at the proposed location. Staff requested quotes from three qualified geotechnical engineering firms in the area. The proposed fees are as follows: BSK Associates $5,500 Blackburn Consulting $12,939 RMA GeoScience $6,600 BSK proposed the lowest fee, though the proposed scope only included two test borings. RMA GeoScience included 7 test borings (4 at 20 ft and 3 at 5 ft). Blackburn Consulting proposed 6 test borings (4 at 20-25 ft. and 2 at 3 - 4 ft.). RESOLUTION 2018-40: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH RMA GEOSCIENCE FOR GEOTECHNICAL INVESTIGATION SERVICES. A motion was made by Councilman Gravelle, seconded by Councilmember Woolley and carried. Roll Call Vote: AYES: Gravelle, Woolley, Ovalle. NOES: None. ABSENT: Preciado. ABSTAIN: None. C. Consider Proposals for Labor Standards Compliance Consultant for Avenal Community Center Construction Project: Mr. Santillan stated the CBG-funded Avenal Community Sports and Recreation Center will require prevailing wage labor standards monitoring to ensure construction contractors and subcontractors are adhering to Davis-Bacon Act wage requirements as well as other applicable labor laws. Staff issued a Request for Proposals (RFP) in June and received three qualified responses. Based on a 7-month construction period, the not-to-exceed fee for each proposal were as follows: Alliant Consulting: $16,220 R.L. Hasting & Associates: $10,500 ($1,500 per month) CCMI $8750 (flat) or 10,500 (hourly) Staff recommends selecting R.L. Hastings & Associates as the Labor Standards Consultant for the project, given that the project is likely to take less than 7 months, though the fee would still be competitive at $10,500 if the project does take 7 months to complete. After a brief discussion, the following action was taken: RESOLUTION 2015-41: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH R.L. HASTINGS & ASSOCIATES FOR LABOR STANDARDS MONITORING SERVICES RELATED TO THE 2016 CDBG PUBLIC FACILITIES GRANT. A motion made by Councilmember Woolley, seconded by Councilman Gravelle and carried. Roll Call Vote: AYES: Woolley, Gravelle, Ovalle, Preciado. NOES: None. ABSENT: None. ABSTAIN: None. Mayor Preciado joined the City Council meeting at 4:26 p.m. D. Consider grant match for Wonderful Community GrantProgram: Mr. Santillan stated the Community Development Department is planning to submit an application at the end of August 2018 for funding in the amount of $50,000 as part of the Wonderful Community Grants program. The total anticipated cost of the Fitness Court is $110,000, and we have been offered a grant of $30,000 from the National Fitness Campaign to assist with the project. If we are successful with the $50,000 Wonderful Grant application, only $30,000 in additional funds would be needed to fully fund the project. Special Joint Meeting City Council/Successor Agency August 21, 2018 Page 3 of 4 Staff recommends approval of the attached resolution which commits $30,000 to the Avenal Fitness Court contingent upon funding being secured from the Wonderful Community Grants program. RESOLUTION 2018-42: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL COMMITTING $30,000 INFUNDING FOR THE AVENAL FITNESS COURT IN PARTNERSHIP WITH THE WONDERFUL COMMUNITY GRANTS PROGRAM IF PROPOSAL IS AWARDED. Melissa Whitten, City Manager, stated that the reason for the meeting was to inform the community that Staff has received two (2) applications for interest to serve on the City Council. The position was open during a two-week notification period and two (2) applications were received. The meeting is to review applications, provide time to interview applicants who are both in attendance and consider appointment of one individual to serve the unexpired term which will expire in November 2020. Mayor Preciado made a motion to extend the application period as he was approached by many community members who felt the 14-days’ notification time period was too short, no second, failed motion. Ms. Whitten introduced the first applicant, Sid Craighead, to address the City Council and submit his resume. Sid Craighead stated the information provided is before the Council and if there any questions, he will answer them. He mentioned that starting out is a learning experience. He served on the Council for over 16 years and want to help again, if they so choose. Mayor Preciado asked if he was still active with the Grand Jury. Mr. Craighead stated that his term ended July 1, 2018. Ms. Whitten introduced the second applicant, Keith Harvick, to address the City Council and submit his resume. Keith Harvick stated that he has lived in Avenal since 1966, working for the school district then working for Avenal State Prison since 1988. He married high school sweetheart, Rose. He has chosen to make Avenal his home, raising three (3) daughters who went to Avenal High School. He has served two (2) terms on the Grand Jury, was Gun Club President for 20 years, on the Hospital Board and he has no agenda. Councilmember Woolley asked for clarification from Mr. Harvick regarding his position on the Hospital Board and would he have to step down? Ms. Whitten stated “yes”. Mayor Preciado opened the nomination for City Council position appointment. Mayor Pro Tem Ovalle nominated Keith Harvick, seconded by Councilmember Woolley and carried. Roll Call Vote: AYES: Ovalle, Woolley, Gravelle. NOES: None. ABSENT: None. ABSTAIN: Preciado. A motion was made by Councilmember Woolley to close Nominations for City Council, seconded by Councilman Gravelle and carried. Roll Call Vote: AYES: Woolley, Gravelle, Ovalle. NOES: None. Mayor Preciado called for a short recess at 4:39 p.m. Meeting reconvened at 4:44 p.m. Ms. Ortiz Administered the Oath of Office to Keith Harvick and seated him as new City Councilmember. Mayor Preciado made a motion to open Public Time to address the City Council, seconded by Mayor Pro Tem Ovalle and carried. Roll Call Vote: AYES: Gravelle, Woolley, Ovalle, Harvick Preciado. NOES: None. ABSENT: None. ABSTAIN: None. Mayor Preciado announced that the public can express their concerns to the City Council at this time. Blanca Aguilera, representing the PUMA Organization and the community. Ms. Aguilera is in support of Mayor Preciado motion to extend the time frame to appoint a new City Councilmember. Ms. Aguilera, lives in Lemoore, but was asked to express her concern for the short period of time given for applicants to submit their application to the City. Ms. Whitten mentioned that it was noticed for two weeks as directed by the City Council and to be filled as soon as possible. Ms. Aguilera would like to see future vacancies allowance of a month-long period before a vacancy is filled. CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS: ADJOURNMENT.
