JOINT MEETING OF THE AVENAL CITY COUNCIL/SUCCESSOR AGENCY
THURSDAY, NOVEMBER 14, 2019; 5:15 P.M.

MINUTES
Mayor Ovalle called the meeting to order at 5:23 p.m.
Staff Present: Whitten, Ortiz, Perkins, Davis, Santillan, Bermudez, Stivers.
Legal Counsel: Ken Jorgensen.
PLEDGE OF ALLEGIANCE: Led by Mayor Ovalle
ROLL CALL: Councilman Preciado, Councilman Hernandez, Councilman Harvick, Mayor Pro Tem
Woolley, Mayor Ovalle.
CITY CLERK: Government Code Section 54952.3: The members of the City Council and Successor Agency are
entitled to receive a total of $300.00 per month because of being elected to the City Council. They receive no other
compensation for sitting as a member of the Successor Agency.
City Council went into Closed Session at 5:25 p.m.

It is the intent of this governing body to meet in closed session to review its position and to instruct its designated representatives:
A. POTENTIAL/PENDING LITIGATION (Government Code § 54956.9).
It is the intention of this governing body to meet in closed-session concerning:
Conference with legal counsel – Deciding whether basis exists for closed-session for anticipated litigation
(Government Code § 54956.9(d)(3)).

Mayor Ovalle, reopened City Council meeting at 5:37 p.m. with no action to report.
CONSENT CALENDAR:

Mayor Pro Tem Woolley abstain form Check # 46786.
A motion was made to approve consent calendar by Councilman/Successor Agency Member Harvick,
seconded by Councilman/Successor Agency Hernandez and carried.

MAYOR & COUNCIL MEMBER/ SUCCESSOR AGENCY/ITEMS OR CONSIDERATION:
A. Swearing-in of Avenal Police Department New Senior Police Officer Jose Garcia: Chief Stivers
Chief Stivers stated that special night swearing-in newly promoting Senior Officer Jose Garcia. Thanked, Major
Crime Task Force Sargent Tyler Lopes, Sherriff Office, Retired Chief Jack Amoroso & Susan. Chief Amoroso has
watched Jose’s progress form explorer, police cadet, police officer and now to Senior Police officer. As Council is
aware Senior Officer is the first promotion of leadership among the ranks. Jose yearned this promotion being an
informal leader, respect of his co-workers, community and supervisors. Things Jose has been involved in are: Major
Task Force representative, crisis negotiator for swat team peer support team. Jose family is present, and his mother
will pin his police officer badge. The City Council congratulated Senior Officer Garcia.
Senior Officers Garcia Thanked, City Council, Chief Stivers, Jack Amoroso, Tyler Lopes and all supervisors that
taught him how to be a leader.
Mayor Ovalle announced a short recess at 5:44 p.m. for Senior Officers Garcia and family can take pictures.
City Council meeting was re-opened at 5:50 p.m.
B. Consider Appointments to the Avenal Recreation Commission:
Melissa Whitten, City Manager reported that asked if there any changes for appointments for Councilman Harvick
and Councilman Preciado.
l) Paul Cobine: Term 3 - Councilmember Harvick's Appointment - Appoint to fill unexpired term (exp. 2021).
2) Arlene Santino: Term 5 - Councilmember Preciado's Appointment - Appoint to serve new term (2019- 2023).
Councilman Preciado appointed Gloria Balderaz to the Recreation Commission. Ms. Ortiz reached out to Mrs.
Balderas and would like her daughter Gloria Angelica Balderas could take her place due to her lack of English.
Councilman Preciado appionted Gloria Angelica Balderas to serve as Recreation Commission.
PUBLIC COMMENT/ANNOUNCEMENTS & UNSCHEDULED APPEARANCES:
Richard Valle, Supervisor District 2 reported the following: 1) KART; 2) Road reconstruction on Nevada; and,
3) Operation Gobble teaming-up with Jose Ramirez and gave Council vouchers.
David Reynosa stated the following: 1) would like to use soccer goals as discussed with Sheila as volunteers ; and,
stop signs along Union Avenue.
Ms. Whitten clarified that the soccer goals were going to be used as requested by the adult soccer league and not for
the community. The request can change if submitted properly.
Mr. Davis mentioned that its on the list will be taken care of.

Sheila Verdugo, Recreation Supervisor reported the following: 1) Community Art Night; 2) Final Market;
3) Soul Fire Risen Band Performed; 4) Rotary- Corn Hole; 5) Pistachio Festival; 6) Day of the Dead - thanked
Anna and all people involved in making this happen;6) Ofrienda went up on Oct. 21st and down on November
4th - had 12 community members submit pictures; 8) AES Fall Festival - Staff set up 4 bounce houses and 3
games carnival games; 9) Upcoming Events: TES Fall Carnival - November 8th from 5-7 pm, Christmas
Decorating begins: November 18th, RSMS Career Day: November 13th from 8-1:00 pm, Community
Thanksgiving Dinner: November 28th in Veteran's Hall from 12:00-3:00 pm, Holiday Magic: December 7th •
Boutique and Breakfast TBD, December 20t h: Pictures with Santa and Community Ornament Decorating Craft
at the Outdoor Bandstand on Kings Street (Free Movie Night too!!). Additionally, Music Fest; KPFP & Tabaco

3) Avenal Theater& Event Center Activity Report: Humberto Bermudez, Avenal Theater &
Event Center Coordinator;
Humberto Bermudez, Avenal Theater & Event Center Coordinator reported the following ;1) October 15th
Toy Story 4 & Godzilla; 2) October 11th - Farmer's Market; 3) October 15th Pistachio Festival Fish Fry
Kickoff; 4) October 17th -20th: Pistachio Festival, October 22nd ; 5) Projector Maintenance; October 28th; 6)
November 4th - Día de los Muertos Ofrenda; 7) Table October 31th Halloween/Kings Treat Street; 8)
November 1st - Day of the Dead Festival; 9) November 2nd - Pegasus Room Rental; 10) November 4th Hardwood
Restoration in Pegasus Room; 11) November 10th ; Two Rentals, Pegasus Room and Meeting Rooms; and,
12) Upcoming events - November 13th - Career Day@ RSMS November 15th - Movie Night, November 22nd

4) Community Development/Planning Activity Report: Fernando Santillan, Community/Economic
Development Director;
Fernando Santillan, Community/Economic Development Director; 1) Community Center continues to move
forward; the concrete contractor should be pouring footings and the slab in the next couple of weeks. Sewer
line has been installed and backfilled; 2) Staff is working on an application for funds to implement an
electronic permitting systems and other measures to support the regional planning process and support new
housing development. The funds are part of the SB 2 Planning Program through Housing and Community
Development; 3) CA State Parks Department will be visiting Avenal on Nov. 12 to visit the three projects
which were part of our Prop. 68 parks grant applications; and, 4) Staff is processing several applications for
CUP, Site Plan Review, Occupancy Inspections, and Rezones which indicates increased business and
development activity in town.
5) Avenal Police Department Activity Report Rusty Stivers, Chief of Police.
Rusty Stivers, Chief of Police reported the following: 1) Investigations; 2) Total CAD Calls; and, 3) Monthly
Statistical Report.

NEW BUSINESS:
A. Consider Authorizing Resolution to Apply for and Receive SB-2 Planning Grant Program (PGP) Funds:
Mr. Santillan reported that the attached resolution is required by the State Water Resources Control Board as
part of the funding application for SB 2 funds. SB 2 is known as the Building Homes and Jobs Act and was

passed in 2017. the City of Avenal is eligible to receive up to $160,000 in non-competitive grant funds (in the
first cycle; future cycles are expected to be competitive) for eligible activities that support housing
development.
Staff is evaluating several potential projects, including electronic permitting systems, upgrades to the planning
counter and other improvements that will facilitate interactions with developers and builders. We are also
looking at potential Zoning/Development Code streamlining efforts as well as developing guidance for ADU
(Accessory Dwelling Unit) development in Avenal. Applications for funding are due Nov. 30, 2019.
Staff recommends adoption of the attached resolution authorizing the City Manager or Community
Development Director to execute the SB2 Planning Grant Program (PGP) funding application and any
documents/amendments attached thereto.
After a brief discussion, the following action was taken.
RESOLUTION 2019-55: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AVENAL
AUTHORIZING APPLICATION FOR, AND RECEIPT OF, SB 2 PLANNING GRANTS PROGRAM
FUNDS. A motion was made by Councilman Harvick, seconded by Mayor Pro Tem Woolley and
carried.

CORRESPONDENCE/ANNOUNCEMENTS/CLOSING COMMENTS:
Councilman Harvick reported the following: 1) thanked Public Works every night they fix our water leaks.
Councilman Preciado reported the following: 1) thanks and supports Public Works Department for all the hard work
fixing water leaks; 2) attended the Day of the Dead; and, 3) Carrier Day at Coaling High School was great.
Mayor Pro Tem Woolley reported the following: 1) Ditto, thanked Public Works for all they do.
City Attorney Jorgensen reported the following: 1) thanked Public Works for all they do.
Melissa Whitten, City Manager reported the following: 1) Thanked, Utilities Department and Public Works
Department for fixing water leaks ; 3) Día De los Muertos – great event thanked: Anna & Sheila and thanked Dawn
for Council information; and 4) attended Grand Jury open house.
Mayor Ovalle reported the following: 1) Thanked, everyone for coming.
